New regulations on contract on e-commerce websites

VGP – The Ministry of Industry and Trade has just introduced a new circular managing the information provision and contracts making on e-commerce websites.

An e-document sent online is considered a request for contract

The Circular provides fundamental regulations on an e-commerce contract; terms relating to clients’ or traders’ request for transactions; conditions for a transactional request to become an e-commerce contract; and the termination of a request for e-commerce contracts.

To ensure clients’ interests, it is compulsory for the enterprises to publicize terms of transaction on their own websites so as to help clients to make good purchase decisions.

The Circular also stipulates how to post information on e-commerce websites. Accordingly, all enterprises must provide the following data: name, transactional address, email, and telephone.

Besides, the document also covers the responsibilities of enterprises and website owners in providing information and concluding contracts; mechanism for handling disputes relating to e-commerce contracts.
