RESOLUTION

THE GOVERNMENT’S REGULAR MEETING – APRIL 2019

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;

Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in April 2019, held on May 04, 2019,

DECIDES

1. Regarding the socio-economic situation in April and the first 4 months of 2019, and the implementation of the Government’s Resolutions No. 01/NQ-CP and 02/NQ-CP

The Government agreed that the socio-economic situation in April and the first 4 months of 2019 continued to witness positive developments. Macroeconomic conditions were relatively stable; inflation was kept under control; the average consumer price index (CPI) in the first 4 months of 2019 grew by 2.71%, the lowest four-month growth in three years; interest rates and foreign exchange rates were relatively stable; foreign exchange reserves continued to augment. Agricultural, industrial and services production maintained growth momentum. Total demand escalated sharply, in which total retail sales of consumption goods and services increased by 11.9%, the highest growth rate since 2015. The number of international visitors to Viet Nam augmented by 7.6%. State budget revenue recorded decent results. Foreign direct investment inflows rose by 81%; total disbursed FDI was estimated at US$5.7 billion, up 7.5% compared with the same period last year. Exports increased by 5.8%, trade surplus was maintained. Business investment environment continued to improve, there were more than 43,000 newly registered enterprises, up 4.9% in terms of number and up 31.7% in terms of registered capital; the number of enterprises returning to operation increased by 52.6%. The fields of culture, society, education and training, science and technology, health care, labor, employment, and communication received due attention. People's lives continued to improve. National defense, security, social order and safety were maintained, especially during the anniversary of Southern Liberation and National Reunification Day on April 30th. Foreign affairs were implemented effectively and achieved a number of significant outcomes.

In addition to the above-mentioned achievements, there remain a number of weaknesses and shortcomings which must be addressed as well as difficulties and challenges faced by the country. Viet Nam was forecasted to suffer complicated and unforeseeable weather conditions, especially the risks of hot weather and droughts in the Central and Southeast regions and a number of provinces. Animal epidemics remained, especially the African swine fever. Price of a number of crops fell sharply, creating negative impacts on agricultural production. Sharp increase in global oil and gas prices was forecasted to create additional pressure on inflation. Slow world economic growth and international trade were projected, causing great impact on domestic economy. Viet Nam’s exports were expected to slow down. Exports of a number of key industrial products were projected to either increase at a lower speed or decrease. Disbursement of public investment capital was not satisfactory enough. Enterprises, especially small- and medium-enterprises, still had to face with a number of difficulties in production and business. Efforts to reduce business conditions and specialized inspection were not implemented in a drastic manner. Many complex societal problems still occurred in a few provinces.

Given the substantial tasks from now until the end of the year, the Government requested ministries, agencies and localities to make their best effort to overcome difficulties and challenges, determine to complete their objectives and plans; each member of the Government, Chairmen of the People's Committees of provinces and centrally-run cities must raise individual roles of leadership, continue to embrace the action motto in 2019 of “Discipline, Integrity, Action, Creativity, Effectiveness”, direct the drastic, comprehensive and effective implementation of tasks and solutions set out in the Government's Resolutions No. 01/NQ-CP and 02/NQ-CP dated January 1, 2019; Directive No. 09/CT-TTg dated April 1, 2019 of the Prime Minister; closely abide by targets on GDP growth set out in quarter growth scenario for each sector and field, closely follow up with domestic and global conditions to provide appropriate responses, fortify administrative disciplines and order, maintain regular monitoring, rectification and inspection; pay due attention to administrative procedure reform in a substantial and effective manner; speed up the handling and resolving of difficulties and barriers to promote production and business development in service of the people and enterprises; determine to comprehensively complete socio-economic development targets, indicators and tasks in 2019. Attention should be paid to the implementation of some of the following contents:

- Continue to consistently abide by targets on inflation control, macroeconomic stability maintenance and growth promotion. The Ministries of Planning and Investment, Industry and Trade, Finance, the State Bank of Viet Nam and the National Steering Committee on Price Management shall regularly monitor and provide analysis, assessment, forecasts, closely coordinate with each other in managing monetary, fiscal and other macro policies to promptly and effectively respond to changes in domestic and foreign situations; promote communication and dissemination activities, provision of objective, comprehensive and accurate information about price administration and the adoption of market price roadmap for essential goods to create consensus in the society.

- The State Bank of Viet Nam shall actively and flexibly regulate the monetary policy in line with the actual situation, closely coordinating with other macroeconomic policies, ensuring to control inflation within the set target, adopting measures to ensure reasonable credit growth, contributing to promoting production and business. The State Bank of Viet Nam shall continue to drastically restructure credit institutions associated with handling bad debts, ensuring credit quality and system safety, as well as promoting non-cash payment and preventing and/or reducing black credit.

- The Ministry of Finance shall continue to tighten and strengthen state budgetary and financial disciplines, promote the restructuring of the state budget, properly perform the management of state budget revenues and expenditures, closely monitor state budget expenditures, adopt saving practices on regular expenditures, especially expenditures on purchases of expensive automobiles, equipment and other expenses associated with event and conference organization. The Ministry was requested to promote the use of electronic invoices for businesses, expand the pilot application of electronic invoices for households and individuals in Ha Noi and Ho Chi Minh City, strengthen inspection, examination and prevention of tax loss, tax arrears, transfer pricing and tax evasion. The Ministry of Finance shall expeditiously report to the Prime Minister on the allocation of funding for the implementation of the Scheme on provision of television services to communicate and disseminate information on diplomatic activities, disaster prevention and mitigation to serve the community, information on agriculture, farmers and rural areas in the 2018-2020 period to Viet Nam Multimedia Corporation (VTC) Digital Television before May 15, 2019. The Ministry of Finance shall preside and coordinate with the Ministry of Planning and Investment in allocating the state budget capital utilizing the state budget revenue increase in 2018 from the My Thuan - Can Tho Expressway Project according to regulations, ensuring the completion of the project in sync with Trung Luong - My Thuan and My Thuan 2 Bridge Projects. This shall be reported to the Prime Minister in May 2019.

- Deputy Prime Minister Vuong Dinh Hue was assigned to direct the Ministry of Planning and Investment to complete the allocation of the remaining state investment plan in 2019, including adjusting the investment plan of ministries, branches, and localities as well as investment plan shared by ministries, branches and localities in May 2019.

- The Ministry of Planning and Investment shall urgently finalize and submit to the National Assembly the (revised) Law on Public Investment; develop, finalize and submit to the Government the Law on Public-Private Partnership (PPP) Investment in August 2019. The Ministry of Planning and Investment shall preside over and coordinate with ministries, agencies and localities to review, synthesize and report on the implementation of assigned tasks in Resolution No. 02/NQ-CP of each ministry, branch and locality and the situation of online bidding over the past time, which shall be reported to the Government at the regular meeting in May 2019. The Ministry of Planning and Investment shall strengthen supervision, inspection, examination and urging ministries, branches and localities having low disbursement rates, especially projects and units with large capital use. It shall study and propose a few solutions to promote the disbursement of public investment capital, review and report to competent authorities to transfer capital from units with low disbursement rate to units with high demand and/or high disbursement rate.

- Ministries, branches and localities shall continue to strictly adopt the Government's Resolution No. 70/NQ-CP dated August 3, 2017 on the main tasks and solutions to speed up the implementation and disbursement progress of public investment capital, strictly review and clarify the responsibilities of organizations and individuals causing delays in the implementation of public investment plans, creating loss and waste of state resources.

- The Ministry of Agriculture and Rural Development shall assume the prime responsibility for and coordinate with ministries, branches and localities in continuing to synchronously and drastically apply measures to prevent and combat epidemics on animals and plants, take control and soon put a stop to the spread of the African swine flu. The Ministry of Agriculture and Rural Development shall closely monitor the weather situation, actively direct the prevention and fight against and overcoming consequences of natural disasters, droughts and hot weather, sufficient water supply for daily life and production, and forest fire prevention and fighting. The Ministry was assigned to formulate plans to meet the requirements of importing countries on labelling for traceability of origin and geographical indications for exported agricultural, forestry and fishery products, ensuring food hygiene and safety, meeting export standards of EU and Japan markets. The Ministry of Agriculture and Rural Development shall collaborate with coastal localities to continue to adopt measures to prevent illegal fishing.

- The Ministry of Industry and Trade shall closely monitor the production and business situation in the industrial sector, especially the processing and manufacturing industries. Attention shall be paid to  encouraging technological innovation, strengthening production capacity, expanding markets, and promoting exports. The Ministry of Industry and Trade shall proactively solve difficulties and obstacles to create favourable conditions for implementing industrial projects. The Ministry was requested to formulate a plan in the second quarter of 2019 to ensure sufficient electricity supply for daily life and production, develop the Government's Action Program to implement Politburo’s Resolution No. 23-NQ/TW on the orientation to develop national industrial development policies by 2030, with a vision to 2045. The Ministry of Industry and Trade and the Viet Nam Electricity Group shall urgently provide full explanation of the plan to increase electricity prices and report to the Prime Minister before May 15, 2019. The Ministry shall promote the prevention of trade frauds and goods imitation, fake goods, poor quality goods; and take measures to prevent foreign goods from being labelled as Vietnamese for smuggling purposes or export to a third country. Based on assigned functions and tasks, the Ministry of Industry and Trade shall collaborate with the Ministry of Transport to identify and formulate goals, solutions and plans to develop logistics services; review and propose to competent authorities to revise relevant legal documents.

- Deputy Prime Minister Trinh Dinh Dung was assigned to direct the Ministry of Industry and Trade, the Committee for Management of State Capital at Enterprises, the Viet Nam Electricity Group to identify specific solutions to rigorously promote the implementation of electricity projects, ensuring sufficient electricity supply for daily life and production.

- The Ministry of Transport shall accelerate the preparation to promptly implement key projects such as the Long Thanh International Airport Project, the Tan Son Nhat Airport Expansion Project and the North - South Expressway Project. The Ministry shall closely coordinate with related ministries, branches and localities, completing necessary procedures to speed up the completion of Trung Luong - My Thuan and My Thuan - Can Tho Expressway Projects by 2020 and bring the route into operation by 2021. The Ministry shall strengthen quality management, promote construction and disbursement progress of projects, especially key projects of the industry. It was requested to urgently submit to the Government the amendment and supplement to Decree No. 46/2016/ND-CP on administrative sanctions in the field of road and railway transport June 2019.

- The Ministry of Construction shall closely monitor the real estate market; urging localities to build information systems and databases on housing and real estate market; quickly proposing mechanisms for management and development of new types of real estate; continuing to implement the National Housing Development Strategy, promote social housing development; proposing mechanisms and policies to encourage the development of rental houses and houses for low-income people; coordinating to urge localities to strengthen the management of capital construction investment and overcome negative issues. The Ministry of Construction shall report to the Prime Minister on the management of planning and exploitation of urban land for community welfare facilities in the third quarter of 2019.

- The Ministry of Culture, Sports and Tourism shall continue to foster tourism promotion, fortify the management and quality control of tourism services while ensuring security and safety for tourists, promote the application of information technology in tourism services, strengthen inspection and in a timely  manner prevent negative manifestations, taking advantage of festivals, religious beliefs, and superstitions to gain illicit profits, and promote communication and dissemination of good traditional cultural values ​​of the nation.

- The Ministry of Home Affairs shall preside over and co-ordinate with the People's Committee of Ha Nam province, Viet Nam Buddhist Sangha and related agencies and localities to successfully organize the Vesak 2019 celebration.

- The Ministry of Labor, War Invalids and Social Affairs shall properly organize activities of the Action month on occupational safety and health in 2019, coordinating with relevant ministries and agencies to direct and strictly handle profiteering of social insurance and unemployment insurance policies, comprehensively adopting social security policies to support disadvantaged people, disabled people, elderly people and orphanages, coordinating with the Ministry of Education and Training and other related ministries, agencies and localities to take the initiative in planning and organizing healthy entertainment activities while ensuring safety and preventing child drownings in the summer.

- The Ministry of Health shall actively take measures to prevent and control contagious diseases and seasonal epidemics, actively implementing measures to reduce hospital overcrowding, strengthening communication, education and awareness raising for the people, coordinating with related ministries, branches and localities in implementing measures to ensure food safety and strict handling of violations.

- The Ministry of Education and Training and other ministries and agencies shall direct and handle strictly negative cases and violations in the national high school graduation and university entrance exams in 2018, preparing and properly organize the national high school graduation and university exams in 2019, ensuring the most favourable conditions for students and their families, as well as examination quality and transparency, preventing occurrence of violations.

- The Ministry of Natural Resources and Environment shall monitor the weather developments, timely providing forecast and information to support production and disaster prevention, actively implementing programs and projects to respond to climate change, enhancing communication and awareness raising to change behaviours of the people in environment protection, especially the disposal of plastic waste in daily life.

- The Ministry of Science and Technology shall effectively implement the Scheme for "Developing Vietnamese digital knowledge system", urgently submitting to the Prime Minister a draft National Strategy on Intellectual Property to develop and exploit intellectual properties for economic development, a draft Directive to promote the Fund to boost Science and Technology Development at enterprises, supporting and promoting the spirit of creativity, innovation and technology transfer activities at enterprises, business groups and corporations.

- The Ministry of Foreign Affairs shall be responsible for organization of high-level diplomatic activities of the Party and State leaders, coordinating with relevant ministries and agencies to promote the implementation of the signed economic agreements and treaties, removing barriers in economic cooperation, boosting trade promotion, investment and tourism abroad.

- The Ministry of Public Security shall focus on directing the prevention, fighting and timely deterrence of all conspiracy activities; ensuring political security and stability and that due attention is paid to strategic and key areas; continuing to deploy plans to attack and suppress crimes, especially drug crimes, high-tech crimes and transnational crimes; strengthening patrol and control, ensuring traffic order and safety; and deploying measures to prevent and fight fire and explosion.

- The Ministry of National Defense shall closely monitor the border and islands situation, coordinating with the Ministry of Foreign Affairs to provide timely and appropriate advices and avoiding passivism in any situation.

- The Ministry of Information and Communications shall develope a draft Directive of the Prime Minister to promote the development of Vietnamese technology enterprises, which will be submitted in June 2019; fortifying monitoring and warning on cyber security; directing press and communication agencies to promote timely communication of accurate information, especially information of new policies to create consensus in the society; and strengthening management efficiency to control the provision of false and untrue information affecting the prestige and honour of individuals and organizations on social networks.

- Ministers and heads of ministerial-level agencies shall concentrate on directing the proper preparation of projects and reports in service of the 10th Plenum of the Party Central Committee and the 7th working session of the 14th National Assembly; actively directing the review and promptly handling of shortcomings and weaknesses and/or outstanding and complex issues under their respective ministries and branches, especially issues concerned by voters; summarizing comments and recommendations of representatives of the National Assembly and the Viet Nam Fatherland Front to provide explanation.

- Ministries, agencies and localities shall, based on their assignments, closely collaborate with the Government Office, paying full attention to properly prepare for the Government's symposia set out in 2019; focusing on overcoming and addressing issues raised at the Viet Nam Private Sector Economic Forum 2019.

- Related ministries, branches, localities and agencies shall positively, urgently and seriously fulfil the tasks of summarizing and evaluating the implementation of socio-economic development strategy for the 2011-2020 period and the 5-year plan in the 2016-2020 period; developing socio-economic development strategy for the 2021-2030 period and the 5-year plan in the 2021-2025 period; reporting to the Ministry of Planning and Investment, the standing body of the Sub-committee on Socio-Economic Affairs of the 13th National Party Congress for synthesis and reporting according to regulations.

2. Regarding the re-evaluation results of the Gross Domestic Product (GDP) in the 2010-2017 period

The Government agreed on the re-evaluation results of the GDP in the 2010-2017 period. The Minister of Planning and Investment was assigned to collect comments of the Government members to finalize the report, and act on behalf of the Prime Minister to report to the Politburo on the announcement and use of the re-evaluation results of the GDP in the 2010-2017 period and guide ministries, agencies and localities to use the results of the GDP revaluation as a basis for designing the 5-year socio-economic development plan in the 2021-2025 period and developing the socio-economic development strategy for the 2021-2030 period.

The Ministry of Information and Communications was assigned to coordinate with the Ministry of Planning and Investment (the General Statistics Office) and related ministries and agencies to communicate and disseminate the re-evaluation results of the GDP scale in the of 2010-2017 period to unify calculation methodology in evaluating socio-economic situation and developing socio-economic development strategies and plans in the coming time

3. Regarding the plan to use the remaining domestic central budget capital for contingencies and the VND 10,000 billion from adjustments to reduce the capital estimates allocated to important national projects and 10% contingencies at ministries, branches and localities in the medium-term public investment plan for the 2016-2020 period.

The Ministry of Planning and Investment was assigned to collect comments of the Government members, finalize the report and submit it to the Prime Minister before reporting to National Assembly Standing Committee at its 34th session and to the National Assembly as prescribed by law.

4. Regarding the preparation progress for the 7th session of the 14th National Assembly

The Government requested that:

- Government members raise personal responsibility, take responsibility to the Prime Minister for preparing documents for the 7th session of the National Assembly as assigned, ensuring that these documents are sent to the National Assembly before May 10, 2019 (in addition to the contents which require additional comments of the Standing Committee of the National Assembly at the 34th session). At the same time, the Government members take initiative in grasping key outstanding issues concerned by delegates of the National Assembly and voters within the state management scope of their ministries and branches to provide proper explanation in questioning and answering questions.

- Chairmen of People's Committees of provinces and centrally-run cities review and strictly implement the directions of the Prime Minister and conclusions of the Government Inspectorate on citizen reception, complaint and denunciation settlement.

5. Regarding the draft (revised) Labor Code

The Ministry of Labor, Invalids and Social Affairs was assigned to collect comments of the Government members, continue to consult the people on the draft (revised) Labour Code, revise and complete this draft Labor Code. The Minister of Labor, Invalids and Social Affairs was authorized by the Prime Minister to act on behalf of the Government to report to the Standing Committee of the National Assembly.

6. Regarding the promulgation of detailing legal documents and the implementation of tasks and recommendations of the Working Group in April 2019

a) Regarding the issuance of detailing legal documents:

The Government requested:

- Ministries and ministerial-level agencies strictly implement the Prime Minister's directions in Document No. 2965/VPCP-PL dated April 11, 2019 on the submission of documents detailing the implementation of laws and ordinances.

- Ministries of Planning and Investment, Transportation, Agriculture and Rural Development, Science and technology, Construction, Culture, Sports and Tourism, and Finance urgently complete and submit to the Government for promulgating decrees detailing respective regulations, ensuring that there are no backlog of detailing documents before the opening of the 7th session of the 14th National Assembly. Ministers of the above-mentioned ministries were requested to hold accountability to the National Assembly and the Government for suspension in the issuance of any detailing legal documents.

- Ministries of Public Security, Industry and Trade, National Defense, Education and Training, and the Government Inspectorate shall promptly submit to the Government for issuance of detailing decrees prior to May 15, 2019. These decrees were projected to take effect from July 1, 2019.

b) The Working Group was assigned to urge and inspect the implementation of the tasks assigned by the Government and the Prime Minister to ministries, agencies and localities, focusing on the assigned tasks in Resolution No. 01/NQ-CP and No. 02/NQ-CP; the development and promulgation of legal documents; the implementation of projects in the working program of the Government and the Prime Minister, and make public report at the Government meeting.

7. Regarding the draft Decree detailing the implementation of a number of articles of the Law on Planning

The Ministry of Planning and Investment was assigned to assume the prime responsibility for and coordinate with the Government Office in collecting comments of the Government members, finalizing and submitting to the Prime Minister for signing for promulgation.

The Government agreed on the policies to be reported to the National Assembly Standing Committee on the draft Resolution of the National Assembly on the implementation of the Law on Planning, which includes the provisions recognizing the validity of regulations related to planning which had been amended at the Law amending and supplementing to a number of articles of 11 Laws related to planning, the Law amending and supplementing a number of articles of 37 Laws related to planning and the Ordinance amending and supplementing a number of articles of 04 Ordinances related to planning until the planning at national, regional and provincial levels for the  2021-2030 period have been decided or approved in accordance with regulations. Deputy Prime Minister Trinh Dinh Dung was assigned to direct the Ministry of Planning and Investment to complete the draft Resolution; the Minister of Planning and Investment was assigned to report to the National Assembly Standing Committee.

8. Regarding the Proposal to develop a draft Resolution of the National Assembly on a number of corporate income tax policies to support and develop micro and small enterprises

The Government unanimously agreed to approve the Proposal to develop a draft Resolution of the National Assembly on a number of corporate income tax policies to support and develop micro and small enterprises. The Ministry of Justice was assigned to assume the prime responsibility for and coordinate with the Ministry of Finance in finalizing the dossier of the Proposal to develop a draft Resolution of the National Assembly on a number of corporate income tax policies to support and develop micro and small enterprises. The Minister of Justice was authorized by the Prime Minister to act on behalf of the Government to report to the National Assembly Standing Committee on the addition of this draft Resolution to the National Assembly's law- and ordinance making program in 2019.

9. Regarding the draft Resolution on pilot autonomy for 04 hospitals under the Ministry of Health

The Ministry of Health was assigned to assume the prime responsibility for, and coordinate with the Ministry of Justice and the Government Office in collecting comments of the Government members at the meeting and appraisal opinions of the Government Office, completing the Draft Resolution and submitting to the Prime Minister for signing and issuance before May 15, 2019.

10. Regarding the draft Report on the situation and results in addressing shortcomings and inefficiencies of projects and enterprises in the Industry and Trade sector

The Government agreed with the draft Report on the situation and results in addressing shortcomings and inefficiencies of projects and enterprises in the Industry and Trade sector submitted by the Ministry of Industry and Trade. The Minister of Industry and Trade was authorized by the Prime Minister to act on behalf of the Government to sign the report and submit it to the Party Central Committee’s Secretariat and the 7th working session of the 14th National Assembly.

11. Regarding the continued application of the contents allowing the use of Oil and Gas Exploration Fund according to the Government's Decree No. 06/2015/ND-CP

Pursuant to Clause 4, Article 3 of the Government's Working Regulation, the Government agreed with the report of the Government Office on the continued application of the contents allowing the use of Oil and Gas Exploration Fund according to the Decree No. 06/2015/ND-CP of the Government./.
