RESOLUTION

The Government’s regular meeting – June 2014

GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Government’s Decree 08/2012/ND-CP, dated February 16, 2012 promulgating the Working regulation of the Government;

Based on the discussions among the Cabinet’s members and the conclusion of the Prime Minister at the Government’s regular meeting held in June 2014,

RESOLVES:

1. Regarding the socio-economic situation and the performance of the Government and the Prime Minister in June and the first half of 2014:

On the threshold of 2014, the economy had advantages but still faced numerous difficulties and challenges. The international and regional situations were complex and risky. Since early May, China perversely placed the drilling rig Haiyang Shiyou 981 into Viet Nam's 200-nautical-mile exclusive economic zone and continental shelf, which seriously infringed Viet Nam’s maritime sovereignty, international law, especially the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and the Declaration on the Conduct of Parties in the East Sea (DOC) to which China is a signatory, ran counter to the high-ranking agreements between the two countries, and seriously threatened to peace, stability, security, safety and freedom of navigation and aviation, cooperation and development in the region and badly affected the national socio-economic development. 

In the first half of the year, thanks to the aggregate efforts of all the sectors, levels, the business community and people, under the prompt leadership and direction of the Political Bureau and the Party Central Committee, the country continued gaining positive achievements in almost all fields. The macro-economy was stabilized, macro-balances were guaranteed, the gross domestic product (GDP) expanded 5.18 percent in the first half, higher than the same period of the two previous years, inflation was put inder control; the consumer price index (CPI) slightly increased; the interest rates continued its downward trend; the foreign reserves rose; payment balance surplus was high; foreign exchange rate, foreign currency and gold markets were basically stable; exports rose fairly high, thus bringing about trade surplus; and State budget revenue was positive. Industrial, agricultural production and service indexes were higher compared to the same periods of the previous years. Policies for people who rendered services to the nation, on job generation, poverty reduction and social security and welfare, health, education, training, science, technology, culture, sports, information, natural resources and environmental protection, climate change adaptation have been launched and brought about positive achievements.

Peaceful measures in accordance with the international law have been taken to affirm the country’s sea and island sovereignty, maintain peaceful and stable environment by resolutely and perseveringly keeping on-field struggles, using political, diplomatic, information and communication channels to demand China withdraw the oil rig and its escort vessles out of Viet Nam’s waters. These measures have been welcomed and supported by both Vietnamese people and the international community. Meanwhile, Viet Nam has determined to prevent and strictly punish the ones who violated laws and acted against on-duty officials, destroyed assets of the State, individuals, businesses, especially foreign businesses in order to firmly safeguard security and order. A number of practical solutions have also been introduced to assist laborers and affected businesses so that they can resume operations soon. The Government tasked ministries, agencies and localities to realize comprehensive measures in order to prevent the repeat of these incidents and guarantee security and safety for all foreign agencies, businesses and people in Viet Nam and ensure a good business investment environment.

The Government and inferior levels drastically performed their duties while tightening administrative discipline and rules; focused on improving institutions and realizing the Constitution 2013; designing and amending crucial laws such as the Law on Public Investment, Law on Enterprises, Law on Bankruptcy; amending and issuing a number of legal documents on detailed implementation of laws and ordinances; checking and tackling difficulties against production; and heightening the responsibility of leaders.

However, the economy was characterized by difficult production and business situation, slow increase in aggregate demand, low credit growth, slow non-performing loan settlement, sluggish consumption, especially rice and other agricultural products, big number of suspended and dissolved enterprises, slow recovery of the real estate market, and equitization of the State-owned enterprises and their divestment of non-core operations failed to meet the requirements, and low econmic competitiveness. A part of the population, especially poor households and ethnic minority, still faced difficulties; a lot of graduates could not find jobs; the proportion of unemployment among young people was high. Epidemic disease control failed to meet the demand; food hygiene and safety was not much improved. The arrears of legal documents guiding the implementation of new laws have not been surmounted absolutely. The administrative discipline and rules sometimes have not been strictly followed. Guaranteeing of social order and safety as well as cyber safety and security and crime prevention revealed shortcomings.    

In the second half, the global economy may continue picking up at a slower pace compared to the earlier forecast at the beginning of the year and contains risks. The East Sea situation is still complex, affecting our country, thus all sectors and levels must keep close watch on the situation and prepare proper solutions in all fields. The Government asked ministries, agencies and localities to bring into full play achievements, overcome difficulties and challenges and make every effort to protect the country’s sovereignty, esure political security and social order and safety; implement synchronously and drastically tasks and measures enshrined in the Resolutions of the Party, National Assembly and Government, especially the Government’s Resolution No. 01/NQ-CP and the Resolutions adopted at the Government’s regular meetings; strive to realize set socio-economic goals, focusing on these following tasks and solutions:

a) Trying best to protect national sovereignty and guarantee political security and social order and safety:

- The Ministry of Foreign Affairs shall take prime responsibility and work with functional agencies and forces to resolutely and patiently resort to political-diplomatic measures; actively update information about the East Sea issues, take advantage of the support from the international community for Viet Nam’s just stance and goodwill solutions in dealing with issues related to the East Sea.

- The Ministries of National Defense and Agriculture and Rural Development shall direct law enforcement forces at sea to continue launching responsive field measures to confirm Viet Nam’s sovereignty, sovereign right and jurisdiction in the exclusive economic zone and continental shelf prescribed by the 1982 United Nations Convention on the Law of the Sea and the international law.

- The Ministry of Public Security shall get a good hold of the situation and cooperates with the People’s Army force to prepare active plans to deal with acts causing social and security disorder, resolutely prevent the repeat of the incident; promptly prevent activities of hostile forces and reactionaries especially in big cities, industrial, economic and processing zones.

- The Ministry of Information and Communications shall direct press agencies to provide exact and prompt information about developments in the East Sea, the Party and State’s guidelines and stance in protecting sea and island sovereignty to create social consensus; design a plan to organize “Hoang Sa, Truong Sa belong to Viet Nam- historical evidence” exhibition, contributing to raise the awareness, consciousness and responsibility in safeguarding the Fatherland’s sea and island sovereignty.

b) Regarding the socio-economic development tasks, economic restructuring acceleration:

- Ministries, agencies and localities shall have a firm grasp on the situation, prepare plans to cope with emerging issues, implement synchronously and effectively preset tasks and solutions, increase aggregate demand and accelerate production; review, amend, supplement and complete mechanisms, policies and laws while reforming administrative procedures to create a favorable business environment; speed up the restructuring of State-owned enterprises, public investment and credit organizations, the realization of the Master plan on economic restructuring and plans for sectoral restructuring.

- The Ministry of Industry and Trade shall beef up trade promotion activities, expand and diversify export markets to avoid heavy dependence on one market/one partner; realize programs on domestic market development and consumption of Vietnamese products; cooperate with the Ministry of Finance and other relevant ministries and agencies in carrying out activities of the the Steering Committee Against Smuggling, Fake Goods and Trade Frauds; take prime responsibility and coordinate with relevant ministries and agencies to push up free trade agreement talks, including the Trans-Pacific Partnership Agreement (TPP), the Free Trade Agreements with the EU, the Customs Union of Belarus, Kazakhstan, and Russia, the Republic of Korea and other partners.

- The Ministry of Agriculture and Rural Development shall accelerate the implementation of solutions for restructuring the agriculture sector in combination with building new-style rural areas, orienting agricultural production for the regions, boosting up the application of science and technology into production; beef up promotion activities to expand consumption market, create favorable conditions for agricultural product exporters; closely monitor illegal cross-border imports; closely follow and actively prepares plans to prevent and control diseases and storms and guarantee reserves and dams safety; cooperate with the coastal localities to encourage fishermen to head to the sea and traditional fishing grounds and firmly protect the country’s sea and island sovereignty.

- The Ministry of Finance shall strengthen measures to prevent budget revenue losses and transfer pricing, and strictly control valued-added tax (VAT) refunds; detect and timely deal with acts of tax fraud, evasion and appropriation; recover tax debts; strictly control budget spending, practise thrift and combat wastefulness; cooperate with relevant ministries and agencies to implement market price mechanism for essential goods and services (electricity, coal, petrol, education, healthcare) based on a suitable roadmap while proposing policies to assist poor households and policy beneficiaries; work with the Ministry of Industry and Trade to strengthen supervision and control of the market, combat smuggling and trade frauds, strictly deal with acts of trading fake and low-quality products, especially fertilizer and plant protection products; coordinate with the Ministry of Planning and Investment and related agencies and localities to quickly deploy assistive shipbuilding policy for fishermen’s offshore fishing and for the Vietnamese coast guard and fisheries surveillance forces; cooperate with the Ministry of Justice to review and reform administrative procedures on tax, customs and accelerate the application of information technology in order to create favorable conditions for people and enterprises.

- The Ministry of Planning and Investment shall direct the implementation of solutions to mobilize all resources, encourage social investment, enhance foreign direct investment (FDI) and official development assistance (ODA) attraction and disbursement; review and tackle obstacles and difficulties to speed up disbursement progress of capital sourced from the State budget and the Government bonds; take prime responsibility and coordinate with the Ministry of Finance to quickly allocate additional corresponding capital for ODA projects, propose advancing State’s developmemt investment capital (reserved for 2015) to realize crucial and urgent projects and report the proposals to the Prime Minister.

- The State Bank of Viet Nam shall continue pursuing reasonable credit growth to accelerate production, support market, and focus on priority areas; direct the realization of credit policy for fishermen to build and repair fishing boats in combination with sea-borne economic development and protection of the country’s sea and island sovereignty and traditional fishing grounds; deploy comprehensive measures to foster the settlement of bad debts, restructure credit organizations, increase the credit quality and guarantee the system safety.

- The Ministry of Transport shall focus on supervising the quality of and accelerating the construction of key transport projects; strengthen management and improves the quality of transport services; continue realizing the tasks and solutions to ensure traffic order and safety. The People's Committees of provinces and centrally-governed cities shall be directly responsible for taking drastic measures to monitor vehicles’ loading capacity in their own localities; speed up site clearance for and faciliate the construction of the National Highways 1A and 14.

- The Ministry of Construction shall collaborate with the Office of Government to submit to the Prime Minister a Resolution on amending and supplementing the Resolution No. 02/NQ-CP dated on January 7, 2013 on some solutions to remove difficulties against production and business, support the market and deal with non-performing loans. Accordingly, the beneficiaries of the housing credit package shall include officials, public employees, servicemen, and urban laborers who own land parcels in accordance with land planning but are facing housing difficulties and have not been supported by the State; specific loan volume must be lower than the amount that each household/individual can borrow to purchase/lease apartments of social housing projects.

- The Ministry of Culture, Sports and Tourism shall cooperate with the relevant ministries and agencies to intensify tourism marketing to lure international tourists to Viet Nam and promote domestic tourism; introduce effective measures to ensure security and order, environmental sanitation at tourist resorts, and safety for visitors; propose specific policies, breakthroughs for some potential markets; improve mechanisms for preserving and exploiting effectively heritage sites.

- Ministry of Labor - Invalids and Social Affairs shall collaborate with other ministries, agencies and localities to launch social security and welfare policies; accelerate the review of the policy for credit people with meritorious services to the nation; fruitfully implement programs on job generation, labor export, sustainable poverty reduction, assistance for households living just above the poverty line, building of new-style rural areas; coordinate with the Committee on Ethnic Minority Affairs to review policies for ethnic minorities.

- The Ministry of Health shall direct the realization of the Law on amending and modifying some articles of the Law on health insurance with a view to speed up the process of universal health insurance; focus on solving hospital overload, enhance the quality of medical examination and treatment; strengthen preventive healthcare, effectively prevent the dangerous and newly-emerged epidemic diseases from becoming epidemics.        

- The Ministry of Education and Training shall direct the implementation of the Government’s action program to realize the Resolution adoptd at the 8th Plenum of 11th Party Central Committee on basic and comprehensive education and training reform.

- The Ministry of Natural Resources and Environment and localities shall actively set up the plan to adapt to climate change, strengthen natural resource management and environmental protection.

- The Ministry of Information and Communications shall direct the dissemination, in a timely manner, of all guidelines and policies issued by the Party, State, and instructions of the Government; canvass for national solidarity in developing production and business and defending the Fatherland’s sacred maritime sovereignty in compliance with Vietnamese and international laws. The Ministries and agencies shall actively provide information regarding new policies and issues of public concern to the press in order to create social consensus.

c) Administration performance

- Ministries, agencies and localities shall continue improving their performance efficiency by introducing specific and drastic measures and actions for pratical benefits; focus on organizing the implementation of mechanisms and policies; combine the direction work with field supervision and inspection to timely remove obstacles, deal with the entanglement, especially urgent issues; give prominence to the role of the leaders; strictly comply with the working rules, attach much importance to administrative discipline and rules, continue reforming ways of working, approaching and solving real issues.

- Ministers, leaders of the agencies shall actively prepare and submit the projects and assignments delegated to them in accordance with the working program of the Government and each ministry, agency; prepare draft laws and ordinances as figured out and promulgate legal documents on detailed implementation of laws and ordinances on schedule with the quality ensured; quickly set up the action plans/programs for realizing the Resolutions, Conclusions approved at the 9th Plenum of 11th Party Central Committee, Resolutions passed by the 13th National Assembly at its 7th working session and commitments to the National Assembly; focus on drafting the Plan on socio-economic development and State budget estimate for 2015, ensuring its relevance and feasibility.

- The Cabinet members shall heighten their responsibilities, strictly follow the Resolutions adopted by the Party, the National Assembly, the Government and instructions of the Prime Minister to manage their sectors/fields with highest determination, contributing to the overall effective performance of the Government in all areas of national defence, political security, diplomacy and socio-economic development.

- The ministries, agencies, based on their assigned functions and tasks, shall actively solve or submit proposals to the competent authorities for dealing with the petitions filed at this meeting by the provincial People’s Committees at this meeting and other written petitions.  The Office of Government shall speed up and sum up the settlement of the petitions and report to the Prime Minister.

2. Restructuring State-owned enterprises and plan to use the revenues generating from restructuring and equitizing enterprises:

a)  Restructuring State-owned enterprises:

The Government tasked the ministries, agencies, the People’s Committees of provinces and centrally-governed cities, State economic groups and corporations to focus restructuring the State-owned enterprises, speeding up and enhancing inspection and supervision of the process of restructuring, equitization and divestment. An enterprise which has established a steering equitization board shall quickly determine its business value; the enterprises which have declared their values shall quickly submit their equitization plans to the competent authorities for approval; the enterprises which meet neccessary conditions shall sell their stocks for the first time as regulated; the enterprises which can not sell their stocks for the first time shall immediately change into joint stock companies with the shareholders are trade unions, employees, strategic shareholders (if any) or other voluntary shareholders; actively coordinate in dealing with all difficulties and obstacles in a timely manner during the implementation process, report to the Prime Minister things that go beyond their statutory authority.

The Ministry of Finance shall quickly submit to the Prime Minister the Project on plot capital contribution to establish some new public non-business units, units under State-owned groups, corporations during equitization process; complete the guidance on implementation of the Decree No. 189/2013/ND-CP on amending and modifying the Decree No. 59/2011/ND-CP on transformation of the 100% state-owned enterprises into joint stock companies.

The Ministry of Planning and Investment shall submit preliminary report on the implementation of the Decree No. 99/2012/ND- CP dated on November 15, 2012 by the Government; complete and submit to the Government the draft Decree on amending and modifying the regulations on sale or assignment of State-owned enterprises; provide guidance on dealing with the difficulties, entanglements relating to capital withdrawal/contribution by trademark.

The Ministry of Home Affairs shall complete the draft Decree on appointment, re-appointment, relief of duty, resignation, contract signing, contract termination, commendation, discipline, and criteria used to evaluate managerial and leading titles and representatives of the enterprises, then submit the draft Decree to the Government in July 2014.

The State Bank of Viet Nam shall take prime responsibility and cooperate with the related agencies to design a plan on handling the capital contributed to the commercial banks by the State-owned enterprises in compliance with the Decree No. 15/NQ-CP of the Government on solutions for speeding up equitization and divestment of the State-owned enterprises, then submit the plan to the Prime Minister.

The Ministries, agencies, People’s Committees of provinces and centrally-governed cities, State economic groups, corporations shall quickly implement the Government’s action program on implementing the Resolution No. 30-NQ/TW dated on March, 12, 2014 by the Politburo on continued arrangement, innovation and development, improvement of the efficiency of operations of agriculture and forestry companies.

b) Regarding the use of incomes generating from restructuring  and equitizing State-owned enterprises for the period 2014 – 2015:

The Government agreed on the guilding principle that the incomes generating from equitization and sales of a part of State’s capital shall be transferred to the Business Arrangement and Development Support Fund as proposed by the Ministry of Finance. The Ministry of Finance is assigned to report the issue to the Politburo for comments.

3. For inspection, settlement of complaints and denunciations, anti-corruption in the second quarter of 2014; administrative reform; implementation of the Law and Ordinance Building Program; composition and promulgation of of legal documents guiding the implementation of laws and ordinances over the first six months of 2014:

The Government Inspectorate, the Ministry of Home Affairs, the Ministry of Justice shall take prime responsibility and cooperate with the relevant ministries and agencies to collect opinions from the Cabinet members and from others presented at this meeting, finalize the related reports; based on assigned functions and tasks, focus on directing the implementation of such works, ensuring the positive changes in the second half of 2014.

4. Regarding conditions for foreign workers working in Viet Nam:

The Government agreed to adjust the conditions for foreign workers working in Viet Nam who fall under one of the cases below:

a) Foreigners who are experts, technicians that satisfy the requirements for professional training qualifications or have been acquiring five-year working experience in the field that they are expecting to work in Viet Nam;

b) Foreigners who have college certificates or equivalents and above and who have training profession suitable to their majors at foreign language training centers (foreign language centers); preschools facilities;

c) Foreigners who have university degrees or equivalents and above and who have profession suitable to their majors at general educational institutions.

The Ministry of Labor – Invalids and Social Affairs, the Ministry of Education and Training shall cooperate with the Ministry of Justice, the Office of Government to quickly submit amendments to the Decree No. 102/2013/ND-CP dated on September 5, 2013 of the Government which elaborates some articles of the Labor Code on foreign workers working in Viet Nam and the Decree No. 73/2012/ND-CP dated on September, 26, 2012 of the Government on foreign cooperation and investment in education in the reduced order and procedures, then submit to the Prime Minister for consideration and decision.

5. Administrative sanctions for violating vehicle load regulations

The Government agreed that the Decree No. 171/2013/ND-CP dated on November 13, 2013 shall not be temporarily applied to the following cases [from now] until December 31, 2014:

a) Violating axial load regulations without violating gross allowable weights as stated in the Certificate of technical safety testing and environmental protection applied to vehicles.

b) Violating Paragraph b, Clause 1 and Paragraph a, Clause 2, Article 24 of the Decree No. 171/2013/ND-CP, if cargo on the vehicle exceeding less than 10 percent of the designed load as stated in Vehicle Registration Certificate or Certificate of technical safety testing and environmental protection.

The Ministry of Transport shall take prime responsibility and cooperate with the Ministry of Justice and the Office of Government to put forward amendments to the Government’s Decree No. 171/2013/ND-CP under reduced order and procedures and report to the Prime Minister for consideration and decision.

6. Enhancing information technology application in the State agencies:

The Ministries, agencies and localities shall focus on realizing measures to foster the development of information technology which is considered as the new method for the increase of labor productivity and efficiency, contributing to the improvement of  competitiveness; actively enhance the efficiency of information technology application in all aspects in order to heighten the performance of State agencies, improve the business environment, create favorable conditions for people and enterprises, particularly in fileds like healthcare, education and training, construction, taxation, customs,etc.

The relevant ministries and agencies shall quickly develop the national database, firstly population database according to the Prime Minister’s instructions.

The Ministers, Heads of ministerial-level agencies, Governmental bodies and Chairmen of People’s Committees of provinces and centrally-governed cities shall directly provide instructions for speeding up computer application in processing documents; develop portals of ministries, sectors and localities link them to the Government Portal; provide online public services for the people and enterprises.

The Government agreed on the policy of leasing information technology services by the State agencies and administrative and non-business units. The Ministry of Information and Communications shall take prime responsibility and work with the Ministry of Finance and the Ministry of Planning and Investment to submit to the Prime Minister for promulgating a decision to concretize the policy in July 2014.

7. Food safety

The Government asked the Ministry of Health, the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade to accelerate the promulgation of legal documents guiding the implementation of the Law on Food Safety.

The Ministry of Health shall cooperate with the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade and the Ministry of Information and Communications to define the responsibilities for food safety communication applicable some communication agencies that their operation expenses are covered by the State.

The Ministry of Finance shall take prime responsibility and cooperate with relevant ministries and agencies to put forward fiancial measures for key food safety activities. First of all, financial measures shall be taken for destruction of the exhibits captured by the competent authorities.

The People’s Committees of provinces and centrally-governed cities shall strengthen the capacity of local-level Food Administration Divisions, Agro-Forestry-Fisheries Quality Assurance Divisions and local food safety management agencies; conduct regular check and inspection of food safety; provide instructions for testing, inspecting and handle under the competence or request the competent authorities to handle if the water for daily consumption in the residential areas fails to meet sanitation standards; provide guidance to and inspect the steps of using fertilizer, crop protection chemicals, and veterinary medicines; prevent and handle the cross-border smuggling of crop protection chemicals; enhance the management of street food, and foot safety and hygiene at tourist sites, speed up the issue of certificates for food processing villages, particularly in Ha Noi and Ho Chi Minh City./.
