Procurement of unmanned aerial vehicles

VGP – Regulations on management of unmanned aircraft and ultra-light aircraft are stipulated at Decree 58/2010/ND-CP and Decree 79/2011/ND-CP.

Question: A tourism company in Ho Chi Minh City intends to buy flying camera (fly cam) to serve its customers’ demands for shooting and photography.  It asked for what requirements for importing and using the device need to be fulfilled.

Answer:

According to the Warfare Department of the Viet Nam People's Army, unmanned aerial helicopters and micro-light aircraft are special vehicles and need to be closely managed to ensure security and national defense, safety of aviation operation, order, and social security.

The Government on March 28, 2008 issued Decree 36/2008/ND-CP (Decree 36) on management of unmanned aircraft and ultra-light aircraft and Decree 79/2011/ND-CP (Decree 79), dated September 5, 2011 to amend and supplement some articles of Decree 36.

The two decrees prescribes the management of unmanned aircraft and ultralight aircraft; organization of flight activities; grant of flight licenses and management of flights of unmanned aircraft, unpiloted balloons, gliders and piloted balloons which do not take off from and land on airfields opened for civil activities.

Accordingly, subjects of application include Vietnamese and foreign organizations and individuals in Viet Nam who import, export, manufacture or trade in unmanned aircraft and ultralight aircraft.

The Ministry of Defense shall perform the unified management, administration and supervision of flights of unmanned aircraft, unpiloted balloons, gliders, piloted balloons which do not take off from and land on airfields opened for civil activities. The management covers: (1) Establishing, licensing, answering inquiries about and announcing zones in which flight activities are permitted (flight zones); (2) Designating agencies, organizations or units to manage and supervise flight activities; (3)The agency directly in charge of management, administration and supervision of flights is stated in each flight license.

Regarding competence to license, refuse or terminate flight activities; the Operations Bureau of the General Command Post licenses or refuses to license flights of unmanned aircraft, unpiloted balloons, gliders, piloted balloons which do not lake offfrom or land on airfields opened for civil activities.
