RESOLUTION

THE GOVERNMENT’S REGULAR MEETING – SEPTEMBER 2018

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in September 2018, held on October 01, 2018,

DECIDES

1. Regarding the document preparation for the 6th working session of the 14th National Assembly

The Government requested:

- Ministers and Heads of ministerial-level agencies directly instruct and urgently finalize draft laws and reports which will be submitted to the National Assembly under the responsibilities of their ministries and agencies according to the assignment, ensure the quality and compliance with procedures and submit them to the National Assembly within the required timeline.

- Members of the Government spend time reading thoroughly and providing comments on documents and reports before submitting to the National Assembly; actively provide sufficient documents, dossiers, explanation to legislators, National Assembly delegations, and press agencies regarding concerning issues of interest to the National Assembly and the society in the sectors and/or fields under their management; pay special attention to the preparation of reports, explanations and answers to questions raised by legislators on commitments and promises of members of the National Assembly from the beginning of their term.

- The Government Office was assigned to follow up, accelerate, and coordinate with ministries and agencies to prepare and finalize draft laws and reports to ensure on-time submission of reports and documents to the National Assembly as per requested.

2. Regarding the socio-economic situation in September and the first 9 months of 2018; the implementation of Resolution No. 01/NQ­CP dated January 1, 2018 of the Government

The Government unanimously agreed that: Thanks to the aggregate efforts of the entire political system, the business community and the people of the whole country, the socio-economic situation in September and the first 9 month of 2018 continued to observe positive development; substantial economic restructuring and growth model transformation were recognized; major economic balances were assured. Macroeconomic stability was maintained, inflation was kept under control. Monetary, credit, and stock markets observed stable development. Gross domestic products in the third quarter maintained growth momentum and was estimated to reach 6.88%. The figure for the first nine months was 6.98%, the highest rate compared to the same period in the previous seven years. All three economic sectors recorded higher growth compared to the same period in the previous year. Although the agricultural sector was heavily affected by the adverse weather conditions and natural disasters, the sector growth was estimated at 3.65%, the highest level since 2012. The industry and construction sector observed strong improvement and was estimated to grow at 8.89%. The manufacturing sector continued to be the main engine of the economy. The service sector improved by 6.89%, total retail and services sales in 9 months increased by 11.3% compared to the same period in the previous year. The number of international visitors was 11.6 million, up 22.9%. January-September exports increased by 15.4% compared to the same period last year, of which those of the domestic sector and the foreign direct investment (FDI) sector increased by 17.5% and 14.6%, respectively. Trade surplus reached nearly US$5.4 billion. State budget revenues increased by 13.7%. The ratio of public debt to GDP decreased. Total social investment increased by 10.9%. Investment and business environment continued to improve. The number of newly-established enterprises and the average size of capital increased compared to the same period last year. The fields of culture, society, education and training, science and technology, environment, labor and employment continued to be effectively deployed. Capability in accessing the Fourth Industrial Revolution had been strengthened. People care, food safety and hygiene received due attention. The social security policy was guaranteed, especially the reward and gratitude for people with meritorious services to the revolution. Defence, security, social order and safety were maintained. Due attention was paid to foreign affairs and international integration, especially the successful organization of the World Economic Forum on ASEAN (WEF ASEAN) in 2018; affirming and contributing to raising the position and prestige of Viet Nam in the international arena.

Besides the above-mentioned achievements, the deployment of the socio-economic development tasks still faced many difficulties and challenges. The US-China trade affairs, risks associated with exchange rate and interest rate rise, unpredictable geo-political tension, science and technology and the fourth industrial revolution continued to pose significant impact on the country’s economy in many ways. Inflationary pressures still existed. The growth rate of foreign direct investment tended to decrease. Disbursement of public investment and ODA remained low. The number of enterprises suspending operation increased, efficiency of production and business activities remained not high enough. The simplification and streamline of business conditions and specialized testing procedures remained slow. Complicating developments were observed for issues related to smuggling, trade frauds, social order and safety, traffic accidents, and mass petitions in some areas. Over the past period, the weather conditions, natural disasters, floods and storms caused serious damage, affecting production, business and the people’s life.

In order to successfully realize the socio-economic development plan in 2018 with a view to consolidate the country’s strengths in the rest of their term, the Government requested ministries, agencies and localities not be subjective, closely monitor the situation in the country and the world to provide timely and appropriate policy responses; focus on the synchronous and effective implementation of the tasks and solutions set forth in the Resolutions of the Party and the National Assembly, the Government's Resolution No. 01/NQ-CP, specialized resolutions and Resolutions of regular meetings of the Government. Ministers, Heads of the ministerial-level agencies, Chairmen of the People's Committees of the provinces and centrally-run cities shall promote personal responsibility, focus on directing, reminding, inspecting and speeding up the completion of the tasks and works assigned, especially the tasks on institutional development and improvement, improving the investment and business environment, creating remarkable changes in the remaining months of 2018. Attention should be paid to the implementation of the following contents:

- Ministries, sector and localities shall closely monitor the price and market developments, strengthen the analysis, forecast, and timely take appropriate measures to control inflation, especially in the end of the year.

- The State Bank of Viet Nam shall closely monitor developments of the monetary and financial markets in the country and in the world, actively and flexibly manage monetary policy in line with market developments, contributing to stabilizing the macroeconomic conditions and controlling inflation, and work closely with the Ministry of Planning and Investment, the Ministry of Finance and the Ministry of Industry and Trade in managing macroeconomic policies.

- The Ministry of Planning and Investment shall expeditiously finalize the draft Law amending the Law on Public Investment and submit it to the National Assembly at its sixth working session. The Ministry shall be the focal point coordinating with the concerned ministries, sectors and localities to speed up the disbursement of public investment, especially for large projects, important works, national target programs, determine not to extend or transfer capital to slowly-disbursed projects. The Ministry of Planning and Investment shall assume the prime responsibility for and coordinate with concerned ministries and sectors in evaluating the opportunities and proposing solutions to cope with the wave of investment shift; urgently finalize the Fourth National Industrial Revolution Strategy; assume the prime responsibility for and coordinate with the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs in reviewing and arranging medium-term investment capital for improving and upgrading drug detoxication establishments, especially in the southern provinces.

- The Ministry of Finance shall work out measures to accelerate the restructuring of the state budget according to the roadmap; reduce the proportion of regular expenditures and increase the spending ratio for development investment; ensure a reasonable state budget revenue and expenditure structure; direct the State budget revenue collection in a drastic manner, be determined to fulfil and/or surpass the estimates; tightly manage savings; thoroughly assess the impact of new tax policies in order to create social consensus; coordinate with ministries, sectors and localities in stepping up the equitization of State enterprises and divestment of state capital; intensify the coordination in examining, detecting and strictly handling cases of smuggling and trade frauds; provide guidance on rearranging and settling public assets which remained in challenges in the implementation of Decree No. 167/2017/ND-CP, especially for housing and facilities in Ho Chi Minh City. In case of necessity, the Ministry of Finance shall report to the Government on the amendment and/or supplementation of the Government's Decree No. 167/2017/ND-CP.

- The Ministry of Industry and Trade shall focus on restructuring the industrial sector in the direction of increasing the content of science and technology and added value. The Ministry shall propose solutions to minimize the impact of the US-China trade affairs; direct to speed up the completion and putting into operation of important industrial production projects to create spill-over effects.

- The Ministry of Transport shall concentrate on directing and expeditiously completing investment procedures for important national transport infrastructure projects; and speed up the implementation and disbursement of key projects and projects of the transport sector.

- The Ministry of Natural Resources and Environment shall direct to raise the quality of natural disaster prediction and warning and strengthen the inspection, control and assurance of the environment.

- The Ministry of Agriculture and Rural Development shall continue to promote agricultural restructuring; attach importance to the processing, preservation, export and development of agricultural value chains; and closely monitor the disease situation on plants and animals, take initiative in the planning for timely prevention and combat against diseases, especially the African pig cholera.

- The Ministry of Culture, Sports and Tourism shall attach great importance to the development of high-quality tourism, striving to meet the set targets for the number of international and domestic tourists; improve the quality of tourism services, ensure to reach the target of the number of international tourists returning to Viet Nam to create a solid foundation in tourism development.

- The Ministry of Health shall intensify the implementation of measures to improve the quality of medical examination and treatment in service of the people; coordinate with ministries, sectors and localities in inspecting and controlling food hygiene and safety; and continue to implement effective methadone treatment program for drug addicts.

- The National Committee for AIDS, Drugs and Prostitution Prevention and Control shall intensify the direction of practical activities to bring into full play the strength of the entire political system, branches, levels and localities in the prevention and fight against drug evils. The People's Committees of the provinces and centrally-run cities shall allocate resources for investment in renovating and upgrading facilities of detoxication establishments; direct the review and strict management of drug addicts and ensure social order and safety in their respective localities.

- The Ministry of Labor, Invalids and Social Affairs shall well implement social welfare, labour and employment policies; assume the prime responsibility for, and coordinate with the Viet Nam Fatherland Front, ministries, branches and localities in effectively implementing the Day for the Poor and the movement on “Actions of Viet Nam to leave no one behind", and diversifying drug detoxification measures.

- The Ministry of Justice shall review and evaluate the application of the Law of Administrative Procedures and propose to the Prime Minister reasonable solutions in the process of settling administrative cases; intensify the monitoring and acceleration of the preparation and submission of draft legal documents and projects to competent agencies, ensuring their quality and progress.

- The Ministry of Education and Training shall promptly report on the overall explanation of textbook issues raised by electors and deputies of the National Assembly before the sixth session of the National Assembly; intensify the inspection and examination of the publication of textbooks and avoid monopoly status; urgently expose and finalize the revised Law on Education and submit it to the National Assembly at the 6th session.

- The Ministry of Science and Technology shall strengthen solutions to bring into play the strength of the Vietnamese young scientific and technological contingent at home and abroad in scientific and technological development and application.

- The Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Education and Training, the Ministry of Finance and localities in, promptly reviewing and proposing specific solutions to handle the shortage of teachers in remote areas, areas with particularly difficult economic conditions and localities with an mechanical growth of population, in the spirit of ensuring the strict implementation of the Government's Resolution No. 19-NQ/TW on payroll streamlining.

- The localities shall take initiative in reviewing and re-arranging the appropriate schools and teacher payrolls to transfer teachers from units with staff surplus to unit shortage of staff with a view to streamline staff and reduce the number of public non-business units to ensure the sufficient number of teachers, prevent shortage of teachers, which could affect the study of students, especially in remote areas.

- The Government Inspectorate shall continue to concentrate on deploying inspection work as planned as well as irregular inspection and case-by-case inspection; promptly issue conclusions after the inspection, especially for the cases of social concern; intensify the inspection and examination of the responsibility of the heads in the application of legislation on inspection and reception of citizens, the settlement of complaints and denunciations and the prevention and fight against corruption; implement and advise on the implementation of the tasks and solutions raised in the Report on Corruption Prevention and Fight in 2018 and the report on the settlement of complaints in 2018 by the Government to the sixth session of the 14th National Assembly according to their assigned functions and tasks.

- The Ministry of Defence shall take initiative in monitoring and following up with the situation, effectively preventing the conspiracy, anti-breaking activities and promptly responding to arising circumstances and ensuring national defence and security.

- The Ministry of Public Security shall take initiative in grasping the situation, promptly detecting, preventing and effectively fighting against demolition activities of hostile and reactionary forces; adopt measures to put a stop to the operation of "black credit", distrainment, debt collectors using deceptive methods, and usury; assume the prime responsibility for, and coordinate with the concerned ministries and branches in directing the inspection of fire prevention and fighting.

- The Ministry of Foreign Affairs shall review the organization of the WEF ASEAN 2018, recommend the assignment of tasks to relevant ministries and agencies to promote the application of the agreements signed at the Forum, and provide good preparation for diplomatic activities, especially the activities of the Party and the State leaders from now until the end of the year.

- Ministries, sectors and localities shall concentrate on performing tasks and solutions on economic restructuring, labor productivity improvement, enhancing competitiveness and resilience of the economy; promote the development of various types of enterprises, especially private enterprises; increase the competitiveness of cities; consider science and technology as a new growth engine; take the initiative in researching and developing an action plan to improve the capability to access to the Fourth Industrial Revolution of each sector, each field and each locality, especially the legal framework, effectively manage economic models applying information technology; and focus on the strict direction of the General Secretary at the key leadership meeting.

- The National Committee for e-Government, with the Government Office as the standing body, shall strongly promote and urge the implementation of the tasks and solutions on e-government development as assigned, ensuring their progress and efficiency.

- The Ministry of Information and Communications shall attach great importance to the development of 4G/5G technology, increase the use of smart phones and the Internet-of-things to promote the transition to the digital economy; step up the implementation of the Planning on national press development and management till 2025; coordinating with the Ministry of Public Security in resolutely handling cases of communication of bad, poisonous or untruthful information; enhance information security and safety in order to create conditions for the application of information technology, digital converting, digital economy, e-commerce, e-payment and e-government; and promote information and communication to create consensus and belief of the society and national aspirations for a powerful country.

- Ministries and sectors shall take initiative in coordinating with the State Committee for Management of Capital invested at enterprises to transfer State corporations and groups to the Committee according to the plan while ensuring the normal operation of these enterprises.

3. Regarding the preliminary Report on economic restructuring and transformation of the growth model for the 2016-2020 period; the Report on the framework for monitoring and evaluating the process of economic restructuring, renewal of the growth model for the 2016-2020 period and the pilot evaluation results of the 2016-2018 period.

The Ministry of Planning and Investment was assigned to collect comments of the Cabinet members to review and synthesize the 02 reports into 01 Mid-term Review Report on the implementation of the National Assembly's Resolution No. 24/2016/QH13 on the economic restructuring plan in the 2016-2020 period (accordingly, the report on the monitoring and evaluation framework of the economic restructuring and renewal of the growth model for the 2016-2020 period and the pilot evaluation results of the 2016-2018 period shall be transformed into an Annex to this Report). The Ministry of Planning and Investment shall report to the Prime Minister before submitting them to the Standing Committee of the National Assembly and the National Assembly. On that basis, the Minister of Planning and Investment shall be authorized by the Prime Minister to act on behalf of the Government to report to the Standing Committee of the National Assembly and the 6th session of the 14th National Assembly and take responsibility for the report contents and data.

4. Regarding the scheme of shared economic model

The Ministry of Planning and Investment was assigned to collect comments of the Government members, complete the scheme and propose the Plan for deployment of the tasks in the scheme and report it to the Prime Minister in the fourth quarter of 2018, in which attention should be paid to solutions to improve the current legal framework for specific forms that have emerged in practice during implementing the shared economic model and continue to study and propose solutions on a general legal framework for the shared economic model.

Ministries and ministerial-level agencies shall take initiative in reviewing and evaluating the practical forms of the shared economic models and the requirements of state management in the branches or domains under their authority; and report to the Ministry of Planning and Investment to synthesize, review and finalize proposals on a general legal framework for this model.

5. On the draft Decree of the Government regulating the standards and norms for the use of automobiles

The Ministry of Finance shall collect comments of the Government members at the meeting and comments of ministries, agencies and localities, finalize the draft Decree prescribing standards and norms for the use of automobiles and submit it to the Prime Minister for review and signing before October 15, 2018.

6. Regarding the implementation of the Government's law- and ordinance-making program and the promulgation progress of documents detailing the implementation thereof; the promulgation progress of documents simplifying and cutting down specialized examination procedures and business conditions; the performance of tasks and the inspection results of the Working Group in September 2018

a) Regarding the implementation of the Government's law- and ordinance-making program and the promulgation progress of detailing documents:

- Ministries and ministerial-level agencies shall intensify the law-making discipline and order, concentrate resources to speed up the drafting, submission and promulgation of legal documents; closely coordinate with agencies of the National Assembly, the Ministry of Justice and the Government Office in elaborating and finalizing dossiers and procedures for submitting legal documents while ensuring their quality, progress and compliance with current regulations.

- Ministries and agencies in charge of drafting the Laws to be submitted to the 14th National Assembly at its 6th session shall urgently provide explanations to comments of the agencies of the National Assembly, revise and finalize the draft Laws to be submitted to the National Assembly according to the regulations.

- The Ministries of Planning and Investment, Finance, Home Affairs, Public Security, Industry and Trade, Labor, Invalids and Social Affairs, Culture, Sports and Tourism, Information and Communications shall urgently complete dossiers and procedures to be submitted to the Government or the Prime Minister for promulgation or, according to their competence, promulgate detailed documents, which remained pending, before October 15, 2018.

b) Regarding the issuance of documents to reduce and/or simplify specialized inspection procedures and business conditions:

The Government requested the specialized management ministries to urgently submit to competent authorities for promulgation or, according to their competence, promulgate legal documents to reduce and/or simplify the list of goods, products and specialized examination procedures and business investment conditions while ensuring the objectives set by the Government.

c) Regarding the performance of the assigned tasks and inspection results by the Working Group:

The Working Group was assigned to continue urging and inspecting the performance of tasks assigned by the Government and the Prime Minister to ministries, agencies, localities, corporations and groups, and report thereon to the Government at the regular meetings. It was requested that:

- The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with the Ministry of Finance in, studying and proposing amendments and supplements to the Government's Decree No. 83/2014/ND-CP dated September 3, 2014, on gas and oil trading.

- The Ministry of Finance shall promptly complete the draft Decree amending and supplementing the Government's Decree No. 108/2015/ND-CP dated October 28, 2015, guiding the Law on Special Consumption Tax before November 15, 2018.

7. Regarding the plan to allocate and use the remaining funds and handle problems in the transfer of the regular budget of the 2017 Central Budget.

The Ministry of Finance was assigned to collect comments of the Standing Committee of the National Assembly, finalize the Government's Report and report it to the Prime Minister for consideration before submitting it to the Standing Committee of the National Assembly and the National Assembly. On that basis, the Minister of Finance shall be authorized by the Prime Minister to act on behalf of the Government to report to the National Assembly at its 6th session.

8. Regarding the exercise of the right to buy shares of state shareholders upon the issuance of additional shares by the Viet Nam Airlines Corporation Joint Stock Company (VNA) with a view to increase its charter capital

The Government unanimously agreed to:

a) Continue to adopt direction to allow state shareholders to buy additional shares when VNA issues additional shares to increase its charter capital in accordance with Decision No. 1611/QD-TTg dated September 10, 2014 and the direction of the Prime Minister's pursuance to documents No. 933/VPCP-DMDN dated May 16, 2016 and No. 1466/VPCP-DMDN dated May 26, 2017 of the Government Office. After completing the purchase of additional shares, based on the Prime Minister's Decision No. 1232/QD-TTg dated August 17, 2017, approving the list of State enterprises to be divested in the 2017-2020 period, the Ministry of Transport shall direct representatives of the State Capital at VNA to carry out the divestment according to current legislation.

b) Agree on the use of the enterprise reorganization and development assistance fund so that the State shareholders may purchase additional shares mentioned at Point a above by mode of offsetting and using the incremental difference in state capital based on the re-evaluation results upon the hand-over of capital to VNA’s joint-stock company to exercise the right to purchase shares of state shareholders when VNA issues additional shares to increase charter capita. Agree on the mobilization of the enterprise reorganization and development assistance fund to exercise the right to purchase additional shares issued with the total value equal to the amount to exercise the right deducted by the amount payable by VNA to the Fund. The Ministry of Finance shall assume the prime responsibility for, and coordinate with the Ministry of Transport in organizing the implementation thereof.

c) Regarding the interest due to delayed payment for VNA’s equitization to the enterprise reorganization and development assistance fund, the payment shall be made in compliance with current legislation.

9. Regarding the application of export processing regulations to Nittoku Co. Ltd. in Ha Nam province

The Government agrees with the proposal of the Ministry of Planning and Investment to allow to continue applying the regulations of export processing enterprises for Nittoku Viet Nam Company Limited in accordance with the Decree No. 82/2018/ND-CP dated May 22, 2018 of the Government regulating industrial zones and economic zones for the deployment of the investment project to build a paper factory in Thi Son industrial complex, Kim Bang district, Ha Nam province, for which an investment certificate had been granted by Ha Nam Provincial People's Committee in 2014.

10. Regarding the exemption of compensation and ground clearance’s expenses for the additional area of ​​17.1 ha of Samsung Thai Nguyen Electronics Company

The Government agreed to waive the payment of compensation and ground clearance’s expenses for the additional area of ​​17.1 ha at Yen Binh Industrial Zone, Thai Nguyen Province of Samsung Electronics Viet Nam Co., Ltd. Thai Nguyen. The People's Committee of Thai Nguyen province and the concerned ministries and agencies were assigned to follow up with the implementation.

11. Regarding the plan for determining interests paid to the Viet Nam’s Social Insurance for the time the Government bonds have not been issued, pursuant to Resolution No. 64/2018/NQ-QH of the National Assembly, recognition of debts shall be conducted as follows

The Government unanimously agreed to approve the plan on annual payment of interests to the Viet Nam’s Social Insurance for the time the Government bonds had not been issued for recognition of debts with the Viet Nam’s Social Insurance. The Ministry of Finance was assigned to pay interest to the Viet Nam’s Social Insurance in 2018 within the estimates approved by the National Assembly, and report in the State Budget estimates for 2019 and 2020. The incremental interest amount in 2019 and 2020 shall be submitted to the National Assembly.

Upon the approval of the National Assembly on the repayment plan of interests payable to the Viet Nam’s Social Insurance for the time the Government bonds have not been issued for debt recognition, the Ministry of Finance shall organize the issuance of Government bonds for recognition of principal and interest payment to the Viet Nam’s Social Insurance pursuant to Resolution No. 64/2018/QH14 of the National Assembly, the Law on Public Debt Management and Decree No. 95/2018/ND-CP guiding the Law on Public Debt Management.

12. Regarding the handling of problems faced by enterprises due to differences in the Law on Investment and the Law on Enterprise Income Tax for the period before 2014

The Ministry of Planning and Investment was assigned to assume the prime responsibility for, and coordinate with the Ministry of Finance in, reviewing cases of enterprises' problems due to differences between the Law on Investment and the Law on Enterprise Income Tax in the period before 2014 (for cases such as Thang Long Factory of Cannon Viet Nam Co. Ltd, Can Tho - PepsiCo - Viet Nam Factory Project, Unilever Viet Nam Company’s investment expansion in the 2009-2013 period ...), and report to Prime Minister in the spirit of ensuring that the principle of non-retroactivity is properly adopted.

13. Regarding the handling of problems arising from the re-lending mechanism of ODA projects

The Government agreed to apply the on-lending rate for three Asian Development Fund (ADF) lending projects of the Asian Development Bank (ADB) as follows:

- The Greater Mekong Subregion Tourism Infrastructure for Inclusive Growth Project, phase 2: the same re-lending rate shall be applied to localities participating in the project as the rate prescribed in Decree No. 52/2017/ND-CP dated April 28, 2017 of the Government;

- The Health Human Resources Sector Development Program, phase 2: The universities participating in the program shall apply the same re-lending rate prescribed in Decision No. 19/2017/QD-TTg dated June 5, 2017 of the Prime Minister on the pilot financial mechanism applicable to ODA projects, preferential loans for the health sector;

- The Skills and Knowledge for Inclusive Economic Growth Program: a re-lending rate of 10% shall be applied to the program participants as proposed by the Ministry of Labor, Invalids and Social Affairs and the Ministry of Industry and Trade.

The Ministry of Planning and Investment and the Ministry of Finance were assigned to closely coordinate with the concerned agencies in accelerating the appraisal, submission for approval of the investment policies and project documents, ensuring the negotiation progress with ADB. In case of any problems, the Ministry of Planning and Investment shall promptly propose the handling plan and report to the Prime Minister.

The Ministry of Finance was assigned to take the prime responsibility for reviewing the list of ODA projects already approved by the Prime Minister and Project proposals. In case of any problems on the re-lending rate in the course of approval of investment undertakings, the Ministry of Finance shall report to the Prime Minister for consideration and decision.

14. Regarding solutions to problems in lending interest rate in Trung Luong - My Thuan Expressway Project

The Ministry of Transport shall review and report on the ratification and implementation of the Trung Luong - My Thuan Project including the financial plan, the provisions of the project contract, the problems related to lending interest rate of the Project (other projects with similar problems) and recommendations for specific solutions in accordance with the regulations, ensuring publicity and transparency while avoiding capital and asset lost; coordinate to collect comments of the Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Construction, the Ministry of Justice, the State Bank of Viet Nam, to synthesize their comments and report to Deputy Prime Minister Vuong Dinh Hue to lead and coordinate with Deputy Prime Minister Trinh Dinh Dung to direct the synthetization before submitting them to the Government members.

15. Regarding the draft Decree detailing the Law on Social Insurance and the Law on Occupational Safety and Health on compulsory social insurance for laborers who are foreigners working in Viet Nam

The Government agreed with the proposal of the Ministry of Labour, Invalids and Social Affairs. The Ministry of Labour, Invalids and Social Affairs was assigned to finalize the draft Decree detailing the Law on Social Insurance and the Law on Occupational Safety and Health for compulsory social insurance for laborers who are foreigners working in Viet Nam, and submit to the Prime Minister for consideration and signing before October 15, 2018.

16. Regarding the draft Decree on the exercise of the rights and responsibilities of the agencies representing owners of state capital

The Government Office was assigned to coordinate with the Ministry of Planning and Investment to submit to the Government members for comments on issues which raise dissimilar opinions in the draft Decree on the exercise of the rights and responsibilities of the representative offices of the agencies representing owners of state capital, synthesize these comments and report to the Prime Minister for consideration and signing.

17. Regarding the implementation of the policy on the management and use of the Health Insurance Fund 2017

The Ministry of Health shall assume the prime responsibility for, and coordinate with the Viet Nam Social Insurance in, collecting comments of the Government members and finalizing the report on the implementation of the policy on the management and use of the Health Insurance Fund in 2017. The Minister of Health was authorized by the Prime Minister to act on behalf of the Government to report to the 14th National Assembly at the 6th session.

18. Regarding the investment, management and use of state capital in enterprises in 2017 in the whole country

The Ministry of Finance shall collect comments of the Government members and finalize the report on the situation of investment, management and use of state capital in enterprises in 2017 and the management and use of revenues from the divestment of State capital at enterprises. The Minister of Finance was authorized by the Prime Minister to act on behalf of the Government to report to the 14th National Assembly at the 6th session and take responsibility for the contents and reporting data.

19. Regarding public debt in 2018

The Ministry of Finance shall collect comments of the Government members and finalize the report on the public debt situation in 2018. The Minister of Finance was authorized by the Prime Minister to act on behalf of the Government to report to the 14th National Assembly at the 6th session on behalf of the Government.

20. Regarding central budget allocation in 2019

The Government basically agreed with the proposal of the Ministry of Finance on the principles and plans for allocating central budget expenditure in 2019 and 8 groups of solutions for the implementation of central budget estimates in 2019.

The Ministry of Finance was assigned to collect comments of the Government members to review and update in detail all appendices, ensuring data accuracy; finalize the report and report it to the Prime Minister for consideration before submitting it to the National Assembly. On that basis, the Minister of Finance was authorized by the Prime Minister to act on behalf of the Government to report to the 14th National Assembly at the 6th session.

21. Regarding the implementation of the financial plan in 2018 and the financial plan in 2019 of the state budget funds outside the state budget managed by the central government.

The Ministry of Finance shall collect comments of the Government members and finalize the report on the implementation of the financial plan in 2018 and the financial plan in 2019 of the State budget funds outside the State budget managed by the central government. The Minister of Finance was authorized by the Prime Minister to act on behalf of the Government to report to the 14th National Assembly at the 6th session.

22. Regarding the evaluation report on the implementation of the national five-year financial plan for the 2016-2020 period

The Ministry of Finance shall collect comments from the Government members and finalize the evaluation report on the implementation of the five-year national financial plan for the 2016-2020 period. The Minister of Finance was authorized by the Prime Minister to act on behalf of the Government to report to the 14th National Assembly at the 6th session.

23. Regarding the adjustment of funding estimates between the General Department of Taxation and the General Department of Customs

In implementation of Clause 4, Article 3 of the Government's Working Regulation promulgated together with the Government's Decree No. 138/2016/ND-CP dated October 1, 2016, the Government agreed with the contents of the report on the reduction of State budget expenditure estimates for operation in 2018 by the General Department of Taxation for supplementation to the General Department of Customs.

24. Regarding the reports on Inspection and settlement of complaints and denunciations and anti-corruption; Public administration reform in the third quarter of 2018; The implementation of Resolution No. 19-2018/NQ-CP on major tasks and solutions to improve the business environment and raise the national competitiveness; the implementation of Resolution No. 35/NQ-CP and Directive No. 26/CT-TTg on enterprise support and development until 2020

Ministries and agencies assigned to be in charge of report development including the Government Inspectorate, the Ministry of Home Affairs, the Ministry of Planning and Investment shall receive comments from the Government members, finalize reports and promulgate them according to their competence and ensuring their effective deployment./.
