Nationality regulations for newborn babies

Question: I have a Swedish husband but we have yet got married. My husband is completing immigration procedures for my permanent residence in Sweden. We also intended to conduct marriage registration in Sweden. My baby will be born next month. Will our baby have two nationalities of Vietnamese and Swedish?

Answer:

Under Point 2, Article 16 of the 2008 Law on Vietnamese Nationality which was amended in 2014 (the 2014 Law on Vietnamese Nationality), a child either of whose parents is a Vietnamese citizen at the time of his/her birth and the other is a foreign national has the Vietnamese nationality if so agreed in writing by his/her parents at the time of birth registration.

In case a child is born in the Vietnamese territory but his/her parents fail to reach an agreement on the selection of his/her nationality, the child has Vietnamese nationality.

According to the Swedish Nationality Law, a child born after April 1,2015 acquires Swedish citizenship automatically if: (1) one of the parents is a Swedish citizen at the time of the child's birth or (2)deceased parent of the child was a Swedish citizen upon their death.  

Thus, the two nationality laws allow your child to have two nationalities. /.
