New nationality law: Better legal conditions for overseas Vietnamese

VGP – Under the Law on Vietnamese Nationality which will come into effect on July 01, overseas Vietnamese who are still holding Vietnamese nationality must register with Việt Nam’s local representative offices for keeping the original nationality.

According to Item 12 of Article 2, Vietnamese nationals settling in other countries and still having Vietnamese citizenship, prior to the Law’s date of coming into effect, are recognized as Vietnamese citizens.

However, within five years since July 01, 2009, they must register with Việt Nam’s representative offices for keeping their Vietnamese nationality.

The Ministry of Justice stressed that the registration will facilitate the State’s nationality management and citizen protection in other countries.

It is estimated that about 70% of Vietnamese nationals residing in other countries are still holding their original citizenship.

Dual nationality allowable

Under the Law, the State of Việt Nam maintains the principle of single nationality. However, the Law permits some "exemptions" which must be accepted by the State President.

Accordingly, dual nationality can be recognized for those who are spouse, parents, natural children of Vietnamese citizens; who make special contributions to Việt Nam; and who benefit Việt Nam.

Stateless cases with no identity documents but residing in Việt Nam’s territories for 20 years or more and observing Vietnamese laws, will be granted Vietnamese citizenship.
