RESOLUTION

THE GOVERNMENT’S REGULAR MEETING – MAY 2018

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting in May 2018, held on June 02, 2018

DECIDES

1. Regarding the socio-economic situation in May and the first 5 months of 2018, the implementation of Resolution No. 01/NQ-CP on major tasks and solutions guiding the implementation of the socio-economic development plan and State budget plan in 2018

The Government unanimously agrees that the socio-economic situation in May and the first 5 months of 2018 continues to observe positive progress. Macro-economy remains stable. Inflation is controlled. The monetary market and the banking system are stable. Liquidity system is guaranteed. Budget revenue increases by 13.6% in 5 months. Net foreign direct investment progresses well. Living standards of farmers have improved. Industrial production, especially processing and manufacturing, continues to improve. Total retail sales of goods and services maintain a fairly good growth. Exports increases by 15.8%, sending trade surplus to US$3.4 billion. Social security continues to be ensured. Policies for people with meritorious services to the revolution are fully implemented. Attention is paid to providing timely support to policy beneficiaries and social protection beneficiaries. Other fields like science, technology, education, training, health, culture, social affairs, employment, information and communication are well taken care of. Defense and security are strengthened. The social security order is guaranteed. Foreign affairs have achieved positive results.

However, the country still faces many difficulties and challenges. Inflationary pressure increases. The stock market has not developed well. Disbursement of public investment is better than that of the same period last year but still remains low. Foreign investment attraction is showing signs of slowing down. Manufacturing and processing industries tend to decelerate. Prices of a number of agricultural commodities decrease. Management of lakes and dams is inadequate. Environmental pollution, deforestation, fire and explosions, and traffic accidents, especially railway traffic accidents remain rampant.

The Government requests ministers, heads of ministerial-level agencies, Chairmen of the People's Committees of the provinces and centrally-run cities to drastically and synchronously realize the objectives, tasks and solutions enshrined in the Resolutions by the Party, the National Assembly, and the Government, especially Resolutions No. 01/NQ-CP, 19-2018/NQ-CP, 35/NQ-CP and Resolutions adopted at the Cabinet’s monthly meetings. Be determined to take action, regularly monitor, accelerate, inspect the work progress, and pay attention to overcome the existing weaknesses. Promptly remove difficulties, promote the development of production and business, and create substantial changes in each sector, each field and each locality. Among which, attention should be paid to the implementation of the following contents:

- Ministries, sectors, localities, especially the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Industry and Trade, the State Bank of Viet Nam shall actively follow up with changes in the policies of major partners and countries in the region, developments in the region and the world, to identify the opportunities and challenges to have appropriate solutions, avoid being passive and reliant too much on a single market.

- The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with ministries and sectors in updating quarterly growth scenarios for each sector or field. To propose specific tasks and solutions to achieve the growth and inflation control goals and report them to the Prime Minister before June 20, 2018.

- Ministries, sectors and localities shall closely follow up with the growth scenario of each sector, each locality, assess the implementation situation and review the direction and management of the first 6 months and actively adopt direction and administration measures in the last 6 months of 2018. To intensify the implementation of measures to accelerate the disbursement of public investment capital. To strictly review, inspect, and clarify the responsibilities of organizations and individuals that cause delays in the implementation of public investment plans.

- The State Bank of Viet Nam shall continue pursuing flexible exchange rate. To take measures to increase foreign exchange reserves upon the favourable conditions of the market. To efficiently implement the scheme on restructuring credit institutions in association with the handling of bad debts. To strictly control credit for potentially risky areas. To enhance the application of advanced technologies, ensuring safety and security in electronic payment and card payment. To collaborate with the Ministry of Public Security, the Ministry of Industry and Trade to control and prevent black credit and usury.

- The Ministry of Finance shall manoeuvre fiscal policy in close coordination with monetary policy. To thoroughly exercise thrift practices and combat wastefulness, especially spending on shopping and meetings. To promote tax inspection and examination, strictly manage tax declaration and tax refund to prevent losses, transfer pricing, trade frauds, and have comprehensive solutions to develop a stable securities market to build trust of investors. To closely coordinate with the border-adjacent localities in implementing drastic measures to combat smuggling and trade frauds.

- Ministries and agencies in charge of managing the prices of essential commodities and services shall take initiative in closely coordinating with the Ministry of Finance to synchronously utilize appropriate tools and solutions to carefully control prices of commodities managed by the State. To avoid electricity price hikes in 2018, consider an appropriate time and level for adjusting prices of health and education services while ensuring to keep inflation under 4%.

- The Ministry of Industry and Trade shall effectively deploys the plan of industrial restructuring. To focus on developing industrial production in depth, creating national brand products capable of being competitive in the global market, especially in processing and manufacturing sector. To inspect and supervise the implementation of production and business investment plans of State-owned groups and corporations under their respective management. To step up the application of information technology in enterprise management. To assume the prime responsibility for, and coordinate with the Ministry for Foreign Affairs and concerned ministries and agencies in intensifying the communication, dissemination and mobilization of partners to recognize the market economy status for Viet Nam. To effectively implement solutions to expand and diversify export markets. To adopt suitable strategies and steps to strongly develop the domestic market and protect production and consumption in the country. To speed up the completion of projects and works of the sector. To regulate the oil and gas price according to regulations and use the petrol price stabilization fund to control inflation.

- The Ministry of Agriculture and Rural Development shall closely monitor the weather conditions, river and stream water levels, dams, and have measures to ensure the safety of dykes, embankments and irrigation works, especially at 55 serious landslide areas during the rainy season. To assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Natural Resources and Environment and localities in, implementing synchronous solutions to overcome river and coastal erosion in the Mekong Delta. To monitor prices of agricultural products, timely direct production adjustment and deploy appropriate solutions. To coordinate with the Ministry of Industry and Trade to promote the negotiation and export of agricultural products. To closely control the quality of agricultural materials and food safety for agricultural products. To direct and guide localities to adopt drastic measures to prevent and stop illegal, unreported and unregulated fishing activities. To strictly deploy forest management and protection measures and strictly handle violations and strictly control the origin of forest products exported to Europe.

- The Ministry of Construction shall closely monitor the construction material price and the real estate market in order to take appropriate measures, especially the management of steel prices, to ensure sufficient supply for construction demand.

- The Ministry of Transport shall concentrate on finalizing draft Laws as assigned and submit them to the Government on schedule with quality ensured. To review and evaluate the implementation of the Scheme on the overall restructuring of the transport sector and propose effective solutions. To accelerate the investment preparation for building the eastern component of the North-South Expressway, the North-South high speed railway, the Tan Son Nhat international airport, and the Long Thanh international airport. To review, rearrange and modernize railroad crossing barriers. To coordinate with localities in thoroughly settling points of danger, especially interchanges at residential areas. To coordinate with the Ministry of Public Security to oversee oversized and/or overload vehicles and strictly handle violations. Continuously review and reduce Build-Operate-Transfer (BOT) fee, especially at BOT stations for which financial payments have already been settled.

- The Ministry of Culture, Sports and Tourism shall focus on promoting outstanding and competitive tourism products. To enhance the management and control of the quality of service provision and tourism. To study on the development of a code of conduct for international tourists in Viet Nam in line with the guidelines and policies for tourism development. To improve and organize activities of the Viet Nam Football Federation.

- The Ministry of Education and Training shall efficiently organize the high school graduation and university entrance exam in 2018, ensuring favourable conditions for the students. To direct and inspect localities in the implementation of solutions to improve the quality of school toilets. To collaborate with the Ministry of Labor, Invalids and Social Affairs and localities to deploy practical solutions to prevent drowning in children, especially during the summer vacation.

- The Ministry of Labor, Invalids and Social Affairs shall effectively implement the policies for people with meritorious services on the occasion of the War Invalids' and Martyrs' Day on July 27, policies on social welfare, poverty reduction, vocational training and job creation. To assume the prime responsibility for, and coordinate with concerned ministries and agencies in formulating a draft action program for the implementation of the Resolution of the 7th plenum of the Party Central Committee on the reform of social insurance policies and submit it to the Government before June 25, 2018. To assume the prime responsibility for, and coordinate with the Ministry of Education and Training, in formulating job-training schemes for unemployed people, people who lost their jobs, graduated students who are unemployed and assist enterprises which, in the transformation of their structure, are prone to result in job loss for its staff from the unemployment insurance fund and report to the Prime Minister. To coordinate with the Ministry of National Defense, the provincial People's Committee of Ha Giang and concerned ministries and agencies in dealing with matters related to the clearance of bombs and mines, seeking the rehabilitation of martyrs and the improvement of Vi Xuyen Martyrs' Cemetery.

- The Ministry of Health shall closely coordinate with the Ministry of Industry and Trade, the Ministry of Agriculture and Rural Development and localities in intensifying the inspection, strict control and assurance of food safety. To direct the implementation of measures to improve the quality of toilets in hospitals.

- Deputy Prime Minister Trinh Dinh Dung shall direct the Ministry of Construction to assist the Ministry of Health in solving problems and speeding up the construction of the second facilities of the Viet Duc Hospital and Bach Mai Hospital (in Ha Nam province).

- The Ministry of Home Affairs shall promptly sum up and submit to the Prime Minister for approval the number of public payrolls of 2019 before July 20, 2018. To assume the prime responsibility for, and coordinate with concerned ministries and agencies in drafting an Action Plan for implementing the Resolutions adopted at the 7th plenum of the Party Central Committee on salary policy reform and building contingent of cadres of all levels, especially those at strategic levels, and submit the Plan to the Government before June 25, 2018. To report to the Prime Minister on the results of the inspection and examination of the appointment of cadres in contravention of regulations.

- The Prime Minister’s Working Group on inspecting performance of public duties shall step up its activities, focusing on performance of responsibilities and tasks, reception of citizens, management and use of the assigned staff and workplace culture.

- The Government Inspectorate and concerned ministries, sectors, and provincial People's Committees shall strictly abide by the conclusions of the Prime Minister at the conference on the settlement of complaints and denunciations. To concentrate on resolving the cases of complicated and prolonged petitions.

- The Ministry of Natural Resources and Environment shall improve the quality of natural disaster warning and weather forecast. To promote the implementation of Resolution No. 120/NQ-CP on on Sustainable and Climate-Resilient Development of the Mekong Delta  as well as programs and projects on climate change adaptation. To quicken submission of proposed adjustments to the provincial-level land use planning scheme for the 2016-2020 period and the land use plan for the 2016-2020 period to the Government for approval. To assume the prime responsibility for, and coordinate with, concerned ministries, sectors and localities in deploying effective measures to manage agroforestry farm land in the Central Highlands.

- The relevant ministries and agencies shall coordinate with the Government Office in preparing the agenda of 2018 thematic conferences as planned. After each of the conferences, promptly submit to the Government and the Prime Minister for promulgation of documents for immediate implementation.

- The Ministry of Public Security shall closely follow up with the world, regional and domestic situation. To efficiently handle complicated emerging security situations. To focus on fighting conspiracies and sabotaging activities of hostile forces. To promote patrol and control activities to ensure security and safety for the people and enterprises. To propose and report to the Prime Minister on the contents of thematic conference on fire and explosion prevention and control before June 20, 2018.

- The Ministry of National Defense shall enhance national defense and actively take control of situations for timely responses.

- Ministries shall expeditiously carry out solutions to substantively reduce specialized inspection procedures as committed in a bid to create a favourable and open investment and business environment.

- The Cabinet members shall actively monitor and concentrate on immediate settlement of pressing issues in the sectors or domains under their responsibility, which have been recommended by agencies of the Fatherland Front, the National Assembly and the National Assembly deputies, and report to the National Assembly on the results of solution implementation at the year-end session

- The Ministry of Foreign Affairs shall continue to improve the efficiency of foreign affairs. To take initiative in deepening the relationship with partners. To promote international integration, promote the country’s role and position at international and regional fora. To closely monitor regional and international developments for active responses.

- The Ministry of Information and Communications shall continue to strengthen the state management of the press, promote the role and responsibility of the media in disseminating the guidelines of the Parties, the policies of the State, and directions and instructions of the Government and the Prime Minister in order to create social consensus. To timely orient and provide full and accurate information regarding the issues of public concern. To continue building and deploying solutions to prevent and strictly handle cases of misrepresentation of information.

3. Regarding the draft Decree defining the functions, tasks, powers and organizational structure of the Committee for State Capital Management at enterprises.

- The Ministry of Planning and Investment shall coordinate with the Committee to collect comments from the Government members, clearly define the tasks and powers of the Committee, the relationship between the Committee and the Ministries of Planning and Investment and Finance in coordinating state management of capital invested at enterprises in compliance with the Law on Management and Use of State Capital Invested in Production and Business at Enterprises and other relevant legal documents.

The draft Decree shall be finalized before June 10, 2018 and reported to the Prime Minister before consulting with the National Assembly Standing Committee.

- Ministries shall continue effective State management of enterprises in accordance with the law. Each ministries shall work out plan and roadmap for rearranging and reorganizing a focal point for management of State enterprises immediately after transferring the enterprise management tasks to the Committee for State Capital Management at enterprises.

- The Ministry of Finance shall expeditiously draft a Decision on procedures for the transfer of the right to represent the owner of State capital portions at enterprises from ministries and agencies to the Committee for State Capital Management at enterprises and submit it to the Prime Minister for consideration and approval.

- The Committee for State Capital Management at enterprises shall be responsible for quality and quantity of staff recruitment in accordance with the legal provisions to ensure its quick operation and effective performance.

4. Regarding the use of the central budget reserve in the first quarter of 2018 and the authorization to report to the National Assembly Standing Committee on the quarterly use of the central budget reserve

The Government unanimously agrees to:

- Approve the Report by the Ministry of Finance. The Minister of Finance shall be authorized by the Prime Minister, acting on behalf of the Government, to report to the National Assembly Standing Committee on the use of the central budget reserve for the first quarter of 2018 in accordance with the State Budget Law and guiding documents.

- In subsequent period, the Prime Minister shall quarterly review the report of the Ministry of Finance on the use of the central budget reserve and decide on the authorization to report to the National Assembly Standing Committee.

5. Regarding the formulation of the National Master Planning, the National Marine Spatial Planning and National Land Use Planning

The Government unanimously agrees to establish a National Planning Council to advise the Government and the Prime Minister on the development of the National Master Planning, the National Marine Spatial Planning, the National Land Use Planning, and the Regional Planning. The Chairman of the Council shall be a Deputy Prime Minister; the Vice-Chairmen of the Council shall be Minister of Planning and Investment, Minister of Natural Resources and Environment; Minister of Construction; Council members include leaders of ministries, ministerial-level agencies and Chairmen of relevant Provincial/Municipal People's Committees.

The Ministry of Planning and Investment is assigned to draft a Decision on the establishment of the National Planning Council and submit it to the Prime Minister for consideration and approval.

6. Regarding the preparation of draft laws and promulgation of documents detailing the implementation of laws and ordinances; the performance of tasks and inspection results in May and the first 5 months of 2018 of the Prime Minister’s Working Group

a) Regarding the preparation of draft laws and promulgation of detailing documents:

The Government requests:

- Ministers and heads of ministerial-level agencies shall intensify the discipline and order in the elaboration and submission of legal documents. Directly manage and supervise the elaboration of legal institutions and take responsibility before the Government and the Prime Minister for the progress and quality of legal documents developed by the respective ministries and/or drafting agencies.

- Ministries and ministerial-level agencies take initiative in implementing the law and ordinance making program for 2019 and the revised program for 2018. Promptly complete, issue and/or submit to the Government and the Prime Minister for promulgation of detailing legal documents which remain pending and documents on detailed implementation of the laws effective from July 1, 2018 to prevent the occurrence of document backlogs.

- The Ministry of Justice shall step up the supervision, urge and inspect the elaboration and promulgation of legal documents. Promptly advise the Government and the Prime Minister in this domain. Promptly report to the Government on the drafting of legal documents which are incomplete and fail to satisfy the quality requirements.

b) Regarding the inspection results by the Working Group:

Ministries, agencies and localities are requested to seriously implement the recommendations by the Working Group of the Prime Minister. To actively carry out the tasks assigned by the Government and the Prime Minister, pay special attention to and concentrate resources on the elaboration and submission of projects under the Government's and the Prime Minister's working programs in 2018, and ensure their progress and quality.

The Working Group has been assigned to continue inspecting the performance of tasks assigned by the Government and the Prime Minister to ministries, agencies and localities and concentrate on inspecting and urging the implementation of solutions to address key issues of the Government’s attention in 2018, especially institutional development, and report to the Government at the regular meeting./.
