RESOLUTION

THE GOVERNMENT’S REGULAR MEETING - DECEMBER 2015

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Decree No. 08/2012/ND-CP of the Government dated February 16, 2012 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting in December 2015 held on December 28 - 29, 2015,

RESOLVES:

1.  Regarding the review of the Government performance in 2015 and implementation of tasks in 2016

 

The Government agreed that the direction and management of the Government in 2015 made significant contribution to the realization of socio-economic objectives and tasks in 2015 and the 5-year plan 2011-2015. The Government directed and managed its administrative apparatus to accomplish synchronously and drastically immediate objectives and tasks, as well as medium and long-term goals and tasks and achieved numerous positive results on almost all aspects. The Government paid due attention to improving working style, enhancing capacity and efficiency of direction and management, creating new changes, especially the enhancement of information technology application and promotion of e-Government development associated with administrative procedures reform, giving prominence to administrative rules and discipline, and improving efficiency and effectiveness of public activities serving the people.

In implementing socio-economic development tasks, the Government regularly reviewed and assessed implementation progress, consistently pursued objectives and tasks set out while ensuring its flexible and drastic working  manner. Under the leadership of the Party, supervision of the National Assembly, efforts of the political system, the business community and the people, many positive socio-economic results were achieved in 2015. Macroeconomy remained stable. Major balances of the economy were maintained. Inflation was controlled at a low level. Interest rate remained relatively stable. Total outstanding loans to the economy increased. Budget revenues exceeded the estimates amid sharp fall of crude oil prices. Central and provincial budget balances were guaranteed. Total social investment capital rose. GDP growth in 2015 was estimated at 6.68%, the highest level within the last 8 years, surpassing the set target. Industrial production, especially production of processing and manufacturing industry, increased, and played as a key driver of economic growth. Agricultural production remained stable in the conditions of unfavorable weather and decreasing prices of agricultural commodities in the world. Service sector continued to develop. Purchasing power and aggregate demand observed improvement. Total attracted and disbursed foreign direct investment (FDI) increased. Restructuring of the economy associated with transformation of growth model were actively deployed towards improving the efficiency and competitiveness of the economy. Deployment of social security and social welfare received adequate attention. Construction of new style countryside reaped positive results. Preventive health care, health services and food hygiene and safety were enhanced. Education-training, vocational training, employment and housing support observed positive progress. Art, cultural and communication activities received due attention. Reform of administrative procedures, especially tax and customs procedures, were implemented drastically. Investment environment and global competitiveness index improved significantly. Due attention was paid to citizen reception, settling of complaints and denunciations, prevention of corruption, implementation of thrift practice and wastefulness combat. National sovereignty was maintained; political security and social order and safety were guaranteed. Foreign affairs and international integration achieved many important results and position of Viet Nam in the international arena continued to be enhanced.

In addition to those achievements, shortcomings and weaknesses still exist in a number of fields. Production and business efficiency and competitiveness of domestic business remain relatively low. Value of agricultural production remains low due to decreasing prices of agricultural commodities in the world. State budget balance still faces difficulties. Restructuring of State agroforest enterprises remains slower than planned. Environmental pollution tends to increase. Protection of maritime sovereignty faces numerous challenges. Life of a part of people living in remote areas and ethnic minority areas and areas affected by natural disasters remains difficult. Occurrence of fires and explosions, crime and social evils are complex. Implementation of action plans of the Government and the Prime Minister, coordination among ministries and agencies remain slow. Deployment of instructions of the Government and the Prime Minister has not met expectation.

 

2016 is the first year to implement the 5-year socio-economic plan (2016 – 2021) and deploy the Resolution of the 12th National Assembly, the Government requests ministries, agencies and localities to promote their achievements and good practices in executive direction, strive to overcome difficulties and try their best to fulfill duties set for 2016 right at the beginning of the year, continue to improve working style, promote the application of information technology in the operation of State administrative agencies associated with streamlining administrative procedures, especially procedures directly related to citizens and enterprises; ensure effectiveness, efficiency, timeliness, publicity and transparency in the execution of their functions; improve quality of service provision in the spirit of the Resolution No. 36a/NQ-CP dated October 14, 2015 of the Government.

 

At the same time, attention should be paid to review and assessment of functions and tasks, reorganization of organizational structure, clear separation of functions and tasks, establishment of effective coordination and management mechanisms among ministries, agencies and localities, meeting requirements of State management and in conformity with the revised Law on Organization of the Government and the revised Law on Local Government. Coordination is required to facilitate the organization of elections of the 14th National Assembly and the People’s Councils of the 2016 – 2021 tenure.

 

The Government Office is assigned to collect comments of the Cabinet members and comments at the Government’s meeting with localities, then complete the Report reviewing the Government performance in 2015 and its Action plan in 2016; Report on the implementation progress of the Resolution No. 36a/NQ-CP dated October 14, 2015 on e-Government for deployment at ministries, agencies and localities. The Government Office shall preside and coordinate with the Ministry of Planning and Investment and other relevant agencies to collect comments of the Cabinet members and comments at the Government’s meeting with localities, promptly complete and submit to the Prime Minister for signing and issuance of the Resolution of the Government on major tasks and solutions on directing and managing the implementation of the Socio-economic development plan and the State budget plan in 2016.

Ministries, agencies and localities, according to their assigned functions and tasks, shall promptly develop, promulgate and implement specific action plans and programs; focus on strong and synchronous realization of specific solutions to effectively implement the Resolution of the Government on major tasks and solutions guiding the implementation of the Socio-economic development plan and the State budget in 2016 from the beginning of the year with the spirit of the highest responsibility, striving to achieve and surpass socio-economic development objectives and indicators in 2016, creating momentum for the implementation of the 5-year socio-economic development plan (2016 – 2021).

 

The Ministry of Planning and Investment, Ministry of Home Affairs, and Government Inspectorate shall preside and coordinate with other relevant ministries and agencies to collect comments of the Cabinet members and comments at the Government’s meeting with localities, then complete and issue Reports on: Results of the implementation of the Resolution No. 19/NQ-CP dated March 12, 2015 of the Government on major tasks and solutions to continue improving business environment and strengthening national competitiveness 2015 – 2016; implementation progress of the Resolution No. 59/NQ-CP dated August 07, 2015 on deployment of the Law on Enterprises and the Law on Investment; administrative reform in 2015; inspection and settling of complaints and denunciations and prevention of corruption, and wastefulness combat in 2015. At the same time, these agencies shall focus on directing the effective implementation of tasks and solutions to improve investment environment, enhance national competitiveness; administrative reform, especially administrative procedures directly related to citizens and enterprises; inspection and settling of complaints and denunciations and prevention of corruption and waste combat to create clear changes in 2016.

 

2. Regarding the draft Review report of the Government and the Prime Minister for the tenure 2011 – 2016

 

In the 2011 – 2016 tenure, the Government, the Prime Minister have always adhered to the Constitution and regulations, complied with the tasks and powers as prescribed; acutely implemented Resolutions and Conclusions of the Party Central Committee and the National Assembly; closely collaborated with organs of the Party, the National Assembly, the President, the Viet Nam Fatherland Front, mass organizations and the judiciary; complied with working regulations of the Government, ensuring the principle of democratic centralism and promoting the collective role associated with responsibility of individual members of the Government before the Party, the National Assembly, the Government and the people. The Government has maintained its solidarity and community responsibility. The Government members have actively and responsibly involved in completing common tasks. Its working methods have been promoted in the tenure. Implementation organization was drastic, well-coordinated, comprehensive, focused, associating immediate objectives with fundamental and long-term targets, ensuring timely response and alignment with new developments of the situation, following reality, solving difficulties and problems and promoting replication of good models and better practices, strengthening monitoring, facilitation and supervision of implementation.

 

Thanks to its efforts over the past tenure of the Government, in principle, the set general goals have been achieved, especially in: controlling inflation, stabilizing macro-economy; ensuring social security, improving the people's lives; maintaining economic growth at reasonable levels and at higher rate in the last years; piloting strategic breakthroughs and economic restructuring associated with renovation of the growth model; firmly safeguarding national sovereignty and maintaining a peaceful environment, ensuring social and political stability, strengthening the friendly relations and development cooperation with other countries; enhancing the prestige and position of Viet Nam in the international arena; paving the way for further development in the future. 17 out of 26 key indicators of the 5-year plan 2011 – 2015 were achieved or exceeded while GDP growth was among other nine indicators that failed to reach the target but the economy observed positive changes in 2014 and 2015, exceeding the plan.

 

The Government Office is assigned to collect comments of the Cabinet members, complete the Tenure review report of the Government and the Prime Minister, and submit to the Prime Minister before reporting to the Standing Committee of the National Assembly.

 

3. Regarding the implementation progress of the Program on laws and ordinance building of Government and the promulgation of legal documents guiding the implementation of laws and ordinances in 2015

 

In 2015, institutional development and completion was one of the Government’s priority tasks. Many important laws and codes have been developed and submitted to the National Assembly for approval. Draft laws and ordinances were properly prepared in correct order, procedures and, in principle, progress and quality were ensured. The development, promulgation of legal documents detailing the implementation of laws and ordinances in 2015 received full attention and observed remarkable changes. Quality of legal document has been improved and became more consistent and uniform. Backlog of legal documents substantially improved. By the end of the year, total backlogs of legal documents reduced considerably.

 

However, some documents were not issued at the same time as the enforcement time of laws, which created difficulties in ensuring synchronous implementation of laws and ordinances once they take effect.

 

The Government requests ministers and heads of ministerial-level agencies continue paying attention to directing the study and drafting to ensure quality, progress and feasibility of draft laws and ordinances under the Program on laws and ordinances building in 2016, expeditiously complete reports of draft laws and ordinances for inclusion in the 2016 program, submit to the Ministry of Justice for the synthesis, then report to the Government for comments at the regular meeting in January 2016, enhance monitoring, facilitation and inspection of the development of legal documents detailing the implementation of laws and ordinances, accelerate and ensure the quality of documents, strive to resolve backlogs, ensure deployment requirements of the revised Law on promulgation of legal documents passed in 2015, strengthen communication, dissemination, and education of laws and monitoring of law enforcement.

 

4. Regarding the implementation of the Decree No. 36/2014/ND-CP dated April 29, 2014 on raising, processing and exporting catfish products

 

The Government agrees to postpone the implementation of Paragraph 5 of Article 4; points b and c, Paragraph 3 of Article 6; Paragraph 2 of Article 7 of the Decree No. 36/2014/ND-CP dated April 29, 2014 on raising, processing and exporting catfish products until the Government issues a Decree amending and supplementing this Decree.

 

The Ministry of Agriculture and Rural Development is assigned to preside and coordinate with relevant ministries and organizations to urgently conduct a comprehensive review and propose amendments and supplements to the Decree No. 36/2014/ND-CP dated 29 April, 2014 on raising, processing and exporting catfish products to the Government.

 

5. Regarding the value added tax on exports of Nike Viet Nam Co. Ltd.

 

The Government agreed with the proposal of the Ministry of Finance on the application of a value added tax rate of 0% for prototype development, material and supplier selection, monitoring of manufacturing process of partner companies in Viet Nam between Nike Viet Nam and Nike 360 serving the production of the final products for export to foreign countries and other similar cases.

 

The Ministry of Finance is assigned to preside and coordinate with other relevant agencies to instruct the specific implementation to ensure compliance with applicable regulations on value added tax.

 

6. Regarding the application of the Resolution No. 77/NQ-CP dated October 24, 2014 of the Government

 

The Government agrees with the proposal of the Ministry of Labor-Invalids and Social Affairs, allowing the application of the Resolution No. 77/NQ-CP dated October 24, 2014 of the Government on pilot renovation of operation mechanism of public tertiary education institutions during 2014-2017 period at public vocational training institutions for pilot renovation of operation mechanism during 2016-2019 period.

 

7. Regarding the draft Decree on management and utilization of official development assistance and concessional loans of foreign donors

 

The Ministry of Planning and Investment is assigned to preside and coordinate with the Ministry of Justice, the Government Office and other relevant ministries and agencies to collect comments from the Cabinet members, complete the draft Decree, and submit to the Prime Minister for review and decision. On condition that provisions on procedures on proposal and selection of programs and projects using ODA and concessional loans shall be developed in the following direction: the Ministry of Planning and Investment shall preside and coordinate with the Ministry of Finance and other relevant agencies to select proposals on programs and projects using ODA and concessional loans accordingly, report to the Prime Minister for consideration and decision before informing donors and notifying governing bodies to develop pre-feasibility studies or Reports proposing investment policy.

 

8. Regarding the draft Decree detailing the implementation of some articles of the Law on foreign laborers working in Vietnam

 

The Ministry of Labor-Invalids and Social Affairs is assigned to preside and coordinate with the Government Office to collect comments of the Cabinet members, complete the draft Decree and submit to the Prime Minister for issuance, where provisions on conditions for experts who are foreign laborers working in Viet Nam must be stipulated in the following direction: Having a university degree or higher and at least 03 years relevant working experience matching the position the foreigner expects to work in Viet Nam; special cases shall be considered and decided by the Prime Minister.

 

9. Regarding the draft Decree amending pensions, labor incapacity allowances and subsidies for preschool teachers having a term of office before 1995

 

The Ministry of Labor-Invalids and Social Affairs is assigned to preside and coordinate with the Ministry of Justice, the Government Office and other relevant ministries and agencies to promptly finalize the draft Decree amending pensions, labor incapacity allowances and subsidies for preschool teachers having a term of office before 1995, following the order and procedures for development and promulgation of legal documents, and submit to the Prime Minister for issuance and implementation in January 2016.

 

10. Regarding the allocation of funds for scientific and technological activities

 

The Government agreed to allow continued allocation of funds to scientific and technological activities to ministries, central agencies assigned to manage national-level scientific and technological programs and missions until the Government issues a Decree amending and supplementing some articles of the Decree No. 95/2014/ND-CP dated October 17, 2014.

 

The Ministry of Science and Technology is assigned to preside and coordinate with other relevant ministries and agencies to urgently review and propose amendments and supplements to some articles of the Decree No. 95/2014/ND-CP.

 

The Ministry of Finance shall preside and coordinate with the Ministry of Science and Technology to urgently develop a plan to allocate funding for scientific and technological missions in 2016, and submit to the Prime Minister for consideration and decision in the first quarter of 2016.

 

11. Regarding debt restructuring of member companies of the Viet Nam Maritime Corporation (Vinalines)

 

The Government agreed with the proposal of the Ministry of Finance on solutions for restructuring debts of member companies of Vinalines in the Viet Nam Development Bank, ensuring compliance with current laws and regulations; companies after debt restructure must be able to recover their production and business.

 

The Ministry of Finance is assigned to preside and coordinate with the Ministry of Transport and other relevant agencies to develop a draft Decision of the Prime Minister on measures to restructure debts of member companies of Vinalines. On that basis, the ministry shall instruct the Viet Nam Development Bank to implement measures to restructure the debts. The Ministry of Transport shall direct Vinalines and its member companies to develop the overall strategic plan, production and business development plan and feasibility of the plan to restructure its debt in the Vietnam Development Bank, and report to the Prime Minister for consideration and decision.

 

12. Regarding the Proposal to step up the re-lending of the Government’s foreign loans and aid capital to investment programs and projects through re-lending agencies bearing credit risks

 

The Government agreed with the Proposal submitted by the Ministry of Finance to step up the re-lending of the Government’s foreign loans and aid capital to investment programs and projects through re-lending agencies bearing credit risks.

 

The Ministry of Finance is assigned to preside and coordinate with the State Bank of Viet Nam and the Ministry of Planning and Investment, based on the Proposal, the draft Decision of the Prime Minister on the implementation of mechanisms for re-lending foreign loans of the Government to investment programs and projects through re-lending agencies bearing credit risks following the order and procedures for development and promulgation of legal documents, and submit to the Prime Minister for issuance./.
