THE GOVERNMENT’S REGULAR MEETING – MAY 2019

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the participants and the conclusion of the Prime Minister at the Government’s video meeting in June 2019, held on July 04, 2019,

DECIDES

1. Regarding the implementation of the Government’s Resolutions No. 01/NQ-CP and the socio-economic situation in the first 6 months of 2019

The Government agreed that: In the context of global and regional complicated and unpredictable developments, declining global economic growth, trade and investment, thanks to the robust engagement of the whole political system, efforts of all levels, sectors, the business community and the people of the country, the socio-economic situation in the first 6 months continued to witness positive changes. The economy expanded at 6.76%, higher than that of the same period between 2011 and 2017. Noteworthy, the agriculture sector managed to overcome sectoral challenges, especially the African swine fever outbreak, hot weather and droughts. GDP growth rate of the fisheries sector reached 6.45%, the highest rate over the past 9 years; processing and manufacturing sector rose by 11.18%; mining sector witnessed growth recovery after 3 year of continuous downfall. Total demand continued to upsurge sharply, total retail sales of consumer goods and services rose by 11.5%. Macroeconomic conditions and inflation were kept under control; the average consumer price index (CPI) in the first 6 months grew by 2.64%, the lowest rate over the past 3 years; liquidity of financial and monetary markets was maintained; credit growth and credit structure observed positive improvement, meeting capital demand for investment, production and business. Total social investment capital grew by 10.3%, in which investment capital from non-public sector accounted for 43.6%, up 16.4%. Good exports were estimated to reach US$122.4 billion, up 7.1%, trade surplus rose to US$1.6 billion. Disbursement of Foreign Direct Investment (FDI) reached US$9.1 billion, up 8.1%. State budget revenues increased by 52.8% of the annual estimates, up 13.2% compared to that of the same period in 2018. Business environment continued to improve; production, business and consumption recorded positive outcomes; most processing and manufacturing enterprises assessed production and business conditions in QII better than that in QI and shared positive outlook for QIII/2019. Viet Nam’s Purchasing Managers’ Index (PMI) ranked the second in the ASEAN; Consumer Confidence Index (CCI) ranked the third in the world. The number of newly registered enterprises increased by 3.8%, total registered capital augmented by 32.5% compared to that of the same period last year. The fields of culture, society, environment received due attention. Tasks on social security were properly implemented. People's lives continued to improve; the number of poor households reduced by 30.9%. Unemployment ratio declined; income of employees improved. Science and technology and innovative initiatives made numerous contributions to the overall country’s socio-economic situation. E-government development made a number of significant steps forward in terms of awareness and implementation. National defense and security were fortified, social order and safety were safeguarded. Foreign affairs and international integration made profuse significant achievements, continuing to raise Viet Nam’s role and status in the international arena.

However, the country still faces with a number of shortcomings, limitations and difficulties. Growth momentum of some sectors and areas tended to slow down; export of a number of key agricultural products decreased. Disbursement of public investment capital remained slow, especially ODA disbursement. Production and business in some sectors and fields were still difficult, especially for small and medium enterprises. The weather conditions were relatively complicated while epidemic continued to emerge, especially the African swine cholera epidemic and prolonged heat in a wide area affecting production and people's life. The area of ​​damaged forest tended to increase. Many social issues raising public concerns had not been resolved thoroughly. Fire, explosion and serious traffic accidents remained rampant. A part of cadres and civil servants still had negligent spirit and irresponsible service attitude, which must be rectified in the future.

In the context of complex global situation posing many potential risks and challenges, declining global economic and trade growth, unpredictable trade tension affecting many aspects of the domestic economy, the Government’s point of view was: Resolutely not to step back on difficulties and challenges, strive to stay tenacious with the set growth objectives and targets, orientations, tasks and solutions; continue to uphold the achieved results, strive to overcome difficulties and challenges; constantly innovate and stay creative, taking drastic moves, being determined and striving to complete the targets and objectives set out for 2019.

The Government highly appreciated the proactive and meticulous spirit of ministries, branches and localities in working, directing and timely handling many practical issues arising. Many good models, effective ways, precious experiences in management and administration needed to continue to be replicated nationwide. The task from now to the end of the year was expected to be extremely heavy. As such, the Government requested ministries, branches and localities not to be subjective in directing and operating; monitor and assess the global and national situation, promptly formulate appropriate policies and solutions; seriously grasp the motto "Discipline, integrity, action, creativity, breakthrough and efficiency"; continue to perform synchronously and effectively the tasks and solutions set out in Resolution No. 01/NQ-CP, No. 02/NQ-CP of the Government; Directive No. 09/CT-TTg of the Prime Minister and other guiding and implementation documents of the Government and the Prime Minister; and at the same time, closely follow up with the country’s growth scenario, attaching importance to the drastic and effective implementation of measures to create a driving force for growth in 2019 stated in Resolution No. 23/NQ-CP dated April 10, 2019. In accordance, attention must be paid to the following contents:

a) Key tasks on socio-economic development

- Each Minister, Head of ministerial-level agency, Chairman of the People's Committee of provinces and centrally-run cities shall reinforce a high sense of responsibility to the Party, the State and the people, and be active, creative, dare to think, dare to do, have specific solutions to immediately overcome problems; regularly monitor, flexibly and appropriately respond to international and domestic developments; clearly identify key tasks and solutions to urgent matters, provide decisive and specific instruction, actively mobilize the participation of the political system in organizing the implementation of their assigned tasks, striving to make stronger and more substantive changes in the respective sectors, fields and areas.

- Ministries of Planning and Investment, Industry and Trade, Finance and the State Bank of Viet Nam shall closely coordinate with each other to improve coordination effectiveness among macroeconomic executive agencies; regularly monitor and conduct evaluation and analysis of the world and domestic economic situation to provide appropriate, timely and effective policies, prevent being passive and unprepared.

- The Ministry of Planning and Investment shall preside over and coordinate with ministries, branches and localities to review and update quarterly and annual growth scenarios of the whole country, each sector and field, and timely provide guidance and direction in line with the practical situation; focus on removing difficulties and obstacles to speed up the implementation and disbursement of public investment plans according to Resolution No. 70/NQ-CP dated August 3, 2017; promptly complete the assignment and adjustment of public investment capital plans, ensuring to comply with the prescribed order and procedures; resolutely adjust and reduce capital of low disbursed projects to shift to projects that are in need of additional capital. Attention must be paid to reinforcing management of public auction and accelerating online auction. Each Ministry, branch and province shall establish a Working Group to review and investigate clearly roles and responsibilities of agencies that created delays to the implementation and disbursement of public investment projects. It was requested to strictly deploy Directive No. 18/CT-TTg of the Prime Minister on improving management and efficient use of ODA and foreign preferential loans. Due attention must be paid to actively prepare for the enforcement of the Law on Public Investment recently approved by the National Assembly.

- The State Bank of Viet Nam shall actively monitor and evaluate the impact of the world financial and monetary market, flexibly leverage monetary policy tools to stabilize the foreign currency market; harmoniously coordinate with fiscal policies, ensuring to achieve the goals of inflation control and strengthening macroeconomic foundation. It was requested to create favourable conditions for businesses and the people to access credit capital for investment, production and business, contributing to limiting black credit; strongly employing non-cash payment methods; speeding up the restructuring of credit institutions associated with bad debt handling, especially the restructuring of weak commercial banks; strengthening financial capacity, governance, tight operation supervision of credit institutions to safeguard system safety. The State Bank of Viet Nam was requested to quickly finalize and submit to the Government a draft Decree amending and supplementing to Decree No. 96/2014/ND-CP.

- The Ministry of Finance shall continue restructuring state budget in the direction of increasing the proportion of domestic revenues and the proportion of development investment expenditures, and reducing the proportion of regular expenditures; tighten financial and budgetary discipline; focus on implementing solutions to manage the state budget; upscale the application of electronic invoices, prevent tax loss and pricing transfer; urgently submit to the Government a draft Decree amending and supplementing to Decree No. 20/2017/ND-CP, a draft Decree regulating the use of public assets for paying investors of Build-Transfer (BT) construction projects; review and propose amendments and supplements to tax provisions on base price regulated in Decree No. 83/2014/ND-CP dated September 3, 2014 on petrol and oil trading. The Ministry of Finance was requested to launch peak campaigns to fight smuggling and commercial frauds.

- The Ministry of Planning and Investment shall assume the prime responsibility for and coordinate with the Ministry of Industry and Trade and other related ministries, agencies and localities in reviewing and selecting suitable areas to attract foreign investment, and develop relevant mechanisms and policies to attract investment and technology transfer from the world's leading corporations specializing in advanced and environmentally friendly technologies while avoiding abuse of investment. The Ministry of Planning and Investment shall study, propose and report to the Prime Minister on the establishment of a Working Group on attracting a new wave of FDI; develop criteria for selecting foreign investors. The Ministry shall quickly finalize and submit to the Government a draft National Strategy on the 4.0 Industrial Revolution; guide other ministries, agencies and localities in elaborating plannings according to current regulations; completing the draft Resolution on implementing transitional provisions of the Law on Planning, and submit it to the National Assembly Standing Committee in July 2019.

- The Ministry of Industry and Trade shall formulate solutions to promote the internal restructuring of the industrial sector in the direction of reducing the proportion of processing and assembly, strongly developing deep processing and auxiliary industries while focusing on developing production of components and modules. The Ministry of Industry and Trade shall preside over and coordinate with the Ministry of Public Security, Ministry of Finance, the Steering Committee 389 and other related ministries, agencies and localities to drastically and effectively implement the Scheme on strengthening state management to combat the avoidance of measures to prevent trade and origin fraud, strengthen the management of Certificate of Origin (C/O) issuance and businesses applying for C/O; strictly handle origin fraud cases from Viet Nam. Attention shall be paid to promoting communication and dissemination of opportunities and challenges of Free Trade Agreements signed by Viet Nam, especially solutions to take advantage of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), the EU-Viet Nam Free Trade Agreement (EVFTA), the EU–Viet Nam Investment Protection Agreement (EVIPA); preside over and coordinate with related ministries to complete dossiers and procedures and submit to the National Assembly to approve the EVFTA and the EVIPA at its 8th session. The Ministry of Industry and Trade was requested to expand Viet Nam’s access to potential export markets, and at the same time reinforce and boost market share of Viet Nam’s commodities at traditional markets and with FTA partners. In addition, attention must be paid to developing the domestic market. The Ministry shall coordinate with the State Bank of Viet Nam to urgently deploy solutions to develop e-commerce and non-cash payment methods. The Ministry of Industry and Trade shall focus on speeding up the progress while ensuring quality, and bringing key industrial projects having a high spill-over potential into operation, especially energy projects. It shall expeditiously report on the method of calculating electricity prices and tariffs, proposing solutions most beneficial to the people, and reporting to the Prime Minister. Attention shall be paid to addressing difficulties and problems of Thai Binh 2, Long Phu 1 and Song Hau 1 thermoelectric plants. The Ministry of Industry and Trade was requested to direct the Viet Nam Electricity Corporation to formulate a plan to ensure sufficient supply of electricity for production and daily live. It shall study and propose amendments and supplements to Decree No. 83/2014/ND-CP dated September 3, 2014 on petrol and oil trading.

- The Ministry of Agriculture and Rural Development shall concentrate its resources and mobilize the involvement of the whole political system, the business community and the people, continue to drastically employ synchronous solutions to prevent, control and put a stop to the African swine cholera epidemic, prevent environmental pollution which may create public concerns; step up the restructuring of the livestock industry in the direction of modernization and proactively ensure sufficient food supply at the end of the year. The Ministry shall coordinate with Central agencies to direct coastal provinces and functional agencies to synchronously, drastically and effectively implement requests of the European Committee in guiding fishermen on sustainable seafood exploitation and preventing illegal, unreported, and unregulated (IUU) fishing. The Ministry of Agriculture and Rural Development shall coordinate with the Ministry of Industry and Trade to proactively negotiate with partners to promote official export of agricultural products, striving to achieve the set-out targets. It was requested to closely monitor weather developments, instruct provinces to formulate solutions to prevent and combat natural disasters, droughts, hot weather, flooding and storms; ensure sufficient water supply to agricultural production; pay due attention to forest fire prevention and extinguishing; and ensure embankment dams and dykes’ safety.

 - The Ministry of Health shall continue to implement measures to improve the quality of medical examination and treatment serving the people, attaching importance to healthcare at the grassroots level. It shall direct and speed up the application of information technology in medical examination and treatment, health record making, and dissemination of medical knowledge on a digitalized knowledge system. The Ministry shall strengthen solutions to ensure security and safety of medical examination and treatment facilities. It was also requested to strengthen inspection, examination and strict handling of food safety violations.

- The Ministry of Education and Training shall organize the application of the Law amending and supplementing a number of articles of the Law on Higher Education and the (revised) Law on Education; guiding localities to train and build capacity of teachers according to the new general education program; building a safe and healthy educational environment, preventing and fighting against school violence; studying, developing and promulgating policies and mechanisms to develop preschool education at industrial parks and export processing zones; properly organizing the grading for high school graduation and university and college matriculation in 2019, ensuring its strictness and objectiveness. The Ministry shall continue to improve regulations on institutional autonomy in higher education institutions.

- The Ministry of Labor, Invalids and Social Affairs shall promote the links between education, vocational training and enterprises, raising the rate of trained workers; coordinating with localities to pay due attention to improve the lives of people with meritorious services, the elderly and social protection beneficiaries; properly fulfil tasks on child protection, child care, prevention of violence, child abuse and drowning accidents. The Ministry shall collaborate with agencies and mass organizations to organize gratitude practices for people with meritorious services on the occasion of the 72th War Invalids and Martyrs' Day (July 27), focusing on solving backlogs, providing housing for people with meritorious deeds, and joining hands to help people with merit to escape poverty. The Ministry of Labor, Invalids and Social Affairs was also requested to collaborate with the Ministry of Public Security and provinces to reinforce drug prevention and combat and drug detention.

- The authorities at all levels and functional agencies shall focus on achieving the 3 reduction targets on: reducing supply, reducing demand, reducing harms of drugs; increasing resources to guarantee the prevention and fight against drug addiction; promoting communication and awareness raising, launching a campaign to encourage all people to participate in drug prevention and fighting; fortifying measures to combat drug crimes and manage drug addicts in their area.

- The Ministry of Culture, Sports and Tourism shall mobilize the participation of the whole political system and the whole society in preventing and repelling against moral and lifestyle degradation; promote communication about cultural and civilized behaviours in families and communities. The Ministry shall quickly complete and submit to the Prime Minister to promulgate a Directive on strengthening law enforcement on domestic violence prevention and control; organizing the effective implementation of the Tourism Restructuring Project, the Project of Comprehensive Information Technology Application in Tourism; urgently putting the Tourism Development Assistance Fund into operation; building plans and organizing the promotion of Viet Nam’s tourism, especially promotion activities at key markets and major international events organized in Viet Nam; focusing on managing and controlling the quality of tourism services, diversifying tourism services and products to attract and prolong the stay of international tourists. The Ministry was also requested to strengthen inspection and improvement of tourism services, strictly handling all distorting forms of zero-dong tours.

- The Ministry of Science and Technology shall focus on fortifying the implementation of the Prime Minister's Directive No. 16/CT-TTg on strengthening the capacity to access the 4.0 Industrial Revolution; restructure national science and technology programs; deploy solutions to improve production and business environment, improve Viet Nam’s Global Competitive Index and Global Innovation Index. The Ministry shall accelerate the implementation of the project of developing the National Start-up Innovation Centre and the National Start-up Connection Network; focus on completing dossiers to promulgate the Prime Minister's Directive on promoting the Science and Technology Development Fund of Enterprises, supporting and promoting the spirit of creativity and innovation as well as technology transfer activities at enterprises. At the same time, the Ministry shall urgently build a Scheme to improve the institutional system to attract social resources, especially enterprises’ resources, to invest in scientific, technological and innovative activities.

- The Ministry of Natural Resources and Environment shall improve the quality of weather forecast and disaster warning for timely prevention. The Ministry shall formulate management solutions to effectively address plastic waste problems, including ocean plastic waste, contributing to the combat against environmental pollution and ensuring sustainable development.

- Localities shall take full responsibility for waste and waste treatment in their administrative area; strengthen the capacity of urban and rural solid waste management, focusing on the classification of domestic waste at primary source, improving the capacity of collecting and developing appropriate solid waste treatment technology, attaching importance to developing mechanisms to minimize and strictly manage plastic waste. Localities were requested to promote communication, education, and application of creative approaches to create spill-over effects and raise awareness of the people and businesses about the environment.

- The Ministry of Transport shall direct to speed up the progress of key projects and transport works, promptly report to the Prime Minister on the selection of investors to build the North-South expressway. The Ministry shall complete a draft Decree replacing Decree No. 46/2016/ND-CP in the direction of applying stronger sanctions on violations of traffic order and safety, which shall be submitted to the Government in August 2019; strengthen inspection and control of automobile and other vehicle driver training in the spirit of Decree No. 138/2018/ND-CP. The Ministry of Transport shall complete the automated non-stop road toll collection system, ensuring to put the system into a synchronous operation in 2019.

- The Committee for State Capital Management at Enterprises shall urgently alleviate its organizational structure and apparatus and properly fulfil the role as the representative of state capital owner in 19 corporations and groups transferred to their management authority.

- The Committee for Ethnic Minorities shall preside and coordinate with agencies to urgently complete and submit to the Government an Investment Scheme to develop ethnic minority and mountainous areas and especially difficult socio-economic regions in the 2021- 2025 period. This shall be reported to the 14th National Assembly at the 8th session.

- The Government Inspectorate shall strengthen coordination and propose solutions to limit overlap and replication in inspection and examination; actively coordinate with central and local agencies to monitor the situation of complaints and timely provide solutions, especially for complicated lawsuits involving a large number of petitioners, which could affect social safety and security; effectively inspect, review and settle large, complicated and prolonged cases and/or complaints according to the direction of the Prime Minister.

- Heads of the Party Committees and authorities at all levels shall uphold personal responsibility, synchronously deploy solutions to improve the efficiency of citizen reception, settlement of complaints and denunciations; focus on resolving cases and pressing issues right at the grassroots.

- Ministries of National Defense, Public Security, and Foreign Affairs shall actively monitor, evaluate, and create accurate forecasts of the situation of the world, the region and the East Sea, so as to timely advise the Party and the State policies and effective solutions, prevent being passive and unprepared, resolutely defend the territorial sovereignty, security and national interests.

- The Ministry of Public Security shall synchronously deploy solutions to ensure political security, social order and safety, achievement of important objectives and successfully safeguard the Party Congresses at all levels. It shall proactively discover, actively combat and prevent conspiracy, destructive activities of hostile and reactionary forces; mobilizing the power of the whole political system, the entire people, building the people's security posture, organizing forces to fight, detect and effectively prevent all kinds of crimes, especially organized crime and drug crimes; accelerate investigation of corruption crimes; resolutely prevent black credit. The Ministry of Public Security shall continue to drastically deploy measures to prevent and combat fire and explosion, ensure traffic order and safety.

- The Ministry of Foreign Affairs shall properly execute high-level external activities in the last 6 months; coordinate with other ministries and agencies to implement conclusions of the 34th ASEAN Summit and the G20 Summit.

- The Ministry of Information and Communications shall coordinate with other ministries, branches and localities in providing information on guidelines and policies of the Party and the State and solutions of the Government; promptly combat and repudiate false information, fake negative news creating social consensus; implement the National Press Development and Management Planning by 2025 according to the set roadmap. The Ministry shall develop a strategic orientation for rapid and sustainable development of the postal sector in the direction of promoting e-commerce application, planning for 5G frequency bands and promoting research on 5G equipment production; organize auction of the 2600 Mhz and 700 Mhz bands. The Ministry of Information and Communications was requested to coordinate with the State Bank of Viet Nam to actively implement the pilot application of electronic payment on mobile subscribers; effectively resolve junk SIM cards, spam messages, spam calls; advise the Government on developing and announcing Viet Nam's national digital transformation strategy; promote the implementation of e-Government, focusing on providing online public services at level 4; coordinate with the Ministry of Public Security to formulate plans to ensure network safety and security for the Party and State agencies; actively build Viet Nam to become a centre of network safety and security in the ASEAN community; build and operate a Center of the 4th Industrial Revolution; and develop policies to effectively develop Vietnamese technology enterprises in the direction of promoting "Make in Viet Nam" technologies.

- Ministries, branches and localities shall continue to accelerate the implementation of tasks and solutions to restructure the economy in association with growth model renovation; expeditiously approve, according to their respective authority, restructuring plans of state-owned enterprises following Decision No. 707/QD-TTg dated May 25, 2017; speed up the collection of comments and approval of land use plans of enterprises undergoing equitization and equitized enterprises possessing land in their respective provinces according to current regulations; organize the equitization and divestment of state capital in enterprises according to plans; review and adjust the list of units undergoing equitization and divestment in the 2019-2020 period; strictly implement the registration, listing on the stock market and the collection and payment of revenues arising from equitization or divestment to the Enterprise Arrangement and Development Support Fund according to current regulations for equitized enterprises; develop socio-economic development plan in 2020 in alignment with practical conditions; properly prepare for the Party Congress of all levels gearing up for the 13th National Party Congress. Localities shall continue to focus on improving the quality of administrative procedures following the one-door and one-stop-shop mechanism to better serve the people and businesses.

- The Ministry of Planning and Investment, the permanent agency and editorial team of the Sub-Committee for Socio-Economic Affairs, shall urge agencies and their focal points to study and complete assigned topics and properly conduct a review of the socio-economic development strategy in the 2011-2020 period and the 5-year plan in 2016-2020; formulate and finalize a draft socio-economic development strategy in the 2021-2030 period including 5-year directions and tasks in the 2021-2025 period to serve the 13th National Party Congress; coordinate with the Document Drafting Sub-Committee to reach a consensus on the contents while ensuring their quality and progress, and submit to the Politburo to report to the 11th plenum of the 12th Party Central Committee as prescribed by law.

- Ministers and heads of ministerial-level agencies, according to their functions and authority,  were assigned to direct to resolve local proposals and recommendations, striving to remove difficulties, obstacles and bottlenecks to development of their respective branches and domains. In case of exceeding their competence, they were requested to report to the Government and the Prime Minister for consideration and decision-making. The Government Office was assigned to synthesize, monitor and urge the resolve of local petitions.

b) Regarding the implementation of the plan on contingencies according to the Resolution of the National Assembly:

The Ministry of Planning and Investment was assigned to assume the prime responsibility for, and coordinate with concerned agencies in, reviewing, summing up and finalizing a plan to use contingency reserves of the medium-term public investment plan for the 2016-2020 period, and report it to the Prime Minister for consideration and decision-making before enforcement.

c) Regarding time limits of capital plans for new projects under the National Target Program on Sustainable Poverty Reduction.

The Government agreed not to apply provisions requiring October 31 of the year prior to the planned year as the deadline for approving project investment decisions for new projects under the National Target Program on Sustainable Poverty Reduction. The Program shall be conducted in 29 poor districts which had recently be supplemented following Decision No. 275/QD-TTg dated March 7, 2018 of the Prime Minister approving the list of poor districts and districts escaping poverty in the 2018-2020 period (applied in the 2019 plan) and the Investment Project to establish primary information clusters at border areas and trade centres of Project 4 - Promoting communication and reducing information shortage under the National Target Program on Sustainable Poverty Reduction of the Ministry of Information and Communications (applied in the 2018 and 2019 plans). The Government also agreed to extend timeline for the implementation and disbursement of the central budget capital investment plan in 2018, which had been assigned to the Ministry of Information and Communications under the National Target Program on Sustainable Poverty Reduction to implement the Investment Project to establish primary information clusters at border areas and trade centres of Project 4 - Promoting communication and reducing information shortage under the National Target Program on Sustainable Poverty Reduction. This shall be extended until the end of 2019.

d) Regarding the allocation of investment capital to prepare for the implementation of investment projects on construction of Vietnamese representative offices in foreign countries in 2019:

The Government unanimously agreed to allocate investment capital for preparation works. Capital shall be mobilized from 70% of consular fee to implement the investment project to construct Vietnamese representative offices in foreign countries in 2019 for the project to improve office and mission houses of the Vietnamese Embassy to the Philippines following the Decision approving budget estimates as of October 31, 2018 with a total capital of US$64,384 (equivalent to VND 1,409 billion).

e) Regarding the allocation of the central budget investment plan in 2019 to projects transferred by corporations and groups to the Committee for State Capital Management at Enterprises:

The Government unanimously agreed to: Allocate the central budget investment plan in 2019 to projects transferred by corporations and groups to the Committee for State Capital Management at Enterprises in accordance with the Law on Public investment, the Law on State Budget, the Law on Railway, and regulations on the management and use of public assets and related regulations (Point b, Clause 5, Article 3 of Decree No. 131/2018/ND-CP, which is currently applied, shall not be applied for the whole project using the central budget capital transferred by corporations and groups to the Committee) according to the following principles:

- For projects using public investment capital invested by corporations and groups, if the state capital was invested in enterprises to form public assets, which shall later be assigned to enterprises for management without forming state capital in enterprises, the public investment plan for the 2016-2020 period and in 2019 shall continue to be assigned to the respective specialized Ministry.

- For projects using public investment capital invested by corporations and groups, if the state capital was invested in enterprises to form state capital in enterprises, the public investment plan shall be assigned to corporations and groups according to the Law on State Budget; corporations and groups having assigned capital projects must report to the Committee and concerned agencies in the course of implementation according to regulations.

- For the Viet Nam Railways Corporation, if the project using public investment capital assigned to the Viet Nam Railway Corporation forms national railway infrastructure assets, the public investment plan in medium-term and in 2019 shall continue to be assigned to the Ministry of Transport.

- For the Viet Nam Airport Corporation, if the project using public investment capital assigned to the Viet Nam Airport Corporation forms aviation infrastructure assets, the pubic investment plan in medium-term and in 2019 shall continue to be assigned to the Ministry of Transport.

- No plan of foreign capital shall be assigned to projects invested by Viet Nam Expressway Corporation (VEC) following the direction of the National Assembly in Resolution No. 71/2018/QH14.

The Ministry of Planning and Investment was assigned to coordinate with the relevant agencies to clearly define the nature of projects, summarize them into a list, and report to the Prime Minister to assign the central budget investment plan in 2019 to projects, ensuring their compliance with the above-mentioned principles and current regulations.

e) Regarding the allocation plan of VND 10,000 billion from adjustments to reduce estimated capital to important national projects in the medium-term public investment plan for the 2016-2020 period:

The Ministry of Planning and Investment was assigned to assume the prime responsibility for, and coordinate with the concerned agencies in, expeditiously collecting comments of the Government members at the meeting, reviewing and finalizing the allocation plan of VND 10,000 billion from adjustments to reduce estimated capital to important national projects in the medium-term public investment plan for the 2016-2020 period, and reporting it to the Prime Minister for consideration before the Minister of Planning and Investment inherits the Prime Minister's authorization to act on behalf of the Government to make report to the Standing Committee of the National Assembly.

g) Regarding the use of the 10% central budget reserves at ministries, branches and localities and a number of contents related to the allocation of medium-term public investment plan for the 2016-2020 period:

The Ministry of Planning and Investment was assigned to assume the prime responsibility for and coordinate with the Ministry of Finance in collecting comments of the Government members at the meeting, completing the plan on using the 10% central budget reserves at ministries, branches and localities and a number of contents related to the allocation of medium-term public investment plan for the 2016-2020 period, and reporting to the Prime Minister for consideration and decision-making according to regulations.

2. Regarding the enforcement of the Resolution No. 02/NQ-CP dated January 1, 2019

The Government requested:

- Ministries and agencies that had not completed the plan to reduce and simplify business conditions to quickly complete the plan formulation and submit it to competent authorities to issue legal documents to implement the plans approved. Ministries and agencies that had their conditions must announce and publicize, in a timely and and comprehensive manner, administrative procedures and strictly organize the application as announced.

- For goods subject to specialized inspection by many agencies, ministries and agencies were requested to urgently review and propose a plan to unify a single focal point to carry out specialized inspection procedures and send the plan to the Government Office in July 2019 to summarize and report to the Prime Minister for consideration and decision-making.

- The issuance of guidelines and plans to improve business environment indicators must be completed in July 2019. Ministries and agencies that had issued their plans must urgently organize dissemination and training for localities to ensure effective implementation.

- Localities shall strictly organize the application of business conditions that have been cut down and/or simplified and publicly announced; continue to review, identify and propose to competent authorities for consideration and decision-making to remove unnecessary business conditions hindering production and business activities.

3. Regarding the performance of the Government in the first 6 months

Identifying 2019 as a year of acceleration and breakthrough, in celebration of the 50-year implementation of President Ho Chi Minh's Testament, in adherence to the motto: "Discipline, integrity, action, creativity, breakthrough and efficiency", the Government focused on directing ministries, branches and localities to organize institutionalization, strictly and drastically adopt the Party's guidelines and the National Assembly's resolutions right from the beginning of 2019. In all Government activities, Government members always abided by the leadership of the Party in compliance with the regulations; upholding individual responsibilities of leaders in association with promoting collective strength; striving to resolve hindrances in accordance with their assigned authority and responsibilities and following an proper order and procedures and in compliance with legislation, programs, work plans and working regulations of the Government while ensuring publicity, transparency and effectiveness; following up closely with conditions at local and grassroots levels, tightening central-to-local linkage, encouraging dialogue and listening to people and businesses’ opinions; promptly solving pressing issues concerned by the people, organizations and enterprises; proactively providing information and explanations about issues of public concerns; coordinating closely and effectively with agencies of the Party, the National Assembly, the Viet Nam Fatherland Front, socio-political organizations and judicial agencies to promote the combined strength of the whole political system in performing their assigned tasks; leading, directing and managing an unified and integral state administrative system from central to local levels.

The Government required ministers, heads of agencies and Chairmen of People's Committees of provinces and centrally-run cities to raise their sense of responsibility to the Party, the State, the people and the country and continue to direct, administer in a drastic, concrete, innovative and creative manner, urgently draw experience and overcome shortcomings and limitations. The Government Office was assigned to collect comments of delegates attending the meeting, finalize the Government's performance report for the first 6 months of 2019. The Minister -Chairman of the Government Office was authorized by the Prime Minister to sign the Report on behalf of the Government.

4. Regarding the implementation of tasks and key solutions to develop e-Government

The Government requested:

- Ministers, heads of ministerial-level agencies and the People's Committee of provinces and centrally-run cities direct, mobilize and prioritize resources to implement e-Government construction tasks and held responsibility to the Government and the Prime Minister on the progress and quality of their work; serving as a good model, pioneering in the application of personal digital signatures to approve documents and work records on the electronic environment.

- Ministries, branches and localities to focus on upgrading software for management of documents and administration, actively applying online document processing, sending and receiving of digital documents using digital signatures; urgently build and improve the One-stop Electronic Information System and the Ministerial-level Public Service Portal which shall be connected with the National Public Service Portal; complete the provision of online public service delivery at levels 3 and 4 according to the list approved by the Prime Minister.

- The Government Office focuses on drafting a Decree on the implementation of administrative procedures in the electronic environment; puts into operation the National Public Service Portal; develops a national axis to link documentations into an integrated data sharing platform.

- The Ministry of Public Security focuses on drafting a Decree on protection of personal data to ensure that submission timeline follows the direction of the Government; speeds up the construction of a national database on population.

- The Ministry of Home Affairs focuses on drafting a Decree replacing Decree No. 110/2004/ND-CP on clerical work and submits it to the Government in September 2019 and a project on electronic document archive tasks of state agencies.

- The Ministry of Labor, Invalids and Social Affairs focuses on formulating and submitting to the Government a draft Decree regulating the national database on insurance.

5. Regarding the situation of supervising and monitoring the implementation of assigned tasks in the first 6 months

The Government requested:

- Each ministry, agency and locality to radically fulfil assigned tasks, especially projects in the working program, socio-economic development tasks in 2019 and tasks to improve business environment stated in the Government's Resolution No. 01/NQ-CP, 02/NQ-CP and Directive No. 09/CT-TTg of the Prime Minister; strengthen discipline and order in performing tasks, regularly and actively review, urge, check the performance of tasks, especially those serving to achieve the national growth target.

- The Working Group was assigned to regularly monitor, urge and inspect the assignment of tasks to ministries, branches and localities, focusing on tasks and solutions stated in Resolution No. 01/NQ-CP and 02/NQ-CP of the Government with a view to remove difficulties for production and business and promote growth, Resolution No. 17/NQ-CP on e-Government development. The Working Group was requested to make public reporting at the Government’s regular meeting.

6. Regarding the implementation of the Government's Law- and Ordinance-making Program and the issuance progress of detailing regulations

- Ministers, heads of ministerial-level agencies shall uphold the leadership role and personal responsibility, strengthen discipline and order in the formulation and submission of legal documents; regularly direct and urge the implementation of the Law- and Ordinance-making Program and detailing documents under the responsibility of their ministries and agencies; be accountable to the Government and the Prime Minister for any delays to the issuance of detailing regulations.

- Coordination efficiency must be strengthened between specialized units and legal units, between ministries or ministerial-level agencies and the Ministry of Justice as well as the Government Office to ensure their close coherence in the formulation, finalization and submission of legal documents, assuring quality and progress of legal documents. The Ministry of Justice shall continue to urge and coordinate with ministries and agencies to remove obstacles in institutionalization of legal documents; speed up the appraisal and guide the examination of the codification and systematization of legal documents. Ministries and agencies shall strictly review and provide explanation to the Ministry of Justice's comments to improve the quality of legal documents and law enforcement effectiveness.

- Ministries and agencies having any detailing legal document backlogs shall urgently rectify their shortcomings and make best effort to speed up the formulation, submission and promulgation of detailing documents under their authority, for which the respective laws had been put into effect, before July 15, 2019.

- Ministries and agencies were requested to actively develop and submit to the Government and the Prime Minister for promulgation or, according to their authority, promulgate documents detailing laws and provisions of laws taking effect from 01 January of 2020. It was requested not to allow any document backlogs arise while the quality and progress of detailing documents must be guaranteed and that the detailing documents must be ready for enforcement at the same time as the respective laws.

7. Regarding Reports on: inspection, settlement of complaints and denunciations and combat against corruption; administrative reforms in the second quarter of 2019; the implementation of Resolution No. 35/NQ-CP and Directive No. 26/CT-TTg on supporting and developing enterprises

The Government Inspectorate, Ministry of Home Affairs and Ministry of Planning and Investment were assigned to collect comments of delegates, Government members, finalize and publicize reports according to their authority, monitor and urge the follow-ups to create stronger transformation in the respective industries and/or fields.

8. Regarding the proposal to revise the Law on Residence:

The Government unanimously agreed to adopt the policies stated in the Proposal to develop the (revised) Law on Residence. The Ministry of Public Security shall assume the prime responsibility for, and coordinate with the Ministry of Justice and the Government Office in finalizing the application dossier for the law drafting.

The Minister of Justice was authorized by the Prime Minister to act on behalf of the Government to sign the Proposal to the National Assembly Standing Committee to add the Law into the Law- and Ordinance-making Program in 2020, which shall be reviewed and commented by the 14th National Assembly at the 9th working session and approved at the 10th session. In the process of Law drafting and research, the Ministry of Public Security shall actively advise the Government and the Prime Minister to direct the review, evaluation, revision and supplementation directions of relevant legal documents. The (revised) Law on Residence must be consistent, feasible, and in alignment with existing regulations./.
