RESOLUTION

THE GOVERNMENT’S REGULAR MEETING - DECEMBER 2016

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusions of the Prime Minister at the Government’s meeting with local authorities and the Government’s regular meeting in December 2016, held on December 28 and 29, 2016,

RESOLVES:

1. Regarding the socio-economic situation in 2016; the implementation progress of the Resolution No. 01/NQ-CP dated January 07, 2016 of the Government on major tasks and solutions guiding the implementation of the socio-economic development and state budget plan in 2016

The Government unanimously agreed that: despite global and domestic economic difficulties, Viet Nam achieved a number of positive socio-economic results in many fields thanks to the leadership of the Party and the supervision of the National Assembly, efforts of all agencies and all levels, the business community and the people. The economy continued recovery pace, macro-economy was stable. Inflation was kept under control. In principle, major economic balances were guaranteed. Level of liquidity of the banking system was abundant. Base rate remained stable. Foreign exchange reserves rose. The stock market observed positive developments. Exports registered decent growth compared to other countries in the region. An export surplus was achieved. Most industrial sectors registered fair growth, especially processing and manufacturing and construction sectors. Service and tourism sectors flourished. Business investment environment continued to improve. Social and market confidence increased dramatically. Disbursement of planned state budget rose. Foreign direct investment (FDI) surged. Institutional development received full attention from the Government. New rural construction achieved positive results. Social security was guaranteed. Employment, labor export, enforcement of policies for people with meritorious services to the nation, and other social sectors made significant progress. The whole political system actively participated in preventing, controlling and overcoming the consequences of natural disasters, droughts, salinity intrusion, coping with climate change and environmental protection. Anti-corruption, thrift practice and waste combat received full attention. Defence and security were strengthened. National security was maintained. Social order and safety were guaranteed in the fight against terrorist plots, activities to sabotage and disrupt security and order of hostile forces and reactionaries. Security and social order observed many positive changes. Crime increase rate was kept under control. Foreign affairs and international integration continued to be deployed proactively and positively and achieved many important results.

However, targets on economic growth and export were not achieved as planned. Exports to ASEAN countries declined. Disbursement of Government bonds was relatively low. Bad debts and restructuring of credit institutions remained challenging. Manufacturing and business still faced numerous difficulties. The number of enterprises dissolved or suspended operations still increased. Management of market and border trade still had a number of inadequacies. Issues related to smuggling, commercial fraud, food safety were not thoroughly handled. Activities to address environmental pollution remained slow. Management of information and communication, information security and security remained limited. There were some complicated developments in crime and social order and safety in a number of areas. The people's life remained difficult, especially in areas affected by natural disasters, droughts, salinity intrusion, floods and environmental incidents at sea.

The Government requested ministries, agencies and localities to leverage the results achieved, to urgently address shortcomings and weaknesses; take advantage of opportunities to overcome difficulties and challenges; determine to take active, innovative, and creative actions; and closely attach to Resolutions of the Party, the National Assembly, and the Government, especially the Resolution on the major tasks and solutions guiding the implementation of the socio-economic development and state budget plan in 2016; drastically and synchronously implement the assigned tasks right from the beginning of the year.

Ministers, Heads of Ministerial-level agencies, Governmental bodies, Chairmen of the People's Committees of provinces and centrally-run cities shall fortify their role and responsibilities, especially in organizing the implementation of the assigned tasks and creating motion in the entire system, contributing to the successful realization of the planned socio-economic development objectives in 2017.

To prepare the best conditions for the people to celebrate the Lunar New Year in 2017, ministries, agencies and localities shall strictly implement Directive No. 11-CT/TW dated November 20, 2016 of the Secretariat on the organization of the Lunar New Year 2017 celebration, Directive No. 33/CT-TTg dated December 17, 2016 of the Prime Minister on strengthening management and administration in order to stabilize market prices, ensure social order and safety in Lunar New Year of 2017, and Directive No. 2239/CD-TTg on ensuring traffic order and safety in during new year holidays.

2. Regarding the draft Resolution of the Government on a number of major solutions guiding the implementation of the socio-economic development and the State budget plan in 2017

The Ministry of Planning and Investment shall lead and coordinate with the Government Office and other relevant ministries and agencies to collect comments of the Cabinet members and participants at the Government’s meeting with local authorities, improve the draft Resolution, and submit to the Prime Minister for promulgation on January 01, 2017.

The Government requested Ministers, Heads of Ministerial-level agencies, Governmental bodies, Chairmen of the People's Committees of provinces and centrally-run cities to promulgate specific programs and action plans to implement the Resolution before January 10, 2017, and send to the Ministry of Planning and Investment for synthesis and reporting to the Government at the regular meeting in January 2017.

Ministries and Ministerial-level agencies shall, based on their authority and competency, proactively handle local authorities’ recommendations stated at the Government’s meeting with local authorities, and report to the Prime Minister to consider matters beyond their competence. The Government Office shall aggregate, monitor, supervise and inspect the process of handling these recommendations.

3. Regarding the implementation of Resolution No. 05-NQ/TW on a number of guidelines and policies to continue innovating growth model, improving growth quality, labor productivity, and economic competitiveness and Resolution No. 24/2016/QH14 of the National Assembly on economic restructuring plan for the 2016-2020 period

The implementation of policies on growth model transformation and economic restructuring delivered some positive results, but has yet met the requirements set out.

The Government requested Ministers, Heads of Ministerial-level agencies, Governmental bodies, Chairmen of the People's Committees of provinces and centrally-run cities, based on their assigned functions and competence, to be active and creative in organizing the implementation of specific tasks outlined in Resolution No. 05-NQ/TW adopted at the 4th plenum of the 12th Party Central Committee, Resolution No. 24/2016/QH14 of the 14th National Assembly and Action Plan of the Government; promptly promulgate programs, action plans of ministries, agencies and localities to implement the Resolutions, and send to the Ministry of Planning and Investment for synthesis and reporting to the Government in the first quarter of 2017.

- Relevant ministries and agencies shall study and propose draft laws and ordinances which need to be promulgated and/or amended and supplemented to support economic restructuring and growth model innovation. Based on proposals of ministries and agencies, the Ministry of Justice shall report to the Government to submit to the National Assembly Standing Committee to shape the law and ordinance building program in 2018 and make adjustments to the law and ordinance building program in 2017.

- The Ministry of Information and Communications shall lead and coordinate with the Ministry of Planning and Investment, the CPVCC’ Commission for Propagation and Education, the Central Committee of the Viet Nam Fatherland Front and other ministries, agencies and localities to fulfill information and communication tasks to raise the awareness, create social consensus, promote a sense of responsibility of leaders, efforts of all sectors, all levels, of the business community and the people to successfully realize goals on growth model innovation and economic restructuring.

4. Regarding the draft Resolution promulgating the Action Plan of the Government to implement Resolution adopted at the 4th plenum of the 12th Party Central Committee on enhancing Party building and rectification, preventing and curbing ideological, ethical and lifestyle degradation as well as the manifestation of “self-evolution” and “self-transformation” inside the Party.

The Ministry of Home Affairs shall lead and coordinate with the Government Office and ministries, agencies and localities to collect comments of the Cabinet members and delegates at the Government’s meeting with local authorities to complete the draft Resolution and submit to the Prime Minister for signing in January 2017.

Ministries, ministerial-level agencies, Governmental bodies, the People's Committees of provinces and centrally-run cities shall quickly issue their programs and action plans to implement the Resolution, and send to the Ministry of Home Affairs for synthesis and reporting to the Government in the first quarter of 2017.

5. Regarding the implementation progress of Resolution No. 19 on improving business environment and enhancing national competitiveness, draft Resolution of the Government on the key tasks and solutions to improve business environment and enhance national competitiveness in 2017

After 03 years of implementation of Resolution No. 19, the local business environment observed critical improvements. Viet Nam jumped nine places (from 91 out of 189 to 82 out of 190) with improvements recorded in five indexes. This was the best ranking improvement since 2008. The business community appreciated and welcomed efforts by a number of ministries, agencies and localities to improve business environment and enhance competitiveness over the past months. With increasing confidence, they are now counting on the innovative solutions of Resolution No. 19. Although the business climate ranking of our country recorded improvements in almost all indicators yet remained lower than the average level of ASEAN 4. Some indicators did not reach the average of ASEAN 6.

To vigorously accelerate the improvement of the business environment and the efficiency and quality of determinants of competitiveness, the Ministry of Planning and Investment shall take the lead and coordinate with the Government Office and the relevant ministries and agencies to collect opinions of the Cabinet members and delegates at the Government’s meeting with local authorities, complete the draft Resolution, and submit to the Prime Minister for signing in January 2017.

6. Regarding the implementation of Resolution No. 35/NQ-CP dated May 16, 2016 of the Government to support and develop enterprises by 2020

After more than 06 months of implementation, Resolution No. 35/NQ-CP dated May 16, 2016 made great contribution to building the confidence of the business community on a constructive Government that supports and promotes enterprise development. The provinces and centrally-run cities signed the commitment to create a favorable business environment for enterprises. Many policies to support business development were issued. However, some tasks and measures stated in the Resolution had been slowly enforced.

In the upcoming period, the Government requested ministries, agencies and localities, based on their assigned functions and tasks, to continue drastic, comprehensive and effective implementation of the tasks and solutions stated in Resolution No. 35/NQ CP and provide periodic report as stipulated for publicity of the implementation results.

Ministers, Heads of Ministerial-level agencies, Chairmen of the provincial People's Committees shall direct the implementation of assigned tasks in an active, aggressive and effective manner in 2017.

The Ministry of Planning and Investment shall lead and coordinate with the Steering Committee for Innovation and Enterprise Development, the Viet Nam Chamber of Commerce and Industry to conduct an overall assessment and review as stipulated, propose recommendations for amendments and supplements to Resolution No. 35/NQ-CP if necessary, and report to the Government in the second quarter of 2017.

7. Regarding the implementation progress of Resolution No. 60/NQ-CP and plan on disbursement of State budget and Government bonds in 2016

Ministries, central agencies and localities shall continue implementing effectively tasks and solutions stated in Resolution No. 60/NQ-CP dated July 8, 2016 of the Government and Dispatch No. 2144/CD –TTg dated November 29, 2016 of the Prime Minister.

The Ministry of Planning and Investment shall synthesize data and report to the Government at the regular meeting in January 2017.

8. Regarding the report of the Prime Minster’s Task Force on implementation results of the tasks assigned by the Government and the Prime Minister to ministries, agencies and localities in 2016 and inspection results of the Task Force from August to December 2016

In 2016, positive changes were recorded in the implementation of the tasks, conclusions and directions that the Government and the Prime Minister delegated to ministries, agencies and localities. The monitoring, acceleration and inspection of the implementation of tasks assigned by the Government and the Prime Minister were put into practice. Ministries, agencies and localities became more and more positive, proactive, and attentive to the implementation of the assigned tasks. Especially, after five months since the establishment of the Task Force, the implementation results of the tasks assigned by the Government and the Prime Minister was clearly improved. The number of overdue tasks reduced significantly. Activities of the Task Force had a powerful ripple effect to strengthening administrative disciplines and order among ministries, agencies and localities. Many ministries, agencies and localities also established Task Forces to help Ministers, Heads of agencies, Chairmen of the provincial People's Committees review, supervise and inspect the implementation of their tasks assigned by the Government and the Prime Minister. However, a number of ministries, agencies and localities still did not pay full attention to the monitoring, acceleration and inspection of the implementation of tasks assigned by the Government and the Prime Minister. As a result, some assigned tasks were not completed within their due date.

The Government required ministries, agencies and localities to strengthen administrative disciplines and order, pay special attention to implementing the tasks assigned by the Government and the Prime Minister, combine direction and implementation with monitoring, acceleration and inspection, highlight the responsibility of the leaders in the implementation and fulfilment of assigned tasks. The Task Force of the Prime Minister shall continue to inspect and supervise the implementation of tasks assigned by the Government and the Prime Minister, especially tasks related to areas of public concern. Attention shall be paid to expanding inspection and acceleration of the implementation of policies and regulations, direction and management under the authority of Ministries, agencies and localities.

9. Regarding drug rehabilitation in 2016, tasks and solutions in the upcoming period

Amid complicated developments in drug crime and drug abuse situation, the Government requested:

a) Ministries, agencies and localities to strictly implement the direction of the Prime Minister at the National Online Meeting on the prevention and fight against drugs and drug abuse on December 23, 2016. In which, attention should be paid to the following tasks and solutions:

- Acutely aware of serious consequences caused by drug crime and drug abuse, the whole political system and the entire people shall actively fight against drug crime, and contribute to safeguarding social order and safety, bringing happiness to the people, and ensuring the quality of our race.

- Clearly define this as a critical, urgent, frequent, continuous task that should not be neglected by all levels of the Party and the Government. Mobilize the power of the people to repel drug crime and drug abuse.

- Focus on three reduction targets: Supply reduction, demand reduction, and impact reduction. In all circumstances, sufficient funding for the drug treatment must be guaranteed. Attention should be paid to strengthening mobilization of central, local and social resources.

b) People's Committees of provinces and centrally-run cities shall promulgate programs and action plans to implement activities for drug prevention and drug rehabilitation, including:

- Utilize central budget (avoid transferring of purpose), allocate local budget for drug prevention and drug rehabilitation.

- Direct specialized agencies to strictly and rapidly convert Centres for Treatment, Education and Social Workforce (known as Center 06) in the area into rehabilitation facilities latest by the first quarter of 2017.

10. Regarding reports on: the inspection and settlement of complaints and denunciations and the fight against corruption in 2016, administrative reform in 2016, the implementation progress of Resolution No. 36a/NQ-CP dated October 14, 2015 of the Government on e-Government

The Government Inspectorate, the Ministry of Home Affairs, and the Government Office shall collect comments of the Cabinet members and delegates at the meeting of the Government with local authorities to complete and issue the reports.

11. Regarding the draft Decree detailing tasks, authorities and organizational structure of the Ministry of Home Affairs

The Ministry of Home Affairs shall lead and coordinate with the Government Office and the Ministry of Justice to collect comments of the Government, complete the draft Decree, and submit to the Prime Minister for signing before January 15, 2017.

12. Regarding the draft Decree detailing tasks, authorities, and organizational structure of the Ministry of Labor - Invalids and Social Affairs

The Ministry of Labor - Invalids and Social Affairs shall lead and coordinate with the Government Office and the Ministry of Justice to collect comments of the Government, complete the draft Decree, and submit to the Prime Minister for signing before January 15, 2017.

13. Regarding the draft Decree detailing tasks, authorities and organizational structure of the Ministry of Transport

The Ministry of Transport shall lead and coordinate with the Government Office and the Ministry of Justice to collect comments of the Government, complete the draft Decree, and submit to the Prime Minister for signing before January 15, 2017.

14. Regarding the draft Decree detailing tasks, authorities and organizational structure of the State Bank of Viet Nam

The State Bank of Viet Nam shall lead and coordinate with the Government Office and the Ministry of Justice to collect comments of the Government, complete the draft Decree, and submit to the Prime Minister for signing before January 15, 2017.

15. Regarding the draft Decree detailing tasks, authorities and organizational structure of the Committee for Ethnic Minority Affairs

The Committee for Ethnic Minority Affairs shall lead and coordinate with the Government Office and the Ministry of Justice to collect comments of the Government, complete the draft Decree, and submit to the Prime Minister for signing before January 15, 2017.

16. Regarding the implementation progress of the Government’s law and ordinance building program and the promulgation of documents detailing the implementation of laws and ordinances in 2016

With the goal of building a constructive Government that can take active actions to serve the people and enterprises, the Government and the Prime Minister have drastically directed the institutional development and improvement with an overall view to quickly eradicate barriers, create a favourable investment environment and achieved certain progress. In 2016, the Government and the Prime Minister basically innovated the process to communicate and consult on draft regulations at the Government’s meetings. In principle, almost all draft laws and ordinances were submitted to the National Assembly on time and with high quality. The development and promulgation of detailing documents timely met requirements on the enforcement of laws and ordinances. For the first time, there was no backlog of Decrees unprocessed by the Government. However, there remained request for adjustment in deadline to submit draft laws. Discipline and order observation in the development and submission of draft laws and ordinances remained not strict enough. The submission of laws and ordinances for review, acquisition, rectification and improvement of draft laws and ordinances which shall be submitted to the National Assembly and the National Assembly Standing Committee did not meet the expected deadline.

In 2017, the Government requests:

- Ministers and Heads of Ministerial-level agencies to fortify their role and responsibilities to continue to pay full attention to closely direct, focus resources for the drafting and submission of legal documents.

- Ministries, Ministerial-level agencies to expeditiously finalize the study and proposal on draft laws and ordinances within their assigned authority to include them in the law and ordinance building program in 2018 and make adjustments to the law and ordinance building program in 2017 as regulated. Agencies assigned to lead the drafting of laws and ordinances need to actively strengthen their coordination with relevant agencies of the National Assembly from the beginning and throughout the study, preparation, acquisition, revision and completion of draft laws and ordinances, strictly comply with the requirement that legal detailing documents must be prepared and submitted in conjunction with draft laws and ordinances.

- The Government Office shall actively better its advising and coordination functions in addressing controversial provisions of draft documents when reviewing and submitting to the Government and the Prime Minister for consideration and promulgation.

- The Ministry of Justice shall focus on improving the quality of the proposal made by the Government on the annual law and ordinance building program, lead and coordinate with the Government Office to drastically and effectively implement the monitoring, acceleration and inspection, timely provide advices to the Government and the Prime Minister to address difficulties and problems in the development and promulgation of legal documents.

17. Regarding measures to stabilize milk prices for children under six years old and the proposal on measures to manage milk prices for children under six years old in the future

The Government unanimously agreed to continue measures to stabilize milk prices for children under six years old until the end of the first quarter of 2017. The Ministry of Industry and Trade shall lead and coordinate with the Ministry of Finance and other relevant ministries, agencies, and localities to conduct survey and assessment on the actual situation, propose and report to the Government on measures to manage milk prices for children under six years old at the Government’s regular meeting in March 2017.

18. Regarding the Government’s draft Decree on on-lending of foreign loan capital to the People's Committees of provinces and centrally-run cities

The Government unanimously agreed to determine the on-lending rate of preferential loans for investment projects on socio-economic development at the following levels: 30%, 70%, and 100%.

The Ministry of Finance shall lead and coordinate with the Government Office, the Ministry of Planning and Investment and other relevant ministries and agencies to collect opinions to the Government, to finalize the draft Decree, and submit to the Prime Minister for signing in January 2017.

19. Regarding extension of the expiration date of Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on a number of policies on fishery development

The Government unanimously agreed to extend the expiration date of Decree No. 67/2014/ND-CP until the end of December 31, 2017.

The Ministry of Agriculture and Rural Development shall lead and coordinate with the Ministry of Finance, the State Bank of Viet Nam and the relevant provincial People's Committees to urgently review and evaluate the implementation of Decree No. 67/2014/ND-CP and report to the Government in the first quarter of 2017. Based on the review and evaluation results, the Ministry of Agriculture and Rural Development shall develop a draft Decree amending and supplementing to Decree No. 67/2014/ND-CP following the simplified procedure and process, and submit to the Government in the second quarter of 2017.

20. Regarding price adjustment of medical services, health insurance and treatment in Ho Chi Minh City, Thanh Hoa, Nghe An and Ha Tinh Provinces

The Government unanimously agreed with the report of the Prime Minister on behalf of the Government to allow price adjustment of medical and treatment services and health insurance (including wages) for the four above-mentioned localities in December 2016 under the working regulations of the Government.

21. Regarding the review of the performance of the Government and the Prime Minister in 2016

2016 was a transition year for the Government when the country faced many advantages as well as difficulties and challenges, especially, natural disasters and complicated weather conditions; prolonged droughts in the Central region and the Central Highlands; salinity intrusion in the Mekong Delta; and large floods occurring recently in the Central region. However, new energy, new motivation, beliefs and expectations were created in the reform process thanks to high determination, spirit of responsibility, solidarity and unity of the Government and the Prime Minister.

The Government and the Prime Minister always sticked to the leadership of the Party and the supervision of the National Assembly, complied with the Constitution and regulations, and fulfilled duties as prescribed, ensured the principle of democratic centralism, promoted collective responsibility in association with individual responsibility, coordinated closely with agencies of the Party, the National Assembly, the judicial bodies, the Viet Nam Fatherland Front and mass organizations in fulfilment of tasks.

The Government and the Prime Minister led the administrative apparatus to comprehensively fulfil their tasks in the spirit of serving the people and enterprises, taking the people and enterprises’ satisfaction as the measurement of the efficiency of performance. Administrative disciplines and order were strengthened. Responsibility of heads of agencies was promoted. Efforts and determination were made to achieve the set objectives including solving immediate problems and proactively deploying mid-term and long-term goals while achieving plenty of fruitful results as well as important markers.

The Government Office shall collect comments of the Cabinet members, complete and issue a Report reviewing the performance of the Government and the Prime Minister in 2016 and the Government’s Work Plan in 2017./.
