The Government’s regular meeting in October 2017

 THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting in September 2017, held on October 03, 2017

 

DECIDES:

1. On overcoming the consequences of the recent storms and floods and urgent tasks in the upcoming period

Due to the impact of climate change, natural disasters are becoming more servere, causing great human and property damages, and seriously disrupting life and production. The whole political system and people have joined hands in disaster prevention and control, thus diminishing damages. The Government recognizes and commends all levels, sectors, organizations and individuals for their active responses to cope with natural disasters and for their prompt support and assistance to help disaster-hit people. However, there remain a number of drawbacks and weaknesses in the prevention and control of natural disasters such as limited quality of weather forecast, limited disaster management infrastructure, and inadequate resources for natural disaster prevention and control, etc. In order to strengthen the prevention and control of natural disasters in the upcoming period, the Government asks for focusing on a number of key tasks as follows:

- Localities affected by natural calamities shall urgently support and assist people to stabilize their life and production; proactively work out plans to mobilize resources to promptly and effectively respond to calamities, minimize damages and overcome consequences in their localities; effectively utilize the state budget reserved for the prevention and mitigation of natural disasters.

- The Ministry of Agriculture and Rural Development shall lead and coordinate with the concerned ministries, agencies and localities in expeditiously finalizing the national strategy on natural disaster prevention and control in the context of climate change and sea level rise; review irrigation planning and flood prevention planning; develop and implement disaster prevention plans at all levels according to the Law on natural disaster prevention and control; report to the Prime Minister on review results of the whole system of dykes and irrigational reservoirs, especially the dyke areas which have been affected by the recent floods and storms, so as to develop a plan for immediate repair right in the end of 2017; review and build a Master plan on emergency evacuation in prevention of floods, flash floods and landslides; propose the development of financial policies for natural disaster prevention and control.

- The Central Steering Committee for Natural Disaster Prevention and Control shall review, propose and report to the Prime Minister on the pilot installation of flash flood and landslide monitoring and warning equipment in a number of high risk areas.

- The Ministry of Natural Resources and Environment shall lead and coordinate with concerned ministries and agencies in reporting and proposing solutions to enhance forecasting and warning capabilities, develop hydro-meteorological observation systems, especially flood monitoring systems, and promote public engagement in this work.

2. Regarding the socio-economic situation in October and the first 10 months of 2017; the implementation of the Government's Resolution No. 01/NQ-CP on the major tasks and solutions guiding the implementation of the socio-economic development plan and the State budget plan for 2017.

The Government unanimously assessed that the socio-economic situation in October and the first 10 months of 2017 witnessed continued improvements across all fields. Macro-economy remained stable. Inflation was kept under control. Money and securities markets observed many positive signals. Foreign exchange reserves increased. Banking operations received positive assessments. The industrial production index improved compared to that of the same period last year, especially in manufacturing and processing industries. Service and tourism industries continued growth momentum. Exports grew 20.7%, almost tripling that of the same period last year. Trade balance has shifted from trade deficit to trade surplus. Foreign direct investment saw decent upturn. Attention was paid to the implementation of administrative procedure reforms and application of information technology in public service delivery.

According to World Bank, Viet Nam's business climate has made noted improvements, jumping 14 positions to 68th out of 190 economies surveyed. Social security policies and programs continued to receive due attention. The Government also paid due attention to maintenance of traffic order and safety, fire prevention, environmental protection, and prevention and control of natural disasters, thus contributing to minimizing damages. Foreign affairs and international integration continued to be strengthened. National defence and security was reinforced.

Apart from the achievements, the country had to face with many difficulties and challenges. Natural disasters caused serious human and property damages. Complicated and unpredictable weather conditions and natural disasters negatively affected production and life, especially agricultural production. Disbursement of public investment has not met the set target. A number of other issues have caught public attention. For instance, dengue fever was not thoroughly prevented. Food safety and sanitation and environmental pollution remained urgent issues. Smuggling and trade frauds tended to increase. Social safety in some areas, traffic accidents, fire and explosion incidents remained complicated.

In the last 2 months of the year, the Government requested ministries, sectors and localities not to be subjective and satisfied with the achieved results but continue innovating, creating and actively monitoring domestic and international context. To resolutely act and promote the synchronous and effective implementation of the tasks and solutions set out in the resolutions of the Party’s Central Committee, the National Assembly and the Government as well as the Prime Minister's directions, striving to fulfill all targets and tasks of the 2017 plan, focusing on the following tasks:

- The State Bank of Viet Nam shall continue proactive and flexible monetary policy, in close coordination with the fiscal and other macroeconomic policies in order to control inflation, stabilize the economy, support economic growth, ensure national currency security and stabilize exchange rates within the prescribed range, especially at the end of the year. To continue to strive to reduce lending interest rates in line with macroeconomic developments, inflation and the monetary market. To concentrate capital on priority areas while ensuring credit quality. To step up the restructuring of credit institutions in association with the handling of bad debts.

- The Ministry of Finance shall intensify measures to prevent losses, transfer pricing and tax arrears, saving of recurrent expenditures. At the same time, the Ministry of Finance shall promote effective public debt management and tighten control over budget deficit. To take initiative in providing explanation to the National Assembly on the issues related to the performance of financial and budgetary tasks and the policy to suspend tax and charge. To collaborate with related ministries and agencies to develop  policies and measures to stabilize prices in areas hit by natural calamities, particularly the prices of construction materials.

- The Ministry of Planning and Investment shall lead and coordinate with the ministries, sectors and localities in elaborating a draft Resolution of the Government on major tasks and solutions guiding the implementation of the socio-economic development plan and the State budget plan for 2018 in the spirit of promoting innovation, giving priority to the selection of breakthrough fields and solutions, creating a motive force for socio-economic development, then sumit to the Government for approval at its regular meeting in December 2017 and for deployment right from the early days of 2018. To continue to analyze objective and subjective causes, responsibilities of sectors and levels for slow disbursement of public investment to promote better performance in the coming time. To promptly finalize the draft of the revised Law on Public Investment to remove obstacles and inadequacies, and submit it to the 14th National Assembly for consideration and approval. To lead and coordinate with the Ministry of Finance and concerned ministries and sectors in reviewing, urging, supervising, intensifying the inspection and examination of the implementation of public investment plans. To effectively implement the Law on Support for Small- and Medium-sized Enterprises.

- Ministries, sectors and localities shall apply drastic measures to disburse all public investment capital in 2017. To review and create favorable conditions to promote the deployment of all sources of investment, especially FDI, ODA and private investment. To accelerate the simplification of administrative procedures and site clearance procedures, shifting from pre-inspection approach to post-inspection approach.

- Ministers, Heads of Ministerial-level agencies and Chairmen of the provincial People's Committees shall closely and drastically speed up the equitization and divestment of the state capital, and hold responsibility before the Government and the Prime Minister in implementing the approved roadmap, in the spirit of publicity and transparency, ensuring the best interests of the State.

- The Ministry of Industry and Trade shall continue measures to promote exports, simplify procedures, apply e-commerce in import-export activities, comprehensively and effectively take advantage of the free trade agreements (FTAs), direct overseas trade offices to actively seek export markets, and ensure good market forecasts. The Ministry shall develop a plan to ensure the supply of essential goods at the end of the year, especially in areas hit by natural disasters. To continue to coordinate the effective implementation of the campaign Vietnamese people use Vietnamese goods. The Ministry of Industry and Trade and the Ministry of Agriculture and Rural Development shall cooperate with associations to promote their role in the implementation of measures to deal with trade barriers against agricultural and aquatic exports.

- The National Steering Committee against Smuggling, Trade Fraud and Counterfeit shall coordinate with concerned ministries and agencies, especially the Ministry of Public Security and the Ministry of Industry and Trade to intensify the inspection, control and management of the market, anti-smuggling, trade frauds and fake goods, especially goods such as fine sugar, tobacco, oil and gas, firecrackers. The Ministry of Public Security shall set up specialized units against smuggling and trade frauds, especially in the South.

- The Ministry of Agriculture and Rural Development shall take the initiative in closely monitoring the weather in order to promptly notify and take measures to cope with natural disasters. To intensify the control of epidemics, seedlings and agricultural supplies, especially the use of banned substances in animal husbandry and food hygiene and safety for agricultural products. To direct localities and associations to mobilize fishermen to exploit aquatic products safely, in accordance with the provisions of law. To organize communication, fighting and preventing the exploitation of illegal seafood, promptly propose amendments, supplements, and development of new legal documents.

- The Ministry of Education and Training shall foster the promulgation of the national education curriculum, syllabus and guidelines for the development of new national education textbooks. To lead and coordinate with the concerned ministries and branches in guiding localities to prepare conditions for the implementation of the program on general education and new national curriculum and textbooks according to the roadmap prescribed in the National Assembly's Resolution. To develop a draft Directive of the Prime Minister on strengthening preparations for innovating national curriculum and textbooks.

- The Ministry of Science and Technology shall lead and coordinate with concerned ministries, agencies and organizations in, reporting to the Prime Minister on the situation and results of the implementation of support activities for business start-ups, innovation and proposals on solutions to further develop the national innovative start-up ecosystem.

- The Ministry of Natural Resources and Environment shall review the overall issues of waste treatment in rural areas and craft villages, control of environmental pollution for large projects, and the transfer of use purpose of land for rice production which is inefficient. To improve quality of the forecast of flood and landslides. To lead and coordinate with the Ministry of Planning and Investment, the Ministry of Agriculture and Rural Development and concerned ministries, agencies and localities in, promoting the effective implementation of the Government's Resolution on sustainable development of the Mekong River Delta adapting to climate change.

- The Ministry of Culture, Sports and Tourism shall promote tourism, diversify tourism promotion activities and attraction of international visitors to Viet Nam. To take advantage of the 2017 APEC Economic Leaders’ Week to promote the image of the country, the people and culture of Viet Nam to the world. To promote the review and improvement of the quality of accommodation services throughout the country.

- The Ministry of Labor, War Invalids and Social Affairs shall coordinate with localities in continuing the implementation of social welfare policies, especially for ethnic minorities, deep-lying, remote and areas affected by storms and floods. To effectively handle the problem of Vietnamese laborers abroad escaping and violating labor contracts, especially in Japan and the Republic of Korea.

- The Ministry of Health shall intensify the inspection, examination and handling of violations of food hygiene and safety and direct the strict control of private clinics, including clinics with foreign doctors. To work out measures to prevent the abuse of health insurance fund for personal gains. To coordinate with the Ministry of Public Security in taking measures to ensure safety for medical staff at hospitals.

- The Government Inspectorate shall intensify the inspection of the responsibility to settle complaints and denunciations. To coordinate with ministries, sectors and localities in settling complaints and denunciations which involve many people and complicated and prolonged cases. Heads of authorities  at all levels must spend proper time receiving citizens according to regulations and efficiently settling complaints and denunciations under their competence.

- The Ministry of Public Security shall coordinate with the Ministry of Defense in taking initiative in responding to complicated security and order situations, prevent conspiracy, demolition activities of hostile forces, especially terrorism and sabotage plots. To protect the absolute safety of key objectives, key projects, important events, especially to ensure security and safety of the APEC Economic Leaders’ Week. To be ready to engage in response, rescue, and relief operations of natural disasters.

- The Ministry of Foreign Affairs shall well organize bilateral and multilateral diplomatic activities, including Viet Nam’s participation in the ASEAN Summits. To co-ordinate with the Government Office, Ministry of Defense, Ministry of Public Security and key localities of Da Nang and Quang Nam provinces to organize events wthin the APEC Economic Leaders’ Week, ensure the absolute security, not to let any flaw occurs. To collaborate closely with ministries and agencies to complete documents of the events during the APEC Economic Leaders’ Week, especially documents signed with key partners.

- The Ministry of Home Affairs shall lead and coordinate with the Government Office in the review and rearrangement of Steering Committees, inter-sector coordination for streamlined and effective operation and report to the Prime Minister in November 2017.

- Ministers, Heads of Ministerial-level agencies shall proactively prepare for the National Assembly’s Q&A session.

- Ministries and Ministerial-level agencies shall urgently complete the draft Decree detailing the implementation of the Laws that take effective from January 1, 2018 and pending guiding circulars. To finalize and submit to the competent authorities for approval of projects on sectoral restructuring in 2017 as assigned.

- The Ministry of Information and Communications shall direct media agencies to promote information dissemination and communication activities to create social consensus and belief among the people to successfully implement the objectives and tasks of 2017, actively communicate of national disciplines, legislation, culture, and morality. To promptly inspect and prevent false information which is detrimental to the national security, political stability and social order and safety, and strictly handle violations. The Ministry of Information and Communications and the Government Office shall coordinate with ministries, branches and localities in accelerating the roadmap to develop an e-Government.

- All levels and sectors shall continue to concentrate on deploying measures to improve the environment for business investment and development of enterprises in the spirit of Resolutions 19-2017/NQ-CP, 35/NQ-CP and Directive No. 26/CT-TTg. To develop specific action plans and programs for the comprehensive implementation of the Resolutions of the 5th and 6th plenums of the Party Central Committee and the National Assembly's Resolution on socio-economic development plan in 2018.

3. Regarding business-related reports

In principle, the Government unanimously agreed with the content of the report on reduction of fees related to input costs for enterprises prepared by the Ministry of Finance; the report on reviewing and reducing types of official fees in addition to fees, charges and expenses incurred in connection with procedures for granting investment, construction and land use permits to enterprises prepared by the Ministry of Planning and Investment; and the report on measures to cut and reduce charges and fees for enterprises prepared by the Advisory Council for Administrative Procedure Reform. To further create favorable environment for enterprises, the Government requested that:

a) On the reduction of charge rates and official expenses:

- Ministries, agencies and localities shall continue measures to reduce charges and input costs for enterprises according to the Government's Resolution No. 75/NQ-CP dated August 9, 2017. At the same time, measures shall be taken to further streamline and simplify administrative procedures, specialized examination procedures, and business conditions, reduce charge rates, and abolish some unnecessary fees. It is advised for agencies to actively coordinate with the Advisory Council for Administrative Procedure Reform to strengthen dialogue with the business community, collect comments from ministries and sectors, and the Advisory Council on Administrative Procedure Reform on plans to reduce and simplify administrative procedures and business conditions before submission to the Government and the Prime Minister.

- The Ministry of Transport, the Ministry of Industry and Trade shall, according to their respective specialized management competence, lead and coordinate with concerned ministries, agencies and localities in, reviewing logistics service charge rates for road use and propose suitable rates and publicize the specific calculation for enterprises to avoid overlapping and rampant charges. The Ministry of Transport shall lead and coordinate with the Ministry of Industry and Trade, the Ministry of Finance and concerned ministries and agencies in, organizing a conference on solutions to reduce logistics service charges in the transport sector in 2017.

- The Ministry of Finance shall lead and coordinate with ministries, agencies and localities in, reviewing charge rates for the use of infrastructure works, public services and facilities in seaports, inland ports and border crossings, and guide localities in setting appropriate charge rates.

- The Ministry of Planning and Investment shall lead and coordinate with ministries, sectors and localities in, formulating action programs to reduce cost for enterprises.

b) On informal cost cutting:

- Ministries, agencies and localities shall intensify the renovation of working mode and method, promote publicity and transparency of administrative procedures and charges and fees, step up the application of information technology to the handling and settlement of work with enterprises, effectively deploy the one-stop-shop mechanism, finalize and publicize the results of the handling of feedbacks and proposals made by the people and enterprises on mechanisms, policies and administrative procedures. To intensify the inspection and examination of public duties, promptly correct and strictly handle units and individuals that commit acts of harassing, creating troubles and burdens for enterprises.

- The Government and the Prime Minister requested and encouraged further promotion of the role of enterprises, associations and organizations on behalf of enterprises in proposing solutions or reporting to competent state agencies and authorities of the difficulties and obstacles in production and business.

4. Regarding the performance of tasks assigned by the Government and the Prime Minister in the first 10 months and the inspection results of the Prime Minister’s Working Group in October 2017.

The Government highly appreciated the work of the working group in monitoring, urging and inspecting the implementation of tasks assigned by the Government and the Prime Minister, especially the specialized inspection of import and export goods. The Government required:

- Relevant ministries must urgently identify and amend management measures on pre- and post- customs clearance for import and export goods subject to specialized inspection to reduce by at least 50% of goods subject to specialized inspection before customs clearance. To announce and publicize the results of the review and simplification of administrative procedures for specialized inspection and reduction of business conditions on e-portals of ministries and agencies. To elaborate and submit legal documents related to the reduction of investment and business conditions and administrative procedures in their fields of management.

- The Ministry of Health shall lead and coordinate with the Ministry of Justice and the concerned ministries in, finalizing the draft Decree replacing Decree No. 38/2012/ND-CP detailing the implementation of a number of articles of the the Law on Food Safety, ensuring the removal of current problems and shortcomings, and submit it to the Government in November 2017. The Government Office shall lead for addressing discrepancies in opinions among ministries and agencies, and submit the document to the Government for consideration and promulgation in December 2017.

- The Ministry of Agriculture and Rural Development shall lead and coordinate with the Ministry of Health, the Ministry of Industry and Trade, and the Ministry of Transport in, specifying the specialized management and inspection of the list of goods subject to inspection, which are currently overlapping among Ministries.

5. Regarding the implementation of the Viet Nam Government Portal’s channels for reception and handling of feedbacks of the people and enterprises

The reception and handling of feedbacks of the people and enterprises has been widely appreciated by the people and enterprises. However, this work still has a number of limitations such as the response to recommendations of some ministries and localities remained slow or adequate answers were not provided. Beside that, there remained many inappropriate and negative feedbacks. In order to further improve the reception and handling of feedbacks and proposals of the people and enterprises through the Viet Nam Government Portal, the Government requested:

- Ministries, ministerial-level agencies, and Governmental bodies, the People's Committees of the provinces and centrally-run cities shall thoroughly comply with and strictly abide by the Regulation on reception and handling of feedbacks of the people and enterprises through the Government Portal, issued in conjunction with Decision No. 574/QD-TTg dated 25 April 2017 of the Prime Minister. To regularly check and promptly correct the handling of feedbacks and proposals of agencies and organizations under their respective management.

- The Government Portal shall publicize to ensure transparency in the reception and handling of feedbacks of the people and enterprises, strengthen online dialogues and discussions between state management agencies and enterprises in implementing policies to timely solve problems, create the most favorable conditions for the people and enterprises, and create social consensus.

- The Ministry of Information and Communications shall direct press and media agencies to actively communicate about different channels for reception and handling of feedbacks of the people and enterprises managed by the Government Portal, and positive examples in handling and responding to feedbacks from the people and enterprises.

6. Regarding the implementation of the Government's Resolution No. 77/NQ-CP dated October 24, 2014 on piloting the renewal of operation mechanism for public higher education institutions in the 2014-2017 period

The Government has assigned the Ministry of Education and Training to lead and coordinate with ministries and agencies in, promptly finalizing and submitting to the Government for promulgation of a draft Decree stipulating the autonomy mechanism of higher education institutions in accordance with the spirit of Resolution No. 19-NQ/TW dated 25 October 2017 approved at the 6th plenum of the 12th Party Central Committee. At the same time, the Ministry shall take the initiative in coordinating with relevant ministries and agencies to review and propose amendments and supplements to the related legal documents to ensure uniform and synchronous implementation of autonomy mechanism at higher education institutions.

Higher education institutions and vocational education institutions that have been assigned to apply the pilot mechanism under the Government's Resolution No. 77/NQ-CP dated October 24, 2014 of the Government shall continue applying the mechanism until the Government's Decree stipulating the autonomy mechanism of public higher education institutions and the Government’s Decree stipulating autonomy mechanism of vocational education institutions take effect.

7. Regarding the proposal for a Decree on organic farming

The Government unanimously agreed with the proposal to develop a Decree on organic farming. The Ministry of Agriculture and Rural Development has been assigned to lead and coordinate with the Ministry of Justice and concerned ministries and agencies in, reviewing and elaborating the draft Decree, and submitting it to the Government for consideration and promulgation in December of 2017.

8. Regarding the pilot establishment of Urban Construction Management Team under the District People's Committee in Ha Noi

While no amendments has been made to Decree No. 26/2013/ND-CP and Decree No. 37/2014/ND-CP, the Government has agreed to pilot the establishment of Urban Construction Management Team under the District People's Committee provided that the pilot must not be contrary to provisions of the relevant laws. The pilot period shall be 2 years.

The People's Committee of Ha Noi has been assigned to lead and coordinate with the Ministry of Justice and concerned ministries and agencies in, formulating a Project on pilot establishment of  Urban Construction Management Team under the District People's Committee, in which positions, functions, tasks, sanctioning competence, organizational structure and working relationships with the Inspectorate of the Department of Construction and related agencies must be clarified, while ensuring that there are no increase in the number of personnel, and submitted to the Prime Minister for consideration and decision.

9. Regarding the draft Resolution on pilot development mechanisms and policies for Ho Chi Minh City

The Government unanimously agreed with the proposal of the Ministry of Finance and the People's Committee of Ho Chi Minh City on the pilot development mechanisms and policies

The Ministry of Finance has been assigned to lead and coordinate with the People's Committee of Ho Chi Minh City in collecting comments of the Government members and finalizing the draft Resolution on pilot development mechanisms and policies for Ho Chi Minh City in the direction of ensuring major national financial and budgetary balance and facilitating the development of Ho Chi Minh City.

The Ministry of Justice shall be assigned to urgently review the draft Resolution. Based on the appraisal of the Ministry of Justice, the Ministry of Finance shall receive feedbacks and finalize the draft Resolution and report it to the Prime Minister before submitting it to the National Assembly.

10. Regarding the request of the National Assembly Standing Committee to provide explanation on provisions of Clause 2, Article 2 of the Law on Social Insurance

The Ministry of Labor, War Invalids and Social Affairs shall lead and coordinate with the Government Office in, collecting comments of the Cabinet members. The Minister of Labor, War Invalids and Social Affairs shall be authorized by the Prime Minister to act on behalf of the Government, to report to the Standing Committee of the National Assembly.

11. Regarding the handling of discrepancies between the retirement pension levels for retirees before and after January 1, 2018 according to the provisions of the Law on Social Insurance.

The Ministry of Labor, War Invalids and Social Affairs shall lead and coordinate with the Government Office in, gathering comments of the Government members, finalizing the report on the handling of discrepancies between the retirement pension levels for retirees before and after January 1, 2018 in accordance with the provisions of the Law on Social Insurance, 2014. The Minister of Labor, War Invalids and Social Affairs has been authorized by the Prime Minister to report to the National Assembly on behalf of the Government.

12. Regarding adjustment of book value for the equitization of the Viet Nam Cable Television Corporation (VTVcab)
