 RESOLUTION

THE GOVERNMENT’S REGULAR MEETING - SEPTEMBER 2016

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 08/2012/ND-CP dated February 16, 2012 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting in September 2016, held on October 03 and 04, 2016,

RESOLVES:

1. Regarding the draft Law on Technology Transfer (revised)

The Ministry of Science and Technology shall lead and coordinate with the Ministry of Planning and Investment, the Ministry of Justice, the Government Office and other relevant ministries and agencies to collect opinions of the Cabinet members, then adjust and finalize the draft Law. In particular, attention shall be paid to the review and strict application of rules on the appraisal, inspection and surveillance of technologies in investment projects to ensure their consistency and synchronization with legal regulations on investment and cost norms while limiting and preventing outdated technologies which could cause negative environmental impacts and affect sustainable development; amend regulations on the management of technology transfer contracts towards compulsory registration of contracts for outbound and inbound technology transfer and transfer of domestic technologies that use the state capital. The Minister of Science and Technology shall be authorized by the Prime Minister and act on behalf of the Government to report the draft Law to the National Assembly.

2. Regarding the authority to approve working positions and staffing structure by official occupational titles and the number of people working in public service delivery units

The Government unanimously agreed on the principles on decentralization of decision-making on working positions and staffing structure by official occupational titles and the number of people working in public service delivery units in order to promote the implementation of the autonomy mechanism and create conditions for public service delivery units to fulfill their assigned political tasks and improve the quality of public services. Decentralization of management authority of public service delivery units must follow clear conditions, processes and procedures closely linked to strict examination and supervision mechanisms to avoid privatization of public service delivery units.

In short-term, public service delivery units assigned with autonomy (the units assigned to self-ensure recurrent expenditures and investment, the units that could afford recurrent expenditures) shall determine working positions and staffing structure by occupational titles and the number of employees in line with their assigned functions and tasks so as to ensure job security and income stability for the increase in number of staff.

For public service delivery units which are not assigned with autonomy (the units with all or a portion of recurrent expenditures secured by the State), Ministers, Heads of ministerial-level agencies, Heads of Governmental bodies, Chairmen of the Provincial People's Committees shall decide on the working positions and staffing structure by occupational titles and the number of employees out of the total number of employees assigned by the competent authorities as stipulated under the law and ensure the implementation of downsizing as stipulated under Resolution No. 39-NQ/TW of the Political Bureau. In case the increase in the number of total staff is higher than the number assigned by competent authorities, Ministries, agencies and localities shall report to the Ministry of Home Affairs for evaluation and submission to the Prime Minister for consideration and decision.

The Ministry of Home Affairs shall lead and coordinate with other ministries and agencies to quickly review regulations on autonomy mechanism of public service delivery units and public employee management mechanism to propose amendments and supplements to Decree No. 41/2016/ND-CP on working positions in public service delivery units and related documents in December 2016.

3. Regarding the draft Decree amending a number of articles of Decree No. 27/2007/ND-CP of the Government on electronic transactions in financial activities

The Ministry of Finance shall lead and coordinate with the Government Office and the Ministry of Justice to collect comments from Cabinet members, revise and improve the draft Decree, and submit to the Prime Minister for consideration and signing in October 2016.

4. Regarding the capital divestment of the State Capital Investment Corporation (SCIC) in enterprises listed on the Stock Exchange or registered for Upcom trading

The Government unanimously agreed to allow SCIC to continue to apply the mechanism to sell capital in enterprises listed on the Stock Exchange or registered for Upcom trading as stipulated in Decree No. 151/2013/ND-CP and securities legislation. The Ministry of Finance shall direct SCIC to earnestly divest capital in listed enterprises with special attention to the selection process of price consulting units to ensure openness, transparency and highest benefits of the State.

5. Regarding the proposal to develop a draft Resolution of the National Assembly on pilot grant of electronic visas for foreigners entering Viet Nam

The Government unanimously agreed to pilot grant of electronic visas for foreigners entering Viet Nam. The Ministry of Public Security shall lead and coordinate with the Ministry of Justice, the Ministry of Foreign Affairs, the Government Office and other relevant ministries and agencies to collect comments of the Cabinet members and complete dossiers for the pilot program. The Minister of Public Security shall be authorized by the Prime Minister and act on behalf of the Government to report to the National Assembly Standing Committee for consideration and submission to the National Assembly the draft Resolution at the 2nd session of the 14th National Assembly.

6. Regarding the draft Decree stipulating the autonomy mechanism of public higher education institutions

The Government unanimously agreed to promote autonomy of public higher education institutions associated with improving the quality of higher education education. Accordingly, universities shall be granted with autonomy in terms of both expertise, staffing, and financing in an accountable manner; issue clear regulations on accreditation and scholarship mechanisms to ensure access to high quality education for children of poor households and policy beneficiaries. Administrative interventions of governing bodies shall be significantly reduced in the operation of universities towards eliminating the governing mechanism. The current tertiary governance model shall be innovated toward switching from individual leadership (principal) to collective leadership (school board), which is similar to the innovation of State enterprises. School board shall be empowered with the right authority. Clear distinction of responsibilities between the school board and the board of directors (principals, vice-principals) shall be made while ensuring the leadership of the Party, promoting openness, democracy and respect for the collective rights of staff and faculty.

The Ministry of Education and Training shall review the Law on Higher Education, the Law on Cadres and Civil Servants, and the Law on Public Employees and relevant regulations for necessary amendments and supplements. In short-term, attention shall be paid to promote pilot autonomy of universities and renovate governance mechanisms of self-governing universities. The Ministry of Education and Training shall issue or propose to issue documents clearly regulating powers and responsibilities of the school board, especially in terms of organization, personnel and financing. Governing agency shall make appointment or approval of the school board, principal, vice-principal and leadership positions of universities at the request of the school board.

The Ministry of Labor-Invalids and Social Affairs shall promptly finalize the draft Decree on the autonomy of public service delivery units in the field of vocational education.

7. Regarding renewal of financial regime of secondary level

The Ministry of Education and Training shall lead and coordinate with the Ministry of Finance to develop a report which shall be submitted to the Party Central Committee and the National Assembly on tuition waive for children under 5 years old who are ethnic minorities in areas with particular difficult socio-economic conditions and junior high school students under the 2020 roadmap.

8. Regarding the mechanisms, policies and solutions to attract students to contribute to national development after foreign studies

The Government unanimously agreed to assign the Ministry of Education and Training to pilot a program in which self-governing higher education institutions are allowed to attract high-quality Vietnamese nationals living overseas to teach and do research in Viet Nam. The Ministry of Science and Technology shall lead and coordinate with the Ministry of Foreign Affairs, the Ministry of Home Affairs and other relevant ministries and agencies to formulate a scheme to attract talented Vietnamese people, good students, and professionals living overseas to participate in production, trade, scientific research activities with domestic establishments.

9. Regarding the Report on inspecting the performance of tasks, conclusions and directions of the Government and the Prime Minister in September 2016

The Government acknowledged the inspection results of the Prime Minister’s Working Group following its inspections at the Government Office, the Government Inspectorate, the Ha Noi Municipal People's Committee and the Viet Nam Electricity. The Government requested the entities that were inspected in August and September 2016 to streamline and withdraw lessons from the shortcomings and limitations revealed through the inspections; expeditiously implement recommendations of the Working Group; focus on completing the remaining work tasks overdue; regularly review the tasks assigned to organize the implementation on time; improve administrative order and disciplines in the implementation of the tasks and work assigned.

The Government requested ministries, agencies and localities to earnestly implement the tasks assigned by the Government and the Prime Minister, regularly examine, supervise and report to the Government Office of the implementation progress before 25th every month as prescribed. The Working Group led by the Minister, Chairman of the Government Office shall continue inspecting a number of ministries, agencies and localities to clarify the causes and responsibilities, and propose specific measures and recommendations to specific overdue tasks, and report in the monthly Government meeting.

10. Regarding the socio-economic situation in September and the first nine months of 2016; the implementation progress of Resolution No. 01/NQ-CP dated January 07, 2016 of the Government on the major tasks and solutions guiding implementation of the plan for socio-economic development and the state budget in 2016

The Government unanimously agreed that: With the aggregate effort and determination of the political system, the business community and the people, the socio-economic situation in September and the first 9 months of 2016 observed a number of positive changes. The economy continued to rebound, expanding 6.4% in the third quarter. Processing and manufacturing, construction, and service sector recorded growth rates higher than those of the same period last year. Agricultural production in the third quarter witnessed significant growth. Export growth was relatively decent, especially agricultural, forestry and fishery products. Viet Nam continued to gain trade surplus. Inflation was kept under control. Basically, major financial and monetary balances were guaranteed. Credit growth was relatively good. Exchange rate remained stable. Foreign exchange reserves increased. The stock markets also prospered. Both foreign direct investment (FDI) and portfolio investment funds rose. Local budget revenues were decent. The Government continued exerting efforts to build institutions with positive outcomes. Business environment and confidence of the people and enterprises clearly improved. Positive signals were recorded in business development. The number of newly established enterprises and the amount of registered capital increased. Progresses can also be seen in the fields of education and training, sport, labor, employment, social security, social welfare, health care. Political security and social order were guaranteed. Foreign affairs achieved many positive results.

However, the competitiveness of the economy and labor productivity have not been remarkably improved. Export of some spearhead goods faced difficulties. Export value of mining commodities plummeted while processing exports increased at a low pace. Exports to ASEAN decreased. Central budget revenues were relatively low. Disbursed volume of development capital, especially government bonds, remained low. Smuggling, commercial fraud, counterfeiting, and production of shoddy goods became increasingly sophisticated. The quality of human resources remained low. The application of science and technology remained weak. Environmental pollution problems were not completely overcome. The total area of damaged forest was relatively large. Lives of the people in remote and mountainous areas, ethnic minority areas, areas affected by disasters, floods, droughts, saltwater intrusion, and environmental pollution areas still faced numerous difficulties. The criminal context remained complicated.

To successfully implement the goals and targets set for 2016, the tasks from now until the end of the year shall be extremely heavy, requiring a lot of effort, consensus, and determination of all sectors, all levels, both the business community and the people nation-wide. The Government called for ministries, agencies and localities’ determination, pro-activeness, and creativity, to actively take specific solutions to solve problems, encourage production and business development, release all social resources, promote entrepreneurship and enterprise development to create significant changes in economic growth in the fourth quarter, strive to complete tasks in 2016 in the best manner to lay foundation for the following years, in which focus on the following solutions and tasks:

a) Regarding preparation for the deployment of the socio-economic development plan in 2017

The Government requested each ministry and ministerial-level agency to develop an action plan to deploy the plan and report to the Prime Minister. The report must identify challenges, analyze their causes, propose specific feasible solutions, and define an implementation roadmap and evaluation indicators.

The Ministry of Planning and Investment shall lead and coordinate with the Ministry of Finance and other ministries, agencies, and localities to draft a Resolution of the Government on the key tasks and solutions guiding the implementation of the plan for socio-economic development and state budget plan in 2017. The Resolution must cover savings solutions, including immediate cut of unnecessary spending items, as well as a set of indicators to assess performance of each ministry, agency and locality.

b) Some key tasks in the last months of 2016

- The State Bank of Viet Nam shall continue to closely combine monetary and fiscal policy to ensure macroeconomic stability and inflation control; manage interest rate in line with macroeconomic and currency developments to stabilize interest rates, striving to reduce lending rates; put forward mechanisms and innovative solutions to restructure weak banks and thoroughly address bad loans; continue close supervision of activities of compulsorily merged weak credit institutions; steer credit to priority sectors and control credit flow into real estate business; urgently submit to the Prime Minister a scheme to restructure credit institutions associated with effective bad debt settlement for 2016-2020 period.

- The Ministry of Planning and Investment shall coordinate with ministries, agencies and localities to monitor, supervise, aggregate, and report the implementation of Resolution No. 60/NQ-CP dated July 8, 2016 of the Government; lead and coordinate with the Ministry of Finance to review and propose amendments to regulations on corporate bankruptcy procedures. The inter-ministerial working group on macroeconomic management led by of the Head of the Coordination Board of the Ministry of Planning and Investment shall strengthen monitoring of inflation and real estate market to design and put forward proper interventions.

- The Ministry of Finance shall lead and coordinate with other relevant ministries, agencies and localities to restructure the State budget and ensure safety of public debts in accordance with the Resolution of the Political Bureau; closely manage expenses to ensure thrift practice; study and direct localities, especially big cities like Ha Noi, Ho Chi Minh City, Da Nang, and Can Tho to check inventory and conduct value assessment of public assets to strictly manage, effectively use, and avoid waste and losses.

- Ministries, agencies, localities, State-owned corporations and groups shall speed up the restructuring process of State-owned enterprises, especially the privatization and divestment of State capital in enterprises, ensuring efficiency, openness, transparency, and maximization of the State’s benefits, and avoiding loss of State assets.

- The Ministry of Industry and Trade shall actively implement measures to boost exports while controlling trade deficit; take the fullest advantage of the domestic market; preside and coordinate with other relevant ministries and agencies to develop appropriate solutions to accelerate consumption of some products such as coal, steel, fertilizer, paper, cement, and agricultural products; promptly report to the Prime Minister on the settlement of coal inventory and develop a production plan until the end of the year and in 2017; direct the review and improvement of the power grid, increase power production capacity, ensure the smooth operation of the power grid with specific measures to ensure the sufficient supply of electricity, avoid electricity shortage, especially in the South to meet the future electricity demand for socio-economic development; coordinate with relevant ministries, agencies and localities to formulate specific solutions to improve integration efficiency through free trade agreements.

- The Ministry of Agriculture and Rural Development shall monitor changes in weather and water resources, direct agricultural production plans of regions and localities; actively support linkages between production and consumption of agricultural products; boost the development of coastal protection forests, forest protection, and the strict closure of natural forests; and urgently submit to the Prime Minister to issue a Decision stipulating principles, criteria and cost norms for allocating capital for the National Target Program on new rural construction in the 2016-2020 period.

- The Ministries of Agriculture and Rural Development, Finance, Natural Resources and Environment, Labor-Invalids and Social Affairs and the People's Committee of the 04 central coastal provinces affected by the environmental breakdown shall quickly implement the compensation and support for affected people according to the norms prescribed while ensuring transparency, fairness, and avoiding negative conducts.

- The Ministry of Construction shall implement measures to promote the real estate market; continue to promote the development of social housing, especially housing programs for people with meritorious services to the revolution, the poor and workers in concentrated industrial zones; preside and coordinate with other relevant ministries and agencies to study, modify and supplement the system of standards and norms especially the rates and levels of investment and construction, guarantee thriftiness and alignment with current capacity and technology level; and preside and coordinate with ministries, agencies and localities to control and propose solutions to proactively manage and promote the healthy development of the real estate market.

- The Ministry of Transport shall implement specific measures to promote and improve the quality of transport and reduce transportation costs; encourage the development of transport networks, value-added services, and multi-modal transport; and supervise and accelerate the progress of key transport projects and implement road maintenance plan.

- The Ministry of Natural Resources and Environment shall conduct an overall review of large sources of emission into rivers and sea, areas that are concentrated with many waste sources, delineate specific entities and regions that should be strictly controlled to avoid contamination and occurrence of environmental incidents; coordinate with the Ministry of Finance to establish electronic communication links between tax authorities and the registration offices for land use rights in construction land transactions; and develop and submit to the Government a Decree on land-related electronic transactions.

- The Ministry of Culture, Sports and Tourism shall implement solutions to develop tourism into an interdisciplinary and spearhead economic sector, operating under the laws of the market economy, in close association with the national advantages; develop preferential policies to attract enterprises to invest in tourism; preside and coordinate with relevant competent authorities to inspect and strictly handle violations in the operations of international travel.

- The Ministry of Labor-Invalids and Social Affairs shall lead and coordinate with relevant ministries and agencies to implement policies on social security, social welfare, and employment; organize the national conference in October 2016 to implement effectively the National Target Program on sustainable poverty reduction for the 2016 – 2020 period; coordinate with the People's Committees of provinces and cities under central and the relevant authorities to strengthen the management and putting of drug addicts in rehabilitation facilities.

- The Ministry of Health shall focus on directing the close monitoring of diseases and epidemics; strengthen the prevention of dengue fever caused by Zika virus; reinforce coordination with relevant agencies to inspect and test food safety, especially by the end of the year; improve health care quality towards focusing more on people's satisfaction with health care services at all levels; accelerate the disbursement of investment projects in health sector, especially projects at central hospitals and last-line central hospitals; actively propose solutions and coordinate with the Ministry of Finance and related agencies to administer medical service prices in line with inflation control target.

- The Ministry of Justice and other relevant ministries and agencies shall actively receive feedback and recommendations on the problems related to legal regulations; continue to review regulations hindering investment, production and business processes; modify or propose amendments within its competence towards simplifying administrative procedures, promoting decentralization and transforming management method from pre-inspection to post-inspection, and increasing the application of information technology in management and transactions.

- The Government Office shall urgently establish and operate a system to receive and respond to recommendations from enterprises a sub-domain of the Government Portal (the sub-domain named "doanhnghiep.chinhphu.vn"), to assist the Prime Minister in information reception and feedback provision to the recommendations of enterprises; Establish a Working Group receiving and handling enterprises’ feedback and proposals sent to the Government Portal; and submit to the Prime Minister to issue a set of procedures to receive and respond to recommendations of the enterprises.

- The Ministry of Defense shall coordinate with agencies and localities to closely monitor developments and the situation for timely responses, and firmly safeguard the independence, sovereignty, unity, and territorial integrity.

- The Ministry of Public Security shall coordinate with agencies and localities to closely monitor and actively take measures to timely prevent, fight and avert anti-state activities, provoking disturbances, especially in key areas; focus on investigating and handling of particularly serious cases of public concerns; organize focus attacks to crack down on crime and social evils, ensure social order and safety, especially by the end of the year.

- The Ministry of Foreign Affairs shall urgently develop and improve the plan for hosting the APEC Year in 2017; prepare well and organize successfully the 8th Cambodia – Laos - Myanmar – Viet Nam (CLMV) Summit and the 7th Summit of the Ayeyawady - Chao Phraya - Mekong Economic Cooperation Strategy (ACMECS).

- The Ministry of Information and Communications shall enhance state information management, urgently submit to the Prime Minister a proposal on media planning; coordinate with competent authorities to ensure cyber safety and security; and promote information and communication to create confidence and enthusiasm among the people. Ministries and agencies according to their functions and tasks shall provide information actively to the public in an open and transparent manner to create social consensus.

11. Regarding the draft Resolution on a number of tax solutions to remove difficulties and problems and promote enterprise development

In principle, the Government agreed with the proposal of the Ministry of Finance. Except for the corporate income tax rates for investment in renovating old apartments, a tax rate of 10% shall continue to be applied. For small and medium-sized enterprises, the Ministry shall submit to the National Assembly for approval of the two plans on the criteria for enterprises to enjoy preferential corporate income tax based on thorough calculations to avoid any negative impacts on the state budget revenue.

The Minister of Finance shall be authorized by the Prime Minister and act on behalf of the Government to report to the National Assembly a draft Resolution on a number of tax solutions to remove difficulties and obstacles and promote enterprise development.

12. Regarding the economic restructuring plan for the 2016-2020 period

The Ministry of Planning and Investment shall review and clarify the need, scope and content of the tasks set out in the Plan; collect comments of the Cabinet members, finalize the Plan on the basis of ensuring the viability and alignment with the conclusions of the Political Bureau and the Resolution of the Party Central Committee on the Scheme on a number of guidelines and policies to renew growth model, improve growth quality, labor productivity and competitiveness of the economy.

The Minister of Planning and Investment shall be authorized by the Prime Minister and act on behalf of the Government to report the plan to the National Assembly Standing Committee and the National Assembly.

13. Regarding the medium-term public investment plan in 5-year 2016-2020 and the plan on public investment allocation in 2017

The Government unanimously agreed that: Allocation of medium-term public investment capital should be focused and avoid scattered investments; non-state investment funds are encouraged; priorities should be given to major and significant inter-regional projects having powerful spill-over effects; to ODA projects; to debt settlement of capital construction; to support remote and disadvantaged areas. It is necessary to study mechanisms to promote socialization of investment for capital construction, especially in urban areas and in sectors and fields with favorable conditions. Due to possible state budget constraints in the upcoming years, contingency rate shall be 10% for each funding source.

The Ministry of Planning and Investment shall lead and coordinate with the Ministries of Finance, Construction and relevant agencies to review relevant regulations on public investment to identify issues that my lead to corruption and dishonesty, and propose measures to for timely removal and rectification.

The Ministry of Planning and Investment shall lead and coordinate with the Ministry of Finance to collect comments of the Cabinet members, review and complete the medium-term public investment plan in 2016-2020 and the public investment plan in 2017. The Government assigned the Prime Minister and Deputy Prime Ministers to review and approve the medium-term public investment plan in 2016-2020 and the public investment plan in 2017, including a detailed list of public investment projects, report to the Government at the regular meeting in October 2016. The Minister of Planning and Investment shall be authorized by the Prime Minister and act on behalf of the Government to report to the National Assembly.

14. Regarding the implementation progress of the 5-year financial-budget plan in 2011-2015 and orientations of the 5-year financial-budget plan in 2016-2020

The Ministry of Finance shall collect comments of the Government to complete the 5-year financial-budget plan in 2011-2015 and orientations of the 5-year financial-budget plan in 2016-2020. The Ministry of Finance shall coordinate with the Ministry of Planning Investment to ensure data consistency before the Minister of Finance, authorized by the Prime Minister and on behalf of the government, report to agencies of the National Assembly and the National Assembly.

15. Regarding the draft Resolution promulgating the Action plan of the Government in the 2016-2021 tenure

The Ministry of Planning and Investment shall lead and to coordinate with the Government Office to collect comments of the Government, complete the draft Resolution, and submit to the Prime Minister for signing in October 2016.

16. Regarding the implementation progress of Resolution No. 60/NQ-CP dated July 8, 2016 on the key tasks and measures to accelerate the implementation and disbursement of public investment plan in 2016

The Government agreed with the recommendations and proposals of the Ministry of Planning and Investment in Report No. 8080/BC-BKHDT dated September 30, 2016 and requested ministries, agencies and localities to strictly and effectively implement the tasks and measures stated in Resolution No. 60/NQ-CP. Accordingly, the Government requested ministries, central agencies and localities to focus on implementing a number of the following key tasks:

- The Minister of Planning and Investment shall be authorized by the Prime Minister and act on behalf of the Government to report to the National Assembly Standing Committee to transfer government bonds that had not been allocated in 2017 to 2017.

- Before the 25th every month, ministries, central agencies and localities shall have to send the report which states the progress of disbursement until the 20th of the reported month to the Ministry of Planning and Investment and the Ministry of Finance. The report forms were prescribed in Official Letter No. 6102/BKHDT-TH dated August 5, 2016 of the Ministry of Planning and Investment. The Ministry of Planning and Investment shall synthesize information and report to the Government, including specific evaluation of implementation results, responsibilities of each relevant ministry, agency and locality as well as recommendations.

- Closely monitor the disbursement progress of the 2016 investment plan of projects, timely detect difficulties for interventions and recommend competent authorities to transfer investment capital of projects that could not be fully disbursed in due time as planned.

- Strengthening the monitoring and inspection, and ensure the proper and effective use of investment capital to guarantee investment efficiency and compliance with regulations.

- Ministries in charge of the target programs as stipulated under Resolution No. 73/NQ-CP dated August 26, 2016 of the Government shall approve the investment policy of target programs for the 2016-2020 period, expeditiously complete feasibility study reports of the target programs for evaluation and submission to the Prime Minister for decision within the deadline stipulated in Resolution No. 60/NQ-CP dated July 8, 2016.

17. Regarding the implementation progress of Resolution No. 36a/NQ-CP dated October 14, 2015 on e-Government

The Government requested ministries, agencies and localities to focus on the deployment and completion of assigned tasks in Resolution 36a/NQ-CP, especially for tasks with specific deadlines, the provision of online public services levels 3 and 4 in 2016 as approved by the Prime Minister, and report on the implementation results before December 10, 2016.

The Ministry of Information and Communications, the Ministry of Education and Training shall specify measures to improve the Telecommunication Infrastructure index and the Human Capital index under the UN Global E-Government Readiness Index.

18. Regarding the implementation progress of Resolution No. 19-2016/NQ-CP dated April 28, 2016 on the key tasks and measures to improve the business environment, enhance national competitiveness in 2016 -2017, with an orientation to 2020

The Government requested Ministers, Heads of Ministerial-level agencies, Chairmen of Provincial People's Committees to focus on effectively directing the implementation of Resolution 19/NQ-CP, especially addressing the issues and shortcomings that cause difficulties for enterprises; consider this a top priority task to create visible and practical changes in 2016; and strictly implement the reporting regime as prescribed.

- Ministries responsible for conducting specialized checks of goods shall immediately implement measures and tasks outlined in Resolution No. 19-2016/NQ-CP and Decision 2026/QD-TTg dated November 17, 2015. Accordingly, these Ministries shall lead and coordinate with the Ministry of Planning and Investment, Ministry of Finance, Viet Nam Chamber of Commerce and Industry review to shorten the list of goods subject to specialized checks, simplify checking procedures, and clarify responsibilities of each ministry for each type of product, goods to avoid duplication; specialized checks of goods quality, energy efficiency, and food safety should be done after customs clearance and before circulation of goods.

- The Ministry of Agriculture and Rural Development shall review and specify the categories of imported goods subject to quarantine before clearance checks.

- The Ministry of Health shall lead and coordinate with other relevant ministries and agencies to urgently amend legal documents regulating the labeling of products.

- The Government Office shall coordinate with the Ministry of Planning and Investment, the Viet Nam Chamber of Commerce and Industry and other relevant ministries and agencies to strengthen inspection of the implementation of the Resolution in some ministries, agencies and localities under the plan approved by the Prime Minister.

19. Other matters:

The Government unanimously agreed with the content and recommendations mentioned in the Reports on: the implementation progress of Resolution No. 35/NQ-CP dated May 16, 2016 on supporting and developing enterprises by 2020; the implementation progress of the Law and Ordinance Building Program of the Government and the promulgation of documents detailing laws and ordinances in the third quarter of 2016; the administrative reform in the third quarter of 2016; the inspection, settlement of complaints and denunciations and the fight against corruption; the implementation progress of the Work Program and the implementation of duties assigned by the Government and the Prime Minister in the third quarter of 2016 that were presented by the Ministry of Planning and Investment, Ministry of Justice, Ministry of Home Affairs, Government Inspectorate and Government Office.

The Ministry of Planning and Investment, the Ministry of Justice, the Ministry of Home Affairs, the Government Inspectorate, and the Government Office shall finalize these Reports and issue them within their authority. The Reports should clearly identify the tasks that should be deployed by relevant agencies and localities. The Prime Minister shall consider and decide on issues beyond their competence./.
