Question: What are the purposes and objects of the application as stipulated in Circular 23/2017/TT-BLDTBXH (Circular 23) guiding the issuance of work permits to foreign employees working in Viet Nam via an electronic portal?

Answer:

Circular 23 provides additional guidance on the mode of receiving new application files online through level 3 online public services (allowing users to fill in and submit forms to online agencies and organizations providing services online).

Accordingly, this Circular will also apply to foreign employers and employees as foreign citizens working in Viet Nam as provided for in Article 2 of Decree No. 11/2016/NĐ-CP (in the form of labor contract performance; intra-corporate transfers, performance of contracts or agreements in regards to economics, trade, finance, banking, insurance, science and technology, culture, sports, education, occupation and medical education; working for foreign nongovernmental organizations and international organizations in Viet Nam. 

The Circular also stipulates that employers, upon conducting electronic transactions hereunder, must have an electronic transaction account to log into the portal./.
