THE GOVERNMENT-TO-LOCALITIES MEETING – DECEMBER 2019

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in November 2019, held on December 02, 2019,

DECIDES

1. Regarding the socio-economic situation in December and 2019

Despite complicated international and regional situation, numerous unfavourable factors and a number of domestic difficulties, especially natural disasters and epidemics, thanks to the strong determination of the whole political system and the efforts of the entire Party, the people as well as the whole army, the socio-economic situation in 2019 continued to witness positive changes and achieved many important and comprehensive outcomes in almost all fields. 2019 was the second consecutive year that all major targets had been achieved, in which 07 targets exceeded the plan. In the context of global economic and trade growth, the GDP growth rate of the whole year reached 7.02%, exceeding the target set by the National Assembly. Viet Nam was listed among the world's leading countries with high economic growth. Quality of growth had been improved; labour productivity increased by 6.2%. The contribution of total factor productivity (TFP) to GDP growth reached 46.11%. The country’s growth model witnessed positive shift, in which science and technology and national start-ups innovation system started to thrive. Macroeconomic conditions were relatively stable. Inflation was kept under control at 2.79%, the lowest level in the past 3 years. Financial, monetary markets and exchange rates were stable. The balance of international payment was improved. Foreign exchange reserves continued to rise, reaching USD 79 billion. State budget revenue exceeded 9.8% compared to annual estimate, making 2019 the second year in which both the central budget and the local budget exceeded the National Assembly estimate. Domestic revenue exceeded 8.5% of the estimate, state budget deficit to actual GDP ratio was 3.4%, lower than the plan (3.6%). Public debt was reduced to less than 55%, lower than the ceiling set by the National Assembly (65%). Total social investment reached 33.9% of GDP, up 10.2% compared to 2018, in which, non-state investment accounted for 46%, higher than ever. Registered foreign investment capital increased by 7.2%. Realized FDI reached a record of USD 20.4 billion. Total import and export turnover reached USD 517 billion. This was the fourth consecutive year of trade surplus, reaching up to USD 9.9 billion. The business environment continued to improve, Viet Nam's country’s competitiveness score assessed by the World Economic Forum moved up 10 places and was graded 3.5 points higher than 2018, the strongest improvement in the world. The number of newly established enterprises reached a record of 138 thousand, increasing both in number and registered capital, average capital of an enterprise reached 12.5 billion Vietnamese dong.

The fields of culture, society, health, education and training, job creation and sports witnessed noticeable changes, creating jobs for 1.65 million people. Poverty reduction achieved positive results: the percentage of poor households based on multi-dimensional standards decreased to less than 4%. Policies for people with meritorious services and social security policies were properly implemented. Due attention was paid to supporting ethnic minority people, regions with difficult socio-economic conditions, and areas affected by natural disasters. People's living standards witnessed remarkable improvement. Ethnic affairs and people mobilization contributed to consolidating the great unity bloc of the entire nation. Resource management, environmental protection, disaster prevention and response to climate change also received due attention. Administrative reform, prevention of corruption, wastefulness and negativity continued to be promoted. Information and communication work were properly implemented, contributing to creating social consensus. National defense and security were strengthened, and national sovereignty was firmly protected. Political security, social order and safety were maintained. Foreign affairs and international integration constantly expanded and developed in depth, contributing to bolstering a peaceful and stable environment for development.

Besides the above-mentioned achievements, the country still had to face with many shortcomings and limitations. Macroeconomic conditions were relatively stable, but some factors remained unsustainable. Solutions to improve the level of independence and autonomy of the economy were still slow to take-up their effectiveness. Manufacturing and trading in some areas were still difficult. Disbursement of public investment, equitization and divestment of state capital remained slow. Infrastructure development and human resource training, especially high-quality human resources, had not met the country’s requirements. And behaviours of degraded morality, domestic and in-school violence, child abuse, etc. continued to raise social concerns. Environmental pollution issues became increasingly complicated, especially air pollution in some big cities. The impacts of natural disasters and climate change became more and more severe given the current context of limited resources. Protection of sovereignty over sea and islands still faced many difficulties and challenges.

2020 was the last year of the five-year plan in 2016-2020 period and was also a year with many important events and anniversaries of the country's major holidays, the year in which the Party Congress at all levels shall be organized to elect the delegates to the 13th National Congress, the Government requested each Government Member, Chairman of People's Committee of provinces and cities under central authority to follow guidance of General Secretary and President of Viet Nam at the Congress, promptly and seriously implement the Conclusions and Resolutions of the Party Central Committee, the National Assembly, and the Government's Resolutions on the main tasks and solutions for the implementation of the Socio-economic Development Plan and the State Budget estimates in 2020 on continuing to perform key tasks and solutions to improve the business environment, enhance national competitiveness in 2020 with specific programs, plans, tasks and solutions suitable to practical conditions, promote achievements in 2019 and from the beginning of the term with the motto "Discipline, integrity, action, responsibility, creativity and efficiency" and the spirit of initiative, positiveness, creativity, solidarity, and determination to strive and make the best efforts to successfully, comprehensively, and even exceeding the goals and tasks set by the Party and National Assembly in 2020 and the whole term to create a solid foundation for the country to enter a new development stage.

Ministries and ministerial-level agencies were requested to proactively carry out local recommendations according to their assigned functions, tasks and competence. In cases beyond their competence, they were requested to report to the Government and the Prime Minister for consideration and decision-making. The Government Office was assigned to synthesize, monitor and urge ministries and ministerial-level agencies in handling local petitions.

Ministries, central agencies and provinces shall utterly implement the Directive No. 40-CT/TW dated December 10, 2019 of the Party Central Committee's Secretariat, Directive No. 33/CT-TTg dated December 19, 2019 of the Prime Minister on strengthening measures to ensure that the Lunar New Year shall be celebrated in a happy, healthy, safe and economical manner, Official Letter No. 1658/CD-TTg dated December 9, 2019 of the Prime Minister on ensuring traffic order and safety during the New Year, the Lunar New Year and the Spring Festivals in 2020.

2. Reviewing the direction and administration of the Government and the Prime Minister in 2019

Identifying 2019 as a year of acceleration and break-through, to celebrate the 50th anniversary of President Ho Chi Minh's Will, the Government set out the motto for action in 2019 as follows: "Discipline, integrity, action, creativity, breakthrough and efficiency". In the management, direction, administration, the Government and the Prime Minister always uphold the sense of responsibility to the Party, the State and the People in strictly implementing their tasks and powers in accordance with the laws and regulations as well as Government work rules, promoting the collective roles and intelligence of the Government associated with encouraging the active and responsible spirit of each Government Member, especially the role of the Prime Minister and the head of the Government, sturdily and persistently sticking to the Resolution of the Party, the Resolution of the National Assembly to accomplish the set targets and objectives in a quicker, more efficient, more practical and more comprehensive manner. It was requested to carry out all tasks with the highest determination and highest sense of responsibility, proactively monitor and promptly respond to global and domestic economic fluctuations. It was also requested to identify bottlenecks and inadequacies to improve policies and regulations, clear up and maximize full potential of all resources. It was necessary to tighten administrative discipline, conduct regular inspection, urge and closely follow up with practical situation, strongly promote and remove obstacles at local and grassroots levels, focus on directing to ensure accomplishment of set goals and targets and timely solve arising problems. Attention must be paid to improving working methodology, actively deploying electronic government and e-government at provincial level, with a view to develop a public, transparent, modern, smooth and effective administration system from the central to local levels. Information and explanation on issues of public concern must be provided in a proactive manner. It also called for the close and effective coordination among agencies of the Party, the National Assembly, the Viet Nam Fatherland Front, socio-political organizations and judicial agencies to promote the synergy of the whole system in performing their assigned tasks. The results of the direction and administration work of the Government and the Prime Minister were clearly reflected in the socio-economic development situation in 2019, which contributed to creating excitement, new spirit and new motivation in deploying the socio-economic development plan in 2020.

In addition to the achievements in direction and administration, a number of issues still existed which called for serious review and assessment to ensure better implementation. Guidelines, policies and regulations were relatively slow to come into effect in real life. Many tasks and work were implemented slowly, and obstacle resolve was not quick enough. Negative behaviours such as suspension and avoidance to fulfil assigned responsibilities, not taking any drastic action, or staying ignorant and inactive, still existed. Coordination, especially interdisciplinary collaboration, was not tight enough. Many process and procedures remained cumbersome and complicated.

Determined to bring out outcomes better than 2019, the Government requested each ministry, sector and locality to follow up with the guidance of the General Secretary and President of Viet Nam at the Party Congress, focusing on prioritized measures to resolve limitations and weaknesses which had been pointed out by applying specific solutions and actions to create clear changes. Ministries, sectors and localities were requested to constantly innovate their thinking, strengthen coordination in the formulation, improvement and implementation of policies and laws. Attention should be paid to removing difficulties and obstacles for production and business to promptly meet practical requirements, creating favourable conditions for businesses and the people; beefing up, mobilizing and effectively using all resources, freeing up all production capacities, making good use of potential strengths, promoting the application of science and technology, and innovation, improving the quality of human resources, tightening administrative order and discipline, regularly inspecting, urging and creating drastic changes in the performance of official duties; improving morality, culture, professionalism of cadres, civil servants and public employees. It was requested to maintain perseverance attitude and resolutely strive to fight against corruption, wastefulness and negativity, improve working practices, further raise the effectiveness and efficiency of direction and administration, promote decentralization associated with invigorating accountability of the head and control of authority. Strict sanctions against violations was of great significant. It was requested to continue to strictly implement the Resolution of the 4th Central Party (Term 11th) and (Term 12th) on strengthening the building, reorganizing the Party, preventing and repelling the decline in political ideology, morality, lifestyle, the "self-evolving" and "self-transforming" expressions associated with studying and following Ho Chi Minh's ideology, morality and style. The Government requested each ministry, sector and locality continue to implement the Resolution of the 6th Central Party (Term 12th) on continuing to renovate and streamline the apparatus to ensure its effective and efficient operation, renovate the organization and management system, improve the quality and performance of public non-business units. It was also necessary to urgently and seriously follow the Resolution of the Central Committee and Directive No. 35-CT/TW dated May 30, 2019 of the Politburo, focusing on leading and directing the successful organization of the Party Congress at all levels in preparation for the election of delegates to the 13th National Congress.

3. Regarding the implementation results of Resolution No. 01/NQ-CP and 02/NQ-CP dated January 1, 2019, draft Resolution on key tasks and solutions to implement the socio-economic development plan and the state budget estimate in 2020, the draft Resolution on continuing to implement key tasks and solutions to improve business environment and enhance national competitiveness in 2020

The Ministry of Planning and Investment was assigned to assume the prime responsibility for and coordinate with the Government Office and concerned ministries and agencies in collecting comments from the Government members, finalizing the draft Resolution of major practical tasks and solutions to implement the socio-economic development plan and the state budget estimate in 2020 and the draft Resolution on continuing to perform key tasks and solutions to improve business environment and enhance national competitiveness by 2020. This shall be submitted to the Prime Minister for signing for promulgation on January 1, 2020.

4. Regarding the results of economic restructuring and growth model renovation

In order to make a clearer change of the growth model and to bring the country to a new development ladder, the Government required ministries, sectors and provinces to continue identifying tasks of economic restructuring and growth model renovation as the top priority of their management work in 2020. Each ministry, sector and province must proactively promote the issuance of solutions to foster the implementation of the tasks of economic restructuring in the 2016-2020 period, ensuring to fulfil the set objectives, in which, attention must be paid to drastically and effectively implementing important groups of tasks on economic institutional improvement, market development of production factors, restructuring of state-owned enterprises, public investment, credit institutions, as well as sectors and fields, development of regional economy and marine economy, renovation of management approach, improving the effectiveness and efficiency of state management. For targets which could not be accomplished, ministries, sectors and provinces were requested to proactively report, identify causes and propose to the Government and the Prime Minister solutions to promptly handle them.

5. Regarding the results of administrative procedure reform, e-government development and activities of the Government’s Working Group in 2019

a) On reforming administrative procedures and improving the business environment:

- Ministries and sectors shall formulate a plan to cut down on regulations on business activities of enterprises in the 2020-2025 period, ensuring to abolish at least one old conflicting regulation document to reduce compliance costs for residents and businesses upon the issuance of a new legal document.

- Specialized inspection activities were requested to be reformed in the direction of promoting electronification, application of electronic customs, in compliance with international standards, concentrating specialized inspection at the border gate customs authorities. Post-inspection shall be carried out by specialized management ministries.

- It was requested to promote the roles of the Working Group and the Advisory Council on reform of administrative procedures of the Prime Minister in the dialogue, research and proposing solutions to remove problems on mechanisms, policies and administrative procedures, to maintain dialogue between state agencies and the business community, to promptly remove obstacles and improve the business environment.

b) Regarding the development of e-government:

- Ministries, sectors and provinces shall continue to strictly implement and fulfil the targets and tasks set for 2020 stated in the Government's Resolution No. 17/NQ-CP dated March 7, 2019. Special attention shall be paid to urgently completing overdue tasks, striving to increase the rate of online public services at level 4 by 30% by 2020, 100% of state agencies publicizing people's satisfaction level when using online public services, 100% of ministries, sectors and provinces having an integrated data sharing platform (LGSP) and adopting centralized security monitoring and management measures.

- Ministries and agencies shall, based on their assigned tasks, urgently submit to the Government for promulgation of Decrees in the first quarter of 2020 to complete the foundation institution of the E-Government including: a Decree replacing Decree No. 110/2004/ND-CP, regulations on electronic identification and authentication, a Decree on management, connection and sharing of digital data, a Decree on personal data protection, and a Decree on the implementation of administrative procedures on the electronic environment.

- Ministries, sectors and provinces shall continue to review, standardize and restructure the professional process of online administrative procedures at third and fourth levels on Public Service Portal of ministries and provinces, which shall be integrated into the National Public Service Portal in accordance with the roadmap approved by the Prime Minister (integration of 30% of total public services/total online public services by 2020 and increasing by 20% for each year).

- By June 2020, the task of sending and receiving electronic documents at 4 levels of government must be completed. This was to step by step put into operation an Information System for policy consultation, a National Reporting Information System and upscale the Information System for meetings and work handling by the Government (E-Cabinet), and an Information System for managing documents under the direction of the Prime Minister.

c) The Working Group of the Prime Minister shall continue to inspect and urge the implementation of tasks assigned by the Government and the Prime Minister, focusing on thematic inspection of institutional development and improvement according to programs/plans, resolutions to remove overlapping regulations, the implementation of Resolution No. 01/NQ-CP, Resolution No. 02/NQ-CP of the Government in 2020 and the implementation of important thematic Resolutions with great scope of impacts, involving reform direction and socio-economic development objectives. At the same time, attention must be paid to urging and inspecting the completion and submission of outstanding law projects of the Work Program in 2019 and the implementation of the Work Program in 2020.

6. Regarding the implementation of Resolution No. 35/NQ-CP dated May 16, 2016 and Directive No. 26/CT-TTg dated June 6, 2019

In the spirit of accompanying businesses, the Government requested:

- Ministries, sectors and provinces effectively implement the Law on Support for Small- and Medium-sized Enterprises, focusing on supporting policies on tax, capital, technology ..., to promote innovative startups, especially innovation in sectors with great advantages and potential linked with regional and global value chains, encourage business households to register as enterprises, as well as implement the Plan on Sustainable Development of the Private Sector till 2025, with a vision to 2030 with specific programs and plans.

- Business organizations and associations actively coordinate with state management agencies to recommend policies to foster enterprise development, develop specific and feasible programs and solutions to continue improving the quality of activities, properly perform the role of supporting member businesses, and function as an effective bridge between businesses and the Government.

- Enterprises actively innovate production and business thinking, attaching importance to innovation, application of advanced science and technology, strengthening linkage and cooperation, improving governance capacity in the context of integration, aiming at the sustainable development goals.

7. Regarding the implementation results of Resolution No. 139/NQ-CP dated November 9, 2018 on the Program of action to reduce costs for enterprises

The Ministry of Planning and Investment was assigned to assume the prime responsibility for and coordinate with the concerned ministries and agencies in drafting a Directive on the continued implementation of solutions under Resolution No. 139/NQ-CP dated November 9, 2018 with a view to achieve the targets set by 2020 and proposing the organization of a national conference on improving the business environment, improving competitiveness, and reducing costs for enterprises according to the Resolution No. 02/NQ-CP and Resolution No. 139/NQ-CP of the Government. This shall be reported to the Prime Minister in the first quarter of 2020.

8. Regarding the draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations

The Ministry of Justice was assigned to assume the prime responsibility for and coordinate with the Government Office and the concerned ministries and agencies in collecting comments from the Government Members, revising and completing the draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations. The Minister of Justice was authorized by the Prime Minister to act on behalf of the Government to sign the draft Law and report to the National Assembly.

9. Regarding the Proposal to develop (revised) Law on Insurance Business

In principle, the Government agreed to approve the policies in the Proposal to develop the (revised) Law on Insurance Business.

The Ministry of Finance was assigned to assume the prime responsibility for and coordinate with the concerned ministries and agencies in collecting comments from the Government Members, improving the provisions in the Proposal to formulate the Law, revising the Summary Report on the implementation of the Law on Insurance Business in 2000, the Policy Impact Assessment Report, completing the application for development of the (revised) Law on Insurance Business in accordance with the Law on Promulgation of Legal Documents, and to submit to the Ministry of Justice for supplement to the Law- and Ordinance-Making Program of 2021 for the Government’s review and decision-making on its submission to the National Assembly Standing Committee.

10. Regarding the Proposal to formulate the (revised) Law on Drug Prevention and Control

In principle, the Government agreed to approve the policies in the Proposal to develop the (revised) Law on Drug Prevention and Control.

The Ministry of Public Security was assigned to assume the prime responsibility for and coordinate with the concerned ministries and agencies in collecting comments from the Government Members, reviewing, evaluating and improving provisions to fully and comprehensively express the undertakings and views of the Party and the State on drug prevention and combat in the new context, ensuring the consistency and synchronization with a number of relevant laws. The Ministry of Public Security shall complete the application for law development in accordance with the Law on Promulgation of Legal Documents and submit it to the Ministry of Justice for supplement to the Law- and Ordinance-Making Program of 2020 for the Government’s review and decision-making on its submission to the National Assembly Standing Committee.

11. Regarding Proposal to formulate the (revised) Law on Inspection

In principle, the Government agreed to approve the policies in the Proposal to develop the (revised) Law on Inspection

The Government Inspectorate was assigned to assume the prime responsibility for and coordinate with the concerned ministries and agencies in collecting comments from the Government Members, improving provisions in the Proposal to formulate the Law, especially impact assessment and policy implementation solutions, logical relationship between policies. The Government Inspectorate shall complete the application for law development in accordance with the Law on the Promulgation of Legal Documents and submit it to the Ministry of Justice for supplement to the Law- and Ordinance-Making Program of 2021 for the Government’s review and decision-making on its submission to the National Assembly Standing Committee. At the same time, the Government Inspectorate shall proactively review, evaluate, and develop lists of legal documents that need to be amended, supplemented with specific time limit for completion to ensure their consistency and alignment with the proposed amended or supplemented contents.

12. Regarding the receipt of used marine scientific research vessels from Japan

The Government unanimously agreed with the proposal of the Ministry of Natural Resources and Environment on the receipt of Vessel Kaiyo Maru No. 2 based on the inspection and evaluation results of an independent consultancy service provider on the vessel's quality, which met all requirements for its operation and use in Viet Nam for 7-10 years. The Ministry of Natural Resources and Environment shall assume the prime responsibility for and coordinate with the Ministry of Foreign Affairs in proposing the Japanese side to repair and upgrade the vessel at the opinion of the independent appraisal unit, ensuring that the vessel can be put into use immediately upon Viet Nam’s reception. The reception, management and use of the vessel as well as related expenses must comply with Decision No. 37/QD-TTg dated June 7, 2019, approving the Scheme on receiving, managing and using marine scientific research ships presented by Japan.

13. Regarding the development of a Resolution of the Standing Committee of the National Assembly promulgating principles, criteria and norms for allocation of public investment capital from the state budget in the 2021-2025 period according to simplified order and procedures

The Government unanimously agreed with the proposal of the Ministry of Planning and Investment to report to the Standing Committee of the National Assembly for the approval of the Resolution of the Standing Committee of the National Assembly to promulgate principles, criteria and norms for allocation of public investment capital from the state budget in the 2021-2025 period according to simplified order and procedures. The Ministry of Planning and Investment was assigned to collect comments of the Government Members, urgently complete the Government's Report, and report to the Prime Minister for consideration and comments before the Minister of Planning and Investment was authorized by the Prime Minister to act on behalf of the Government to report to the Standing Committee of the National Assembly.

14. Regarding the review and survey of economic and technical norms as a basis for medical service price adjustment

The Ministry of Health was assigned to urgently assume the prime responsibility for and coordinate with the Ministry of Finance and Viet Nam Social Insurance in aligning plans and conducting an independent survey to review, amend, supplement and overcome inadequacies in the economic and technical norms of medical services, in which the mandatory level must be clearly stipulated to ensure quality control of health services and interests of participants of health insurance, medical examination and treatment facilities, to avoid loss and waste of health insurance fund. The survey shall be completed, and results shall be reported to the Prime Minister in June 2020.

15. Regarding Report on public administration reform and Report on inspection and settlement of complaints and denunciations and fight against corruption in 2019

The Ministry of Home Affairs and the Government Inspectorate were assigned to organize and strictly implement their assigned tasks, programs, and work plans, to create clearer changes in the work of their branches in 2020.

16. Regarding the implementation of the Government's Law- and Ordinance-Making Program and the promulgation of documents detailing the implementation of laws and ordinances in 2019

The Government requested:

- Ministers and heads of ministerial-level agencies concentrate on directing the drafting and submission of laws and ordinances under the National Assembly's 2020 Law- and Ordinance-Making Program according to their respective assignment, ensuring their quality and completion within specified schedule. At the same time, they were requested to urgently complete and submit to the Government for promulgation pending Decrees and Decrees detailing 05 Laws which shall take effect from January 1, 2020, as well as actively draft documents detailing laws that shall take effect after June 2020.

- Ministries and ministerial-level agencies shall take initiative in coordinating and revising Laws approved by the 14th National Assembly at its 8th session and at the same time closely coordinate with the Government Office and the Ministry of Justice in the process of drafting, adjusting, perfecting and submitting for promulgation legal documents as assigned and in preparing the Government's Proposals on the Law- and Ordinance-Making Program in 2021 and adjusted Program in 2020./.
