RESOLUTION

THE GOVERNMENT’S REGULAR MEETING - AUGUST 2016

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 08/2012/ND-CP dated February 16, 2012 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s meeting in July 2016, held on August 01 and 02, 2016,

RESOLVES:

1. Some tasks should be implemented from the beginning of the tenure

The Government anonymously agreed and determined to develop a clean, transparent, and action-oriented Government, taking the people and enterprises as targets of support, and creating a favorable investment and business environment. The Government agreed to focus on developoing modern and professional public administration, considering the national interests and benefits of the people as the highest goal; continue on institutional and legal improvement, ensuring transparency, openness and international integration; encourage administrative procedure reforms, tighten discipline, and promote strong democracy associated with the rule of law.

Each member of the Government should uphold the responsibility before the Party, the State and the people; enhancing work coordination responsibility, regularly capturing information, proactively coordinating to handle unexpected issues arising and of public concern; renovating the recruitment, training, use and appointment of cadres and civil servants; assigning the right work to the right people, creating good working environment for developing the capabilities of cadres and public servants; paying full attention to review and adjust functions and tasks, reorganize, streamline and downsize organizational apparatus, associated with public service and civil servant reforms, pursue anti-corruption activities, thrift practices and waste combat, effectively and thriftily utilize the State budget and public assets.

The Government requested ministries and local authorities to frankly acknowledge, review and draw experience from existing limitations, weaknesses that were pointed out in the performance review of the the 2011 - 2016 tenure; fully acknowledge advantages and difficulties, recognize opportunities and challenges; avoid escaping difficulties, stay determined to achieve the highest goals set out, sturdily innovate and improve the working style, take action with specific and breakthrough steps to create clear changes and transformation in the State management as well as promote the active role of each level, each sector, in both the short and long term. In the short run, focus on the deployment of the following key tasks:

- Ministries, agencies and localities shall expeditiously implement the Resolution No. 64/NQ-CP of the Government on the action plan to implement the Resolution of the XIIth National Party Congress, the Resolution No. 63/NQ-CP on the action plan to implement the Resolution of the National Assembly on socio-economic development in 5 years from 2016 to 2020; the directions of the Government and the Prime Minister. Ministers, heads of agencies, Chairmen of Provincial People's Committees must bear full responsibility before the Government and the Prime Minister on the State management and implementation results of socio-economic development tasks within their management fields and areas.

- The Ministry of Planning and Investment shall coordinate with the relevant ministries and agencies to develop an action plan of the Government in the 2016 - 2021 tenure and submit to the Government at its regular meeting in August 2016.

- Each ministry, agency and locality shall actively develop and promulgate its action plan in the 2016 - 2021 tenure, which clearly identifies the content, tasks, deadlines, and responsibilities held by individuals and units; develop working regulations of ministries, agencies and People's Committees, clearly and transparently identifying the procedures, deadlines to process tasks at each stage and promoting the application of information technology immediately in August and September of 2016.

- The Government Office shall lead and coordinate with ministries, agencies and localities to expeditiously amend, supplement and improve the working regulations of the Government, and submit to the Government for consideration and approval at the Government’s regular meeting in August 2016.

- Ministries and agencies based on their assigned tasks shall expeditiously finalize the Economic, Industrial and Sector Restructuring Programs, the National Target Programs, 21 Target Programs and major Programs under the Work Program of the Political Bureau, the Secretariat of the Party Central Committee and the Work Program of the Government and the Prime Minister.

- The Ministry of Home Affairs shall lead and coordinate with the Ministry of Justice and the Government Office to collect comments of the Cabinet members, improve a draft Decree promulgating the functions, duties, authority and organizational structure of Ministries and ministerial-level agencies, and submit to the Prime Minister for consideration and signing in August 2016. On the basis of this Decree, each ministry, ministerial-level agency shall urgently draft a decree amending and supplementing the Decree promulgating its functions, duties, power and organizational structure, and submit to the Prime Minister for promulgation in September and October of 2016.

2. Regarding the draft Law on management and use of weapons, explosives and supporting tools

The Ministry of Public Security was assigned to lead and coordinate with the Ministry of Justice, the Government Office, relevant ministries and agencies to collect comments of Cabinet members, and improve the draft Law on management and use of weapons, explosives and supporting tools. The Minister of Public Security, authorized by the Prime Minister, on behalf of the Government, shall report to the National Assembly.

3. Regarding the draft Law on Communal Police

The Ministry of Public Security was assign to lead and coordinate with the Ministry of Justice, the Government Office, relevant ministries and agencies to collect comments of Cabinet members, revise and improve the draft Law on Communal Police. The Minister of Public Security, authorized by the Prime Minister, on behalf of the Government, shall report to the National Assembly.

4. Regarding the draft Law on foreign trade management

The Ministry of Industry and Trade was assigned to lead and coordinate with the Ministry of Justice, the Government Office, relevant ministries and agencies to collect comments of Cabinet members, revise the draft Law and report to the Prime Minister before submitting to the National Assembly.

5. Regarding the draft Law on Legal Aid

The Ministry of Justice was assigned to lead and coordinate with the Government Office, relevant ministries and agencies to collect comments and improve the draft Law on Legal Aid, and report to the Prime Minister before submitting to the National Assembly.

6. Regarding the draft Law on State Compensation Liability (revised)

The Ministry of Justice was assigned to lead and coordinate with the Government Office, relevant ministries and agencies to collect comments and correct the draft Law on State Compensation Liability (revised), towards identifying clearly the compensation liability of the State as prescribed by law for the cases where wrongful conviction was made by public administrative and/or judicial officials and staff, and identifying a focal state representative to address issues quickly to ensure the legitimate rights and interests of the people, and report to the Prime Minister before submitting to the National Assembly.

7. Regarding the proposal to develop a draft Law amending and supplementing to the laws related to investment and business activities

The Government anonymously agreed with the proposal of the Ministry of Justice on the perspective, orientation, and targets of the draft Law. Accordingly, the Government affirmed its determination to resolutely eliminate unreasonable legal barriers to create an open and favorable investment and business environment as well as powerful impetus for development while ensuring the State’s management requirements.

The Ministry of Justice was assigned to lead and coordinate with the Ministry of Planning and Investment and relevant ministries and agencies to collect comments at the Government’s meeting, continue synthesizing comments of ministries, agencies and localities and the business community to improve dossiers of the draft Law. The Minister of Justice, authorized by the Prime Minister, on behalf of the Government, shall submit to the Standing Committee of the National Assembly the Government proposal to add this bill to the Legislature’s 2016 Law and Ordinance Making Program before August 15, 2016.

The Ministry of Planning and Investment was assigned to lead and coordinate with the Ministry of Justice and relevant ministries, agencies and organizations to urgently study, draft the Law, and submit to the Government for consideration and comments at the regular meeting in August 2016.

8. Regarding the draft Law supporting small and medium enterprises

The Ministry of Planning and Investment was assigned to lead and coordinate with the Ministry of Justice, the Government Office to urgently collect comments of Cabinet members, the Viet Nam Chamber of Commerce and Industry, the Viet Nam Association of Small and Medium Enterprises, to continue to revise and improve the draft Law supporting small and medium enterprises, ensure strong policy support, in line with international commitments engaged by Viet Nam and submit to the Government for consideration and comments at the regular meeting in August 2016.

9. Regarding the draft Law on planning

The Ministry of Planning and Investment was assigned to lead and coordinate with the Ministry of Justice, the Government Office, relevant ministries and agencies to collect comments and revise the draft Law towards submitting both plans on national planning including Plan 1: Overall national planning and Plan 2: National master plan, and report to the Prime Minister before submitting to the National Assembly.

10. Regarding the proposal to amend and supplement to the Decree No. 59/2015/ND-CP dated June 18, 2015 of the Government on management of construction investment projects

The Ministry of Construction was assigned to lead and coordinate with ministries, agencies and localities to develop and submit a draft Decree amending and supplementing to the Decree No. 59/2015/ND-CP dated June 18, 2015 of the Government on management of construction investment projects following the shortened order and procedure, submit to the Ministry of Justice to evaluate and collect comments of ministries, agencies and localities concerned, improve the draft Decree, and submit to the Prime Minister for review and approval in September 2016. In which, clear and rational decentralization should be made in management of construction investment projects between the various levels and agencies, between central and local levels. Clear responsibilities of various levels and sectors and entities engaged in construction activities should be identified to simplify administrative procedures, create favorable conditions for the investors, who decide to invest in construction projects.

11. Regarding the health insurance mechanism for family members of defence workers and officers who do not have health insurance as prescribed under the draft Decree guiding a number of articles of the Law on Professional Military Personnel and Defence Workers and Officers

The Ministry of Defense was assigned to lead and coordinate with the Ministry of Justice, the Government Office and relevant ministries and agencies to collect comments of Cabinet members, improve the draft Decree guiding a number of articles of the Law on Professional Military Personnel and Defence Workers and Officers, and report to the Government. In which, an insurance mechanism should be promulgated for family members of defence workers and officers who do not have health insurance.

The Ministry of Defense shall lead and coordinate with the Ministry of Finance, the Ministry of Health to identify specifically the level of support from the State budget to the above mentioned subjects, ensuring equality between civil and military subjects and in alignment with capacity of the State budget.

The Ministry of Health was assigned to lead and coordinate with the Ministry of Home Affairs, the Ministry of Public Security and the Ministry of Labour, Invalids and Social Affairs to study on a health insurance regime for family members of police officers, cadres and civil servants and officials receiving salary from the State budget, who do not have health insurance as promulgated under the provisions amending and supplementing to the Decree No. 105/2014/ND-CP detailing and guiding the implementation of some articles of the Law on Health Insurance.

12. Regarding the socio-economic situation in July and first 7 months of 2016; the implementation progress of the Resolution No. 01/NQ-CP dated January 07, 2016 of the Government on the key tasks and solutions to direct and execute the implementation of the socio-economic development plan and the State budget plan in 2016

The Government unanimously agreed that: The socio-economic situation in July and the first 7 months of 2016 continued to observe some changes and achieved certain results. In principle, the macro-economy remained stable. Inflation was kept under control. Credit growth was good. Interest rate was relatively stable and tended to decrease. Exchange rates and foreign exchange markets were relatively stable. Foreign exchange reserves increased. The stock market observed positive changes. Bond markets, especially the Government bond market achieved good results, contributing positively to raising funds for the State budget. Foreign Direct Investment (FDI) increased significantly. Processing and manufacturing sectors maintained the growth propel. Agricultural production gradually recovered. Exports of agricultural, forestry and aquatic products increased over the same period of the previous year. The number of international tourist arrivals increased. The fields of labor, employment, social security, social welfare, health care services for the people, gratitude repaying activities and other social areas received full attention and were duly implemented. The National High School Examination in 2016 was organized safely and successfully. National defense, security and social order and safety were guaranteed. Traffic safety was enhanced. The number of traffic accidents reduced. Foreign affairs continued received full attention.

However, the country still faced numerous difficulties and challenges. Room for fiscal and monetary policies remained limited. Public debt started to reach the permitted ceiling. There was a huge pressure on repayment. Exports of processed products observed little increase. Particularly, there was a sharp decline in exports to the ASEAN region. Imports of input materials, machinery and equipment fell. Aggregate demand was lower compared to that of the same period last year. Information security still had numerous limitations. The people's life in mountainous, remote areas, areas with ethnic minorities, areas affected by natural disasters, droughts, salt water intrusion, polluted areas remained difficult. Besides, there was an increasing trend of unpredictable national disasters. The global economic and politic landscape continued to observe complicated developments

The Government requested ministries, agencies and localities to overcome difficulties and challenges, strive to reach the highest level of growth targets set out while promoting the spirit of innovation, dare to think, dare to do, dare to held responsibility, strengthen order and disciplines, mobilize and utilize effectively all resources at home and abroad, continue to implement decisively and synchronously tasks and solutions across all sectors as stipulated under the Resolutions of the Party, the National Assembly, and the Government, continue to drastically reform administrative procedures associated with building e-government in all sectors and at all levels, remove barriers and obstacles, create favorable conditions and encourage entrepreneurship and production and business development of enterprises, in which focusing on the implementation of the following key tasks:

- The State Bank of Viet Nam shall proactively and flexibly manage monetary policy in close coordination with fiscal policy to control inflation, ensure macro-economic stability and promote growth, create favorable conditions for credit access, capital concentration for priority sectors, especially for small and medium enterprises, direct credit organizations to reduce costs, and strive to reduce the interest rate.

- The Ministry of Finance shall develop a Program on fiscal and public debt restructuring towards ensuring the budget’s safety and sustainability and report to the Government in September 2016. The Ministry shall direct to tighten fiscal order and disciplines, combat losses and transfer pricing, and increase savings; report on the management of public assets and solutions to manage and utilize State resources thriftily and efficiently at the Government's regular meeting in August 2016; accelerate administrative reform, especially in the fields of taxation and customs; examine and rectify immediately value-added tax refund and propose plan to refund tax speedily, timely and conveniently for enterprises, in the direction that tax authorities shall pay value-added tax refund first and check afterwards, and report to the Prime Minister in August 2016.

- The Ministry of Industry and Trade shall coordinate with ministries to consolidate and develop import and export markets, take advantage of and promote the opportunities when participating in the ASEAN market and other potential markets, avoid dependence too heavily on a market while taking control of imports; review mechanisms to promote domestic consumption of goods through retail distribution systems; focus on developing border trade, creating favorable conditions for exports, especially exports of agricultural commodities; improve a Strategy to develop Viet Nam’s power sector in the next period, focusing on solutions to ensure long-term and sustainable supply of electricity to meet the requirements of socio-economic development, and report to the Prime Minister on the possibility for Viet Nam to join the Extractive Industries Transparency Initiative in August 2016.

- The Ministry of Transport shall propose solutions to reduce the burden of domestic transport costs for citizens and enterprises and report to the Prime Minister in August 2016; direct to accelerate disbursement progress of traffic construction projects using government bonds in 2016; lead and coordinate with the Ministry of Finance to inspect, revise and handle over-collection of BOT fees.

- The Ministry of Agriculture and Rural Development shall urgently direct to recover consequences of Typhoons No. 01 and No. 02 and quickly restore production and the people’s life; drastically develop cultivation and husbandry to regain agricultural growth momentum from now until the end of the year; have specific measures to ensure input for agricultural production such as seedlings, pesticides, fertilizers, etc.; closely monitor the weather and direct the safe operation of irrigation reservoirs and implement measures to ensure safety of dikes and reservoirs, particularly during the rainy season; coordinate with the Ministry of Natural Resources and Environment, the Ministry of Finance, and relevant ministries, agencies and 04 central provinces affected by the environmental incident to provide compensation to the people affected by the incident publicly, transparently and appropriately to the right subjects.

- The Ministry of Culture, Sports and Tourism shall enhance the management and fortify solutions to develop tour guides supporting foreign tourists; organize a national conference promoting tourism into a spearhead economic sector in August 2016.

- The Ministry of Labor-Invalids and Social Affairs shall continue to implement policies on social assistance and preferential treatmen to people with merits to the revolution, poverty reduction and social security assurance; focus on providing career support and job creation for the people in the areas affected by the environmental incident.

- The Ministry of Health shall focus on directing disease prevention, especially the handling of dengue fever in the Central Highlands; improve the quality of health care services; coordinate with the relevant authorities to strengthen inspection and examination, strictly handle violations of food safety regulations.

- The Ministry of Education and Training shall review and assess performance in the academic year 2015 - 2016 in order to take timely measures to fix the limitations and shortcomings of public concern, in which focusing on improving facility conditions and ensuring hygiene for students at school; concentrate on directing the preparations for the new academic year 2016 - 2017; study to adjust tuition fee mechanisms for high school education and report to the Prime Minister in August 2016.

- The Ministry of Science and Technology shall implement synchronously measures to promote construction and investment attraction progress in 03 national high-tech zones in Hoa Lac (Ha Noi), Ho Chi Minh City and Da Nang City; actively implement the Program on a national entrepreneurship ecosystem by 2020 that has been approved by the Prime Minister.

- The Ministry of Natural Resources and Environment shall urgently inspect, examine and report to the Government on the current status of environmental pollution; organize a national conference on environmental protection in August 2016; develop a draft Directive of the Prime Minister on strengthening environmental protection and pollution control and submit to the Prime Minister in August 2016; strengthen the exploitation management and sustainable use of natural resources; effectively implement the Environment and Climate Change Program, the Green Growth Program, and the Paris Agreement on Climate Change in 2015; draw experience in weather forecasts; improve meteorological forecast quality to support prevention of natural disasters.

- Ministries, agencies and localities according to their assigned functions shall direct the inspection and examination of environmental legislation compliance, especially in industrial production facilities, industrial complexes, industrial zones, handicraft villages and in urban centers; strictly handle violations; foster responsibility of each agency and cadre, civil servant and public employee, especially the responsibility of heads of agencies in management and supervision of environmental protection.

- The Ministry of Home Affairs shall report on the assessment and classification of cadres, civil servants and public employees as stipulated under the Decree No. 56/2015/ND-CP dated June 9, 2015 of the Government to publicize the system of criteria to evaluate and classify performance of each agency at the central and local levels; lead and coordinate with the Ministry of Planning and Investment to study and develop a Program to establish agencies managing state-owned capital and assets in enterprises and report to the Prime Minister in August 2016.

- The Government Inspectorate shall lead and coordinate with other ministries, agencies and localities to strictly implement the Directive No. 12/CT-TTg dated April 28, 2016 by the Prime Minister to strengthen detection, handling of corruption cases; timely provide compliments and rewards and ensure safety of people detecting and reporting corruptions; and coordinate with the relevant authorities to complete the reception of citizens, settlement of complaints and denunciations from the grassroot level.

- The Ministry of Defense and the Ministry of Public Security shall closely monitor developments and situation in the East Sea for active and quick responses. The Ministry of Public Security shall direct and maintain political security and social order and safety, ensuring peaceful life for the people; urgently investigate, handle, and dismantle gangs, illegal deforestation, smuggling and counterfeiting; strengthen the protection of state secrets, ensuring the safety and security of information networks.

- The Ministry of Foreign Affairs shall coordinate with relevant ministries and agencies to closely monitor the global economic changes, assess impacts and timely propose response measures; carefully prepare for the ASEAN Summit, the East Asia Summit and other related meetings in Vientiane, Laos; direct Viet Nam’s representative offices abroad to strengthen support activities, trade promotion and expand export markets for Vietnamese goods.

- The Ministry of Information and Communications shall coordinate with the Ministry of Public Security to guide ministries, agencies and localities to strengthen the inspection, review and handling of malicious code; actively develop technical plans and solutions to ensure the security and safety of the information system; organize regular practices on information network safety for the key sectors and areas; conduct preliminary assessment and review of the implementation of the Directive No. 28-CT/TW dated September 16, 2013 of the Secretariat of the Party’s Central Committee, Directive No. 15/CT-TTg dated June 17, 2014 of the Prime Minister related to information network security and safety; urgently develop emergency response plans to ensure a safe national information network, and submit to the Prime Minister.

- The Government Office shall establish a working group established by the Prime Minister to monitor and supervise the implementation of the conclusions and instructions of the Government and the Prime Minister assigned to ministries, agencies and localities, focusing on the Resolution No. 01/NQ-CP dated January 07, 2016, the Resolution No. 19-2016/NQ-CP dated April 28, 2016, the Resolution No. 35/NQ-CP dated May 16, 2016, the Resolution No. 60/NQ-CP dated July 8, 2016, and the Resolution No. 36a/NQ-CP dated October 14, 2015, synthesize and report on the implementation progress of the tasks of ministries, agencies and localities at the Government's regular meeting. Ministries, agencies and localities shall establish working groups on their own to review, monitor and inspect the implementation of the assigned tasks.

13. Regarding the tasks and solutions to improve the labor productivity of Viet Nam

The Government unanimously agreed with the proposal of the Ministry of Planning and Investment not to request the Ministry to submit a separate draft Resolution of the Government on the tasks and solutions to improve the labor productivity of Viet Nam, but instead to integrate this content into the Program on "a number of key guidelines and policies to reform growth model, improve the quality of growth, labor productivity, and competitiveness of the economy," and report to the Government before submitting to the Political Bureau and the Party Central Committee in accordance with the work plan in 2016 of the Political Bureau and the Secretariat of the Party Central Committee.

14. Regarding the implementation progress of the Resolution No. 60/NQ-CP dated July 8, 2016 of the Government on the key tasks and key solutions to accelerate the progress of the implementation and disbursement of public investment funds in 2016

The Government unanimously agreed with the Report No. 5936/BC-BKH dated July 29, 2016 of the Ministry of Planning and Investment, requested ministries, agencies and localities to continue to implement synchronously tasks and solutions outlined in the Resolution No. 60/NQ-CP of the Government and the recommendations of the Ministry of Planning and Investment stated in the Report on overcoming difficulties and obstacles, accelerating the progress of the disbursement of public investment funds in 2016, striving to disburse all the allocated funds by the end of the year.

The Ministry of Planning and Investment and the Ministry of Finance were assigned to accelerate, supervise and address bottlenecks. The Ministry of Planning and Investment was assigned to review the implementation progress of tasks and report to the Government at the regular meeting in August 2016.

15. Regarding the implementation progress of the Resolution No. 19-2016/NQ-CP dated April 28, 2016 of the Government on the key tasks and solutions to improve business environment, enhance national competitiveness in two years 2016 - 2017, with an orientation to 2020.

Ministries, agencies and localities shall promote order and disciplines in the implementation of direction of the Government, focus on effectively directing the implementation of tasks and solutions specified in the Resolution No. 19-2016/NQ-CP associated with the implementation of the Resolution 35/NQ-CP dated May 16, 2016 on supporting and developing enterprises, follow up and address problems immediately. In particular, it is required to urgently remove difficulties, renovate management, specialized inspection of imported goods and focus on addressing issues that are urgent to enterprises and can present challenges to shortening the clearance time according to the objectives proposed in the Resolution.

The Government requested ministries, agencies and localities that have not developed, enacted action plans to implement the Resolution No. 19-2016/NQ-CP to review and withdraw experience, and expeditiously develop and promulgate plans in August 2016.

The Government Office shall coordinate with the Ministry of Planning and Investment to inspect the implementation of the Resolution No. 19-2016/NQ-CP in some ministries and localities, focusing on the agencies where there remain plenty of issues affecting business and investment environment and which are highly concerned by the business community and the people. Deputy Prime Minister Vu Duc Dam was assigned to provide specific direction.

16. Regarding the implementation progress of the Resolution No. 35/NQ-CP dated May 16, 2016 on supporting and developing enterprises by 2020

The Government requested the ministries, agencies and localities that have not enacted action plans to implement the Resolution No. 35/NQ-CP to review and withdraw experience, and urgently develop and promulgate plans in August 2016.

The Ministry of Planning and Investment shall coordinate with the Steering Committee for Enterprise Innovation and Development and the Vietnam Chamber of Commerce and Industry to organize the inspection, supervision and evaluation of the implementation of the Resolution in ministries, agencies and localities and periodically report to the Government as prescribed by law./.
