Fresh regulations on sanctioning administrative violations of prices and invoices

VGP – The Government on May 27 issued Decree 49/2016/ND-CP (Decree 49) amending and supplementing a number of articles of Decree 109/2013/ND-CP dated September 24, 2013 on sanctioning administrative violations in the area of managing prices, charges, fees and invoices.

Question: What are the new regulations on price management, charges and fees, and invoices as stipulated in Decree 49?

Answer:

Price management

Decree 49 provides regulation regarding additional sanctions including revoking a price appraiser’s license, suspending business activities in price appraising services, suspending the activities of training and fostering the profession of price appraisal, which are only time limited remedies. There are pertinent to note because currently these additional sanctions are applied to violating organizations and individuals without a time limit.

The acts violating the regulations on price declaration, price registration for merchandise and services shall be sanctioned. Failure to register prices in line with the time limit as required in writing by the competent state bodies shall be fined from VND 10 million to VND 15 million. Any failure to declare or register prices with the competent state bodies shall be fined based on the specific quantity of merchandise that should have been declared. The fine level from non-declaration ranges from VND 5-25 million while that for non-registration is from VND 10-30 million.

Charges and fees

Decree 49 supplements the respective fine for losing vouchers of collecting charges or fees. Specifically, losing all the vouchers for collecting charges or fees shall be fined VND 50,000 at a minimum, with the maximum fine is equal to the denominated value printed on the vouchers.

Regarding fraudulence and evasion of paying charges or fees, the fine level shall equal from one to three times the amount of fraud and evasion, and the maximum is VND 50 million.

Invoices

The fine level for ordering invoice prints without entering into a written print order contract shall be from VND 500,000 to VND 1.5 million.

Organizations or enterprises who place an order for an invoice print after receiving a written notice by the tax department stating that such organizations or enterprises are ineligible for ordering invoice prints shall be fined from VND 2 million to VND 4 million.

Decree 49 takes effects from August 1, 2016./.
