RESOLUTION

The Government’s regular meeting in September 2017 

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting in September 2017, held on October 03, 2017

 

DECIDES:

1. Regarding the draft Law amending and supplementing to a number of articles of the Law on Public Investment

The Ministry of Planning and Investment shall assume the prime responsibility, and coordinate with the concerned ministries and agencies in conducting a comprehensive and overall review and assessment of the implementation of the Law on Public Investment to clearly identify obstacles and inadequacies in the implementation of the Law study and evaluate impacts of proposed amendments and/or supplementation; complete the proposal on revision of the Law on Public Investment and send it to the Ministry of Justice for appraisal and submission to the Government for consideration and approval at its regular meeting in November 2017; then draft a Law amending and supplementing to a number of articles of the Law on Public Investment and send it to the Ministry of Justice for appraisal and report to the Government at its regular meeting in February 2018. The bill will then be submitted to the 14th National Assembly at its 5th session.

2. Regarding Feasibility Study Report on Land Acquisition, Compensation, Support and Resettlement Project of Long Thanh International Airport

- The People's Committee of Dong Nai province is assigned to take prime responsibility and coordinate with the Ministry of Communications and Transport in continuing two-way exchanges with the State Appraisal Council in order to finalize the feasibility study report. After the National Assembly passes the feasibility study report, the People's Committee of Dong Nai province shall closely coordinate with local socio-political organizations in disseminating and mobilizing local residents to abide by the State’s policies and laws on land acquisition, compensation and resettlement, satisfactorily resolving obstacles and creating favorable conditions for stable production and living conditions.

- The Minister of Transport shall be authorized by the Prime Minister to present the feasibility study report to the National Assembly.

3. Regarding the preparations for the 4th session of the 14th National Assembly and development and promulgation of legal documents in the 3rd quarter of 2017

- Ministers and Heads of ministerial-level agencies need to be aware that it is a priority for these agencies to collaborate to prepare for the 4th session of the 14th National Assembly. Thus, ministers and heads of ministerial-level agencies have to promptly prepare all the documents as required and send them to the National Assembly.

The ministers and heads of the ministerial-level agencies need to closely follow the session as well as issues raised by the public, voters and National Assembly deputies for full explantions.

- The Government Office is assigned to review and speed up coordination among different stakeholders to prepare for the 4th session of the 14th National Assembly and arrange appropriate working schedules of the Prime Minister and Deputy Prime Ministers to attend activities of the Legislature’s session.

- Ministries and agencies shall concentrate their resources to speed up the drafting and issuance of documents detailing and guiding the implementation of laws and ordinances; review specific responsibilities of agencies, units and heads of agencies that have led to delays in promulgation of documents detailing implementation of laws and ordinances having taken effect. Ministry and agencies shall closely coordinate with the Ministry of Justice and the Government Office in reviewing and elaborating a list of documents detailing and guiding the implementation of laws and resolutions which are expected to be approved by the 14th National Assembly at its 4th session to avoid passiveness and incoordination in the implementation process.

4. Regarding the socio-economic situation in September and the first 9 months of 2017; the implementation of the Government's Resolution No. 01/NQ-CP on the major tasks and solutions guiding the implementation of the socio-economic development plan and the State budget plan for 2017

The Government unanimously assessed that with the efforts and determination of the entire political system, the business community and the people in the whole country, many important results were achieved in all fields in the reviewed period. Economic growth has kept increasing quarter by quarter. The 3rd quarter saw a jump of 7.46% in economic growth. Average economic growth in the first 9 months was 6.41%, higher than that of the same period last year. The quality of growth and competitiveness of the economy have been gradually improved. Dependence on the exploitation of resources has been reduced. Macroeconomic situation was relatively stable. Inflation was kept under control. Credit increased by nearly 12%. Average interest rates decreased. Exchange rates and foreign exchange markets were stable. Foreign exchange reserves increased. Stable stock market was recorded. Foreign direct investment (FDI) and export increased sharply. Trade deficit was low. Agricultural production has been affected by natural disasters but recovered strongly and achieved higher growth rate than that of the same period last year. Manufacturing industry grew by 12.8%. Services sector’s growth rate was 7.25%. Domestic trade grew strongly. Sales of retail and service sectors have increased significantly. Market confidence improved. Administrative procedure reforms and the implementation of the one-stop shop mechanism and the one-door mechanism created positive changes and favorable and open business environment. According to the World Economic Forum (WEF), the national competitiveness index in the 2017 - 2018 period of Viet Nam jumped by 5 places to 55th out of 137 countries and territories. The cultural and social fields have made great progress. Social security and social welfare received full attention. Environmental protection, prevention, combat and overcoming of the consequences of natural calamity were well attended and implemented drastically. Political security, social order and safety were guaranteed. Foreign affairs and international integration continued to be promoted and achieved positive results.

Apart from the achievements, the country is still facing many difficulties and challenges. For instance, the industry and construction sectors observed lower growth than that of the same period. The number of enterprises halting and terminating operation tends to increase. Equitization, divestment of state capital and disbursement of investment capital were relatively slow. Administrative procedures and business conditions in some areas remained cumbersome and complicated. The culture and society fields still see a number of drawbacks. Dengue fever and hand-foot-and-mouth disease observed complex development. There remained violations in pharmaceutical management and hygiene and food safety. The situation of natural disasters and epidemics was complicated. Traffic accidents, fire and explosion remained serious.

The tasks in the remaining months of 2017 are heavy. The Government requires ministries, sectors and localities to avoid being subjective, continue to promote the spirit of innovation, creativity, taking drastic action, to concentrate on synchronously implementing the set tasks and solutions, closely monitor global and domestic situations in order to promptly take appropriate measures to cope with newly emerging issues. Leaders of each ministry, sector and locality shall raise their personal responsibility, continue to closely monitor the situation, tighten administrative disciplines and order, directly direct and take responsibility before the Government and the Prime Minister for the implementation of the assigned political tasks, and strive successfully and comprehensively achieve the objectives and tasks of the plan in 2017. Attention should be paid to the implementation of the following tasks:

- The State Bank of Viet Nam shall closely monitor the domestic and international situation, continue to manage the monetary policy actively and flexibly in close coordination with the fiscal and other macro policies to control inflation, stabilize macro economy and support growth. Manage interest rates in line with macroeconomic developments, inflation situation and monetary markets, strive to reduce interest rates. Concentrate credit for priority areas, create favorable conditions for small and medium enterprises to access credit capital for production and business development. Strictly implement the restructuring of weak commercial banks, efficiently deploy the scheme on credit institution restructuring associated with bad debt settlement in the 2016-2020 period, which have been approved by the Prime Minister in Decision No. 1058 / QD-TTg dated July 19, 2017.

- The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with the Ministry of Finance in, promptly adjusting according to its competence and proposing competent agencies plans to adjust the budget plan for 2017 among programs and localities. In the case of slow disbursement, resolute action will be taken to reduce and transfer capital to perform other urgent tasks according to regulations.

- Ministers, heads of ministerial-level agencies and Chairmen of the provincial-level People's Committees shall be accountable to the Government and the Prime Minister for the implementation progress and disbursement results of public investment capital in the 4th quarter of 2017, ensuring to disburse all of the planned capital in 2017.

- All sectors and levels shall create favorable conditions for accelerating foreign investment, official development assistance (ODA) and private investment as an important impetus for growth.

- The Ministry of Finance shall assume the prime responsibility for, and coordinate with ministries, sectors and localities in, strictly implementing financial and budgetary disciplines and order, concentrate on handling and recovering tax arrears, preventing losses and transfer pricing, striving to outperform the tasks assigned by the National Assembly. The Ministry shall strictly control budget expenditures, thoroughly reducing regular expenditures, effectively implement the mechanism to assign a lumpsum management funding for state agencies, implement the mechanism to assign a lumpsum funding for the use of public vehicles, promote auction and order placing mechanisms in public service delivery. Together with the Ministry of Industry and Trade, relevant ministries and localities, the Ministry of Finance shall strengthen the management of prices, prevention of smuggling and trade frauds.

- The Ministry of Industry and Trade shall continue drastic and synchronous measures to promote export, foster trade promotion, market searching and expansion; develop a market information system, disseminate, guide and support businesses to take advantage of free trade agreements (FTAs). The Ministry shall simplify administrative procedures in the fields of import and export, especially the procedures for issuing certificates of origin. Assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development and the Ministry for Foreign Affairs in, taking measures to deal with trade barriers in Viet Nam’s export markets. Coordinate with ministries, sectors and localities in continuing the implementation of programs to promote consumption and development of the domestic market. Strengthen the coordination of market management, especially at the end of the year and the Lunar New Year. Review and apply measures to protect the domestic market in accordance with international commitments. Strictly control the import of small-sized goods and temporary import for re-export, especially the import of products which can be produced at home and not encouraged for import. Speed up the process of divesting state capital in the enterprises owned by the Ministry, including Ha Noi Beverage Corporation (HABECO) and the Saigon Alcohol Beer and Beverages Corporation (SABECO).

- The Ministry of Agriculture and Rural Development shall concentrate on directing the implementation of measures to ensure the growth of 3.05% in the agricultural sector. Take initiative in monitoring the weather, have plans on prevention, mitigation and damage of natural disasters. Guide localities to effectively implement the restructuring of production. Strictly control the quality of agricultural varieties and materials. Coordinate with the Ministry of Industry and Trade in seeking new markets and boosting the export of some agricultural commodities with potential and advantages of Viet Nam.

- The Ministry of Science and Technology shall speed up the implementation of scientific research, technological development and innovation. Collaborate with the Ministry of Foreign Affairs, the Ministry of Culture, Sports and Tourism and the Ministry of Agriculture and Rural Development to carry out activities to promote Viet Nam’s role in the World Intellectual Property Organization.

- Ministries, sectors, localities, state-owned groups and corporations shall strictly abide by the roadmap on restructuring, equitization and divestment of state capital, which have already been approved by the Prime Minister in Official Letter No. 991/TTg -DMDN dated July 10, 2017 and Decision No. 1232/QD-TTg dated August 17, 2017, ensuring transparency, according to the market mechanism. Take initiative in reviewing and clearly identifying obstacles and inadequacies in the process of restructuring, equitization and divestment of State capital to have timely solution, and ensure completion of equitization and divestment of State capital according to the proposed timeline.

- Ministries, sectors and localities shall review projects and works invested by the State budget and concentrate on resolutely handling ineffective projects and works, which created prolonged losses.

- The Ministry of Culture, Sports and Tourism shall organize the review and evaluation of tourism quality so as to have effective policies and measures to attract international tourists, especially during the APEC Economic Leaders’ Week and strive to reach the goal of 13-15 million international tourists in 2017.

- The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with ministries, sectors and localities in, concentrating effectively on the national target program on poverty alleviation. Continue the preferential policy for people with meritorious services to the revolution, ensuring social welfare, organizing a day for the poor on the 17th October. Improve the quality of vocational training and creating jobs for laborers. Properly implement the policy on unemployment insurance and social insurance for laborers. Strengthen coordination and inspection of labor safety and fire prevention.

- The Ministry of Health shall focus on the thorough treatment of dengue fever and hand-foot-and-mouth disease, preventing the reoccurance of the disease. Strengthen the application of information technology in the management of medical examination and treatment. Strictly control the distribution system, actively implement solutions to reduce drug prices for patients.

- The Ministry of Education and Training shall organize well the deployment of education and training tasks in the school year 2017-2018. Actively implement the scheme on renewal of general education programs and textbooks, to create social consensus on education reforms and innovation.

- The Committee for Ethnic Minority Affairs shall follow up with the living situation of ethnic people living in remote, disadvantaged areas, disaster-stricken areas so as to timely propose and implement policies to help people stabilize their lives, proactively produce, not to let people suffer from hunger.

- The Government Inspectorate shall monitor and urge localities to improve the quality of the reception of citizens and settlement of complaints and denunciations; promptly and resolutely resolve complaints and denunciations arising right from the grassroots level.

- The Ministry of Public Security shall actively implement plans for absolute safeguarding of APEC events in 2017 and drastically and synchronously apply measures to ensure political security and social order and safety.

- The Ministry of Foreign Affairs shall assume the prime responsibility for, and coordinate with the concerned ministries and agencies in, organizing the 2017 APEC Economic Leaders’ Week and coordinate and urge the implementation of commitments and agreements reached during high-level visits.

- Ministries, sectors and localities shall promptly elaborate the socio-economic development plan and the public investment plan in 2018 as required by the Prime Minister's Directive No. 29/CT-TTg dated July 5, 2017, and report to the Ministry of Planning and Investment for synthesis and submission to competent authorities for promulgation and implementation right at the beginning of 2018.

- The Ministry of Information and Communications shall promote communication and dissemination activities. Actively provide sufficient information, orient the public, publicize and clarify the undertakings and policies of the Party and the State as well as the management, direction and administration activities of the Government and the Prime Minister, especially the deployment of growth targets to create confidence and enthusiasm among the people, and create social consensus. The Ministry shall continue to perform well and proactively prevent false, distorted and hatred information. Communication on external activities and promotion of the image of Viet Nam shall also be strenghtened.

5. Regarding the proposed public investment plan in 2018 and implementation progress of the medium-term public investment plan for 2016-2020 period

a) Regarding the Government bond capital plan: According to the Law on the State Budget, the Government’s bond capital shall be incorporated in the State budget investment plan. The Ministry of Planning and Investment has been requested to assume the prime responsibility for, and coordinate with the Ministry of Finance in, identifying specific needs of each year in order to propose the level of allocation in the medium-term public investment plan for the 2016-2020 period. It is essential to ensure not to change the purpose of use, the structure of Government bond capital and the amount of capital to be allocated to each project using Government bonds assigned by the Prime Minister in the medium-term investment plan for 2016 – 2020 period.

b) In principle, priority order for the allocation of the State budget in 2018 as follows:

- To allocate capital for the repayment of at least 20% of the total outstanding payment for the investment in capital construction for the 2016-2020 period, which has not yet been paid;

- In 2018, to allocate capital to recover at least 20% of the advance capital  between 2016 and 2020 that has not been collected.

- Projects using ODA capital and preferential loans of foreign donors, public-private partnership projects;

- Transitional projects which are expected to be completed in 2018;

- Transitional projects which are expected to be completed after 2018 but comply with set timeline;

- Projects which will be launched in 2018, with priority given to urgent projects on flood and natural disaster prevention and control and environmental protection (after allocating sufficient capital for the above-mentioned tasks).

c) Regarding the mechanism for allocating central budget investment capital in 2018: On the basis of the list of projects under the medium-term public investment plan for the 2016-2020 period already approved by the Prime Minister, ministries and local authorities shall select specific projects according to the principles, criteria and order of priority.

The Ministry of Finance is assigned to report to the Prime Minister before October 10, 2017 and concurrently send to the Ministry of Planning and Investment details of the first-nine-month disbursement data by ministries, sectors and localities, which serves as the basis for capital allocation to ministries, sectors and localities next year in accordance with the Resolution No. 70/NQ-CP dated August 3, 2017 of the Government on major tasks and solutions to accelerate public investment disbursement.

d) Regarding the implementation results of the medium-term public investment plan for the 2016-2020 period: The Ministry of Planning and Investment shall assume the prime responsibility and coordinate with the Ministry of Finance in synthesizing and reporting on the allocation results. The medium-term public investment plan for the 2016-2020 period shall be submitted to the Prime Minister for reporting to the National Assembly at the 4th session of the 14th National Assembly. The Government will ask for the Legislature’s permission to use unallocated capital reserves of the medium-term public investment plan for the 2016-2020 period from 2019 as prescribed.

6. Regarding the draft Resolution of the Government on the sustainable development of the Mekong Delta adapting to climate change

The Ministry of Natural Resources and Environment is assigned to assume the prime responsibility for, and coordinate with the Government Office, the Ministry of Justice and other concerned Ministries, agencies and localities in, receiving comments of Cabinet members, finalizing the draft Resolution, and submitting to the Prime Minister for signing in October 2017.

7. Regarding the assignment of commune-level public employees to monitor the food safety work

To implement the National Assembly's Resolution No. 43/2017/QH14 dated June 21, 2017 on stepping up the implementation of the law on food safety in the 2016-2020 period, the Government assigns the provincial People's Committees to guide the concurrent supervision of the food safety work of commune-level public employees.

8. Regarding adjustments to the implementation timeline of new general education textbooks and programs

The Government agrees with the proposal of the Ministry of Education and Training on adjusting the timeline for commencement of the implementation of the new general education textbooks and programs in the whole country on the rolling basis for each grade as follows: new general education textbooks and programs will be applied to primary school level from 2019; secondary school level from 2020, and high school level from 2021.

The Minister of Education and Training is assigned to be authorized by the Prime Minister to act on behalf of the Government and report to the National Assembly on the adjustment of timeline to apply the new general education texbooks and programs.

9. Regarding the implementation of the tasks assigned by the Government and the Prime Minister in the first 9 months and the inspection results of the working group in September 2017.

a) The working group shall focus on examining and urging the implementation of the Prime Minister’s conclusions.

b) The Government Office shall take the lead and and coordinate with the ministries in proposing to the Government and the Prime Minister solutions to overcoming overlappings in specialized inspection in the direction to assign one ministry to take the prime responsibility for carrying out the specialized inspection of goods items which are subject to a variety of documents and two or more procedures. The Government Office shall supervise and inspect ministries in the reduction of business conditions and specialized inspection procedures, which are causing troubles, difficulties, costly expenses and time for enterprises.

10. Regarding the implementation of policies towards prestigious people in ethnic minority areas

The Government agrees with the proposal of the National Committee for Ethnic Minority Affairs to supplement and improve policies for prestigious people in ethnic minority areas to replace Decision No. 18/2011/QD-TTg and Decision No. 56/2013/QD-TTg of the Prime Minister.

The Committee for Ethnic Minorities Affairs shall assume the prime responsibility and coordinate with the Ministry of Justice, the Ministry of Finance, the Government Office and relevant ministries and agencies in gathering comments of Cabinet members and finalizing the draft Decision of the Prime Minister on the prestigious people in ethnic minority areas, and submit the document to the Prime Minister for signing in the 4th quarter of 2017.

11. Regarding the reports on the 3rd quarter implementation of the Government's resolutions and working programs of the Government and the Prime Minister, the inspection and settlement of complaints and denunciations and anti-corruption, the implementation of the Government's law- and ordinance-making program and the issuance of documents detailing the implementation of laws and ordinances, administrative reform, the implementation of Resolution No. 19-2017/NQ-CP on continuing implementation of the major tasks and solutions to improve the business environment and raise the national competitiveness in 2017, with an orientation to 2020, and the implementation of Resolution No. 35/NQ-CP on enterprise development policy to 2020

The Government assigns ministries and agencies including the Government Office, the Government Inspectorate, the Ministry of Justice, the Ministry of Home Affairs, The Ministry of Planning and Investment to collect comments of the Cabinet members, complete the reports, promulgate them according to their competence, and organize effective implementation.

12. Regarding the implementation of Resolution 36a/NQ-CP on e-Government

Ministries, sectors and localities shall concentrate on completing the tasks and solutions assigned to them in Resolution No. 36a/NQ-CP to speed up e-Government development, focusing on strengthening the National Committee on Information Technology Application, promulgating a Decree replacing Decree No. 102/2009/ND-CP dated November 6, 2009, on management of investment in the application of information technology using state budget capital; implementing the Government's Decree No. 85/2016/ND-CP dated July 1, 2016 on ensuring the security of the information system by different levels, and enhancing the assurance of information safety and security in the network environment. The Government Office shall urgently complete the establishment of the National Public Service Portal and the document management system at 4 authority levels of.

13. Regarding the classification of Viet Nam Bank for Agriculture and Rural Development and the Viet Nam Asset Management Company of Vietnamese credit institutions

The Government considered and agreed with the proposals of the State Bank of Viet Nam and the Ministry of Finance on the classification solution for Viet Nam Bank for Agriculture and Rural Development and the Viet Nam Asset Management Company of Vietnamese credit institutions.

The State Bank of Viet Nam is assigned to assume the prime responsibility for, and coordinate with the Ministry of Finance in, classifying the Viet Nam Bank for Agriculture and Rural Development and the Viet Nam Asset Management Company of Vietnamese credit institutions. The State Bank of Viet Nam shall be responsible for the assessment and rating./.
