RESOLUTION

THE GOVERNMENT’S REGULAR MEETING – JULY 2017

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting in July 2017, held on August 3rd, 2017,

RESOLVES:

1. Regarding the draft Law on Cyber Information Security

The Ministry of Public Security shall lead and coordinate with the Ministry of Justice, the Ministry of Information and Communications, the Government Office and concerned ministries and agencies in receiving opinions of the Cabinet members and amending the draft Law to ensure its quality, feasibility, and consistency with the legal system, avoid overlapping, duplication of scope of regulation with other laws and draft Laws. The Prime Minister and the Minister of Public Security shall have the competence to decide whether a network security situation is urgent. The Ministry of Public Security shall finalize the draft Law and report to the Prime Minister before submitting it to the National Assembly.

2. Regarding the draft Law amending and supplementing a number of articles of the Law on physical training and sports

The Ministry of Culture, Sports and Tourism shall lead and coordinate with the Ministry of Justice and the Government Office in gathering comments of the Cabinet members, amending and finalizing the draft Law amending and supplementing a number of articles of the Law on physical training and sports, and reporting to the Prime Minister before submitting it to the National Assembly.

3. Regarding electronic procedures for vessels entering and/or leaving seaports, inland water ports, and offshore oil ports

The Government agreed to continue the application of electronic procedures for vessels entering and/or leaving seaports, inland water ports, and offshore oil ports through the National One-Stop-Shop mechanism until June 30, 2018 as stipulated in the Government's Decree No. 08/2015/ND-CP dated January 21, 2015, Decision No. 10/2016/QD-TTg dated March 3, 2016 and No. 34/2016/QD-TTg dated August 23, 2016 of the Government.

The Ministry of Finance shall be assigned to lead and coordinate with the Ministry of Communications and Transport, the Ministry of Defense, the Ministry of Agriculture and Rural Development, the Ministry of Health, and concerned ministries and agencies in promptly submitting to the Government for promulgation the Decree on the suspension of some contents and master plans and transitory roadmap for implementing electronic procedures for vessels entering and leaving seaports, inland water ports, and offshore oil ports according to the Decree No. 58/2017/ND-CP from July 1, 2017 until June 30, 2018. At the same time, the Ministry shall perform the following tasks:

a) Review and determine gaps between legal documents related to administrative procedures for vessels entering and/or leaving seaports, inland water ports, and offshore oil ports. Develop an adjustment plan in line with provisions of the Decree No. 58/2017/ND-CP to create a synchronous, uniform and convenient environment for the operation of enterprises at the seaports.  Continue to implement electronic procedures based on the national One-Stop-Shop mechanism in accordance with international practices and treaties.

b) Organize upgrading of the national One-Stop-Shop portal and specialized information technology systems of state agencies at seaports.

Ministries and agencies concerned shall complete the tasks mentioned in sections a and b above prior to March 31, 2018 in order to officially apply procedures for vessels entering and/or leaving seaports, inland water ports, and offshore oil ports as stipulated under the Decree No. 58/2017/ND-CP from July 1, 2018.

4. Regarding the draft planning for national press development and management until 2025

The media is a means of communication and tool of propagation of the Party and the State, a forum of the people. It is placed under the leadership of the Party, the management of the State and operates in the spirit of the rule of law. The planning of the press aims to develop the national press that is revolutionary, professional, modern, with high quality and effectiveness and to improve the effectiveness of the leadership and management of the State.

The Ministry of Information and Communications shall be assigned to expeditiously complete the planning and the draft Decision of the Prime Minister approving the draft planning for national press development and management until 2025 in strict accordance with the contents decided by the Political Bureau and the 11th Party Central Committee in the Official Letter No. 3189-CV/VPTW dated May 3, 2017 of the Office of the Party Central Committee. Particularly, the deadline for the restructuring of electronic newspapers will be completed by 2019. At the same time, the Ministry of Information and Communications shall base on the national planning approved by the Political Bureau and the 11th Party Central Committee to actively re-organize press agencies under the Ministry, and press units of the enterprises and associations managed by the Ministry in 2017 as an example.

The Ministry of Justice shall be assigned to appraise the draft national planning. On that basis, the Ministry of Information and Communications shall report to the Prime Minister in September 2017.

5. Regarding the proposal for developing a draft Decree of the Government on the management of inland waterway activities

The Government agreed on the proposal of the Ministry of Transport to develop a draft Decree of the Government on the management of inland waterway activities. The Ministry of Transport shall be assigned to lead and coordinate with the Ministry of Justice and concerned ministries and agencies in elaborating a draft resolution and submitting it to the Government according to regulations.

6. Regarding the report of the Working Group of the Prime Minister

The Government highly appreciated and acknowledged the active and drastic work of the Working Group (­­led by Minister, Chairman of the Government Office Mai Tien Dung) over the past time, and its contribution to the positive changes in the performance of the tasks and directions of the Government and the Prime Minister in ministries, agencies, and localities. The Government agreed with the recommendations of the Working Group and requested ministries, agencies and localities to strictly implement the Working Group’s recommendations, especially recommendations related to institutional building to remove difficulties for enterprises and accelerate growth.

The Working Group shall continue to urge and inspect ministries, agencies, localities, state-owned corporations and groups in applying measures to achieve growth goals, improve the quality of institutional development, improve investment and business environment, and reduce costs for businesses. Particularly, it is necessary to concentrate on inspecting the equitization and divestment of state capital, organizing specialized inspection of imports and exports, improving administrative procedures, especially customs and tax procedures, and business conditions for conditional business lines.

7. Regarding the socio-economic performance in July and the first 7 months of 2017, the implementation of the Government's Resolution No. 01/NQ-CP on the major tasks and solutions guiding the implementation of the socio-economic development plan and the State budget plan for 2017

The Government unanimously agreed that: The socio-economic situation continued to observe positive changes. Macroeconomy was relative stable. Inflation was kept under controlled. Credit growth rate reached the highest level compared to those of the same period over the last six years. Stable exchange rate was recorded. Foreign exchange reserves increased. Average lending rates dropped. The stock market observed the highest increase in nine years. Exports grew 18.7%. Budget revenues increased by 11.6%. Agricultural production remained stable. Industrial production observed positive changes, in which manufacturing and processing industries continued recording higher growth than their performance in the same period last year. Service sector maintained its upward momentum. Total retail sales of goods and consumer services elevated. The number of domestic and international tourists increased sharply. Foreign direct investment (FDI) recorded sharp escalation. There were 73,000 newly registered enterprises and more than 17,000 enterprises resuming operation. Business environment and national competitiveness continued to improve. Social security and social welfare policies received due attention. Education, training, health care, science and technology, employment, physical training and sports, information and communication sectors gained improvements. Corruption prevention was implemented in a drastic fashion. Defence and security were maintained. Social security order was guaranteed. Foreign affairs were fortified and achieved many positive results.

The Government recognized and commended all levels, sectors, organizations, mass organizations and people throughout the country for many meaningful and practical activities to care for and express thanks and gratitude to people with meritorious services to the revolution on the occasion of the 70th anniversary of War Invalids and Martyrs’ Day, to present the tradition of good deeds and the moral code of “remembering the source when drinking water”, honoring people who sacrificed for national independence and freedom. Especially, the Government highly appreciated the organization of a series of commemorative activities by the Ministry of Labor, Invalids and Social Affairs, in coordination with all levels, sectors and mass organizations throughout the country.

In addition to the above-mentioned achievements, the country still faces numerous difficulties and challenges. Industrial production in the first seven months recorded lower increase than that of the same period last year, in which mining industry has not recovered. The industrial production index of some major industrial provinces rose at a lower level than the national average. Production and business still faced many difficulties. The number of enterprises stopping operation remained large. Consumption of some agricultural products was difficult. Disbursement of investment funds remained low and has not met set requirements. Traffic order and safety, fire and explosion, environmental pollution, epidemics, especially dengue fever observed complicated developments. Natural disasters caused serious human and property damages, adversely affecting production and people's life.

The Government requests ministries, agencies, localities, especially localities in disaster-stricken areas to continue mobilizing forces, to promptly search, rescue and assist people to mitigate consequences and overcome difficulties, restore production, and stabilize people’s life.

To strive to achieve targets and indicators of the 2017 plan, especially the economic growth goal of 6.7%, the Government requires sectors and levels to direct the drastic and synchronous implementation of tasks and solutions proposed in Resolutions of the Party, the National Assembly and the Government, especially the Resolutions No. 01/NQ-CP dated January 1, 2017, No. 19-2017/NQ-CP dated February 6, 2017, No. 35/NQ-CP dated April 28, 2016 of the Government; Directives No. 14/CT-TTg dated 19 April 2017, No. 24/CT-TTg dated June 02, 2017, No. 26/CT-TTg dated June 06, 2017 of the Prime Minister. To concentrate on the implementation of the following principal contents:

- The Ministry of Planning and Investment shall lead and coordinate with concerned ministries and sectors in reviewing and updating growth scenarios so as to take specific measures for each sector and domain and report them to the Prime Minister before August 20, 2017. Urgently complete the delivery of medium-term public investment plan in the 2016-2020 period. Lead and coordinate with relevant ministries and agencies to review and remove barriers and inappropriate business conditions. Continue updating and synthesizing some problems in the Law on Public Investment and the Decrees No. 77/2015/ND-CP and No. 136/2015/ND-CP and propose necessary amendments to Government in August 2017. Lead the review of business conditions in accordance with the OECD competitive market principles and propose the abolishment of conditions restricting market competition, and report to the Prime Minister before December 2017. Urgently complete the draft Decree amending and supplementing the Decree No. 210/2013/ND-CP on policies to encourage enterprises to invest in rural agriculture and report to the Government in August 2017 and finalize the draft Law on Special Administrative-Economic Units for submission to the 14th National Assembly at its 4th session.

- Ministries, agencies and localities shall drastically implement the Resolution No. 70/NQ-CP dated August 3, 2017 on major tasks and solutions to accelerate the implementation and disbursement of public investment plans. At the same time, measures shall be proposed to promote private investment, ODA and FDI, striving for a total social investment target of 34-35% of GDP.

- The State Bank of Viet Nam shall continue to reduce lending rates in line with the developments of macroeconomy, inflation and monetary markets to promote production and business. Coordinate with related ministries and agencies to remove difficulties, obstacles, promote lending under the lending program to encourage the development of high technology agriculture and clean agriculture. Effectively implement tasks and solutions to restructure credit institutions and settle bad debts according to the roadmap and plans.

- The Ministry of Finance shall tighten state financial and budgetary disciplines and order, prevent transfer pricing, tax losses, especially tax losses in non-state economic sectors and large household businesses. Urgently submit to the Government for promulgation a Decree guiding the implementation of the Law on Management and Use of Public Assets. Actively build and complete the draft Law amending and supplementing tax laws. Strongly develop the stock market and put the derivatives market into operation.

- The Ministry of Industry and Trade shall identify measures to control imports, reduce trade deficit, boost exports, and improve quality of trade promotion activities. Efficiently implement the domestic market development project in association with the campaign entitled "Vietnamese people prioritize the use of Vietnamese goods" to promote the consumption of domestic goods. Work out solutions to consolidate and develop domestic distribution and retail systems, avoid the domination and manipulation of foreign goods in the market. Lead and coordinate with the Ministry of Finance and concerned Ministries and sectors in proposing solutions to the guaranteed purchase of products of Nghi Son petroleum refinery project and report it to the Prime Minister in August 2017. Identify solutions to offset the decline in production growth of the mining industry.

- The Ministry of Agriculture and Rural Development shall focus on implementing specific measures to ensure the sector’s GDP growth target of 3.05% and the export value of US$33 billion. Beef up the development of hi-tech agriculture. Monitor closely the weather situation, reservoirs and irrigation dam systems, have readily available response solutions to ensure people’s safety and protect production.

- The Ministry of Science and Technology shall develop a program and plan to efficiently implement the Prime Minister's Directive No. 16/CT-TTg to make full use of opportunities of the 4th Industrial Revolution, and promote innovation and high technology development.

- The Ministry of Transport shall implement measures to improve the efficiency of the use of seaports in Cai Mep - Thi Vai port in the Ho Chi Minh City - Ba Ria - Vung Tau port cluster, and at the same time, accelerate progress of traffic projects and the construction of logistics clusters for Sai Gon port cluster, and expeditiously complete procedures to submit the North-South expressway project to the Party Central Committee and the National Assembly and soon start expansion of the Tan Son Nhat airport.

- The Ministry of Construction shall continue reviewing construction licensing procedures and construction practice certificates, directing the development of appropriate real estate market segments, ensuring the healthy development of the real estate market, and promoting the development of social housing.

- People's Committees of the provinces and centrally-run cities shall concentrate on efficiently implementing solutions to remove difficulties for production and business, creating all favorable conditions for the people and enterprises, strive to complete the socio-economic development plan in 2017, and strictly implement regulations on sand mining, solutions to stabilize sand prices, especially to control supply and demand, transportation, terminals, speculation, and unreasonable price increases.

- The Ministry of Natural Resources and Environment shall improve the forecasting and warning of natural disasters, closely monitor, inspect and supervise environmental conditions in thermal power plants, steel plants, and especially production activities of Formosa Company.

- The Ministry of Culture, Sports and Tourism shall foster promotion, marketing activities and attraction of international tourists, especially activities taking advantage of the APEC year 2017, and continue to strengthen the management of travel and tourism, strive to reach the goal of drawing of 13-15 million international tourists in 2017.

- The Ministry of Education and Training shall prepare well for the new academic school year opening for all levels, step up the renovation of tertiary education and develop high-quality human resources associated with the development and application of science and technology.

- The Ministry of Labor, War Invalids and Social Affairs shall lead and coordinate with localities in directing effective implementation of the national target program on sustainable poverty alleviation, closely monitor and take appropriate measures to create jobs for workers in both short and long term, and fortify the full deployment of social welfare policies, especially for people living in remote, isolated and ethnic minority areas.

- The Ministry of Health shall focus on directing the implementation of measures to prevent and control dengue fever and epidemic diseases after monsoon season, and improve the quality of medical examination and treatment, especially quality of grassroots medical establishments in remote and deep-lying areas.

- The Steering Committee for Enterprise Renovation and Development shall coordinate with ministries, sectors and localities in reviewing and promptly removing problems arising in the equitization of State-owned enterprises, stepping up equitization and divestment of the State capital, ensuring transparency and strict compliance with market mechanism, strictly implementing the plan and roadmap on equitization and divestment of the State capital, promoting the responsibility of leadership to strictly handle cases of deliberately delaying, slowing down the deployment progress. First of all, attention should be paid to the divestment of the State capital in enterprises listed on the stock exchange, attaching importance to inspecting and supervising the entire process of equitization and divestment of the State capital to avoid losses or contravention of regulations, and strictly handling violations.

Ministries, sectors, localities, state corporations and groups shall take initiative and drastical action to accelerate the equitization and ensure equitization progress approved by the Prime Minister in the Official Letter No. 991/TTg-DMDN dated July 10, 2017 on the approval of the list of state-owned enterprises to be equitized in the 2017-2020 period.

- Deputy Prime Minister Vuong Dinh Hue shall be assigned to direct concerned ministries and sectors to focus on resolving ineffective corporations, groups, and investment projects and works which create large and prolong losses, and accelerate the fundamental settlement of 12 inefficient projects, especially 05 projects of the oil and gas industry in 2017.

- Deputy Prime Minister Vu Duc Dam shall be assigned to set up a delegation to inspect the implementation results of the Resolution No. 19-2017/NQ-CP of Ministries, sectors and localities.

- The Government Inspectorate shall direct localities to intensify dialogues, purposefully settle complaints and denunciations right from the grassroots level, prevent the gathering of citizens at central agencies to make complaints. The Government Inspectorate shall finalize the (revised) Law on Corruption Prevention for submission to the 14th National Assembly at its 4th session.

- The Ministry of Defense shall strengthen national defense and security assurance, actively and promtly respond to and handle cases in the East Sea, to firmly defend national sovereignty and ensure the safety of fishermen and economic activities at sea. The Ministry shall actively take measures to prevent natural disasters, improve search and rescue activities, especially during the rainy season.

- The Ministry of Public Security shall continue attacks against crimes, strengthen the political security, social order and safety, not to generate "hot spots" in security and order, implement plans to ensure security and safety of important political events of the country, especially the 2017 APEC economic leaders’ week, strengthen patrol, surveillance, and guarantee of traffic order and safety, fire and explosion prevention and fighting, and concentrate forces and means ready for rescue and assistance to the people to mitigate the consequences caused by storms and floods.

- The Ministry of Foreign Affairs shall lead and coordinate with the concerned ministries and sectors in organizing high-level external affairs activities of the Party and the State, especially during the 2017 APEC economic leaders’ week, and well prepare and organize activities commemorating the 50th founding anniversary of the Association of Southeast Asian Nations (ASEAN).

- The Ministry of Information and Communications, press agencies and other ministries, sectors and localities shall intensify the communication and dissemination of policies and directions  of the Party and the State, and administrative and directive solutions of the Government and the Prime Minister, contributing to building a consensus in society, timely prevent and strictly deal with distorted information, and collaborate with the Ministry of Public Security to strictly handle breaches in information and communication.

- The Government Office shall continue operating information exchange channels with people and enterprises through the Government’s e-Portal, organize the preliminary review and assessment of the implementation progress, and report to the Government at its regular meeting in October 2017.

- Ministries assigned to lead the development of Schemes to be submitted to the Political Bureau and the 6th plenum of the Party Central Committee shall expeditiously complete them for submission as prescribed.

- Ministries, sectors and localities shall urgently carry out the task on elaborating the socio-economic development and state budget plan for 2018 according to the Directive No. 29/CT-TTg dated July 5, 2017 of the Prime Minister, including withdrawing experience in developing the 2017 plan, identifying, assessing, analyzing the situation, calculating the feasibility of the plan in 2018, to ensure appropriateness and feasibility of the plan, and submit it to the Ministry of Planning and Investment and the Ministry of Finance for synthesis and reporting to competent authorities according to regulations.

- Each minister, Head of ministerial-level agencies and Chairmen of provincial People's Committees are requested to closely follow up with their work, renovate and innovate in organizing the implementation thereof, fortify administrative disciplines and order, continue to remove difficulties, promote production and business development and accomplish targets and objectives set for each Ministry, sector, locality and the whole country.

They are requested to strictly carry out the policy of personnel downsize, develop a state administrative apparatus streamlined, professional and effective. Each cadre and civil servant must have proper attitude in the execution of work, timely completion of tasks, have high responsibility in the spirit of serving and consolidating trust of citizens and enterprises. Strict handling shall be applied to acts of harassment, violation of regulations, obstructing legitimate activities of people and enterprises.

- The Government encourages localities to build open data systems in the spirit of openness, transparency, following up closely with reality and the people to promote entrepreneurship and private investment. Accordingly, localities shall review and consider the replication of the model of a shared database center of the People's Committee of Hanoi.

8. Regarding the initiation of construction investment projects in 2017

The Government agreed to allow two new projects to be commenced, including: (1) Phu Quoc Fisheries Inspection Station by the Ministry of Agriculture and Rural Development; and (2) The project on expansion and upgrading of the cemetery of Vi Xuyen district phase 1 of Ha Giang province.

The relevant ministries, agencies and localities are assigned to organize the implementation thereof according to regulations.

9. Regarding the report on measures to reduce charges and input costs for enterprises

In the spirit of accompanying enterprises, the Government agreed on the theme of 2017, which is to reduce costs for businesses. Heads of ministries, sectors and localities shall take responsibility before the Government and the Prime Minister for the application results of measures to reduce charges and input costs for enterprises. This requires attention on the following tasks:

- Ministries, sectors and localities shall take measures to immediately eliminate the procedures and regulations that give rise to unofficial expenses. Inspect, closely monitor and supervise the performance of official duties of cadres and civil servants. Strictly handle cases of harassing or creating difficulties to enterprises. Promote reform of administrative procedures, increase the application of information technology, publicity and transparency of state management activities. Review and reduce the costs associated with business conditions applicable to conditional business lines. Abolish unnecessary business conditions which increase costs for businesses, causing unequal competition. Proactively direct specialized agencies to review their professional operations, simplify and improve the inspection, quarantine, surveillance, evaluation and test procedures and order, and other activities related to the issuance of permits and other papers. On that basis, continue proposing the elimination of charge rates associated with professional operations directly related to the enterprises' expenses and send them to the Ministry of Finance for synthesis and reporting to competent agencies for promulgation or promulgate them according to their competence.

- Provincial People's Committees shall direct inferior authorities to review and propose measures to simplify and improve professional procedures in order to reduce charges and fees associated with professional operations directly related to expenses of enterprises, and report to the provincial People's Councils for fee reduction.

- The Ministry of Industry and Trade, the Ministry of Transport, the Ministry of Agriculture and Rural Development, and the Ministry of Health shall review and reduce specialized inspection procedures with a view to reducing the ratio of import goods subject to specialized inspection at clearance stage down to 15% from the current ratio of 30 - 35%.

- The Ministry of Science and Technology shall lead and coordinate with relevant ministries and sectors in reviewing and removing at least 50% of the commodities on the list of group-2 commodities subject to state inspection before customs clearance of 12 ministries before June 2018.

- The Ministry of Transport shall coordinate with the Ministry of Finance in inspecting and directing the reduction of road tolls collected at BOT stations.

- The Ministry of Industry and Trade shall identify solutions to reduce logistic costs to 25% of GDP by 2018, and 20% of GDP by 2020.

- The State Bank of Viet Nam shall accelerate the implementation of the Scheme on development of non-cash payment in Viet Nam in the 2016-2020 period under the Prime Minister's Decision No. 2545/QD-TTg dated December 30, 2016 to encourange increased transparency of payment transactions of businesses.

- The Ministry of Labor, Invalids and Social Affairs shall coordinate with the Viet Nam General Confederation of Labor to review issues on wage and compensations in line with labor productivity.

- The Ministry of Health and Viet Nam Social Insurance, at first, shall suspense raising the level of health insurance premiums to avoid creating pressure on enterprises and workers.

- State-owned corporations, groups and enterprises shall reduce production and business expenses at least by 10%. Heads of representative owners of state capital in enterprises shall be responsible for the implementation results of the expenditure reduction norms. Businesses and commercial banks shall reduce costs, prevent group interests, negativity and corruption.

- Ministers, Heads of agencies and Chairmen of provincial People's Committees shall organize the preliminary review of expense reduction for enterprises and report implementation results to the Ministry of Planning and Investment and the Ministry of Finance before October 15, 2017.

- The Ministry of Planning and Investment shall lead and coordinate with relevant ministries, agencies and localities in reviewing all types of official expenses in addition to charges and fees under current laws on charges and fees, and costs incurred for investment licensing, construction permits, land use certification, etc. for enterprises that need to be reduced in different areas, propose solutions on reduction, and report to the Government at its regular meeting in October 2017.

- The Ministry of Finance shall coordinate with ministries, sectors and localities having agencies and units providing public services and collecting charges and fees to agree on the reduction level for enterprises' expenses and submit them to the competent authorities for decision or promulgation according to its authority. Provincial People's Committees shall report to the People's Councils of the same level for charge reduction under their respective competence. The Ministry of Finance shall lead and coordinate with ministries, agencies and localities in evaluating results of cost reduction for enterprises in the spirit of this Resolution and further reviewing and proposing in detail the reduction of charge rates and types of fee charges as stipulated by laws on charges and fees, and report to the Government at its regular meeting in October 2017./.
