New regulations on public bidding

The information is stipulated in the newly-approved Decree 62/2010/NĐ-CP which amends and supplements some articles of Decree 53/2007/NĐ-CP dated on June 4, 2007 on administrative penalties against infringements in planning and investment sector. 

The move targets to fill loopholes and prevent red tape and illegal acts in using State investment capital.

Accordingly, a pecuniary penalty of VND 15-18 million will be applied to every organization or individual which prevent contractors to purchase bidding files.

Violators will pay VND 18-20 million for offering standards which are higher than practical demands in each package of bidding.

The fine of VND 15-20 million will be imposed on contractors who transfer over 10% of volume of work as stipulated in the contracts for other contractors.

The decree will be valid since August 2, 2010./.
