Establishment of social support institutions encouraged

VGP – The State encourages individuals and organizations, both at home and abroad, to establish social support institutions, in order to care for and provide social assistance to those in demand across the Vietnamese territory.

Individuals and organizations investing in the construction of social support establishments will enjoy the socialization stimulation policies in accordance with the law, as stipulated in the Government’s Decree No. 103/2017/ND-CP in regards to the establishment, organization, operation, dissolution and management of social support facilities.

Seven types of social support establishments

According to the decree, social support establishments include public and non-public ones.

There are seven types of social assistance establishments, including:

1 – Social protection institution taking care of the elderly people;

2 – Social protection institution taking care of children in special circumstances;

3 – Social protection institution taking care of people with disabilities;

4 – Social protection institution taking care of and rehabilitating people with mental disorders;

5 – General social protection institution taking care of those under social protection or those in need of social assistance;

6 – Social working center providing advice, urgent care or other necessary support for those in need of social assistance;

7 – Other social assistance establishments in line with the law.

Beneficiaries of social support establishments

The decree clearly stipulates the beneficiaries of social support establishments, including:

1 – Those under social protection;

2 – Those in need of urgent protection;

3 – Minors who have no stable residence and are applied with education measures in communes, wards and towns;

4 – Those who are not under social protection but are in need of social assistance and voluntarily pay for the services they receive;

5 – Other subjects in support programs and projects, or decided by the chairpersons of the provincial-level People’s Committees.

Licensing conditions

Social support establishments are granted operation permits if they meet the full requirements as follows:

1- Public social support institution established in line with regulations at Article 1 of Chapter 3 of the Decree.  

2- The head of the establishment must have full capacity for civil acts as well as good moral qualities, whilst not committing any social evils and not being among the criminally liable people or those having been sentenced but yet to be remitted.

3- The social support establishment has the staff directly advising and taking care of the subjects.

4- If the establishment takes charge of caring for and nurturing the subjects, it also has to ensure the infrastructure and personnel requirements stipulated at Article 1 of Chapter 4 of the Decree, in addition to meeting the aforementioned conditions.
