Procedures for re-issuance of birthday certificate

VGP – An overseas Vietnamese who lose their original birthday certificates can ask for the re-issuance of the document at competent bodies in Việt Nam.

Question (Overseas Vietnamese in Canada): I have lost my original birthday certificate granted by the Ba Đình District People’s Committee, Hà Nội, but I have a copy of the certificate in my personal computer. How can I regain the certificate or make another certified version? And how long does it take?

Answer:
According to Article 62 of Decree 158/2005/NĐ-CP dated on December 27, 2005 on the registration of births, deaths and marriages, if individuals loose their original birthday certificates, they can acquire other official versions at the provincial Department of Justice.

Procedures for the re-issuance of the birthday certificate:

  1. Applicants must submit declaration forms provided by Vietnamese competent bodies.

  2. After the reception of valid declaration forms, Chairperson of the district People’s Committee or Directors of the provincial Departments of Justice will sign and re-issue new birthday certificates within five working days (Item 2 Article 59 of Decree 158/2005/NĐ-CP).

In case the inspection is needed, the term can be extended not more than five working days.
