THE GOVERNMENT’S REGULAR MEETING – AUGUST 2019

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in August 2019, held on September 04, 2019,

DECIDES

1. Regarding the implementation of the Government’s Resolution No. 01/NQ-CP and the socio-economic situation in August and the first 8 months of 2019

The Government agreed that: The socio-economic situation in August and the first 8 months of 2019 continued to witness positive changes. It is expected that 12 key targets of 2019 shall be achieved. In the context of numerous difficulties and challenges in the region and the world, the relatively comprehensive achievements in all fields indicated significant efforts and hard work of the entire political system, agencies at all levels and branches, business communities and the people nationwide. Macroeconomic stability was maintained. Inflation was kept under control. The average consumer price index (CPI) in 8 months increased by 2.57%, the lowest rate over the last 3 years. Monetary  and credit markets were relatively stable. Stock market capitalization grew by 13.3% compared to the end of 2018. Exports increased by 7.3%, of which exports of the domestic sector grew by 13.9%, higher than that of the foreign-invested sector (up 4.6%). Trade surplus widened dramatically and was estimated at US$3.4 billion. State budget revenue reached 70.7% of the plan, up 12.4% over the same period in 2018. Particularly, domestic revenue augmented by nearly 14%. Disbursement of foreign direct investment reached nearly US$ 12 billion, up 6.3%. Value of capital contribution and share purchase of foreign investors reached US$9.51 billion, up 80%. Although agricultural production faced with many difficulties due to natural disasters and epidemics, development momentum was still maintained. Aquatic production increased by 5.4%, poultry population increased by 10%. Industrial production increased by 9.5%, of which processing and manufacturing output increased by 10.6%. Especially, in August, the mining industry recorded sharp increment in output, up by 14.4%. Investment and business environment continued to be improved. There were nearly 90.5 thousand newly established enterprises, up 3.5%. Total registered capital reached over VND 1.15 trillion, up 31%. The number of enterprises registering for temporary cessation of business reduced by 7%. The number of enterprises returning to operation increased by 21.8%. Total retail sales of consumer goods and services increased by 11.5%. The number of international visitors reached 11.3 million, up 8.7% over the same period.

The fields of culture, society, environment, defense, security and foreign affairs continued to receive due attention and achieved many important results. Policies for people with meritorious services, families of martyrs, war invalids and sick soldiers as well as policies on social welfare and sustainable poverty reduction were properly implemented. Due attention was paid to activities to improve public healthcare, job creation, education, training and environmental protection. The task of college and university enrolment was properly deployed. Active initiative was taken to promote and encourage the participation in and response to the movement "The whole country joins hands for the poor". People's lives continued to improve. Many cultural, art, information and communication activities were organized on the occasion of the 74th anniversary of the August Revolution and the National Day of September 2nd. Various events were organized in a solemn and sincere manner on the occasion of the 50th anniversary of the implementation of President Ho Chi Minh's Testament. Administrative reform and anti-corruption activities continued to be promoted. National defense and security had been strengthened and persisted to fight for and protect the country's sovereignty. Foreign affairs and international integration were strengthened. And Viet Nam's position and prestige in the international arena continued to be improved.

However, besides the achievements, the country still faced with a number of limitations and weaknesses. Disbursement of public investment had been relatively slow, especially disbursement of foreign capital, Government bond capital and capital for national target programs. Equitization and divestment of state capital did not meet the requirements. A number of key energy and transport infrastructure projects were behind schedule. Agricultural production faced many difficulties, especially due to the African swine cholera epidemic. The price of agricultural products dropped while the country had to experience numerous natural disasters, prolonged hot weather, flood, landslides. Processing and manufacturing industries had not been able to make any breakthrough. Production and business in a number of branches and areas faced numerous difficulties. Slow action was taken to address social ethic degradation, violence, and negative cultural behaviours in some places. Security and order, fire and explosion, traffic accidents in some areas remained complicated.

The tasks of the last 4 months of 2019 remain extremely heavy. As such the Government requested all levels and branches to continue to drastically, synchronously and effectively implement the tasks and solutions set out in Resolutions No. 01/NQ-CP, 02/NQ-CP dated January 1, 2019 of the Government, Resolutions of the regular Government meetings and the direction of the Prime Minister. Accordingly, it was requested not to be subjective. Attention must be paid to regularly monitoring, analysing and assessing domestic and global situations in order to timely provide effective, appropriate and active responses. Ministers, heads of ministerial-level agencies, and Chairmen of provincial-level People's Committees must raise their sense of responsibility to the Party, the State and the people, take stronger action in their in-depth and practical management, direction and administration, maintain discipline and order, hold accountability for the implementation results of the targets of the respective branches, domains and localities under their management. The Government's overall guiding spirit shall be making the best effort, striving to comprehensively fulfil the goals and targets in 2019 to create a solid foundation for 2020, the last year of the term, and contribute to the successful implementation of the 5-year plan in the 2016-2020 period.

Ministries, branches and localities were requested to continue to vigorously reform and improve their institutions, ensure macroeconomic stability, promote economic growth, continue to consider this a key and prioritized task. Attention must be paid to reviewing and removing difficulties, problems, overlaps and inadequacies in mechanisms, policies and laws to create an open and favourable investment and business environment to serve the people and businesses and attract resources serving the country’s rapid and sustainable development, narrowing the gaps, catching up with advanced countries in the region and the world in the context of the Fourth Industrial Revolution as well as the ever deeper and broader international integration. In particular, attention must be paid to implementing some of the following key contents:

a) Regarding schedule of key infrastructure projects and works:

- Regarding power projects: The Minister of Industry and Trade was assigned to assume the prime responsibility, the Chairman of the Committee for Management of State Capital at Enterprises shall be responsible for related matters in removing difficulties of key projects such as the Long Phu 1 Project, Song Hau 1 Project, Thai Binh 2 Project, etc. while completion schedule must be guaranteed. Specifically:

For Song Hau 1 Thermal Power Plant Project: Ensure to put the first turbine generator into operation in the second quarter of 2021 and the second turbine generator in the third quarter of 2021.

For Thai Binh 2 Thermal Power Plant Project: The Secretary of the Party Committee of the Ministry of Industry and Trade must urgently complete the report to submit to the Government Party Committee before reporting to the Politburo for comments on the Thai Binh 2 Thermal Power Plant Project, ensure to put the first turbine generator into operation in December 2020 and the second turbine generator in the first quarter of 2021.

For Long Phu 1 Thermal Power Plant Project: Specific plan must be proposed and reported to the Prime Minister in December 2019.

For Song Hau 1 Thermal Power Plant Project: Ensure to put the first turbine generator into operation in the second quarter of 2021 and the second turbine generator in the third quarter of 2021.

- Regarding transport infrastructure projects: The Minister of Transport shall be responsible for developing specific implementation plans for each important project and work, and reporting to the Prime Minister before September 15, 2019; take responsibility for directing and speeding up the preparation for the implementation of key transport infrastructure projects; pay special attention to solving problems caused by procedures, clarify responsibilities of ministries, the Committee for Management of State Capital at Enterprises, Project Management Units, contractors and related provinces; and at the same time handle shortcomings of a number of pending projects and works. In which:

For the Project to build some expressway sections on the Eastern North-South Expressway: The Minister of Transport shall be responsible for the commencement schedule of three investment projects funded by the state budget, and the bidding progress to select investors for 8 public-private partnership projects upon receiving official instruction of competent authorities on the form of investor selection to ensure the project completion by 2021 in accordance with the Resolution of the National Assembly. The Ministry of Transport was requested to promptly report to the Government and the National Assembly on matters beyond its competence. It was requested not to allow the occurrence of any stagnation or delay.

For the Trung Luong - My Thuan Expressway Project: Minister of Transport and Chairman of the People's Committee of Tien Giang Province shall hold accountability to the Government and the Prime Minister for ensuring the route’s readiness for operation in 2020 and inauguration of the entire route in 2021 in accordance with the direction of the Prime Minister in the Government Office's Notice No. 272/TB-VPCP dated August 2, 2019.

For the Ha Noi Urban Railway Project, Cat Linh - Ha Dong metro line: The Minister of Transport shall be responsible for reporting to the Prime Minister before September 30, 2019 on the progress of testing and putting the route into operation in accordance with the Prime Minister's direction in Document No. 6334/VPCP-QHQT dated July 5, 2019 of the Government Office; according to their competence, take proactive measures to definitely handle or propose to competent authorities to address problems if they are beyond their competence. It was requested not to allow any further delay, which could erode the people’s trust on the Government.

For the Long Thanh International Airport Project: The Minister of Planning and Investment shall be responsible for the tasks of the State Evaluation Council, urgently appraising the Feasibility Study Report of the project while ensuring submission progress to the 14th National Assembly at its 8th session.

For the project of building terminal T3 at Tan Son Nhat International Airport: The Minister of Transport shall take the prime responsibility, the Ministry of Planning and Investment and the Municipal People's Committee of Ho Chi Minh City shall take responsibility for the progress of submission, appraisal and approval of investment policies following the Prime Minister's direction in the Government Office's Document No. 6557/VPCP-CN dated July 24, 2019.

Regarding the repairing and overcoming damage of the runway and taxiway systems at Noi Bai and Tan Son Nhat International Airport: the Minister of Transport and Chairman of the Committee for Management of State Capital at Enterprises shall directly instruct the General Director of Airports Corporation of Viet Nam (ACV) to complete the repair of damage in November 2019; take personal responsibility for aviation safety problems caused by the runway and taxiway systems.

Review the overall investment needs of airports, classify and select the appropriate form of investment for each port to announce the list of ports calling for investment, and report to the Prime Minister in September of 2019.

- Regarding the Project on constructing the Viet Nam - Germany Hospital and Bach Mai Hospital No. 2 in Ha Nam province: The Minister of Health shall be fully responsible for the progress, ensuring to complete and place these 2 hospitals into full use in 2020.

- Regarding investment projects of State enterprises transferred to the Committee for Management of State Capital at Enterprises: The Chairman of the Committee for Management of State Capital at Enterprises shall be responsible for removing problems in administrative procedures to ensure progress and effectiveness of investment projects.

b) Regarding the disbursement of the public investment plan in 2019:

- Ministers, heads of ministerial-level agencies, government-attached agencies, and Chairmen of People's Committees of provinces and centrally run cities shall focus on drastically directing investors and project management boards to speed up the implementation and disbursement of the assigned public investment plan in 2019; take full responsibility to the Prime Minister for any disbursement delays of their ministries, branches and provinces; synchronously perform the tasks and solutions set out in the Government's Resolution No. 70/NQ-CP dated August 3, 2017; Directive No. 09/CT-TTg dated April 1, 2019 and Official Letter No. 1042/CD-TTg dated August 21, 2019 of the Prime Minister; strictly review responsibilities and give strict punishments on organizations and individuals that intentionally violate, hinder, cause delay in the implementation and disbursement of public investment capital.

- Decisively transfer or withdraw public investment capital in 2019 assigned to ministries, branches and provinces that were slow in disbursement or incapable of disbursing, affecting progress and efficiency of public investment.

- The Ministry of Planning and Investment was assigned to assume the prime responsibility for and coordinate with the Ministry of Finance and related ministries, agencies and provinces in urgently preparing contents and programs for the national online conference on tasks and solutions to promote disbursement of public investment in 2019. The conference shall be chaired by the Prime Minister in September 2019.

c) Regarding some other key tasks:

- Ministries and branches, according to their functions and tasks, were assigned to manage macroeconomic policies in a flexible manner in order to promptly respond and at the same time create more room for state governance, promote economic growth and increase the resilience of the economy when facing adverse effects of the world and regional economy. They were requested to improve the quality of statistics, analysis and forecasting to serve state governance and administration work. A new policy testing framework shall be developed and issued for the deployment and application of new technologies in a shared economy model. Equitization and divestment following Decisions approved by the Prime Minister shall be promoted. Review, adjustments and formulation of new sectoral plannings shall be made to avoid duplication, wastefulness and ineffectiveness in investment. Ministries and branches were requested to expeditiously finalize the report on the socio-economic development plan in 2020 and the public investment plan in 2020, and send it to the Ministry of Planning and Investment and the Ministry of Finance for synthesis and reporting to the Government before submitting to the National Assembly as prescribed.

- The State Bank of Viet Nam shall continue to closely monitor fluctuations of domestic and international markets, manage monetary policy proactively and flexibly, and manage exchange rates accordingly. It was requested to congregate credit capital in priority areas, strictly control credit for high-risk areas, create favourable conditions to increase access to capital for small and medium enterprises and households, contributing to restricting black credit. The State Bank of Viet Nam shall continue to promote restructuring of credit institution system associated with bad debt handling; organize a preliminary review of the 2-year implementation of Resolution No. 42/2017/QH14 on piloting settlement of bad debts of credit institutions and Decision No. 1058/QD-TTg of the Prime Minister. It was requested to supervise, provide early warnings and prevent risks associated with the buying and selling of corporate bonds and granting of credits to customers for investment in corporate bonds at credit institutions. The State Bank of Viet Nam shall hold responsibility for ensuring security and safety in e-payment activities. It shall proactively work closely with relevant ministries and agencies to provide information and explanation to the multilateral assessment team of the Asia/Pacific group (APG) on money laundering prevention, in compliance with the Prime Minister's instructions at the meeting of the Steering Committee for money laundering prevention on September 3, 2019.

- The Ministry of Finance shall continue to tighten fiscal disciplines on state budget; strengthen inspection and examination and ensure publicity and transparency of the use of state budget. It was requested to ensure thrift practice and wastefulness combat, drastic saving on regular expenditures, strictly preventing spending on unnecessary tasks. The Ministry of Finance shall promote tax inspection and examination, take effective measures against tax loss due to transfer pricing, smuggling and trade frauds, and strictly collect tax arrears.

- The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with the Ministry of Finance and related ministries and agencies in, urgently reviewing and finalizing the allocation procedure, and report to the Prime Minister to assign the remaining foreign capital investment plan in 2019 within September of 2019. The Ministry of Planning and Investment was assigned to promote the establishment of a National Innovation Centre, assume the prime responsibility for, and coordinate with concerned ministries and branches in, formulating an action program to implement the Politburo's Resolution No. 50/NQ-TW on orientations to improve institutions, policies, enhance quality and effectiveness of foreign investment cooperation by 2030. It shall coordinate with the Ministry of Industry and Trade and the Ministry of Agriculture and Rural Development in proposing specific policies and solutions to actively attract and catch the new wave of investment, especially the world's leading technology corporations. The Ministry of Planning and Investment was requested to strengthen coordination with other ministries, branches and provinces to promote the implementation of policies supporting small and medium-sized enterprises according to the provisions of the Law on Support for Small- and Medium-sized Enterprises and guiding documents.

- The Ministry of Industry and Trade shall actively support a number of important petroleum projects including: Block B, Blue Whale, LNG Thi Vai and LNG Son My natural gas projects. It shall foster trade promotion, market expansion, and promote official export of Viet Nam’s advantageous goods. The Ministry was requested to strengthen advocacy for the EU’s early ratification of the EU-Viet Nam Free Trade Agreement (EVFTA) and accelerate the completion of Free Trade Agreements (FTAs) which remained in the negation process. The Ministry shall urgently complete the FTA negotiation plan with the United Kingdom to submit to the Prime Minister. It shall review and evaluate the implementation of the National Action Program on cleaner production and sustainable consumption in the 2016-2020 period, urgently complete and submit to the Prime Minister in the fourth quarter of 2019 for approval of the Program in the 2021-2030 period. The Ministry of Industry and Trade shall preside and coordinate with the Ministry of Finance, the Steering Committee 389 and the border provinces to direct functional forces to regularly closely monitor the market situation, actively take measures to prevent acts of evading trade remedies and requirements on goods origin, especially trade frauds, to protect domestic production.

- The Ministry of Agriculture and Rural Development shall regularly monitor the weather, natural disasters and water sources to guide provinces to take initiative in developing appropriate plans on production organization; promptly guide the prevention, combat and overcoming of natural disasters and epidemics consequences; evaluate crop restructuring in rice cultivation land; strengthen inspection and examination of trading activities of seeds, fertilizers and plant protection products; synchronously, drastically and effectively adopt recommendations made by the European Commission (EC) for Viet Nam to combat illegal, unreported and unregulated fishing; have a strategy of exploiting and production of aquatic products in a sustainable direction; review and evaluate to effectively exploit new fishing fleets according to Decree No. 67/2014/ND-CP of the Government. The Ministry shall guide provinces to apply biosafety practices in livestock production to repopulate and expand pig herd in non-epidemic areas and/or establishments which have sufficient conditions for safe production to actively prepare food supplies for Tet holidays. The Ministry of Agriculture and Rural Development shall actively prepare national conferences reviewing 10-year implementation of the National Target Program on New Rural Construction held in October 2019; 10-year review of food security; and a Conference on agro-forestry processing and agricultural mechanization.

- The Ministry of Transport shall coordinate with the Ministry of Industry and Trade to effectively implement the Action Plan to improve competitiveness and develop transport logistics services by 2025. The Ministry of Transport, the People's Committees of provinces and centrally run cities, and the Committee for Management of State Capital at Enterprises shall accelerate the implementation of non-stop automatic electronic toll collection system for all toll stations nationwide, ensuring to complete this no later than December 31, 2019.

- The Ministry of Culture, Sports and Tourism shall review and take solutions to remove limitations and shortcomings in tourism development; enhance tourism promotion and communication, improve the quality of tourism service and management, ensure security and safety for tourists as well as sustainable tourism development. The Ministry shall pay attention to developing literature and art. It was requested to improve the quality of training and enhancing capacity of talented athletes, especially those in a number of Viet Nam’s high-performance sports to raise Viet Nam's sports rankings in the region and the continent.

- The Ministry of Labor, Invalids and Social Affairs and related ministries and agencies shall actively deploy the Action Program to implement the Central Resolution on social insurance policy and salary policy reform; continue to handle backlogs of pending policies and properly deploy policies for people with meritorious services; synchronously adopt solutions to sustainable poverty reduction, especially for ethnic minorities in disadvantaged areas; ensure the comprehensive application of social security policies. The Ministry was requested to promote the implementation of measures to prevent and combat social evils, prevent violence, child abuse and domestic violence; synchronously adopt solutions to improve the quality of vocational training to meet market demands.

- The Ministry of Education and Training shall focus on directing the embarkment of the 2019-2020 school year in a practical and effective manner; strengthen the management of tuition and fees collection, taking measures to prevent over-collection in the beginning of the school year; ensure school security, safety and hygiene; attach importance to building school culture and equipping students with life skills; promote ethical and healthy lifestyle education; build a healthy, democratic and disciplined educational environment. The Ministry of Education and Training shall assume the prime responsibility for, and coordinate with the Ministry of the Home Affairs and the Ministry of Finance in formulating a teacher training/education mechanism based on practical demand/order to overcome the current shortage of teachers. The Ministry of Education and Training  was requested to review and reorganize the second-degree programs at university, so as to prevent the occurrence of negative practices; strictly and effectively apply policies on education and training development for disadvantaged areas, ethnic minority areas and policy beneficiaries.

- The Ministry of Health shall proactively and properly conduct activities to prevent and combat diseases; strengthen healthcare at grassroots level, continue to improve the quality of medical examination and treatment for the people, reduce hospital overcrowding to meet patients’ expectation. The Ministry shall promote the autonomy mechanism at healthcare facilities, encourage the development of private health services in association with strengthening management of health services quality, preventing over-collection to guarantee benefits and rights for insured people and policy beneficiaries, especially the poor, to access quality health services at reasonable costs.

- The Ministry of Science and Technology shall actively implement the Intellectual Property Strategy by 2030; improve the effectiveness and enforcement of intellectual property rights protection, decisively cope with violations of intellectual property rights, considering this as one of the important solutions to promote science and technology development and innovation in the international integration process. The Ministry shall work closely with related agencies to proactively propose solutions to catch up with and harness the trend of multinational corporations applying high-tech and environmentally friendly technologies. At the same time, it was requested to strictly control the import of outdated technology.

- The Ministry of Natural Resources and Environment shall take measures and sanctions to improve the effectiveness of environmental protection, especially plastic waste prevention; closely coordinate with the Ho Chi Minh Communist Youth Union, the Viet Nam Fatherland Front Committee and mass organizations to launch national movements on prevention of plastic wastes and zero plastic waste at coastal areas. It shall urgently conduct an assessment on the environment of the entire area and the surrounding areas of the fire at Rang Dong Light Source and Vacuum Flask JSC.

- The Ministries of National Defense, Public Security and Foreign Affairs shall regularly monitor, analyse and provide accurate forecast; synchronously apply solutions to firmly protect the national sovereignty and interests; propose solutions to proactively respond, strictly, promptly and effectively handle issues at sea, not to be passive and/or unprepared in any situation.

- The Ministry of Public Security shall reinforce political security, social order and safety, continue to open peak periods to combat and suppress all kinds of crimes, especially criminal acts and high technology crimes; assume the prime responsibility for, and coordinate with the Ministry of Finance and concerned ministries and agencies in rectifying third-party debt collection services. The Ministry was requested to provide direction to strengthen patrol activities to control and ensure traffic order and safety and minimize traffic accidents.

- The Ministry of Foreign Affairs shall properly prepare and organize high-level external activities; effectively realize the agreements reached during the Viet Nam visits by the Prime Minister of Australia and the Prime Minister of Malaysia.

- The Ministry of Information and Communications shall focus on developing information and communication technology infrastructure, piloting the deployment of 5G network system, coordinating with the Ministry of Public Security and the Ministry of National Defense in ensuring network information security and safety. The Ministry shall urgently submit to the Government a Project piloting the application and provision of public services via the public postal network and provincial public postal services, a Project on national number conversion, a draft Decree regulating electronic identification and authentication, a Project to improve the operation effectiveness of basic information by applying information technology, formulate a national program to publish essential cultural, social and political books; a Project to improve the quality of press publications on foreign affairs in foreign languages. The Ministry of Information and Communications shall direct news agencies to enhance communication to direct public opinion, timely combat and counter false allegations, create consensus, social trust and aspirations for a powerful Viet Nam.

- Ministries and agencies were assigned to closely coordinate with the Government Office to make proper preparation for national thematic conferences as planned; urgently complete reports submitted to the 11th plenum of the Party Central Committee and the 8th session of the 14th National Assembly; strictly adopt the General Secretary's direction at the monthly meeting of key leaders.

2. Regarding the Report on Socio-Economic Situation in 2019, and the Socio-Economic Development Plan 2020

The Ministry of Planning and Investment was assigned to collect comments of the Government members and complete the Report. The Party Affairs Committee of the Ministry of Planning and Investment shall report to the Party Affairs Committee of the Government for submission to the Politburo and the Party Central Committee as prescribed. The report must clearly assess key directive and executive performance of the Government, the Prime Minister, different levels and branches, specify breakthroughs, shortcomings and limitations, and identify appropriate solutions. And at the same time, the report shall meticulously review the targets, indicators, tasks and solutions in 2020, carefully analyse different factors, calculate and determine appropriate growth targets for 2020 to ensure sufficient ambition and feasibility.

3. Regarding adjustments of the foreign investment plan in 2019 among ministries, branches and localities

The Ministry of Planning and Investment was assigned to assume the prime responsibility for and coordinate with the Ministry of Finance in collecting comments of the Government members, finalizing the plan and reporting to the Prime Minister before September 20, 2019. On that basis, the Minister of Planning and Investment was authorized by the Prime Minister to act on behalf of the Government to report to the Standing Committee of the National Assembly for consideration and decision-making on adjustments of the foreign investment plan in 2019 among ministries, branches and provinces. It was requested to ensure compliance with capital allocation principles stipulated in the Law on Public Investment, in accordance with the project disbursement progress and commitments with foreign donors. If it is impossible to adjust the plan, investment capital must be transferred back to the Central Budget.

4. Regarding the implementation of the National Assembly's Resolution on explaining a number of articles of the Law on Planning

a) Regarding the preparation, evaluation and approval of master plans for the 2021-2030 period according to the Law on Planning:

- The Ministry of Planning and Investment was assigned to coordinate with the related ministries and branches in guiding the planning development prescribed in Clause 1, Article 1 of Resolution No. 751/2019/UBTVQH14 to ensure consistency, harmonisation, inheritance, stability and systematisation between planning documents; guiding project management, development of cost estimates for planning, conditions and procedures for allocating public investment capital for planning projects and tasks according to the regulations.

- The Ministry of Finance was assigned to guide the management and payment procedures of public investment capital arranged for the development, appraisal, decision-making or approval and adjustment of plannings in the national planning system, including procedures for management and payment of funding for planning development and evaluation.

b) Regarding the implementation and adjustment of the plannings, prescribed at Point c, Clause 1, Article 59 of the Law on Planning, for which decision had been made or approved before January 1, 2019:

- Ministries, branches and provinces shall base on the planning lists integrated in the national, regional and provincial plannings as prescribed at Point c, Clause 1, Article 59 of the Law on Planning, Resolution No. 751/2019/UBTVQH14 of the Standing Committee of the National Assembly and relevant laws before the effective date of the Law on Planning to make adjustments to their respective plannings to promptly meet socio-economic development requirements.

- The regular funding sources in the annual plan shall be used and must comply with regulations on the state budget to make, evaluate, approve and adjust urban and rural plannings, technical and specialized plannings and adjusted master plans according to Clause 2, Article 1 of Resolution No. 751/2019/UBTVQH14. Punctuality and flexibility in administration process must be ensured.

- The Ministry of Finance was assigned to guide ministries, branches and provinces in elaborating economic capital plans supporting the development of urban and rural plannings, technical and specialized plannings and adjusted master plans according to Clause 2, Article 1 of Resolution No. 751/2019/UBTVQH14 in the 2020 plan.

5. Regarding Reports: implementation of the state budget in 2019, the state budget estimates in 2020; the 3-year financial plan of the state budget in 2020-2022 and assessment of the 5-year implementation of the national financial plan in 2016-2020

The Ministry of Finance was assigned to assume the prime responsibility for and coordinate with the Ministry of Planning and Investment in collecting comments of the Government members, aggregating data, finalizing reports and taking responsibility for the contents and data of the reports. The Party Affairs Committee of the Ministry of Finance shall report to the Party Affairs Committee of the Government for submission to the Politburo and the Party Central Committee as prescribed.

6. Regarding the Report on the implementation of the financial plan in 2019 and the financial plan in 2020 of the central state-run financial funds

The Ministry of Finance was assigned to collect comments of the Government members and finalize the Report. The Minister of Finance was authorized by the Prime Minister to sign the report on behalf of the Government and submit it to the Standing Committee of the National Assembly and the National Assembly as prescribed.

7. Regarding the performance of assigned tasks and inspection results in August 2019 of the Government’s Working Group

a) Regarding the performance of assigned tasks:

Ministries and agencies were requested to urgently complete and submit pending projects in the Working Program before September 15, 2019. At the same time, they were requested to actively implement the Working Program in September 2019, not to create any further delays.

b) Regarding the promulgation of detailing documents:

Ministries and agencies were requested to focus on finalizing, submitting for promulgation or promulgating according to their competence outstanding documents before September 15, 2019, resolutely prevent any suspension of promulgation before the opening of the National Assembly meeting. At the same time, they were requested to actively study and develop 61 documents detailing laws that will take effect from 2020. The Ministry of Justice was assigned to closely coordinate with the Government Office to monitor, urge and review the formulation and issuance of legal documents.

c) Regarding simplifying administrative procedures, cutting down the list of specialized inspection goods and business conditions:

- The Ministry of Planning and Investment shall provide instruction on criteria and methodologies to unify the approach to calculate the number of business conditions and create a foundation for ministries and agencies to review, cut down and simplify their procedures. This must be completed in September 2019. The Ministry of Planning and Investment shall assume the prime responsibility for and coordinate with the concerned ministries and agencies in independently proposing a list of business conditions that need to be removed or simplified and reporting to the Prime Minister in October 2019.

- Each ministry and agency shall urgently review and propose plans to simplify and cut down the list of specialized inspection goods, as well as overlapping and obsolete business conditions in 2019. After reduction and simplification, administrative procedures must be publicized.

d) Regarding administrative regulations reform

- The Government agreed to adopt the principle that: When issuing a new document (legal or administrative document), at least one old document must be abolished, and compliance cost must be reduced for the people and businesses. The Government Office was assigned to provide specific instructions.

The Working Group shall continue to urge and inspect the performance of tasks assigned by the Government and the Prime Minister to ministries, branches and provinces and make public report at the Government's regular meeting.

8. Regarding the construction of e-Government:

The construction of e-Government under the Government's Resolution No. 17/NQ-CP dated March 7, 2019 had achieved a number of initial positive results, creating spill-over effects in the state administrative system. In order to further accelerate the implementation of the Resolution, promoting the Ministry of Information and Communications’ state management roles of information technology application and human resources related to information technology, the Government agreed to:

- Assign Deputy Prime Minister Vu Duc Dam to be the Standing Vice Chairman of the National Committee on E-Government to provide direct instructions on regular affairs of the Committee.

- Assign the Minister of Information and Communications to be the Vice Chairman of the National Committee on E-Government, taking prime responsibility to the Government and the Prime Minister for the implementation and performance of tasks and solutions for building an e-Government.

- Transfer the Standing Secretariat assisting the Chairman of the National Committee on E-Government from the Government Office to the Ministry of Information and Communications.

- Transfer the current tasks undertaken by the Government Office to the Ministry of Information and Communications from September 4, 2019, specifically:

Submit to the Prime Minister the Scheme on solutions for connecting, sharing data and restructuring information technology infrastructure in ministries, branches and provinces in 2019.

Develop a national axis to link documentations into an integrated platform for information system and database sharing by applying advanced technologies. This shall be a national integrated platform for data sharing. The Ministry of Information and Communications shall be responsible for ensuring the utmost connection safety of information systems serving the direction and administration of the Government and the Prime Minister at the request of the Government Office, ensure not to affect the progress of the tasks assigned by the Government and the Prime Minister.

Direct the opening of data, providing open data of the Government, integrating with Vietnamese digital knowledge system.

Quarterly report to the Government on the implementation of the Government's Resolution No. 17/NQ-CP dated March 7, 2019, study and develop a set of key performance indicators (KPIs) to measure and evaluate efficiency and quality of the development of E-Government and E-Government at provincial level.

- The Government Office shall continue to fulfil in a timely and effective manner the tasks of building the National Public Service Portal, the Government Reporting Information System and the Steering and Executive Centre of the Government and the Prime Minister in accordance with the tasks assigned by the Government in Decree No. 150/2016/ND-CP dated November 11, 2016, Decree No. 09/2019/ND-CP dated January 24, 2019 and Resolution No. 17/NQ -CP dated March 7, 2019 of the Government; properly fulfil the tasks of consulting on general matters, urging the implementation and synthesizing the progress and results of e-Government development at ministries, branches and provinces; and promote the application of information technology serving the direction and administration of the Government and the Prime Minister.

- Ministries, agencies and provinces shall select the services of the people’s interest and demand to provide online public services at level 3 and level 4, avoid impracticality and superficiality, causing unnecessary waste. Attention must be paid to building an electronic one-stop information system and ministerial-level and provincial-level public service portals connected to the National Public Service Portal. It was requested to strictly apply the sending and reception of electronic documents on the National Data Link Axis.

- The Ministry of Information and Communications was assigned to urgently submit the E-Government Architecture Framework (version 2.0) connecting the specialized data transmission networks of the Party and state agencies to the Public Service Portal, the one-stop electronic information system of ministries, branches and provinces. The framework must meet standards on information security and other specific tasks.

9. Regarding adjustments to the term and name of the "Strategy for domestic trade development by 2025, vision to 2035"

The Government agreed to adjust the strategy from "Strategy for domestic trade development by 2025, vision to 2035" to "Strategy for domestic trade development by 2030, vision to 2045". The Ministry of Industry and Trade was assigned to expeditiously complete the Draft Strategy and submit it to the Prime Minister for approval in the first quarter of 2020.

10. Regarding the addition of the 2019 non-refundable aid estimates for Program 135

The Government agreed to allocate Irish Government's non-refundable aid in fiscal year 2018 to five provinces: Ha Giang, Hoa Binh, Quang Tri, Kon Tum and Tra Vinh to implement the Project with a total capital of VND 77,490 million as proposed by the Committee for Ethnic Minorities in Document No. 17/TTr-UBDT dated August 28, 2019.

- The Minister of Planning and Investment was authorized by the Prime Minister to act on behalf of the Government to report to the Standing Committee of the National Assembly and the National Assembly on adjustments to the medium-term public investment plan for the 2016 - 2020 period and the investment plan in 2019 by adding the Irish Government's non-refundable aid for the 2017-2020 period for localities to implement the Support Program for extremely difficult communes under Program 135.

- The Committee for Ethnic Minorities was assigned to hold responsibility for aid allocation, take charge of instructing provinces to select the list of essential infrastructure projects prioritized for investment, the list of communes receiving aids, ensure compliance with the principles and criteria prescribed in Decision No. 1788/QD-TTg dated November 13, 2017 and the provisions of the Funding Agreement signed between representatives of the Governments of Viet Nam and Ireland.  The Committee for Ethnic Minorities shall assume the prime responsibility for, and coordinate with concerned ministries, branches and donors in directing, inspecting and evaluating the implementation, assessment of progress and efficiency of aid disbursement in provinces under the Funding Agreement signed between representatives of the Governments of Viet Nam and Ireland, as well as reporting to the Prime Minister as prescribed.

11. Regarding the plan to apply regulations on water surface and sea surface rents for petroleum activities implemented under petroleum contracts

- The Ministry of Finance was assigned to lead and coordinate with the Ministry of Justice, the Ministry of Natural Resources and Environment, and related ministries and agencies to evaluate the implementation of Decree No. 123/2017/ND-CP dated November 14, 2017 of the Government amending and supplementing a number of articles of the Decrees which stipulate the collection of land use levies, collection of land rents and water surface rents, propose amendments to regulations on water surface and sea surface rents applicable to petroleum activities while ensuring their suitability with characteristics of petroleum prospection, exploration and exploitation without affecting the petroleum investment environment.

- While Decree No. 123/2017/ND-CP has not been amended, the Government agreed to permit the exemption of water surface and sea surface rents for PSC Lot 15-2/17 and the PSCs which were or shall be negotiated and signed in the coming time.

- The Ministry of Natural Resources and Environment was assigned to assume the prime responsibility for and coordinate with the Ministry of Finance and the Ministry of Justice in urgently completing and submitting to the Government for promulgation a Decree replacing Decree No. 51/2014/ND-CP dated May 21, 2014 promulgating the allocation of certain maritime areas to organizations and individuals for exploitation and use of marine resources, which must not overlap or conflict with other relevant regulations.

12. Regarding the draft Resolution of the National Assembly on the management and use of revenues from equitization and divestment of state capital at enterprises

The Ministry of Finance shall assume the prime responsibility for and coordinate with the Ministry of Justice, the Government Office and concerned ministries and agencies in collecting comments of the Government members, finalizing the draft Resolution according to Document No. 7691/VPCP-QHDP dated August 27, 2019 of the Government Office, and reporting to the Prime Minister before reporting to the Standing Committee of the National Assembly.

The Minister of Finance was authorized by the Prime Minister to act on behalf of the Government to sign the proposal on the draft Resolution submitted to the Standing Committee of the National Assembly at its meeting; and concurrently submit the draft Resolution to the Ministry of Justice.

The Minister of Justice was authorized by the Prime Minister to report to the Standing Committee of the National Assembly on behalf of the Government on the addition of the above-mentioned draft Resolution to the law- and ordinance-making program in 2019 as prescribed before submitting to the National Assembly for consideration and decision-making following the shortened order and procedures.

The Prime Minister was assigned to decide and direct the collection of the Standing Committee of the National Assembly’s comments, finalize the draft Resolution before submitting it to the National Assembly.

13. Regarding the proposal to develop a Decree replacing Decree No. 36/2018/ND-CP on the management of unmanned aircraft and ultralight aircraft

The Government unanimously agreed to approve the proposal to develop a Decree replacing Decree No. 36/2018/ND-CP. The Ministry of Defense was assigned to assume the prime responsibility for and coordinate with the concerned ministries and branches in drafting a Decree and submitting it to the Government in the first quarter of 2020.

14. Regarding the draft Law amending and supplementing a number of articles of the Law on Entry, Exit, Transit and Residence of Foreigners in Viet Nam

The Ministry of Public Security was assigned to assume the prime responsibility for and coordinate with the Ministry of Justice and the Government Office in collecting comments of the Government members, adjusting and improving the draft Law, and reporting to the Prime Minister before the Minister of Public Security, on behalf of the Government as authorized by the Prime Minister, report to the National Assembly as prescribed./.
