RESOLUTION

THE GOVERNMENT’S REGULAR MEETING – NOVEMBER 2019

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in November 2019, held on December 02, 2019,

DECIDES

1. Regarding the implementation of the Government’s Resolutions No. 01/NQ-CP and the socio-economic situation in November and the first 11 months of 2019

The Government unanimously agreed that: The socio-economic situation in November and the first 11 months of 2019 continued to witness positive changes. Macroeconomic conditions were relatively stable. Inflation was kept under control. Average consumer price index (CPI) of the first 11 months increased by 2.57%, the lowest in the last 3 years. Lending interest rates for priority areas tended to decrease. State budget revenue reached 97.5% of the annual estimates. Implemented FDI increased by 7.2% over the same period. Agricultural, forestry and fishery production witnessed stable development; poultry production increased by 12%; aquaculture production increased by 5.7%, particularly aquaculture production in November increased by 7.9%; the African swine cholera had been kept under control. Industrial production increased significantly, the index of industrial production (IIP) up by 9.3% over the same period. Total retail sales of consumer goods and services increased by 11.8%, particularly in November 2019 retail sales grew by 12.6%, the highest growth rate in the last 6 years. The number of international visitors continued to rise sharply, reaching over 1.8 million in the month, the highest ever. Collectively for 11 months, this number was aggregated at nearly 16.3 million, up by 15.4%. Export increased by 7.8%; trade surplus reached US$ 9.1 billion, in which exports of the domestic economic sector increased by 18.1%, much higher than the foreign invested sector (3.8%). The whole country had 126.7 thousand newly established businesses, up 4.5% in terms of the number of businesses and up 27.5% in terms of registered capital. The fields of culture, society, health care, education, social security, science and technology, job creation, environmental protection, information and communication continued to receive due attention. People's living standards had been improved; the number of hungry households decreased by 34.2%. Sports had made a number of encouraging achievements. National defines, security and social order and safety were maintained. Foreign affairs had been strengthened and achieved many positive results.

In addition to the above-mentioned achievements, Viet Nam’s economy still had a number of limitations and faced various difficulties and challenges. Industrial production tended to slow down. Prices and export turnover of many key agricultural commodities declined. Disbursement of public investment had not changed much. Production and business in some areas still faced with numerous difficulties. The number of enterprises temporarily suspending their business, suspending their activities and waiting for dissolution, undergoing dissolution had increased. Deforestation still occurred in many places, especially in the Central Highlands. Many social problems arose, causing social concerns. Security and order, traffic accidents, fires, air pollution in some places were relatively complicated.

In the last month of 2019, the Government requested all levels and sectors to not be subjective, continue to implement drastically and synchronously the proposed solutions to exceed the targets and objectives assigned by the National Assembly in 2019 to create a solid foundation for the implementation of socio-economic development plan and state budget estimates in 2020. The Government members were requested to develop specific solutions to timely overcome the shortcomings and limitations in their respective branches and fields, especially those raised by voters and the National Assembly at the last session. And at the same time, Government members were requested to proactively set out the direction of tasks, solutions and actively prepare necessary conditions, ensuring the implementation of the 2020 plan right from the beginning of the year. Attention shall focus on the following contents:

- Ministries, agencies and localities shall continue to closely monitor world and regional economic developments, market supply and demand movements, and prices of essential commodities to have appropriate macro political-administrative solutions in stabilizing market prices, prioritizing inflation control, maintaining macroeconomic stability, promoting production, business and export development at the end of the year and the upcoming Lunar New Year.

- Each ministry and branch shall closely follow up with the growth scenario, formulate timely and appropriate management solutions to promote the development of production and business in their respective sectors and fields, ensuring to fulfil and achieve the maximum results for the set targets. They were requested to actively urge, remove obstacles, accelerate the disbursement of public investment capital in the 2019 plan to ensure achievement of the highest results, especially for large and important projects, to create a driving force for socio-economic development. It was also necessary to strengthen supervision and prevention of corruption, wastefulness, group benefits, and ensuring efficient use of public investment.

- The State Bank of Viet Nam shall continue to proactively, flexibly, prudently operate monetary policy, creating favourable conditions, meeting the demand for credit capital for production and business activities, especially for priority industries and areas. It was requested to ensure monetary security and safety in the context of the digital economy, as well as the smooth monetary circulation, especially at the end of 2019 and early 2020. The State Bank of Viet Nam shall continue to implement measures to enhance access to credit capital for production, business and legitimate consumption needs of the people, contributing to restricting black credit.

- The Ministry of Finance shall focus on directing the completion of the state budget plan in 2019, striving to increase state budget revenues higher than the result reported to the National Assembly, contributing to creating more investment resources for important and urgent projects and works, and for the salary reform. The Ministry of Finance shall coordinate with the Ministry of Industry and Trade to direct provinces to strengthen prevention and combat of smuggling, trade frauds and fake goods, as well as strictly handle violations according to regulations.

- The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with the Ministry of Finance in reviewing the allocation of public investment capital, avoiding over-allocation or under-allocation of capital plans, completing the task of assigning the plan in 2020 before December 31, 2019. The Ministry of Planning and Investment shall urge other ministries, branches and provinces to actively implement the solutions set out in Resolution No. 94/NQ-CP dated October 29, 2019 of the Government and the Prime Minister's direction on the implementation and disbursement of public investment in 2019. The Ministry shall proactively review and submit to the competent authorities to adjust the state budget investment plan in 2019 of the projects that were slow in disbursing their assigned budget or unable to carry over to projects with higher disbursement potential to speed up their completion and put them into use.

- The Government unanimously agreed with the report on the allocation of public investment plans in 2020 for projects using 10% of state budget reserves in localities having investment decisions or decisions on investment preparation and investment preparation estimates after October 31, 2019, which had been implemented according to the provisions of Clause 4, Article 3 of the Government's Working Regulation issued together with Decree No. 138/2016/ND-CP dated October 1, 2016.

- The Ministry of Industry and Trade shall focus on directing and removing difficulties and obstacles in development of industrial production, supporting and creating favourable conditions for the implementation of industrial projects, especially key and large-scale projects, to increase production capacity. The Ministry shall continue to diversify export markets, while maintaining stability of key markets, collaborate with relevant ministries and agencies in formulating trade rules, standards and barriers to protect domestic production and trade in accordance with international practices and commitments. It shall continue to implement solutions to improve the quality and competitiveness of Vietnamese products, build Vietnamese brands in the context of integration, foster the implementation of the Campaign on "Vietnamese people prioritize using Vietnamese goods" to promote domestic consumption, strengthen competition management and consumer protection, prevent fake goods and poor quality goods, especially at the end of the year and during the Lunar New Year. The Ministry shall direct provinces to work out plans to properly prepare the supply of essential goods for the people, especially for people in remote areas, border areas, islands and areas affected by natural disasters, floods and storms, making sure not to increase food and foodstuff prices. The Ministry of Industry and Trade shall accelerate the approval process for the EU-Viet Nam Free Trade Agreement (EVFTA) in the first half of 2020, and report to the Prime Minister on the structure of electricity sources and regulations on calculation of solar power prices.

- The Ministry of Agriculture and Rural Development in coordination with the Ministry of Industry and Trade shall develop a plan to stabilize pork prices at the end of the year, so as not to allow the occurrence of supply shortages, causing price fever. The Ministry of Agriculture and Rural Development shall review and evaluate the effectiveness and take measures to restructure fishing fleets in accordance with Decree No. 67/2014/ND-CP, ensuring the fishing capacity in alignment with marine resources. The Ministry shall expand the official export markets of agricultural products, have solutions to ensure efficient and sustainable development and production of agricultural products, expeditiously deploy the directions of the Government and the Prime Minister on supporting provinces damaged by natural disasters and epidemics, as well as monitor and take initiative in prevention and control of epidemics on plants and animals.

- All levels and sectors shall create favourable conditions for production and business activities, unfreeze resources, avoid overlapping inspection and examination. The Government Inspectorate shall assume the prime responsibility and coordinate with the concerned Ministries and agencies in reporting to the Prime Minister solutions to overcome inspection and examination overlapping.

- The Prime Minister shall establish a special Working Group headed by the Minister of Justice with the participation of related Ministries and agencies to review overlapping, inadequate and inappropriate legal regulations which caused difficulties, hindering development. A list of legal documents that need amendments and supplements shall be developed to submit to competent authorities for consideration and decision-making.

- The Ministry of Justice, by adopting practices of participating in international dispute settlement, shall lead and coordinate with the Ministry of Planning and Investment and related Ministries and agencies to review the causes and rectify the law enforcement and key issues in negotiating international treaties with commitments on investment protection, proposing solutions to minimize international disputes, improving national regulations, and reporting to the Prime Minister.

- The Ministry of Labor, Invalids and Social Affairs shall continue to properly implement social welfare policies, focusing on deploying the policies for people with meritorious services, taking care of social protection beneficiaries and the poor, especially before, during and after the Lunar New Year. The Ministry shall promote and improve the effectiveness of vocational training and job creation, strengthen labour safety inspection, fire and explosion prevention.

- The Ministry of Health shall urgently direct the pilot of 4 hospitals under the Ministry of Health according to the Government's Resolution No. 33/NQ-CP dated May 19, 2019; in which, on the provision on organization and personnel (Point a. 2, Section II, Article 1), the Chairman of the Management Board shall not concurrently be the Hospital General Director/Director during the pilot period.

- The Ministry of Science and Technology shall strongly develop the national innovation start-up ecosystem, which shall be closely linked with regional and international start-up communities, to encourage start-ups to innovate and quickly bring scientific and technological achievements into practice.

- The Ministry of Culture, Sports and Tourism shall boost up promotion, advertisement and improvement of the quality of tourist services to attract tourists, as well as continue to promote high-achievement sports, gradually affirming Viet Nam's position in the region and the world.

- The Ministry of Transport shall formulate a plan to ensure traffic safety at the end of the year and best serve the travel needs of the people during the Lunar New Year, expeditiously deploy the system of automated non-stop toll collection and report to the Prime Minister on matters beyond their competence. The Ministry shall focus on directing and ensuring the progress of the implementation of key transport projects, and urgently select contractors to implement the My Thuan - Can Tho highway project.

- The Ministry of National Defense shall continue to strengthen national defense, territorial sovereignty protection, proactively respond and promptly handle situations, effectively prevent conspiracy and sabotage activities. Together with other related Ministries, branches and provinces, the Ministry of National Defense shall bolster the dissemination of regulations and guide fishermen not to fish in foreign waters.

- The Ministry of Public Security shall effectively strive to prevent and combat conspiracy of hostile and reactionary forces, actively deploy solutions to prevent and combat crimes, law violations, strictly handle violations, especially acts of organized illegal cross-border trafficking, human trafficking, black credit and gangsters; focusing on suppressing crimes, especially drug and criminal crimes, strengthening prevention and deterrence of negative behaviours in the functional forces, strengthening fire prevention and fighting, and ensuring traffic safety and order.

- The Ministry of Foreign Affairs shall develop specific programs and action plans to implement the tasks of the ASEAN Chairmanship in 2020 and non-permanent member of the United Nations Security Council; closely coordinate with the concerned Ministries and branches in promptly deploying the development of thematic contents and contents of the three main pillars of the ASEAN Chairmanship in 2020. Together with other Ministries and branches, the Ministry of Foreign Affairs shall properly implement the outcomes of the 35th ASEAN Summit, the ASEAN-Republic of Korea Commemorative Summit and the official visit to the Republic of Korea by the Prime Minister.

- The ministries of National Defense, Public Security and Foreign Affairs shall take initiative in coordinating in monitoring the situation and making plans in a timely manner to protect sovereignty over sea and islands, prevent being passive and unprepared in any situation.

- The Government Office shall urgently lead and coordinate with Ministries and sectors to build and finalize the draft Directive on strengthening measures to ensure the celebration of the Lunar New Year be organized in a happy, healthy and economical manner, and submit it to the Prime Minister for review and promulgation before December 15, 2019.

- The Ministry of Information and Communications shall urgently submit to the Government the Decree on electronic authentication and identification, properly prepare the contents for the meeting of the National Committee on E-Government to review the implementation of Resolution No. 17/NQ-CP dated March 7, 2019 of the Government, and formulate the orientation to implement e-Government in 2020. The Ministry of Information and Communications shall coordinate with the State Bank of Viet Nam to draft the Prime Minister's Decision on the mobile money pilot. The Ministry was requested to enhance the assurance of network information security and safety, as well as security and safety control of the surveillance camera system. The Ministry shall direct the news and media agencies to actively communicate and propagate the results of socio-economic development of the country, the undertakings of the Party, policies and laws of the State, and executive solutions of the Government and the Prime Minister, contributing to creating consensus and strengthening social trust, promptly reject bad, toxic or false information.

- Ministries, agencies and provinces shall urgently deploy the Conclusions of the Politburo, the Resolution of the 11th Plenum of the 12th Party Central Committee, Resolutions and Laws passed by the 14th National Assembly at the 8th session.

2. Regarding the Government's draft Resolution on major tasks and solutions to direct and administer the socio-economic development and the State budget estimates in 2020

The Ministry of Planning and Investment was assigned to assume the prime responsibility for collecting the Prime Minister's conclusions in Notice No. 408/TB-VPCP dated December 1, 2019, comments of the Government members, comments of related Ministries and agencies to finalize the draft Resolution, in which the Ministry of Planning and Investment was requested to provide specific solutions, tasks, clear responsibilities with the highest effort and in the spirit of building an independent and autonomous economy, which constantly improves productivity, quality, efficiency and competitiveness, developing sustainably, integrating deeper in regional and global production networks and value chains. The economy must promote dynamic competition but also foster social and environmental safety and sustainability, ensuring the maintenance and consolidation of a stable macro-economic foundation and major balances of the economy, while creating a solid premise for the new period. Attention must be paid on institutional review and improvement; drastically restructuring the economy; finding new room for growth; promoting the drastic application of the Fourth Industrial Revolution associated with the development of human resources; clearing and maximizing all resources, strongly promoting the role of key economic regions, big cities and digital economies; speeding up the equitization and divestment of state capital in enterprises; strongly developing the private and collective economy in the spirit of the Central Resolution, striving to have at least 1 million enterprises by the end of 2020; accelerating the progress of important national projects, key and urgent projects; continuing to improve the business environment and formulate specific plans and solutions to increase national competitiveness by 10 ranks; attaching importance to cultural and social development, people's health care, social security assurance and people's life improvement, effective implementation of sustainable poverty reduction and development of national development target programs to develop Socio-economic conditions in ethnic minority and mountainous areas in the 2021-2030 period; managing natural resources and environment in response to climate change, especially in the Mekong Delta region; streamlining organization, reorganizing administrative apparatus and public non-business units associated with reform of wage and social insurance policies under the Central Resolution; promoting the prevention and fight against corruption and waste; improving the effectiveness of foreign affairs and international integration activities, properly fulfill the duties of the ASEAN Chairman, the non-permanent member of the United Nations Security Council and the 41st AEPA Chair; continuing to consolidate national defense and security, ensuring social order and safety; promoting information and communication, spreading the aspiration for a powerful Viet Nam; promoting patriotic emulation movement to welcome the Party Congress at all levels, towards the 13th National Party Congress.

Ministers, heads of ministerial-level agencies and government-attached agencies shall directly provide comments on the draft Resolution and send them to the Ministry of Planning and Investment before December 10, 2019. The Ministry of Planning and Investment and Investment shall assume the prime responsibility for and coordinate with the Government Office in reviewing and finalizing the draft Resolution and reporting to the Prime Minister before December 15, 2019.

The Deputy Prime Ministers shall directly direct the development and approval of the contents of the draft Resolution of their respective branches or domains before submitting it to the Prime Minister for comments and agreement on implementation approach at the Government's meeting with provinces on December 30, 2019.

3. Regarding the proposal to develop a Law Amending and Supplementing a Number of Articles of the Intellectual Property Law

The Government unanimously agreed to approve the policies mentioned in the Proposal to develop a Law Amending and Supplementing a Number of Articles of the Intellectual Property Law. The Ministry of Science and Technology was assigned to assume the prime responsibility for collecting comments of the Government members, finalizing the dossier of request for development of this Law as prescribed.

4. Regarding the Proposal to develop a (revised) Law on Cinematography

The Government unanimously agreed to approve the policies mentioned in the Proposal to develop a (revised) Law on Cinematography. The Ministry of Culture, Sports and Tourism was assigned to assume the prime responsibility for collecting comments of the Government members, finalizing the dossier of request for development of this Law as prescribed.

5. Regarding the Proposal to develop a (revised) Law on Road Traffic

The Ministry of Transport and the Ministry of Public Security were assigned to coordinate with the Ministry of Justice and concerned Ministries and agencies in clarifying the scope of (revised) Law on Road Traffic; clearly identify contents and responsibilities for state management of the Ministry of Transport and the Ministry of Public Security in road traffic and the necessity of the proposal to develop a Law on Ensuring Road Traffic Order and Safety .

The Ministry of Transport was assigned to assume the prime responsibility for collecting comments of the Government members to complete the dossier of request for the development of a (revised) Law on Road Traffic as prescribed and report it to the Prime Minister for review and decision-making.

6. Regarding the request for amendment of Decree No. 20/2017/ND-CP on tax administration for enterprises having associated transactions

The Government unanimously agreed to amend and supplement Decree No. 20/2017/ND-CP dated February 24, 2017 on tax administration for enterprises having associated transactions according to simplified order and procedures. Accordingly, attention shall focus on revising the contents of Clause 3, Article 8 at the proposal of the Ministry of Finance (Report No. 175/TTr-BTC dated November 29, 2019). The Ministry of Finance was assigned to expeditiously complete the draft Decree and submit it to the Government for review and promulgation in December 2019.

7. Regarding the domestic financial mechanism for investment project on building Viet Nam - Japan University

The Government unanimously agreed that:

- Regarding the domestic financial mechanism for investment project on building an university: A mixed mechanism shall be applied, of which 90% of the project expenses shall be allocated from the State Budget, Ha Noi National University shall borrow the remaining 10% by using Japanese loans, and arrange the co-funding capital of US$ 0.43 million for interest payment during the university construction process, remaining co-funding capital of US$ 28.6 million shall be mobilized from the State Budget.

- Regarding specific financial mechanism for Viet Nam - Japan University: In principle, support for Viet Nam - Japan University shall be similar to support for Viet Nam - Germany University and University of Science and Technology Ha Noi (Viet Nam - France University).

Ha Noi National University was assigned to expeditiously complete the report on specific financial mechanism for Viet Nam - Japan University, and submit it to the competent authorities for review and decision-making.

The Ministry of Finance was assigned to propose and report to the Government the amendment of Decree No. 97/2018/ND-CP dated June 30, 2018 in the direction of the Prime Minister deciding a number of special cases.

The Ministry of Planning and Investment was assigned to expeditiously submit to the Government a draft Decree replacing Decree No. 16/2016/ND-CP dated March 16, 2016 and Decree No. 132/2018/ND-CP dated October 1, 2018 in the direction of the Prime Minister deciding a number of special cases for the contents of reciprocal capital support for projects using ODA and concessional loans.

8. Regarding the plan to increase charter capital for joint stock commercial banks with more than 50% of charter capital owned by the State and Agribank

The Ministry of Finance was assigned to assume the prime responsibility for, and coordinate with the State Bank of Viet Nam, the Ministry of Justice and related agencies to urgently submit to the Government for review and promulgation of a Decree amending and supplementing Clause 2, Article 12 of Decree No. 91/2015/ND-CP (amended and supplemented in Clause 5 Article 1 of Decree No. 32/2018/ND-CP) in December 2019 according to simplified order and procedures.

The State Bank of Viet Nam and the Ministries of Finance, Justice, Planning and Investment were requested to strictly implement the Prime Minister's guidance in Document No. 3529/VPCP-KTTH dated November 30, 2019.

9. Regarding the expense settlement for the procurement of special-use cars of the An Giang Provincial Police Department and the Quang Ninh Provincial Police Department

The Government agreed to allow the Ministry of Public Security to finalize the settlement dossier for the procurement of special-use cars of the An Giang Provincial Police Department and the Quang Ninh Provincial Police Department according to the prescribed regime as proposed by the Ministry of Public Security (in Letter No. 958/BC-BCA-H01 dated November 30, 2019). The Ministry of Public Security was assigned to direct the An Giang Provincial Police Department and the Quang Ninh Provincial Police Department to draw experience from this.

10. Regarding the inspection results of the Working Group in November

a) Regarding the Work Program: Ministers were requested to base on their assigned tasks, directly instruct and urgently complete the 54 outstanding law projects out of 431 assigned projects. And at the same time, they were requested to ensure the implementation progress of 75 projects in the Work Program in December 2019.

b) Regarding the detailing documents: Ministers were requested to base on their assigned tasks, directly instruct and urgently complete the 10 outstanding Decrees, not to allow any further delays or existence of any legal gap

c) Regarding C/O issuance and origin fraud

The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with the Government Office in urgently collecting comments from the Government members, finalizing the Government's draft Resolution on a number of urgent measures to enhance state management and prevention of origin frauds, and submitting it to the Government for review and promulgation before December 15, 2019.

d) Regarding the National Public Service Portal

Ministries, agencies and provinces were requested to closely coordinate with the Government Office to review and restructure processes and technical solutions before putting online public services on the National Public Service Portal, especially for services connected in the first quarter of 2020.

11. Regarding the Report on the signing of an Agreement on visa exemption for holders of diplomatic or official passports between the Government of the Socialist Republic of Viet Nam and the Government of the Federal Republic of Nigeria

The Government unanimously agreed with the Report on the signing of an Agreement on visa exemption for the holders of diplomatic or official passports between the Government of the Socialist Republic of Viet Nam and the Government of the Federal Republic of Nigeria, which had been deployed in compliance with Clause 4, Article 3 of the Government's Working Regulation issued together with the Government's Decree No. 138/2016/ND-CP dated October 1, 2016.

12. Regarding extension of visa exemption for citizens of several countries

The Government unanimously agreed to extend visa exemption for citizens of Russia, Japan, the Republic of Korea, the Kingdom of Denmark, the Kingdom of Norway, the Kingdom of Sweden, the Republic of Finland and the Republic Belarus entering Viet Nam until December 31, 2022 with the duration of temporary residence in Viet Nam not exceeding 15 days from the date of entry, regardless of passport type and purpose of entry on the basis of meeting all conditions prescribed by the Vietnamese law./.
