RESOLUTION

The Government’s regular meeting – January 2015

GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;  

Pursuant to the Government’s Decree 08/2012/ND-CP, dated February 16, 2012 promulgating the Working regulation of the Government;

Based on the discussions among the Cabinet members and the conclusion of the Prime Minister at the Government’s regular meeting held on January 30, 2015.

RESOLVES:

1. Regarding socio-economic situation in January 2015; implementation of Resolution 01/NQ-CP dated January 3, 2015 of the Government on major tasks and solutions guiding and directing the realization of the socio-economic development and State budget Plan in 2015.

The Government unanimously agreed: Right from the beginning of the year, ministries, agencies and localities fully grasped and deployed the resolutions adopted by the Party Central Committee, National Assembly and Government; timely delegate tasks and budget estimates to inferior levels. Thanks to the activeness of all levels, sectors, business community, and people, socio-economic situation in January witnessed positive and comprehensive progress in almost all fields. Macro-economy became more stable. Inflation was put under control, consumer price index fell down; exchange rate and foreign currency market were stable. Industrial and agricultural production expanded stably. Service sector grew fairly. Disbursement of foreign direct investment (FDI), official development assistance (ODA) and preferential loans was encouraging. Exports maintained growth momentum. Market confidence improved. Social welfare and social security got due attention. Other fields like culture, information, healthcare and education were strengthened. Administrative reform, settlement of complaints and denunciations, anti-corruption were enhanced. National defense and security were firmly maintained, and social order and security were ensued. External relations were fostered.

However, some ministries, agencies and localities have slowly introduced their programs/plans for the realization of the Resolution 01/NQ-CP. The number of dissolved and bankrupt small and medium-size enterprises remained high. Life of part of the population was still hard. Serious explosions and fires and traffic accidents were common. Acts of trade fraud, counterfeit and contraband goods were complicated. Meanwhile, the weather and diseases posed many risks; global economy was forecast to have unexpected changes, affecting our economy.

The Government asks ministries, agencies and localities to exert highest effort to fulfill targets approved by the National Assembly, striving to attain the GDP growth rate of 6.2% and keep the inflation rate around 5%; simultaneously prepare well for people to have a warm, joyful, safe and economical Lunar New Year holiday, focusing on the following tasks:

- Ministries, agencies and localities shall quickly adopt programs/plans to deploy the Resolution 01; continue drastic implementation of solutions in support of production and business in order to create real advances in 2015, particularly administrative and business environment reforms; accelerate the realization of the Master program on economic restructuring, Circular 11/CT-TTg dated June 19, 2013 of the Prime Minister on some tasks to implement the Master plan within 2013-2015 and sectoral restructuring plans that have been approved.

- The State Bank of  Viet Nam shall deploy solutions to beef up credit growth in service of production and business since the beginning of the year, in combination with improving credit quality; enhance supervision of credit organizations’ performance; continue with solutions for handling bad debt and lowering the debt rate below 3% by the end of 2015; resolutely restructure credit organizations in accordance with the approved roadmap; ensure cash supply, especially before and after the Lunar New Year holiday.

- The Ministry of Planning and Investment shall take prime responsibility and coordinate with ministries, agencies and localities to focus on beefing up investment; actively implement solutions to encourage and lure investment from the society; coordinate with the Ministry of Finance to speed up disbursement of State budget, Government bonds and seek additional capital resources for ODA programs and projects so that they can be carried out as scheduled; synthesize and make a report on the issuance of programs/plans by ministries, agencies and localities to implement the Resolution 01, which will be presented at the Government’s monthly meeting in February 2015.

- The Ministry of Finance shall ensure State budget balance, particularly budget collection in 2015, even in the case of further plunges of global oil prices; strictly and effectively manage budget expenditures; enhance inspection of the observance of regulations on price management, especially prices of essential goods and services; take prime responsibility and coordinate with ministries, agencies and localities to accelerate disbursement of State budget and Government bonds; propose competent agencies to allocate more funding sourced from equitizing State-owned enterprises to finance the Program on building new-style rural areas; reform tax-related administrative procedures and apply risk management mechanisms, ensure tax inspection over high-risk tax payers without annoying those who comply with tax legislation; quickly handle tax dossiers and make public the settlement of tax-refund dossiers and relevant complaints and petitions; promote the role of the Steering Committee 389 for smuggling, trade fraud and counterfeit goods prevention and control; create conditions, in terms of finance, working vehicles, compliment and reward for forces in charge of fighting smuggling and trade fraud; launch the campaign to encourage the whole society to counter smuggling; while upholding the role and responsibility of State management of anti-smuggling; take prime responsibility and coordinate with the Ministry of Industry and Trade and other ministries, agencies to design a draft Instruction on smuggling and trade fraud prevention and control, and submit it to the Prime Minister for issuance; take prime responsibility and coordinate with the Ministry of Justice and other relevant ministries and agencies to promptly design a Resolution to amend and supplement the Resolution No. 1269/2011/UBTVQH12 dated July 14, 2011 of the National Assembly Standing Committee on the environmental protection tariff  in order to adjust tax rates imposed on petroleum, then submit it to the Government and act on behalf of the Prime Minister to submit the draft Resolution to the National Assembly Standing Committee.

- The Ministry of Industry and Trade shall ensure goods supply-demand, especially essential goods for the Lunar New Year holiday, and avoid scarcity of goods and price hikes; coordinate with competent agencies to enhance market inspection and control, strictly handle acts of trading, producing and transporting contraband, counterfeit, unqualified and unhygienic goods; manage the plan for crude oil exploitation and put forwards proposals regarding oil reserve in case of continued plunges in global oil prices, to the Prime Minster for decision, and keep domestic petroleum prices at reasonable levels to facilitate production and consumption and balance the interests of the State and businesses and individuals; strengthen cross-border smuggling prevention and control; submit ways to adjust electricity prices in accordance with the realities and improve the electricity productivity, then report to the Prime Minister for consideration and decision; take prime responsibility and coordinate with ministries, agencies to disseminate information  regarding the roadmap for implementation of signed free trade agreements; propose concrete solutions to exploit the benefits of the agreements and mitigate domestic weaknesses and shortcomings.

- The Ministry of Transport shall take measures to organize passenger transport during the Lunar New Year holiday; take prime responsibility and coordinate with the Ministry of Finance to study and introduce reasonable transportation fees to ensure the interests of transport companies and service users; take prime responsibility and coordinate with the Ministry of Public Securities and the Ministry of Justice to review and propose measures and sanctions to handle violations of vehicles which failed to ensure safety, including overloaded and man-made vehicles; and measures to handle cars whose time have expired in order to guarantee traffic order and safety.

- The People’s Committees of provinces and centrally-governed cities shall direct local-level authorities to regularly check and control vehicle load, transportation business conditions, and freights; enhance inspection and control and management of the quality of traffic projects.

- The Ministry of Agriculture and Rural Development shall speed up the restructuring of agriculture to exploit the potentials and strengths for sustainable development of the sector; direct agricultural production, especially food and foodstuff, vegetables so as to ensure the supply during the Lunar New Year holiday; actively take measures to cope with weather changes, prevent diseases for domestic animals and plants and cross-border smuggling of livestock and poultry.

- The Ministry of Labor, Invalids and Social Affairs shall take prime responsibility and coordinate with ministries, agencies and localities as well as mass organizations at central and local levels to continue social security policies for people rendering meritorious services to the revolution, the poor and policy beneficiaries during the Lunar New Year holiday; provide timely rice to aid the right beneficiaries; take prime responsibility and coordinate with the Ministry of Finance to provide instructions for not collecting the margins of monthly allowances granted from January 1, 2013 to the end of May 2013 to the persons who joined the assistance war and infected with toxic chemicals and their  ability to work is reduced by up to 81% (the margins caused by Decree No. 47/2012/ND-CP dated May 28, 2012 of the Government providing preferential allowances for people rendering meritorious services to the revolution and Decree No. 31/2013/ND-CP dated April 09, 2013 on detailed implementation of the Ordinance on preferential treatment of people with meritorious services to the Revolution). In case the monthly allowances were already provided after June 1, 2013 in accordance with above Decree No. 47/2012/ND-CP, the margins will be recovered by gradual deduction of the monthly allowances.

- The Ministry of Health shall direct public medical examination and treatment; enhance preventive medicine; actively take measures to prevent human diseases; strengthen inspection of food hygiene at production and business facilities, especially before and during the Lunar New Year holiday.

- The Ministry of Culture, Sports and Tourism and localities shall beef up cultural and sport activities; improve the quality of artistic activities during the Lunar New Year holiday; deploy tourism development plan and promote the values and potentials of cultural heritages; effectively manage Spring festivals; prevent and strictly handle negative activities during festivals and at tourist attractions.

- The Ministry of Education and Training shall decide the way to well organize the upper secondary school final examination in 2015; continue to consider reforms of the national examination in the coming years; take prime responsibility and coordinate with the Ministry of Foreign Affairs to study and propose measures to improve the efficiency of the implementation of the program on teaching the mother tongue to overseas Vietnamese, then report to the Prime Minister.

- The Ministry of Public Security shall ensure national security, social order and safety, drastically crack down on crimes; foster inspection of the fight against smuggling, trade fraud, fires and explosions, especially in big cities, key zones, trade centers, and residential areas; direct police forces and localities to enhance traffic patrols and control and impose strict punishments on those who violate regulations on traffic safety, especially during the Lunar New Year holiday.

- The Ministry of National Defense, the Ministry of Foreign Affairs, and the Ministry of Public Security shall closely follow the situation and take timely measures to deal with circumstances related to border, sea and island sovereignty, particularly during the 85th anniversary of the establishment of the Communist Party of Viet Nam and Lunar New Year holiday. The Ministry of National Defense shall direct the border and coast guard forces to intensify efforts to fight smuggling.

- The Ministry of Information and Communications shall quickly acquire the conclusions presented at the 10th plenary session of the 11th Party Central Committee, finalize the national press planning and development plan then submit it to the Politburo for further comments before promulgation; direct news agencies to actively and precisely popularize the guidelines and policies of the Party and State, Government’s performance, activities on the occasion of the founding day of the Communist Party of Viet Nam and the Lunar New Year holiday in order to create an inspired momentum right from the beginning of the year; mobilize the public to join efforts in realizing socio-economic development targets. Ministries and agencies shall actively disseminate official information, especially on issues of public concern; timely correct and strictly deal with wrong and falsified information; coordinate with the Ministry of Public Security to ensure cyber safety and security; take prime responsibility to design a plan to improve awareness of and responsibilities for information safety.

- Ministries, agencies and localities shall focus on carrying out tasks and solutions enshrined in the Instruction No. 36/CT-TTg dated December 22, 2014, Public Telegraph No. 2620/CD-TTg dated December 19, 2014, and Public Telegraph No. 115 dated January 23, 2015 of the Prime Minister, especially those relevant to price and market management and regulation, social security and care for people’s material and spiritual life, traffic order and safety, traffic accident reduction in all three criteria, firm maintenance of sovereignty and territorial integrity, political security, and social order and safety.

2. Regarding import tax exemption policy for goods traded, exchanged by border residents

The Government agreed to continue to exempt import tax and other tariffs (if any) levied on goods traded, exchanged for direct consumption or production by border residents.

The Ministry of Finance shall be assigned to take prime responsibility and coordinate with the Ministry of Industry and Trade and other relevant ministries, agencies and localities to review and propose amendments to the tax policy towards reducing the times for tax exemption, adjusting the list of goods subjected to tax exemption for each stage and zone and in accordance with Viet Nam’s laws and international commitments on border trade while strengthening control and management to prevent tax evasion;  taxes will be levied on goods which are purchased, exchanged by border residents not for their direct consumption and production;  design a draft Decision on amending and supplementing Decision 254/2006/QD-TTg dated November 7, 2006 of the Prime Minister on management of cross-border trade activities with bordering countries, then report to the Prime Minister for consideration and decision.

3. Regarding draft Decree on regimes and policies applicable to officials ineligible for re-election and re-appointment to termed posts or titles in the Party and State bodies and socio-political organizations

The Ministry of Home Affairs shall be assigned to take prime responsibility and coordinate with the Ministries: Finance, Labor-Invalids and Social Affairs, Justice, Office of Government and relevant agencies to acquire the Cabinet members’ comments, then finalize the draft Decree and submit it to the Prime Minister for consideration and issuance prior to February 10, 2015 in the direction of maintaining and stabilizing the regimes and policies which are in line with the Decree 67/ND-CP dated June 15, 2010 while amending and supplementing regulations on regimes and policies in line with the Politburo’s Instruction No. 36/CT-TW dated on May 30, 2014 and the Conclusion No. 64-KL/TW dated on May 28, 2013 adopted at the 7th plenary session of the 11th Party Central Committee.

4. Regarding the policies to attract excellent graduates and young scientists to prepare cadres in the period 2015-2020

The Ministry of Home Affair shall be assigned to take prime responsibility and coordinate with the Ministry of Justice, Office of Government and other relevant ministries and agencies to acquire the Cabinet members’ comments to finalize the draft Decree of the Government on attraction excellent graduates and young scientists as source of cadres in the period 2015-2020, which includes the Government’s competence in this area; simultaneously, review and report to the Government proposed amendments to relevant laws.

5. Regarding pilot specialized inspection in the domain of food safety at district and precinct levels in Ha Noi and Ho Chi Minh City

The Government agreed with the Ministry of Health’s proposal to pilot specialized inspection in the domain of food safety at district and precinct levels by arranging the existing workforces of Ha Noi and Ho Chi Minh City in 2015:

- Civil servants and public employees who carry out food safety inspection at district and precinct levels shall be allowed to handle administrative violations in the domain of food safety; have their own clothing and be entitled to enjoy the regimes applicable to specialized inspectors.

- Funding for specialized inspection at district and precinct levels shall be covered by the two cities. The money collected from sanctioning of administrative violations in the domain of food safety shall be retained and spent on activities to ensure food safety at district and precinct levels.

The Ministry of Health shall be assigned to take prime responsibility and coordinate with the Ministries: Agriculture and Rural Development, Industry and Trade, Justice, Home Affairs and Government Inspectorate and relevant agencies to develop draft Decision on pilot implementation of specialized inspection in the domain of food safety at district, town and commune levels in Ha Noi and Ho Chi Minh City, then submit it to the Prime Minister for issuance in February 2015. Based on the outcomes thereof, the Ministry of Health shall review, evaluate and put forward concrete policies.

6. Regarding Methadone treatment for drug addicts managed by detention centers

The Government agreed to implement the pilot program on Methadone substitution treatment for drug addicts being managed by the Ministry of Public Security’s detention centers:

- The Ministry of Health shall be assigned to provide instructions, support, and Methadone for treatment. The Ministry of Finance shall ensure funding for the program.

- The Ministry of Public Security shall take prime responsibility and coordinate with relevant ministries and agencies to outline concrete plans to provide Methadone treatment for the drug addicts from three to six months before they complete their judgments; report to the Prime Minister the outcomes of the pilot program by the end of 2015.

Based on such outcomes, the Ministry of Health shall take prime responsibility and coordinate with ministries, agencies and localities to summarize, report and put forward amendments to Decree 96/2012/ND-CP dated November 15, 2012 of the Government on opiate addiction treatment by using alternative medicines.

7. Regarding the law and ordinance building program for 2016; adjustments to the law and ordinance building programs for the 13th tenure and 2015 and relevant issues

a) The law and ordinance building program for 2016; adjustments to the law and ordinance building programs for the 13th tenure and 2015 should focus on amending and supplementing draft laws and ordinances in accordance with the Constitution adopted in 2013; support economic restructuring, improve business environment. Ministries, agencies shall actively review and carefully select well-prepared ones. The adjustments to the law and ordinance building programs for the 13th tenure and 2015must be strictly carried out. Ministers, heads of ministerial-level agencies themselves shall direct the compilation of the targeted draft laws and ordinances and ensure their quality and progress.

The Ministry of Justice shall review the draft law and ordinance building programs for 2016 and 2017 to guarantee the links between them and between the 13th and 14th tenures of the National Assembly.

The Ministry of Justice shall take prime responsibility and coordinate with the Office of Government and relevant agencies to collect the Cabinet members’ comments, correct and finalize the law and ordinance building programs for the 13th tenure and for 2015, then report to the Prime Minister before submitting to the National Assembly Standing Committee.

b) Ministers, Heads of ministerial-level agencies shall drastically direct the development and submission or promulgate within their competence the legal documents on detailed implementation of laws and ordinances to basically overcome slow promulgation of guiding documents, especially those guiding the implementation of laws and ordinances that took effect since January 1, 2015; enhance coordination in designing and issuing inter-agency legal documents for synchronous implementation.

c) The Ministry of Justice shall take prime responsibility and coordinate with the Ministry of Home Affairs and relevant ministries and agencies to review and evaluate the implementation of Decree 55/2011/ND-CP dated July 4, 2011 of the Government on functions, obligations, rights and structural organization of legislation departments, then put forward measures to the Prime Minister in order to raise the effectiveness of the legislation work.

8. Regarding draft law on amending and supplementing some articles of the Accounting Law

The Ministry of Finance shall be assigned to take prime responsibility and coordinate with the Ministry of Justice, Office of Government and relevant agencies to collect the Cabinet members’ comments, correct and finalize the bill, then report to the Prime Minister for consideration and decision before submitting the bill to the National Assembly./.
