RESOLUTION
The Government’s regular meeting – August 2010
The
Government, on August 30 and 31, convened its August 2010 regular meeting to
discuss and decide the following issues:
1.
The Government discussed the reports on socio-economic situations in August and
the first eight months of 2010, and economic forecast in the world and at home;
on socio-economic situations in 2010 and the socio-economic development plan
for 2011; on the realization of the State budget in 2010 and the estimates for 2011;
on inspection work, settlement of people’s complaints and accusations, and
anti-corruption work in August; on administrative reforms in August; and on the
implementation of the Government’s July regular meeting resolution and the
working agenda for August. These reports were presented by the Minister of
Planning and Investment, the Minister of Finance, the Inspector General, the
Minister of Home Affairs, and the Minister-Chairman of the Office of Government.
a)
The Government was unanimous that socio-economic situations in August and the
first eight months have continued to see positive changes. Macro-economy is
being stabilized and inflation curbed fruitfully. GDP growth rate in the 3rd
quarter can reach over 7%. The State budget collection was higher than the same
period last year, meeting the demand for expenditures and reducing the
overspending; development investment was promoted, resources of development
investment were mobilized and disbursed fruitfully; export posted a relatively
high growth rate while the excess of imports over exports was going down; market
prices were stabilized and inflation was in control. Social security was
guaranteed and enhanced; social well-being was further boosted up. Administrative
reforms, anti-corruption, and settlement of people’s complaints and accusations
received due attention and saw advancements. Diplomatic work gained important
achievements, contributing to economic development and Việt
Relying
on achievements in the first eight months, the fulfillment of the general goal
and major socio-economic indicators for 2010 is feasible, creating favorable
preconditions for the socio-economic development plan of 2011, the first year
in the five-year socio-economic development plan 2011-2015. However, there
remain many socio-economic difficulties in the remaining months of the year: prices
in the world market tend to go up, causing pressure on prices in the domestic
market; banks’ lending interest rate still stay high; natural calamities and
epidemics are complicated, negatively affecting production and people’s life.
The
Government urges ministries, agencies and localities to continue closely
following socio-economic development goals and norms, drastically directing the
effective realization of solutions put forth in the Government’s Resolution 03/NQ-CP
dated on January 15, 2010, Resolution 18/NQ-CP dated on April 06, 2010 and
other regular meeting resolutions; to focus on the control of supply and demand
of goods while stabilizing market prices; to further remove difficulties and
hindrances in favor of production and business, so that to complete all
assignments in 2010.

The Ministry of Planning and Investment shall function as the main implementer,
in collaboration with relevant agencies, in reviewing sectoral planning schemes,
proposing renovation plans, tightening investment management decentralization, enhancing
State management in line with the master planning scheme, especially in such
fields as steel, cement, minerals and electric power, and submitting these to
the Prime Minister for decision. The Ministry shall also shake hands with the
Ministry of Finance and relevant agencies to assess the social engagement in
public services, put forth solutions to improprieties in this work, and report
to the Prime Minister for consideration and decision.

The Ministry of Industry and Trade shall play as the main implementer, in
collaboration with the Ministry of Agriculture and Rural Development, in
closely monitoring the rice market at home and in the world, regulating the
export of rice while safeguarding national food security.

The Ministry of Labor, War Invalids and Social Affairs working as the main
player, in collaboration with the Ministry of Justice and relevant agencies, shall
consider and evaluate social impacts caused by marriages between Vietnamese
women and foreigners, especially in Southwestern provinces, propose solutions
of management, reduce negative impacts, protect women’s human dignities, and
make reports to the Prime Minister.

The Ministry of Education and Training shall work with relevant agencies to
organize a topical meeting to evaluate educational index in the Southwest,

Ministers and heads of the ministerial-level agencies and governmental bodies shall
be in charge of directing the summing-up of anti-corruption, thrift practice, and
anti-prodigality while proposing plans and measures to enhance this work.

Authorities of provinces and centrally-administered cities must closely work
with competent agencies to completely settle complaints and accusations of
their local residents.
b)
Our economy enters the year of 2011 on the background of considerable
achievements gained during 25 years of renovation; socialist-orientated market
economy has been formed and being perfected; economic ability and infrastructure
have been solidified; the national economy is recovering and regaining its high
growth rate after a period of recession due to the global financial crisis and
economic downturn; macro-economic indicators have been stabilized; inflation
has been curbed; Việt Nam’s status and prestige are increasingly raised on
international arena. These are important preconditions for new trend of
development and higher sustainable growth rates in 2011 and the following years.
As
defined by the Government, the overall target of the socio-economic development
plan 2011 is to further enhance macro-economic stability, strive for a higher
economic growth rate than 2010 while restructuring the economy and sharpening
its quality and efficiency for sustainable development. To guarantee social
security and better people’s life. To promote externally-orientated activities
and international integration. To maintain national defense, security and
socio-political stability.
Accordingly,
some socio-economic indicators for 2011 were initially fixed as follows: economic
growth rate 7.5%; total export turnover, up over 10%; trade deficit below 20% compared
to the total export turnover; and CPI increase, about 7%.
The
Ministry of Planning and Investment and the Ministry of Finance shall gather
opinions of the Government’s members, complete the report on socio-economic
situations in 2010 and the plan for 2011; the report on State budget 2010 and
estimations for 2011; then, authorized by the Prime Minister, present these
documents to the Party’s Politburo and Central Committee and the National
Assembly.

The Government discussed the report on the five-year socio-economic development
plan 2011-2015; the report on the realization of the five-year finance-budget
plan 2006-2010 and the five-year finance-budget plan 2011-2015 presented by the
Minister of Planning and Investment, and the Minister of Finance respectively.
On
the basis of socio-economic achievements in 2011 and forecasts of the world
economy, the five-year socio-economic development plan 2011-2015 should follow
the socio-economic development strategy 2011-2020, with the general viewpoint
of development, overall target, and specific proper and feasible socio-economic
norms which show the economy’s quality. It is necessary to identify breakthrough
aspects and major indicators so as to surely obtain growth rate, secure
macro-economic stability, then propose solutions for the fulfillment in 2011-2015.
Minister and sectors must give their comments on the related issues so that the
Ministry of Planning and Investment can make a report.
The
Ministry of Planning and Investment and the Ministry of Finance shall collect
opinions of the Government’s members and complete the report on the five-year
socio-economic development plan 2011-2015 and the report on the five-year
finance-budget plans for 2006-2011 and 2011-2015; the Minister of Planning and
Investment and the Minister of Finance, authorized by the Prime Minister, shall
present these documents to the Politburo before reporting to the Party Central
Committee and the National Assembly.

The Government considered and commented the Minister of Justice-presented report
on implementing the National Assembly Standing Committee’s Plan 900/UBTVQH on
realizing the Politburo’s Resolution 48-NQ/TW on the Strategy to build and
perfect Việt
The
Ministry of Justice shall collect Cabinet members’ comments and finalize the
report; then the Minister of Justice shall submit it to the Prime Minister for
consideration.
4.
The Government discussed the report on the realization of national goal
programs in the period of 2006-2010 and the list of national goal programs for
2011-2015 which were presented by the Minister of Planning and Investment.
Results
of the national goal programs during 2006-2010 have promoted the country’s
socio-economic development and contributed to the fulfillment of millennium
goals committed by the Government. Through managing and implementing these
programs, the Government agreed with a list of 15 national goal programs in the
period of 2011-2015 which will be submitted to the National Assembly for
approval. They include the Program on clean water and sanitation in rural areas
and the Program on bringing information to mountainous, border, remote areas
and islands.
The
Ministry of Planning and Investment shall be the main player, working with the
Ministry of Finance, the Office of Government and relevant agencies, in
receiving Cabinet members’ comments, reviewing component projects of national
goal programs in order to solve urgent and interdisciplinary issues in line
with stipulated criteria, and submitting them to the Prime Minister for
consideration of the submission of the National Assembly.
5.
The Government listened to the Minister of Planning and Investment’s Statement
on the draft decree which will replace Decree 139/2007/NĐ-CP dated on September
05, 2007 instructing the enforcement of some articles of the Enterprise Law.
The
enforcement of the Enterprise Law over the past five years and the
implementation of the Government’s Decree 139/2007/NĐ-CP (September 05, 2007) have
faced some challenges because some instructions mentioned in Decree 139/2007/NĐ-CP
were not really clear, specific and inappropriate to the realities. Thus, it is
necessary to revise and supplement Decree 139/2007/NĐ-CP.
While
waiting for a full set of legal documents relating to activities of fully
State-owned enterprises, the Government requires ministries, sectors and
localities:
a)
Rights and obligations of State owners:
-
State-owned single-member liability-limited companies and untransformed
companies shall be subject to the related regulations stipulated in the
Government’s Decree 25/2010/NĐ-CP dated on March 19, 2010 on converting
State-owned companies into single-member liability-limited companies and
managing State-owned single-member liability-limited companies.

Corporations 91 shall be subject to stipulations in the Government’s Decree 132/2005/NĐ-CP
(October 20, 2005) on State owners’ rights and obligations to State-owned
companies; Decree 86/2006/NĐ-CP (August 21, 2006) on revising some articles of Decree
132/2005/NĐ-CP (October 20, 2005); and Decree 25/2010/NĐ-CP (March 19, 2010).

State-run economic groups shall be subject to stipulations in the Government’s Decree
101/2009/NĐ-CP (November 05, 2009) on the pilot establishment, organization,
operation and management of State-run economic groups.
At
the same time, State-run groups and corporations shall follow the Prime
Minister’s Directions 1568/CT-TTg dated on August 19, 2010 on implementing the
Politburo’s Conclusion 78-KL/TW dated on July 26, 2010.
b)
Financial management: Untransformed companies shall be subject to the Government’s
Decree 25/2010/NĐ-CP (March 19, 2010) and the Ministry of Finance’s Ordinance 117/2010/TT-BTC
(August 05, 2010) instructing financial regimes in State-owned single-member
liability-limited companies.
c)
Salary: State-run economic groups without pay-sheet as stipulated in the
Government’s Decree 101/2009/NĐ-CP (November 05, 2009), State-owned companies
not converted into single-member liability-limited companies, and organizations
using the salary policy which is applied for State-run companies shall be
allowed to continue using the salary policy as stipulated in the Government’s Decrees
205/2004/NĐ-CP, 206/2004/NĐ-CP, and 207/2004/NĐ-CP (December 14, 2004) and Decree
141/2007/NĐ-CP (September 05, 2007) until new regulations are issued.
The
Ministry of Planning and Investment shall function as the main implementer, in
collaboration with the Ministry of Justice and the Office of Government, in
gathering opinions from Cabinet members, completing the draft decree which will
replace Decree 139/2007/NĐ-CP (September 05, 2007) instructing the
implementation of some articles of the Enterprise Law, then submitting it to the
Prime Minister for issuance.
The
Ministry of Planning and Investment shall draft the Decree on rights and
obligations of State owners to fully State-owned enterprises; the Ministry of
Finance shall draft the Decree which will replace Decree 109/2007/NĐ-CP (June 26,
2007) on converting fully State-invested enterprises into joint stock companies;
the Ministry of Labor, War Invalids and Social Affairs shall draft the Decree
on salaries and wages in fully State-owned enterprises. These documents must be
submitted to the Government for consideration and issuance in the 4th
quarter of 2010.
6.
The Government gave comments on the draft ordinance on managing and using weapons,
explosives and law enforcement equipment and the Bill on revising and
supplementing some articles of the Co-operative Law which were presented by the
Minister of Public Security and the Minister of Planning and Investment respectively;
the Minister-Chairman of the Office of Government made a report on Cabinet
members’ comments on these documents.
a)
The Ministry of Public Security shall work with the Ministry of Justice, the
Office of Government and relevant agencies to collect Cabinet members’ opinions
and complete the draft ordinance; the Minister of Public Security, authorized
by the Prime Minister, shall submit it to the Government trình the National
Assembly Standing Committee.
b)
The Ministry of Planning and Investment shall work with the Ministry of Justice,
the Office of Government and relevant agencies to collect Cabinet members’
opinions and complete the Bill; the Minister of Planning and Investment,
authorized by the Prime Minister, shall submit it to the National Assembly
Standing Committee./.
