RESOLUTION

The Government’s regular meeting – March 2013

The Government on March 28 and 29 convened its regular meeting to discuss and decide the following issues:

1. Reports on socio-economic performance in March and Q1, 2013; the implementation of Resolution 01/NQ-CP and Resolution 02/NQ-CP; administrative reform; inspection work; settlement of complaints and denunciations, and anti-corruption; the realization of Government regular meeting Resolutions, the Government’s working program in Q1, 2013 presented by the Ministry of Planning and Investment; the Ministry of Home Affairs, the Government Inspectorate and the Office of Government.

The Government agreed that in Q1, ministries, agencies and localities positively implemented the Resolutions of the Party Central Committee, the National Assembly and the Government, especially Resolution 01/NQ-CP on major solutions guiding the realization of socio-economic development and state budget estimate in 2013 and Resolution 02/NQ-CP on solutions to remove difficulties against production and business, support the market and deal with non-performing loans. The macro-economy gained some outcomes -- GDP expanded 4.89% in Q1, which was higher than the same period last year; inflation was put under control; CPI went up 2.39% against December 2012 but was lower than the same period over the last four years. Interest rates were on the decline, liquidity of the banking system was improved; exchange rates and foreign exchange market were stabilized and foreign reserve increased. Exports continued to surge and imports of equipment and materials for production rebounded. FDI surged in terms of both capital disbursement and registration in comparison with the same period last year. Social security and welfare were ensured, in particular material and spiritual lives of policy beneficiaries, people with merits, and poverty and difficulty-ridden households. Food hygiene received due attention. The information work, especially the collection of comments on the amendments and supplements to the 1992 Constitution attained positive results. The administrative reform, inspection work, settlement of accusations, anti-corruption, thrift practice were paid due attention. National defense and security strength was enhanced; political and social security was maintained. Diplomatic relations were consolidated.

However, there remain difficulties and challenges, including a high inflation rate, a low credit growth and unsettled non-performing loans. The number of dissolved and bankrupted enterprises increased. Agricultural production encountered droughts, salt erosion and difficulties in consumption markets. Industrial production growth rate was low, grappling with high inventory levels. The disbursement pace of development investment capital was slow. A proportion of people were battling against difficulties in life and work. Traffic accidents and crime evolved complicatedly. The implementation of Resolution 01/NQ-CP and Resolution 02/NQ-CP was sluggish, failing to timely deal with difficulties for enterprises to revive and flourish. Meanwhile, regional and global economic situations continued to grow complicatedly, negatively affecting the domestic market and society.     

The Government requested ministries, agencies and localities to surmount difficulties and challenges; take drastic and effective actions to conduct their assigned missions in line with the Resolutions adopted by the Party, National Assembly and Government, especially Resolution 01/NQ-CP and Resolution 02/NQ-CP dated January 7, 2013; and deploy urgent solutions to enable the economy to recover:

- The State Bank of Viet Nam shall continue to reduce lending interest rates in early April, 2013; intensify investigations at commercial banks; unblock loan conditions and procedures to facilitate credit circulation in the economy; prioritize loans for agricultural production and rural areas; work with the Ministry of Construction to promptly guide and deploy credit assistance for households and individuals to enjoy a low and stable interest rate when buying social policy houses, low-income houses and commercial houses with floor space of less than 70 square meters at a cost of below VND15 million per square meter; stabilize the exchange rate and strictly control the domestic currency value.

-  The Ministry of Construction shall promptly propose new policies to enable more people to buy and own houses including overseas Vietnamese, foreign organizations and individuals and submit the fresh policies to competent agencies to consider and decide.

-  The Ministry of Finance shall direct thrift practice, especially strictly control the spending sourced from budget reserves; work with other ministries, agencies and localities to assess the realization of fiscal policies in accordance with Resolution 02/NQ-CP, possibilities to guarantee 2013 budget balance; take into consideration a possibility to continue pulling corporate income tax down to 20%; apply VAT tax breaks and report to the Government in April, 2013.

-  The Ministry of Industry and Trade, the Ministry of Finance, and the Ministry of Health shall jointly work to adjust prices of electricity, gas, and healthcare services appropriately to prevent price escalation.

-  The Ministry of Planning and Investment shall chair and cooperate with the Ministry of Finance and other ministries, agencies and localities to speed up capital disbursement in fundamental construction projects, especially those spending State budget, Government bonds and ODA; consider  advancing Government bonds for 2014 and 2015 for urgent projects which need to move quickly in 2013, ensure the efficiency of capital balance and report  to the PM for deciding; research and propose mechanisms and policies to attract FDI especially in high-tech and auxiliary industries, and expand effective businesses.

-  The Ministry of Industry and Trade shall conduct measures to encourage export, streamline procedures, strengthen investigations, and carry out export procedures at localities and border gates; timely respond to cut-throat and illegal export competitions among Vietnamese enterprises; push up negotiations for Free Trade Agreements; promptly finalize negotiation plans for the Trans-Pacific Partnership and submit them to the Political Bureau.

-  The Ministry of Agriculture and Rural Development shall instruct the fight against droughts in the Central Region and Central Highlands and salt erosion in the South; work with the Ministry of Industry and Trade to ensure electricity and water regulation at hydro-electric dams on rivers to ensure water supply for production; collaborate with the Ministry of Finance to consider providing vaccines to combat  epidemics in poultry, livestock and aquaculture in the affected areas and work with the Ministry of Planning and Investment to set up Public-Private Partnership investment model in agriculture.

-  The Ministry of Education and Education and the Ministry of Health shall chair and work with the Ministry of Finance and relevant agencies to propose amendments to Decision 1466/QD, dated October 10, 2008, on standards and criteria for educational and medical establishments which are entitled to socialization promotion polices in accordance with Decree 69/2008/ND-CP, dated May 30, 2008, and submit it to the Prime Minister before April 15, 2013.

-  The Ministry of Labor, Invalids and Social Affairs and Provincial and Municipal People’s Committees shall continue to keep an eye on labor and employment situation and carry out measures to reduce unemployment especially in industrial production and rural areas; keep abreast with the life of people living in remote, far-flung and difficulty-ridden areas, poor people and those affected by abnormal natural disasters in order to provide them with timely assistance and food.

-  The Ministry of Home Affairs shall cooperate with other ministries, agencies and localities to define and publish the 2012 Public Administrative Reform Index (PAR Index). Ministries, agencies and localities shall continue to speed up the administrative reform in line with the Government’s Resolution 30c/NQ-CP; seriously realize the 2013 administrative reform plan; supervise and examine the implementation of the 2013 administrative reform work.

-  The Ministry of Natural Resource and Environment shall monitor and investigate the granting of land-use certificates, residential house ownership certificates, and land-related assets in accordance with the Resolution adopted at the 3rd session of the 13th National Assembly and the Prime Minister’s Direction 1474/CT-TTg; work with relevant ministries and agencies to resolve obstacles during the process of land-use certificate issuance.

-  Ministries, agencies and localities shall promptly take action to conduct the Master Plan on Economic Restructuring; compose and deploy restructuring programs and plans in branches and sectors in accordance with their functions and tasks; strengthen administrative rules and disciplines; monitor, investigate, assess and review the implementation so as to put adopted mechanisms and policies into reality; positively prepare projects and reports for the upcoming 5th session of the 13th National Assembly.

-  The Ministry of Information and Communications and related ministries and agencies shall accelerate and proactively provide, disseminate, and explain policies especially those which draw much attention from the public. Ministries and agencies should focus on collecting public opinions and respect them during the process of making policies and mechanisms to ensure social consensus is gathered and the effectiveness of policies and mechanisms is achieved.

2. Regarding the supplementary reports on implementation of socio-economic development plans in 2012 and 2013; realization of budget estimates in 2012 and 2013 presented by the Ministry of Planning and Investment and the Ministry of Finance.

Government members shall give comments on the above reports, review and assess what achieved in 2012 and how to implement 2013 tasks in the sectors and branches of their authority and give feedbacks to the Ministry of Planning and Investment before April 10, 2013 to report the PM before submitting the documents to the National Assembly.

3. Regarding the Government’s draft decree on the Viet Nam Asset Management Company, presented by the State Bank of Viet Nam.

The State Bank of Viet Nam chairs and works with the Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Justice and relevant agencies to collect comments; define goals, requirements, necessities, scopes of regulation and application, fundamental principles to sort out non-performing loans, organization and operation of the Company; finalize the draft decree and submit to the PM for consideration.

4. Regarding the 2011 State budget balance sheet presented by the Ministry of Finance

Government members shall comment on the balance sheet. The Ministry of Finance shall collect and finalize the 2011 State budget balance sheet and act on behalf of the Prime Minister to submit it to the National Assembly.

5. Regarding the pilot of container service cost stabilization in Cai Mep-Thi Vai deepwater port area, presented by the Ministry of Finance.

Government members shall give comments on the Resolution on the pilot of container service cost stabilization in Cai Mep-Thi Vai deepwater port area. The Ministry of Finance shall preside over and cooperate with the Office of Government to collect feedbacks of Government members; finalize the Resolution and report to the Prime Minister.

6. Regarding the Draft Report on collecting comments on the 1992 Constitution draft amendments presented by the Steering Committee on drafting amendments to the 1992 Constitution.

The Government assessed that ministries, agencies and localities seriously conducted the Politbureau’s Circular 22/CT-TW and the National Assembly’s Resolution 38/2012/NQ-QH13, plans and directions of the Government and the PM as well as instructions of the Steering Committee on Constitution draft amendments. The comment collecting process was conducted in a broad, open and democratic manner, becoming a vast political and legal campaign in the whole political system and society. It was implemented by ministries, agencies and localities as scheduled with good quality.

The Government specified that the issues that are included in the Constitution need to have stable and long-lasting value to adjust the most fundamental and important social relation groups in the country as they root from the nature and role of the Constitution, which is seen as the source law and the highest legal document in the country’s legal system.

The Ministry of Justice was assigned to collaborate with the Office of Government to collect comments from Government members on the issues which were made clear, highly consented and proved in practice in line with the Party’s Political Program adopted at the 11th Party Congress. Meanwhile, the Ministry shall collect feedbacks on the issues of different views and continue to amend and finalize the report and send to the Prime Minister before submitting it to the Committee for the 1992 Constitution Revision Draft.

7. Regarding the 2014 Law-and-Ordinance-Making Program; adjustments to the Law-and-Ordinance-Making Programs in 2013 and 13th National Assembly presented by the Minister of Justice.

It is necessary to prioritize amendments to laws and ordinances after the 1992 Constitution Revision Draft is passed; projects which serve economic restructuring goals and better the investment and business environment on the 2014 law and ordinance building program. Ministries and agencies should take careful consideration what laws and ordinances to be added to the program; clearly define scopes of regulations, subjects and goals of law projects to ensure their feasibility. Adjustments of the Law-and-Ordinance-Making Programs in 2013 and the 13th National Assembly must be conducted strictly, especially those mentioned in the conclusion of the Politbureau, touched upon the perfection of market economic mechanism and the 2012 projects which had been adjusted for further submission. Ministers and ministerial-level leaders shall direct the building of draft laws and ordinances which were planned to be added in the program on schedule and in good quality.

The Ministry of Justice is responsible for working with the Office of Government and relevant agencies to collect comments from Government members to finalize the 2014 Law-and-Ordinance-Making Program; adjustments to the Law-and-Ordinance-Making Programs in 2013 and during the 13th National Assembly. On behalf of the Prime Minister, the Minister of Justice shall present the documents to the National Assembly.

8. Regarding the Draft Law on People’s Public Security (amended) submitted by the Ministry of Public Security

The Ministry of Public Security shall cooperate with the Ministry of Justice and the Office of Government to continue completing the Draft Law to match with the Law on Viet Nam People’s Army Officers (amended) on military ranks, rank promotion and retirement ages in accordance with the spirit of the Polibureau's Conclusion, and submit it to the Government.

On behalf of the PM and the Government, the Minister of Justice shall submit the two draft laws at the same time at a session of the National Assembly in 2013./.
