 RESOLUTION

On the issuance of the Governmental Action Program to implement

the Resolution of the 10th Party Congress

and the Resolution of the 11th National Assembly

on the socio-economic development plan 2006-2010

THE GOVERNMENT

Pursuant to the Law on Governmental Organization dated 25 December 2001;

According to the Resolution of the 10th Congress of the Communist Party of Vietnam and Resolution 56/2006/QH11 of the 11th National Assembly on the socio-economic development plan 2006–2010;

On the request of the Minister of Planning and Investment;

DECIDES

Article 1. To issue in attachment to this Resolution the Governmental Action Program to implement the Resolution of the 10th Party Congress and the Resolution of the 11th National Assembly on the socio-economic development plan 2006-2010.

Article 2. This Resolution shall come into effect within 15 days after it is published in official gazettes.

Article 3. The Ministers, heads of the ministrial-level agencies and governmental organs, and chairpersons of the People’s Committees of the centrally-administered cities and provinces shall be responsible to execute this Resolution./.

   GOVERNMENT’S ACTION PROGRAM

to implement the Resolution of the 10th Party Congress and

the Resolution of the 11th National Assembly on the socio-economic development plan 2006-2010

(Issued in attachment to Resolution 25/2006/NQ-CP dated 09 October 2006 by the Government)

The 10th Congress of the Communist Party of Vietnam issued the Resolution approving the Report on orientations and tasks of socio-economic development for five years (2006-2010). The 11 National Assembly, in the 9th Session issued Resolution 56/2006/QH11 dated 29 June 2006 to approve the Report in order to effectively implement the Ten-year Strategy 2001-2010 to lay foundation for Vietnam to become a modern industrial country by 2020.

The Government shall issue the Action Program to implement the 10th Party Resolution and the 11th National Assembly Resolution on the socio-economic development plan 2006-2010. The Action Program consists of the following contents:

 Part I

MAJOR TASKS

I. Economy

1. To speed up the economic growth rate; to raise the economy’s effectiveness, sustainability and competitiveness

a) To create positive shifts in agricultural production, rural economy and farmers’ living standards

To uniformly implement solutions and policies to bring about qualitative changes in agriculture, forestry and fishery; to develop an agriculture of high productivity, quality and competitiveness.

To further examine and readjust the planning schemes of different sectors; to form and develop hi-tech production zones and concentrated areas of materials; to promote the intensive cultivation of advantageous crops, in parallel to post-harvet processing and restoring technologies.

To enhance the scientific and technological application in agricultural production in order to develop crop varieties, animal breeds, and aqua-products of high yield and quality; to boost the encouragement of agriculture, forestry and aquaculture; to improve the capability to prevent and fight against natural disasters and epidemics for crops and domestic animals.

To effectively realize investment programs on the construction of socio-economic infrastructure in rural areas, including the master programs, major projects and supportive policies on production development; to speed up agricultural and rural industrialization and modernization; to accelerate the restructure of agricultural and rural economy, in which priorities should be given to the products with high marketshare and economic effectiveness.

To implement the policy on supporting sustainable development for traditional crafts, handicraft villages, rural groups of craft units, and services directly relating to production activities and farmers’ life, in the connection to environmental protection.

To pay attention to and enhance the training work of cadres and vocational training, especially in remote and ethnic areas, through which it is possible to generate more jobs, raise income and improve farmers’ material and spiritual life.

b) To speed up the growth rate, improve quality and competitiveness of industrial sector

To mobilize resources to develop industries with competitive advantages, and exports using a lot of labour as well; at the same time, it is necessary to integratedly realize regimes and policies in order to increase technological content, added value and competitiveness of industrial produce; to encourage and support the investment in infrastructure for production, especially in big provinces and cities, industrial parks, export processing zones and economic areas.

To consider and issue regimes and policies suitable to domestic conditions as well as international regulations and commitments to encourage the development of manufacturing industry of important materials, high technologies, information technology, and infrastructure for the cause of industrialization and modernization; at the same time, it is necessary to pay attention to the development of traditional sectors and crafts, making products to meet the demands of life, society and production.

To promptly examine, amend and supplement the planning schemes of sectoral development, industrial products, eocnomic areas, industrial parks, export processing zones, material producing regions; to encourage enterprises in all economic sectors, both domestic and foreign, to invest in industrial sector.

c) To make a great progress in service sector

To strongly develop service sector, especially services of great potentiality and high competitiveness; at the same time, it is necessary to enlarge and improve quality of traditional services like transport, trade, tourism, post and telecommunication; to develop new services, especially high-grade services, those with high intelligence content, and business supporting services.

To build and fruitfully implement regimes and policies in order to create a good environment for enterprises in all economic sectors to invest in service sector; the State budget should be spent in the development of material and technical foundations to raise social welfare, ensure the provision of primary social services, first and foremost health care and education for the poor people, poor regions and beneficiaries of social policies.

To renew the management mechanism and method of providing public services; to proactively and integratedly realize the guideline of socializing public services in the orientations of self-reliance and self-responsibility, especially in health care, education and training, culture, science and technology, sports and gymnastics.

d) To focus on the development of regional and marine economy

To mobilize and concentrate resources on the development of key economic zones, major economic,  commercial and financial centers, and economic corridors and belts throughout the country; to faciliate the faster development of disadvantageous regions, especially border areas, islands, the Central Highlands, the Southwest, and the Northwest, in order to gradullay narrow the gaps in development levels and living standards between different regions in the country.

To design and implement the strategy of comprehensive development of marine economy, with focus and main points; to set up planning schemes, regimes and policies to effectively develop coastal economic zones.

To promptly examine, amend, supplement and perfect the regional planning schemes in order to fulfil the targets of socio-economic development in conformity with the Resolutions of the Politburo and the Government; to set up policies, programs and plans to mobilize and fruitfully exploit investment capital from economic sectors to bring into play potentials and comparative advantages of different regions, improve socio-economic efficiency and guarantee environmental protection.

e) To mobilize and make use of different resources for rapid and sustainable economic development

To further promote the mobilization and effective use of investment resources for development; to consistently eradicate the “asking-giving” regime, deal with extensive investment, waste and loss, low quality in the investment in basic construction; to change regimes and policies in order to improve the performance of project managing units; to put important projects and national master programs into realization.

To implement stable macro-economic policies, especially those on finance, currency, balance of payment, and inflation to minimize risks in investment and business activities, building and strengthening domestic and foreign investors’ confidence.

To executte the Laws on Investment, Enteprises, Commerce, Bidding and Contract, and Construction; to continue the perfection and implementation of policies on land, taxation, currency, and credit in the orientations of equality and non-discrimination among investors from different economic sectors, in line with internal conditions and international commitments.

To focus on the amendment, supplementation and perfection of the State management regimes and policies on investment, especially with State capital; on consultancy, supervision, and management of projects in the tendencies of transparency, openness, clear competence and responsibilities; at the same time, it is necessary to enhance the inspection, examination and supervision work; to persistantly overcome inefficient and unplanned investment, as well as fight against loss and waste and corruption in the investment with State budget.

2. To proactively create turning points in international economic integration; to raise the effeciency in external economic activities

To proatively integrate into international economy in a deeper and comprehensive manner, both at regional and world levels. To prepare good conditions to implement all commitments after Vietnam becomes a full member of the World Trade Organization (WTO), especially those about investment, trade and services; to boost the information and propagation work about international economic integration; to disseminate to all sectors, echelons, enterprises and the people the entire contents of the WTO accession commitments and other multilateral and bilateral agreements signed by Vietnam, especially those on the market opening process, reduction of import duties, reduction and eradication of direct support from the State to domestic enterprises.

To promptly realize research projects on positive and negative impacts during the implementation of international commitments in general and the WTO accession commitments in particular for each specific sectors, fields and product; to propose proper policies and measures to protect domestic industries and services, suitable to domestic conditions and international commitments.

To set up and implement the Action Program to realize the WTO accession commitments made by the Government in general and by different ministries and sectors in particular; to pay attention to the realization of import duties reducing process, the application and dealing with non-tariff measures, the opening of the domestic investment market in sensitve fields.

To promote and improve the export quality; to control and narrow trade gap; to increase the export of processed products of high added value, high technology and high competitiveness.

To diversify export markets; to broaden and develop new potential markets like the US and EU; at the same time, to further strengthen and enlarge traditional markets. To support domestic enterprises in raising their competitiveness through investment and commerical promotion, market development, construction and protection of trade marks.

To effectively realize the strategy on foreign loans and debt payment; to amend, supplement and perfect the mechanism to manage and use foreign loans by clearly defining competence and responsibility, improving the efficiency of loan management and exploitation, and ensuring the solvency; to promptly approve and implement the orientations and plans to attract and use ODA capital (ODA).

To further consider and perfect regimes and policies on investment in the orientations of consistent and non-discriminative application among domestic investors from all economic sectors and between them and foreign counterparts, in which special importance should be attached to policies on land, taxation, price and minimal salary; to encourage and manage Vietnamese enterprises’ investment abroad.

3. To create a good environment for enterprises to develop

To further maintain a stable macro-economic environment, creating good conditions for enterprises in all economic sectors to perform and develop in the market regime; to provide enterprises with time-limit assistance in their production and business as well as essential products in localities with socio-economic disadvantages; to considerably narrow the State’s exclusive business fields; to abolish business privileges of enterprises. To restrict the establishment of new State-run enterprises; those enterprises should be founded mainly in the form of joint-stock companies, only when all necessary conditions are met and in the fields to make and provide primary products and services for socio-economic development.

To implement the plans on rearranging and developing State-run enterprises; to focus on speeding up and extend the equitization of State-run enterprises, including economic corporations, big companies in which the State onwership is dominant; at the same time, to develop other property converting forms to raise State-run enterprises’ efficiency and competitiveness. To complete the conversion of all companies of which 100% the capital is owned by the State into one-member liability-limited companies or joint-stock ones within four years since 1 July 2006. To found and develop some economic groups and big corporations in order to increase the economy’s competitiveness during the market opening process and international economic integration, in conformity with domestic conditions and international commitments.

To set up and perfect legal documents on financial management, creating a legal corridor for economic groups to raise their competitiveness and operate in the socialist-oriented market mechanism in line with international commitments.

To amend and supplement the Law on Cooperatives to create a consistent and favourable legal environment for cooperatives to be founded and develop. To issue and implement policies on supporting different economic cooperation and development models in the tendency of multi-ownership.

To build up a healthy investment and business environment; to realize and uniformly apply regulations on interests and obligations of enterprises in investment and business activities in the orientation of equality; to carry out policies on encouraging and supporting small and medium-scale enterprises, especially the policies on investment promotion, trade promotion and technological transfer.

To proactively take measures to simplify administrative procedures; to overcome the criminalization of economic violations and infringements.

II. Science and technology, culture and social affairs

1. To develop and improve the effetiveness of scientific and technological activities

To take strong and consistent measures to create qualitative changes in scientific and technological activities; to gradually increase the scientific and technological contributions to the growth of each sector, field and product.

To renovate the management regime in the tendency of speeding up the socialization of scientific and technological activities; to enhance the interrelation between science-technology and education-training, between research-teaching and production-business. To raise the awareness of execution and validity of legal documents on protecting intellectual property and other legal rights of organizations and individuals in scientific and technological activities.

To promote the effective research and application of scientific and technological achievements, escpecially high technologies like IT and communication, bio-technology, material technology, automation technology, energy technology, agricultural produce restoring and processing technology.

To boost fundamental research in natural sciences, social sciences and humanities, management sciences to be able to provide scientific foundations for designing strategies, planning schemes, and plans on socio-economic development, speeding up the cause of national industrialization and modernization, creating pre-conditions for the implementation of the guidelines on developing an intellectual economy.

To encourage and support enterprises, first and foremost economic groups and big corporations, to invest in research and development activities in order to improve the capacity in technological transfer and later, technological creation and invention.

2. To create qualitative development in education and training

Through summarizing and assessing educational and training work over the recent time, it is possible to set up regimes, policies and solutions to comprehensively renew the teaching and studying contents, curriculums, methods, to develop proper training scope and structure, to raise the quality of the contingent of teachers and schools’ materical facilities, to insistently prevent and eradicate all nagative phenomena in education and training.

To promote the socialization of education and training. To promptly amend, supplement and perfect the tuition mechanism; at the same time, to renew financial regim in education and training. To concentrate on implementing priority policies on educational and training development in remote and ethnic minority areas as well as the regions with socio-economic disadvantages; to apply the policies on tuition exemption and reduction and granting scholarships to poor students, excellent pupils and the beneficiaries of social policies. To fruitfully realize the National Program on the Development of Human Resources up to 2020.

To continue the implementation of the program on solidifying schools and classrooms under the planning schemes; to attach this work to the construction and standardization of material and technical facilities for the network of schools and classrooms; to invest in the construction of some national- and international-level universities and key vocational training schools.

3. To improve the quality of people’s health care and protection

To complete the planning and development schemes for the system of health care throughout the country, including preventive health, and the network of hospitals and clinics from the central to communal levels; on this basis, it is possible to design programs and plans to mobilize resources to build and upgrade medical facilities in order to increase the quality of medical examination and treatment and people’s health care, improving Vietnamese people’s stature and physical strength.

To innovate the management regime of public hospitals in the orientations of raising self-reliance and self-responsibility, especially in financial aspect; to promptly perfect the planning schemes and specific conditions to encourage investors in all economic sectors, both domestic and foreign, to invest in the construction of medical facilities; to encourage and support the investments in remote and ethnic minority areas and the regions with socio-economic disadvantages.

To develop pharmaceutical industry and improve the competitiveness of domestic pharmacy; at the same time, to solidify the provision network in line with planning schemes, and to control the market of drugs.

4. Job generation, income increase and poverty alleviation

To effectively carry out the National Master Program on employment to generate more new jobs, raise productivity and increase labourers’ income.

To encourage labourers in creating jobs; to discover and disseminate effective job-generating models; to assist medium- and small-scale enterprises, especially those employing a large number of labourers. To extend the markets and increase the quality of labour exportation; to basically renew the training and vocational education for labourers before dispatching them to work abroad; to strictly manage and execute legal regulations on the protection of Vietnamese laborers’ legitimate interests in foreign countries.

To implement effectively the National Master Program on Poverty Alleviation, the Program 135 and other programs; to invest in infrastructure and to support production in remote and ethnic minority areas; to realize the programs on vocational training and education and on job generation, especially in cities, densely-populated regions, and the areas where many labourers shift from agricultural to industrial production; to encourage people to make their fortune in legal ways; at the same time, it is necessary to enhance social security activities.

To further complete necessary regimes and policies to assist and improve labourers’ material and spiritual life, especially those working in concentrated industrial parks.

5. To develop and socialize cultural, information, sport and gymnastic activities; to effectively realize policies on gender equality, child care and protection, youth, religious affairs, to take measures to prevent and fight against social evils and traffic accidents, maintaining social safety and security.

III. Environmental protection and sustainable development

1. To execute the Law on Environmental Protection, the Agenda XXI (Millennium Declaration); to encourage, discover and popularize the typical models of sustainable development; to include environmental protection in the plans on socio-economic development. To take proper measures and solutions to manage and strictly control wastes, especially toxic ones; to encourage the investments in environmental protection, collection, treatment and reproduction of wastes to better protect the environment and water sources.

To strictly execute legal regulations and sactions against environmental pollutions, especially the chemical producing and/or using enterprises, industrial parks, cities, densely-populated areas and handicraft villages.

2. To promote the propagation and popularization to all sectors, echelons, enterprises and the whole society about negative impacts of environmental pollution which can destroy natural resources and the living habitat, through which it is possible to raise the society’s awareness of environmental protection and sustainable development.

3. To build, amend and supplement sound regimes, policies and measures to increase efficiency and validity  of the State management over the environment at all echelons; to fruitfully apply economic instruments in environmental protection; to promote the propagtion and popularization work to raise the society’s awareness of the strict implementation of legal regulations on environmental protection fees.

IV. Socialist-oriented market economy

1. To further perfect the socialist-oriented market mechanism. Particularly, it is necessary to clarify big and important issues, both theoratically and practically, to institutionalize them into legal stipulations.

2. To issue regimes and policies to ensure the integrated development of different markets, inlcuding those of commodities, services, real estate, science and technology, labour, finance and currency.

3. To renovate and increase the validity and efficiency of the planning schemes and plans on socio-economic development. To set up and submit to the National Assembly for its approval the Law on Planning Schemes and Plans on Socio-economic Development; to supervise and assess the results of the implementation of socio-economic development plans, ensuring the fulfillment of the set targets and orientations of socio-economic development. To enhance the State management through inspecting and supervising the realization of planning schemes and plans, especially the compulsory ones.

4. To prepare the Ten-year Strategy on Socio-economic Development (2011-2020) and the Five-year Plan on Socio-economic Development (2011-2015).

V. National defense and security

1. To strengthen the country’s potential for national defense and security to be able to actively deal with all occurances; to firmly protect national independence, sovereignty, unity and territorial integrity; to ensure national security, political stability and social safety.

2. To design programs, projects, and plans to carry out the Strategy on Fatherland Protection, the Strategy on National Security, and the Natioanl Master Programs on Criminal Prevention and Struggle in the New Context.

3. To arrange a national defense and secutiry deployment suitable to new situations, in the close combination with socio-economic development through bringing into play the country’s potentialities. To continue the arrangement and improvement of the capacity of the national defense industries. To realize the planning scheme to build and develop national defense industries up to 2010, with the vision to 2020. To set up and put into reality the Five-year Plan on the Development of National Defense Industries (2006-2010).

VI. Corruption prevention and struggle, and the anti-prodigality work and thrift practice

1. To promptly build up and perfect the legal system of corruption prevention and eradication; to integratedly implement the Law on Corruption Prevention and Eradication, Law on Thrift Practice and Anti-prodigality Work; to amend, supplement and perfect the Law on Complaint and Denunciation.

2. To found and operate the Central Steering Committe for Corruption Prevention and Eradication and the similar organs in some ministries and sectors as stipulated by the Law on Corruption Prevention and Eradication. All echelons and sectors shall strictly execute the Action Program on Corruption Prevention and Eradication as well as the Action Program on Thrift Practice and Anti-Prodigality Work, especially in the fields of land, fundamental construction, State budget collection and spending, public financial management, personnel promotion and appointment.

3. To consistantly carry out the decentralization and devolution in parallel to clear definition of power and responsibility of each echelon, sector, and unit, especially the leaders.

4. To direct and resolutely deal with the discovered cases of corruption and negative phenomena in line with legal regulations, and to publicize them to the entire people.

5. To enhance the supervision of the organs and agencies administered by the National Assemby, the Fartherland Front, People’s Councils, and social organizations and unions in preventing and eradicating corruption as well as in practising thrift and fighting against prodigality.

6. To realize the statutes on grassroots democracy, to make economic and financial acitivities open and transparent in public administrative organs and non-productive units.

VII. Administrative reform

1. To continue the comprehensive and effective implementation of the General Program on State Administrative Reform in the Stage 2001-2010. To strongly renovate methods and procedures to set up and issue legal documents.

2. To innovate functions, obligations and methods of State management, esepcially executive and judicial functions in order to raise the effectiveness and coerciveness of the State management. To organize and rearrange the Governmental apparatus and local authorities at all levels in the orientations of quantitative reduction and qualitative increase; to establish interdisciplinary ministries and State management agencies.

3. To enhance the cadre training and standardization to improve the quality of the contingent of civil servants and officials in State management organs at all echelons, so that they will obtain necessary skills and qualifications to fulfill their assignments. To continue the Program on Salary Reform for cadres, civil servants, the retired and other beneficiaries of social insurance.

4. To modernize the national administration in conformity with the requirements of State management during the integration process; to carry out the Program on E-government and, at the same time, to renew the operation mode of the administrative system, making it suitable to the process of IT application in State management; to implement the ”one-door one-stamp” regime; to apply ISO 9000 in administrative and public financial management.

5. To strictly execute the principles of open and transparent performance of State management organs at all echelons; to broadly popularize and publicize the working statutes and procedures.

6. To set up and issue the regime of examination, inspectation, and supervision in order to solidify administrative rules and disciplines of cadres and civil servants; to raise their morality, responsibility and awareness in serving people, first and foremost the leaders of every unit. To realize the Statutes on Grassroots Democracy; to bring into play people’s and the Fatherland Front’s role as supervisors over State agencies, cadres and civil servants.

Part II

ORGANIZATION AND IMPLEMENTATION

1. On the basis of the above-mentioned tasks in this Action Program, depending on their assinged functions and obligations, the Ministers, heads of ministrial-level agencies and governmental organs, and chairpersons of the People’s Committees of centrally-administered cities and provinces shall direct the setting up of the Action Programs in their own ministries, sectors and localities in the Five-year Plan 2006-2010 and concretize them into specific tasks in annual plans. They shall design, check, amend and supplement their planning schemes, policies, programs, projects, and legal documents as assigned by the Government and the Prime Minister. For the tasks which will not be carried out under the above-mentioned projects/programs, they need to be instantly done to timely meet the requirements of socio-economic development of each sector and/or locality.

2. The ministers, heads of ministrial-level agencies and governmental organs, and chairpersons of the People’s Committees of centrally-administered cities and provinces shall direct and supervise the implementation of this Action Program; they shall make annual reports to the Prime Minister. At the same time, these reports shall be sent to the Ministry of Planning and Investment which shall summerize and report to the Prime Minister.

3. During the implementation of this Resolution, if some specific contents of the Action Program need to be amended and supplemented, the ministries, sectors and localities shall actively cooprate with the Ministry of Planning and Investment to report to the Prime Minister for consideration and final decision./.
