RESOLUTION

On major solutions guiding and directing the realization of
the Plan for socio-economic development and state budget estimate in 2013

In 2012, the economy faced a number of difficulties and challenges during the period when the world economy experienced complicated and unpredictable changes. However, thanks to the leadership of the Party, the drastic direction of the Government, great efforts of sectors, business community and people at all echelons, our national economy continued to progress and gained significant results in curbing inflation, maintaining macro-economic stability and social security: inflation rate was kept at 6.81%; export continued to grow up, contributing to better import-export balance; monetary, credit and financial balances were maintained; foreign exchange market and exchange rate were stabilized; foreign reserve increased. Agriculture continued to develop; tourism and service sectors saw fairly high growth. Social security policies received due attention and people’s life was improved. Political security and social safety were guaranteed; national defense and security strengths were enhanced; diplomatic work continued to bring about positive results.

However, inflation pressure and macro-economic instability were rather big; the monetary market was not really stable, the lending interest rate, though going down, was still high, bad debts tended to increase; production and business were difficult, especially in accessing to credit sources, and inventories were big; the real estate market was frozen; the stock market sharply dropped. People’s life, especially the poor, low-income laborers, and beneficiaries of social policies, was still difficult. The number of traffic accidents remained quite high. Complaints, crimes, social evils and corruption were complicated. Such realities require greater efforts and higher determination from the whole political apparatus, the business community and people in the time to come.

The overall objectives of the National Assembly-approved Plan for socio-economic development in 2013 are: To strengthen macro-economic stability; to gain lower inflation and higher growth than in 2012. To speed up the realization of three strategic breakthroughs which are associated with economic restructuring and changing the model of growth. To guarantee social security and welfare. To improve diplomatic work and international integration. To consolidate national defense and security while maintaining political and social stability. To lay more solid foundations for development in the following years.

The major norms set for 2013 include: GDP grows by 5.5%; export turnover rise by 10%; the excess of imports over exports accounts for 8% of the total export turnover; State budget overspending is not higher than 4.8% of GDP; CPI increases about 6-6.5%; the total development investment accounts for 30% of GDP; the proportion of poor households drops by 2% in general and by 4% in poor districts; about 1.6 million laborers have jobs; the urban unemployment rate is below 4%; the rate of trained laborers reaches 49%; the rate of below-5-year-old malnutrition is slashed down below 16%; the number of sick-beds per 10,000 people (excluding beds at communal clinics) is 22; 84% of environment polluting cases are treated; 75% of industrial parks and export processing zones have standard concentrated sewage treatment systems; forest coverage reaches 40.7%; 79% of urban population are supplied with clean water; and 84% of wastes are collected and treated properly.

To fruitfully put into reality the National Assembly’s resolutions on the Plan for socio-economic development and state budget estimate in 2013, the Government requires ministries, central agencies, and provincial-level People’s Committees to direct and organize the implementation of the following solutions:

 

Part I

MAJOR SOLUTIONS TO DIRECT THE IMPLEMENTATION OF
THE PLAN ON SOCIO-ECONOMIC DEVELOPMENT AND STATE BUDGET ESTIMATE IN 2013

 

I. STRENGTHENING MACRO-ECONOMIC STABILITY AND INFLATION CONTROL

1. Realizing flexible monetary policies in a careful and effective manner

The State Bank of Viet Nam shall play as the main implementer, in collaboration with ministries, agencies and local governments:

- Realize monetary policies carefully and effectively; apply flexibly and fruitfully instruments of these policies; closely attach them with fiscal policies in order to curb inflation, enhance macro-economic stability and maintain proper growth;

- Manage interest rates and credit in line with macro-economic changes, so as to rein in inflation and support economic growth; secure liquidity safety and performance of credit organizations and the whole economy;

- Adjust exchange rates according to market signals in order to maintain the value of Vietnamese currency; promptly perfect mechanisms to manage and stabilize the gold market, so that the price of gold in domestic market is equivalent to that in international market; take synchronous measures in improving international balance of payment and raising the State foreign reserve;

- Expand cash-free payment through the banking system; further implement the Plan on popularizing cash-free payment in 2011-2015 approved in the Prime Minister’s Decision 2453/QĐ-TTg dated December 27, 2011;

- Complete the restructuring of weak financial and credit organizations; resolutely deal with legal violations in financial and banking activities; support the healthy development of the stock market.

2. Tightening fiscal policies and thrift practice

a) The Ministry of Finance shall act as the main implementer, in collaboration with ministries, agencies and local governments:

- To realize synchronously and effectively State budget-related solutions, fulfilling budget collection and spending in conformity with the estimates decided by the National Assembly; strive to raise budget collection while saving expenditures to have funds for urgent items of spending; keep the budget overspending not higher than 4.8% of GDP;

- To further prevent the loss of revenue, clear tax debts, and prevent price conversion; promote tax inspection, especially in the fields and items with highly possible loss of revenue; build tax database; enforce sanctions and laws on tax; enhance and diversify legal information, assistance and advice on taxation; sum up, evaluate and propose proper solutions for encouraging, mobilizing and using revenues from land, resources, and public properties, especially land, and report to the Prime Minister in the 2nd quarter of 2013;

- To review and strictly manage all expenditures within the frame of estimates approved by competent agencies and in line with regulations; take measures to prevent loss, waste and corruption; guide the realization of the Prime Minister’s Instruction 30/CT-TTg dated November 2012 on strengthening thrift practice and anti-prodigality; save regular expenditures, especially for purchasing vehicles, organizing festivals, meetings, seminars, signing ceremonies, groundbreaking ceremonies, and title conferments, and paying for electricity, water supply, telephone charges, stationary and other costs;

- To calculate and realize State budget estimate in association with development strategies and orientations in specific periods, guaranteeing sustainability of the State budget while showing the order of priority in distributing the State budget in each and every sector and field;

- To work with ministries, sectors and local governments to design and issue financial mechanisms and policies for realizing national target programs;

- To strictly keep financial and budget discipline; boost inspection and supervision over the use of the State budget; check, monitor and inspect items of spending in the budget balance, expenditures managed through the State budget, loans for refinancing, Government-guaranteed loans, spending from the State financial funds; recover loans and advances taken by ministries and local governments; make budget spending and public investment transparent;

- To strictly manage public debts and national foreign debts, secure debt safety and national financial security; further monitor and manage risks while restructuring public debts, government debts and national debts; found risk contingency funds and allocate sources for paying due loans in order to prevent overdue debts; enhance management, inspection, auditing and improvement of the mobilization and use of loans;

- To develop and diversify the bond market through increasing debt instruments of long term of 10 years up; review regulations on issuing corporate bonds in order to help enterprises mobilize more investment capital, apart from credit capital from credit organizations, for production and business activities;

b) Ministries, agencies, local governments, economic groups, State corporations and enterprises shall strictly observe the Prime Minister’s Instruction 30/CT-TTg dated November 26, 2012 on promoting thrift practice and anti-prodigality. Thoroughly review inspective programs and working teams sent to a lower level, so that they are effective and save on costs; rigidly prohibit receptions at great expense. Minimize State budget-funded delegations going abroad for study, survey and sharing experience. Working visits to foreign countries must be approved by authorities and scheduled in yearly working programs.

c) Ministry of Planning and Investment shall play as the main implementer, in collaboration with ministries, agencies and local governments:

- To further implement and inspect the realization of the Prime Minister’s Instructions 1792/CT-TTg dated October 15, 2011 on enhancing management of investments using the State budget and governmental bonds, and 27/CT-TTg dated October 10, 2012 on major solutions to overcome debts in capital construction at local level. Review and arrange, by order of priority, State-invested projects, giving priority to the projects which are completed and put into operation but having insufficient capital as well as keynote, urgent and effective projects which can be completed within 2013; return all advances from the budget. Minimize new budget-funded projects. Transfer or revoke investment capital of ineffective and behind-schedule projects. Not advance capital from the State budget and governmental bond to any project, except those on preventing and overcoming consequences of natural disasters, epidemics, national defense and security and urgent key ones;

- To strictly apply the principle of allocating investment capital for socio-economic infrastructure on the basis of maintaining the overall balance of State budget and governmental bond capital sources in the period of 2013-2015 and possibility to mobilize other legal sources;

- To enhance inspection and supervision of investment projects using budget capital and State budget-origin sources, so that these projects are effective, economical and in line with legal stipulations. Seriously punish all legal violations in managing and using investment capital from the State budget and State budget-origin sources. 

d) Ministry of Education and Training, Ministry of Health, other ministries and agencies in charge of public non-productive fields, within their competence and assignment, shall work with the Ministry of Finance and relevant ministries and agencies:

- To speed up the implementation of the Government’s Resolution 40/NQ-CP dated August 09, 2012 on the Plan “Renewing performance of public non-productive agencies, boosting social engagement in some public non-productive services,” 

- To draft, issue and realize proper mechanisms and policies to adjust prices of public services toward full and correct calculation of costs; at the same time, revise, supplement and issue sound supporting policies for the poor and beneficiaries of social policies;

- To renew financial mechanism applied for public non-productive fields by increasing self-control and accountability of agencies and units and giving them specific orders and assignments;

dd) Ministry of Science and Technology shall play ass the main implementer, in collaboration with the Ministry of Planning and Investment, Ministry of Finance, relevant ministries and agencies, to design the principle and process  of allocating funds for scientific and technological activities, submitting it to competent agencies for approval; join in monitoring and checking the use of science and technology funds by ministries, sectors and local governments, so that the State budget for science and technology must be used fruitfully.

e) Ministries, agencies and local governments shall strictly observe financial and budget disciplines, enhance inspection, supervision and publicize the use of State budget; concentrate investment capital in effective projects which can be completed in 2013; strictly implement the regulation of not issuing or submitting authorities for issuance of State budget-using programs and projects for which the capital sources are not balanced yet; direct the auditing work over investment capital in completed projects.

3. Promoting trade development and attracting investment

a) Ministry of Industry and Trade shall act as the main player, in collaboration with ministries, sectors and local governments:

- To review and evaluate international economic integration, design the Action Program on further speeding up international economic integration in 2014 - 2020, and submit the Program to the Government in the third quarter of 2013;

- To promote export, strictly control imports which are not encouraged or can be domestically produced;

- To boost trade promotion, multi-lateralize and diversify relations with partners, expand export markets to prevent the dependence on any single market. Improve forecasts of domestic and foreign markets and timely disseminate market information;

- To accelerate the development of supporting industries and production of domestically-made consumer goods. Review and evaluate the realization of mechanisms and policies on developing enterprises in the fields of high competitive advantages; map out the Priority Plan on developing enterprises in the fields of high competitive advantages in 2013-2020 and submit it to the Prime Minister in the second quarter of 2013.

b) Ministry of Science and Technology shall work with the Ministry of Industry and Trade and ministries in charge of export management to continue reviewing, designing and issuing regulations on technical standards and quality of imports, so as to secure quality management in line with Viet Nam’s realities and international practices, preventing the import of low-quality goods and products which are not encouraged or should be limited.

c) Ministry of Industry and Trade, Ministry of Health, Ministry of Agriculture and Rural Development, Ministry of Resources and Environment, pursuant to their competence and assignment, shall work with ministries, agencies and local governments to strictly implement mechanisms and policies of controlling quality of imports; tighten the serious management over imports in terms of food safety and environment protection.

d) Ministry of Planning and Investment shall play as the main implementer, in collaboration with ministries, agencies and local governments:

- To increase sources for development investment; map out, issue or submit to authorities for issuance of mechanisms, policies and solutions which can create favorable conditions for attracting and effectively using investment capital sources;

- To take measures to promote social engagement in investment, mobilize capital sources from all economic sectors to additionally fund socio-economic infrastructure construction, adopt proper measures to boost the mobilization of non-State resources into infrastructure projects of which investment capital can be recovered, especially in provinces, big cities and industry-service centers. Continue reviewing and perfecting pilot mechanisms and policies on public-private partnership (PPP) investment, submit them to the Prime Minister in the first quarter of 2013. Pilot the social involvement in some important projects in transportation, irrigation, health, education and information technology;

- To seriously implement the Prime Minister’s Instruction 1617/CT-TTg dated September 19, 2011 on enhancing FDI management in the time to come. Continue to review and perfect FDI mechanisms and policies toward selectively drawing foreign investments in infrastructure, green and environmentally-friendly industries, high technologies, mineral processing, human resource training, fields having linkages with other economic sectors and regions, fields and projects of high added value, supporting industries, so as to join the global production network and chain of value. Perfect relevant legal documents in order to overcome existing weaknesses in decentralizing management of foreign investment activities under the principle of highlighting local governments’ initiative, preventing dispersive decentralization, and maintaining the unity, efficiency and power of State management. Promote inspection and supervision to raise efficiency of foreign investment. Speed up the construction of a national integrated system of FDI information, which is networked to State management agencies of all echelons, FDI enterprises and relevant partners;

- To perfect mechanisms and policies on ODA management; improve capacity of ODA and preferential loan management and use; further direct and support project managers to timely deal with difficulties in conducting ODA- and preferential loan-using programs and projects;

- To perfect mechanisms, policies, legal frameworks and regulations on managing Vietnamese enterprises’ outbound investment; further direct and assist investors to timely deal with difficulties in conducting outbound investment projects.

đ) Ministry of Finance shall function as the main implementer, in collaboration with ministries, agencies and local governments, to craft proper tax policies in order to promote production, improve enterprise and goods’ competitiveness, and facilitate investment activities.

e) Ministries, agencies and local governments, pursuant to their competence and assignment, shall drastically and fruitfully realize the Prime Minister’s Decision 1601/QĐ-TTg dated October 29, 2012 approving the Plan on improving the management of foreign investment flow into Viet Nam. Fruitfully control foreign indirect investment (FII); enhance check-up and supervision of capital inflows and outflows; promote and improve analysis and prediction of capital inflows and outflows. Create favorable environment to attract international tourists and remittance.

4. Enhancing price and market management

a) Ministry of Industry and Trade shall work as the main actor, in collaboration with the Ministry of Finance, other ministries, agencies and local governments, to take sound measures for maintaining demand-supply balance of primary commodities, especially during festivals and holidays. Closely monitor fluctuations in domestic and foreign markets, timely take measures to regulate demand and supply, stabilize the market, especially regarding to primary goods for production and life, and prevent the scarcity of goods and price fever.

b) Ministry of Industry and Trade, Ministry of Finance, other ministries, and public non-productive management agencies, within their competence and assignment, shall work with ministries, agencies and local governments:

- To consistently realize the guideline that the prices of electricity, coal, petroleum, and public services must be managed under the State regulation in line with market laws and a proper roadmap in order to rein in inflation. Publicize costs, production price, consumption of electric power, coal, petroleum, and public services. Strictly control component factors of the price of the goods of which the price must be decided by the State and the commodities which are produced under State budget-funded orders;

- To instruct and organize the uniform and effective implementation of regulations on price management. Tighten market management, inspect and supervise the obeisance of legal regulations on price; resolutely prevent and cope with smuggling, counterfeits and trade frauds; seriously punish legal violations in price management and illegal price increase.

c) Ministries and agencies in charge of price management over public services shall work with the Ministry of Finance, relevant ministries and agencies, and local governments to realize the price roadmap in line with the market mechanism; focus on predicting impacts of goods price fluctuations on the consumer price index in order to take proper solutions. Implement sound mechanisms and policies to adjust prices of education and health services in line with market laws and in association with supportive policies for the poor and beneficiaries of social policies; promote social engagement in improving quality and efficiency of services.

d) Provincial-level People’s Committees shall:

- Realize proper solutions in conformity with their specific conditions to stabilize price; enhance market and price inspection and supervision. Promote the “Buy Viet Nam” campaign and the enforcement of the Law on Consumer Protection fruitfully;

- Work with the Ministries of Finance, Health, Education-Training, relevant ministries and agencies to plan the level and schedule of adjusting prices of some goods and services controlled by the State, such as medical examination and treatment, education service (tuition fees), clean water for daily use, and bus charges (with State supports), to serve inflation control and macro-economic stabilization.

dd) Ministry of Information and Communications shall play as the main implementer, together with other ministries, agencies and local governments, in guiding and organizing the realization of information and communications programs to popularize guidelines, regulations and policies; provide financial, monetary, price and market information timely and clearly for the business community and people’s understanding, support and realization.

5. Improving statistical and prediction work

a) Ministry of Planning and Investment, in collaboration with other ministries, agencies and local government, shall:

- Further improve quality of statistical work, analysis and forecast of domestic and international situations, especially financial and economic changes in the world;

- Direct the General Statistics Office to implement the Plan on perfecting statistical work so as to provide, since 2014 on, data of productivity of economic industries (grade 2), laying foundations for restructuring production, making policies and drawing investment.

b) Ministry of Industry and Trade shall work with other ministries, agencies and local governments to enhance and better market prediction, regularly update and disseminate information about the world market, especially important markets and exports, policy changes, and protective measures applied by other countries.

c) Ministries and agencies, within their competence and assignment, shall strengthen and improve quality of statistical and predictive information in the fields of their respective charge; work together effectively; provide and disseminate statistical and predictive information.

 

II. REMOVING DIFFICULTIES TO PROMOTE PRODUCTION AND BUSINESS

1. Supporting enterprises to take loans and clear bad debts

a) State Bank of Viet Nam shall play as the main actor, in collaboration with ministries, agencies and local governments, in direct and guide credit organizations:

- To take appropriate measures to help enterprises obtain credit loans at proper interest rates; save costs to slash down lending interest rate of credit organizations;

- To extend credit fruitfully while controlling credit quality in production and consumption activities in line with legal stipulations. Apply sound measures to ease enterpises’ difficulties by facilitating their access to credit capital; giving priority capital to production of exports, agriculture, supporting industries, small and medium enterprises, hi-tech enterprises, labor-intense businesses, and effective projects. Extend credit loans for purchasing houses, encourage credit organizations to shake hands with project owners in providing long-term credit to house buyers;

- To promptly finalize the Plan on clearing credit organizations’ bad debts and the Plan on establishing the Viet Nam Asset Management Company, submit them to the Prime Minister for approval and put them into reality. Classify non-performing loans by clients and borrowers (credit organizations, enterprises, industries, fields of production and business, risks); gradually develop a debt trading market;

- To direct credit organizations to initiatively restructure their debts in proper forms; allocate risk reserve funds and use these funds to clear bad debts; collaborate with the borrowers and competent agencies to promptly and drastically deal with properties in line with legal regulations in order to collect debts and minimize bad debts while preventing new outstanding debts;

- To review, revise and supplement legal documents as foundations for dealing with non-performing loans. Collaborate with relevant ministries and sectors to design and submit to the Government a Decree on organization and operation of the Viet Nam Asset Management Company.

b) Ministry of Finance, as the main implementer and in collaboration with the Ministry of Planning and Investment, State Bank, other ministries, sectors and local governments, shall:

- Review realities and take measures to properly and completely deal with enterprises’ debts to the State budget, cross debts among enterprises, debts in capital construction, debts in projects using investment and export credit loans from the Viet Nam Development Bank (VDB), outstanding debts in real estate projects and in State-owned enterprises. Complete the mechanism of credit guarantee for small and medium enterprises through the VDB system and local credit guarantee funds;

- Revise, supplement or issue regulations as the legal foundation for forming and developing debt trading. Design new financial institutions to support the real estate market (Housing Savings Fund, Real Estate Investment Fund, House Mortgage Refinancing Agency). Perfect tax policies to minimize real estate speculation and encourage effective use of land.

c) Ministries, agencies and local governments, within their competence and assignment, shall:

- Work with the State Bank, relevant ministries and agencies to design plans for clearing bad debts in the fields of their charge;

- Closely collaborate with the State Bank, Ministry of Finance, relevant minisitres and agencies to clear outstanding debts and restructure enterprises.

d) Provincial-level People’s Committees shall:

- Adopt mechanisms and policies to remove difficulties for production and business and grant financial supports to enterprises in their locality;

- Boost inspection of outstanding debts in enterprises and projects in their locality and timely deal with them timely. Chairpersons of provincial-level People’s Committees shall take initiative in adopting proper solutions and be responsible for implementing mechanisms, policies and plans on clearing debts in their locality.

2. Giving supports to the market and easing inventories

a) Ministry of Industry and Trade, in collaborate with ministries, agencies and local governments, shall:

- Take measures to remove difficulties for production, support enterprises to expand markets and sell products. Work with the Ministry of Construction and local governments to clear goods of high inventory, such as steel, cement and building materials;

- Promote domestic market development and expansion, perfect channels of collecting, purchasing and distributing goods. Boost the “Buy Viet Nam” campaign. Assist enterprises to sell their products, placing importance on the sale of home-made products in the domestic market, bringing made-in-Viet Nam goods to rural, mountainous and border regions and islands;

- Work with the Ministry of Public Security, other ministries, agencies and local governments to tighten market management, drastically prevent and strictly punish smuggling and counterfeits. Review and increase sanctions against trade frauds;

- Make full use of all chances to raise export volume to all existing markets while promoting export to the potential markets of high purchase power; take measures to boost penetration into new markets;

- Remove difficulties and take integrated measures for promoting production and business, securing the schedule of large-scale industrial projects.

b) Ministry of Planning and Investment, working with the Ministry of Finance, shall urge other ministries, agencies and local governments to allocate capital and speed up projects listed in the plan 2013, focusing on the projects of high significance, projects on new rural development, social housing, and student dormitories.

c) Ministry of Construction, in collaboration with other ministries, agencies and local governments, shall:

- Propose and implement solutions to remove difficulties for the real estate market, deal with unused lands, adjust the market structure, balance demands and supplies, and clear outstanding debts. Continue to realize the National Housing Development Strategy to 2020 and visions to 2030. Take uniform and effective measures to recover the real estate market, adjust the market structure, balance demands and supplies, and clear bad debts. Quickly and fruitfully realize social housing programs. Build up a legal frame for establishing the Housing Savings Fund and adjust policies on selling houses to foreigners doing long-term investment or business in Viet Nam;

- Work with the Ministry of Transport to support domestic contractors in improving their capacity so that they can take part in infrastructure construction projects;

- Work with the Ministry of Industry and Trade to seek for markets for steels, cement, and building materials in order to reduce their inventories;

- Review, evaluate and classify real estate investment projects, then propose proper solutions which clearly define criteria and lists of permitted projects and halted ones.

d) Ministry of Transport shall act as the main implementer, working with ministries, agencies and local governments, to accelerate the realization of infrastructure projects while enhancing inspection and supervision to secure quality and efficiency of these works.

đ) The Viet Nam Development Bank shall allocate VND 10 trillion for the credit program on solidifying canals, building rural roads, aquaculture infrastructure and craft village infrastructure.

e) Provincial-level People’s Committees shall:

- Direct competent agencies to boost up trade promotion activities, market development, and the “Buy Viet Nam” campaign within their localities; bring into full play the role and accountability of local governments in clearing inventories and developing local markets;

- Direct the provision of cement and steel for improving, upgrading and building new transport works, irrigation, houses for the poor while mobilizing contributions from local people.

3. Creating favorable conditions for production and business activities

a) Ministry of Planning and Investment shall work with ministries, agencies and local governments:

- To further review and complete legal documents, mechanisms, policies, investment and business registration procedures, policies to improve investment and business environment, support domestic and foreign investors in doing business in all fields as regulated by laws;

- To publicize enterprise information; operate single agencies in charge of managing and providing legal information of enterprises;

- To further take uniform policies and solutions to support the development of small and medium enterprises as stipulated in the Action Program issued under the Prime Minister’s Decision 1231/QĐ-TTg dated September 07, 2012 approving the Plan on Small and Medium Enterprise Development in the period of 2011-2015;

- To promptly issue documents detailing and guiding the enforcement of the Law on Cooperatives 2012 in order to put the Law into reality soon and facilitate the development of new cooperatives.

b) Ministry of Finance shall collaborate with ministries, agencies and local governments to propose sound measures relating to tax policies and budget collection in order to encourage consumption, production and business, assist enterprises, especially small and medium ones, agro-product processing enterprises, labor-intense enterprises operating in producing and processing agro-forestry and marine products, textiles and garments, footwear, electronic components, building socio-economic infrastructure facilities, enterprises investing and trading in housing, and enterprises producing and trading in steel, cement, bricks and tiles.

c) Ministry of Science and Technology shall work with the Ministry of Industry and Trade and other relevant ministries:

- To support and guide enterprises and local governments to register for intellectual property protection of their exports, especially in Viet Nam’s potential markets;

- To continue to consider and realize the Technology and Component Market (Techmart) and virtual Techmarts (www.techmartvietnam.vn, www.techmart.cesti.gov.vn) to help enterprises introduce and sell their technologies, devices and solutions.

d) Ministry of Justice shall work with ministries, agencies and local governments:

- To further improve quality of assessment, inspection and settlement of legal documents and administrative procedures; at the same time promote the supervision of legal enforcement, focusing on problems which are difficulties or hindrances to production and business activities.

đ) Ministries, agencies and local governments, in line with their competence and assignment, shall realize the Prime Minister’s Directive 32/CT-TTg dated December 07, 2012 on removing barriers and completing mechanisms and policies to improve investment efficiency.

e) Provincial-level People’s Committees shall:

- Enhance their direction, take measures to remove difficulties in terms of administrative procedures, mechanisms, policies, labor force, and land; create all favorable conditions to draw investment, and assist enterprises recover and develop their production and business activities;

- Further review and reform administrative procedures in the field of land, especially the issuance of certificates for land use rights, ownership of house and other land-related properties, land revocation, land transfer, land lease for investment projects, in order to facilitate and attract investments as well as raise the efficiency they can bring about.

III. SPEEDING UP THE IMPLEMENTATION OF STRATEGIC BREAKTHROUGHS ALONG WITH RESTRUCTURING ECONOMY AND GROWTH MODEL

1.     Speeding up the implementation of strategic breakthroughs

- The Ministry of Planning and Investment assumes prime responsibility to collaborate with relevant ministries, agencies and localities:

-    To summarize and evaluate the implementation of the Resolution passed at the 6th Plenary session of the tenth plenum Party Central Committee on continual completion of socialist-oriented market economy institutions; recommend how to enhance market economy institutions in the context of the country’s wide and deep integration into the world’s economy, then submit these accomplishments to the Government in the Q3/2013;

- To speed up the implementation of the Government’s Action Program on executing socio-economic development Strategy in the 2011-2020 period and Orientations and tasks for the national development in the 2011-2015 period;

- To review the list of national infrastructure projects towards working out a prioritized list for major national infrastructure projects needed to early complete, including roads connecting key economic regions, highways, airports, ports, and railways which are greatly significant to international economic integration, which will then be submitted to the Government in the Q2/2013;

- To prioritize State budget for national strategic projects and economic regions which are slow to recover capital, and generate no profit or a minor profit.

- To simultaneously implement solutions to mobilize investment resources, particularly land-related resources, into constructing an infrastructure system.

-     To boost the pilot implementation of public-private partnerships (PPP) according to the Prime Minister’s Decision No. 71/2010/QD-TTg dated November 9, 2010 on promulgating regulations to pilot PPP; arrange a proper State budget to finance PPP projects; to pilot financialization of land resources; design a roadmap to increase infrastructure tolls towards ensuring investment expense recovery to encourage investments in infrastructure projects.

b) The Ministry of Finance (MoF) assumes the prime responsibility to collaborate with relevant ministries, agencies and localities to study, establish and carry out a reform roadmap that suits the policy on infrastructure tolls to ensure investment expense will be recovered so as to encourage more investment capital from the private sector and foreign investment in infrastructure projects.

c)     The Ministry of Justice collaborates with relevant ministries, agencies and localities:

- To review, propose amendments and supplements, and complete legal documents related to sectors where strategic breakthroughs will be made to ensure they suit requirements of socio-economic development in the new period, in combination with enhancement of organizational and implementing efficiency and effectiveness;

-     To continue to study and recommend amendments and supplements to the Constitution 1992; to assist the Government in designing and implementing the Plan on collecting people’s comments on the draft of the revised Constitution;

-  To continue to formulate and complete legal system, focusing on completing market economy institutions to create a strong and firm legal foundation to speed up economic restructuring; to study and compile bills like the Civil code (amended), the Criminal Code (amended), and the Law on promulgation of legal documents (unified);

- To improve the quality of making bills, ordinances and legal documents; to enhance the quality of verification done by the Ministry of Justice and the Government Office regarding legal projects and legal document drafts of the Government; to strictly control and ensure unification and synchronization of circulars issued by Ministries and agencies;

- To quickly and synchronously carry out mechanism of supervising law enforcement in compliance with the Government’s Decree No. 59/2012/ND-CP dated July 23, 2012; to ensure  prompt promulgation and the quality of legal documents detailing the implementation of Laws and Ordinances;

- To continue to reform sequence and procedures regarding promulgation of legal documents; to quickly study and compose a legal project to make two laws on promulgation of legal documents in one, then report to the Government in 2013 before transferring it to the National Assembly for consideration and making decision.

- To heighten responsibilities of Ministers and Heads of ministerial-level agencies regarding instructing, examining and monitoring the implementation of programs on the building and issuance of legal documents and working programs of the Government.

- To reinforce and promote the role of legislation departments under Ministries and agencies regarding composition and submission of documents; to make a close coordination during the process of making legal documents by each Ministry and agency.

- To improve and increase the quality and efficiency of discussing and deciding bills and draft decrees by the Cabinet members; to continue organizing the Government’s thematic meetings on legal building.

- To correct the making and implementation of Programs on the building of laws and ordinances and the Government’s working program; resolutely leave aside bills and document drafts which fail to fully and seriously satisfy legal requirements; to tighten administrative disciplines and rules regarding the implementation of such Programs.

- To closely and regularly cooperate with agencies under the National Assembly prior and during the process of studying, compiling and approving laws and ordinances;

d)     The Ministry of Education and Training and the Ministry of Labor, Invalid and Social Affairs, by their assigned functions and tasks, assume  prime responsibility and collaborate with relevant ministries, agencies and localities:

- To carry out specific and practical measures to increase education quality in universities, colleges and vocational schools; to focus on expanding the scope and enhancing the quality of vocational training and market-based training to timely satisfy demand of enterprises and society.

- To boost the implementation of Conclusion No. 51-KL/TW dated October 29, 2012 by the Central Committee of the Communist Party of Viet Nam on renewing fundamentally and comprehensively education and training.

- To strengthen inspection and supervision of education and training facilities; to seriously deal with breaches.

2. Enhancing the quality and ensuring the implementation of planning

a) The Ministry of Planning and Investment takes prime responsibility to collaborate with relevant ministries, agencies and localities:

- To continue to review and complete socio-economic development master plan, and sectoral and branch development planning in the direction of increasing the quality, efficiency and connection between planning schemes.

- To reinforce inspection and supervision of compliance with planning schemes of ministries, agencies and localities, particularly the combination between zone planning schemes and sectoral and branch development planning schemes and socio- economic development master plan. To timely request competent authorities to solve problems still existed regarding the management and implementation of planning schemes.

- To continue to study and renew process and methods of planning in accordance with reality. To quickly make the Law on planning and submit it to the National Assembly for issuance.

b)     The Ministry of Industry and Trade takes prime responsibility to coordinate with relevant ministries, agencies and localities to review master planning schemes on hydroelectricity plants and clearly determine which projects will be stopped and which will be adjusted. To take measures to ensure absolute safety of hydropower works.

c)     The Ministries: Planning and Investment, Natural Resources and Environment, Construction, Transport, and Justice, and localities stick to their functions and assigned tasks:

- To review and perfect legal regulations of planning. To carry out suitable measures in order to raise the quality of construction, ensure regulations and mechanisms regarding the implementation of planning schemes, first of all, the socio- economic development master plan, the plan on land use and urban areas; to inspect and supervise the observation of approved planning schemes, minimize early, frequent adjustments in approved planning schemes, particularly those on urban infrastructure.

- To review and update land use planning schemes and plans at all levels to ensure the most efficient use of land resources to serve socio- economic development in line with set targets, then submit them to the Government in the Q3/ 2013;

- To review the implementation of investment projects which have been allocated land, to handle suitably projects which do not comply with planning; to resolutely recover or recommend competent authorities recover land allocated to investment projects which have not been carried out or carried out slowly in comparison with legal regulations on land and real estate.

- To well implement the Planning scheme on development and organization of notarization practice by 2020.

3. Resolutely and efficiently carrying out main tasks of economic restructuring

a) Regarding public investment restructuring

- The Ministry of Planning and Investment takes prime responsibility to coordinate with the Ministry of Finance, ministries, agencies and localities:

+ To continue to review and complete laws, mechanisms and policies on governance decentralization and management of public investment. To strengthen the compliance with laws, mechanism and policies, and enhance responsibilities of inspection and supervision of public investment.

+ To establish a legal framework, approve and carry out a medium-term investment plan in the 2013- 2015 period, focusing on allocating State budget for national important projects and works; to be  proactive in balancing resources and arrange investment plans of sectors and branches.

+ To increase capital mobilization to upgrade and expand key national roads according to plans approved by competent authorities.

+ To establish criteria to evaluate State investment efficiency which will serve as a basis for annual evaluation on efficiency of State investment in each local and region, and submit them to the Government in Q3/2013.

+ To establish a national information system which is supported by an electronic database and linked with a nationwide information data on State-invested projects.

- The Ministry of Construction assumes prime responsibility to collaborate with relevant ministries, agencies and localities:

+ To review, amend and supplement mechanisms and policies regarding the management of construction investment in the direction of strengthening State management on construction investment and increasing the quality and efficiency of construction investment, particularly State budget-funded works.

+ To carry out measures to minimize expenses, enhance investment efficiency and assure work quality and efficiency. To seriously apply sanctions in construction inspection, acceptance and final payment in order to detect and prevent in a timely manner incorrect execution of designs, failure to ensure the quality of materials as agreed and construction load according to approved design.

- Ministries, agencies and localities under their assigned functions and tasks seriously carry out Directive No. 1792/CT-TTg dated October 15, 2011 by the Prime Minister on strengthening management of investments sourced from the State budget and Government bonds. To quickly review unfinished investment works with progress being prolonged or postponed, speed up the payment of capital construction debts, focus investments on completing key projects of grave importance to the country’s socio-economic development, resolutely overcome spread and inefficient allocation and use of investment capital.

b) Regarding restructuring of credit organization system

- The State Bank of Viet Nam instructs credit organizations:

+ To focus on synchronous and resolute implementation of the Prime Minister’s Decision No. 254/QD-TTg dated March 1, 2011 and the banking sector’s an action plan to deploy Project on “restructuring a system of credit organizations in the 2011- 2015 period.”

+ To strengthen financial capacity; to increase asset quality, control credit quality and decrease bad debts; to renew governance system, particularly risk governance in accordance with advanced international common practice and standards; to review and reinforce core business activities; to gradually divest capital from non-financial sectors and branches or risk-prone investment fields.

+ By inspection and supervision, to review, assess and classify commercial joint-stock banks, financial companies and financial-leasing companies in order to take suitable solutions, especially to handle weak credit organizations and those which seriously breach legal regulations; to closely inspect the establishment of plans and implementation of approved restructuring plans at credit organizations.

+ To gradually apply principles and criteria on banking evaluation according to international norms; to focus on settling bad debts; to strengthen inspection and supervision to increase the quality and minimize credit risks.

+ To speed up the inspection, supervision, and auditing, focusing on the fields: financial health and ownership; transfer of shares, stocks and equity,  regulations on interest rate; prevention and combat of money laundering. To detect and treat seriously such behaviors as fraud, negatives and legal breaches, obstruction of restructuring and intentional false statement of information and data;

+ To actively renew and strengthen apparatus of banking inspectors and supervisors and content and methods of inspection and supervision as required by reality; to study and gradually apply standards on banking governance, particularly risk management in accordance with international norms and actual conditions in Viet Nam; to increase transparency of banking activities;

+ To enhance the management, granting of operation license and network expansion of credit organizations and foreign banks’ branches; to continue to study, build and complete mechanisms and policies on management, inspection and supervision of activities of credit organizations and foreign banks’ branches;

- The Ministry of Finance assumes prime responsibility to work with relevant ministries, agencies.

+ To boost restructuring and increase efficiency of securities and insurance markets through restructuring, diversifying and enhancing the quality of products introduced to the market; to restructure investors; to re-arrange and increase the capacity of organizing business in the market; to ensure standards on publication and transparency of information;

+ To carry out suitable measures to solve difficulties and boost capital mobilization through capital and securities market;

+ To carry out measures to protect small-sized investors together with enhancing efficiency of sanctions to be implemented in the securities market;

c) Regarding restructuring of State-owned enterprises

-  The Ministries: Finance, Planning and Investment, Ministries which manage sectors and fields; the National Steering Committee for Enterprise Renovation and Development, Ministries, agencies and localities under their assigned functions and tasks:

+ To boost privatization and restructuring of economic groups, State-owned corporations and enterprises under approved Projects, of which attention is paid to comprehensively restructuring organization model, management, human resources, lines of business, development strategies, investment, market and products; to re-organize some economic groups and State-owned corporations in accordance with actual situation, requirements and tasks;

+ To follow the roadmap of withdrawing State investments in non-core business lines and joint stock companies where the State does not need to control; to restructure enterprises at their sectors and fields regardless of their management levels and agencies;

+ To seriously and efficiently carry out Project “Restructuring of State-owned enterprises, particularly economic groups and State-owned corporations in the 2011- 2015 period”  promulgated together with Decision No. 929/QD-TTg dated July 17, 2012 by the Prime Minister and Decree No. 99/2012/ND-CP dated November 15, 2012 by the Government on assignment and decentralization of implementation of rights, responsibilities and obligations of State owners to State-owned enterprises and State budget in enterprises; to seriously execute the Prime Minister’s guidance as specified in Official Letter No. 2071/TTg-DMDN dated December 17, 2012 on the implementation of Conclusion adopted at the 6th Plenary session of the 11th Party Central Committee; to early study the model on implementing uniformly the representative function of an owner; methods to increase leadership of the Party and personnel in State-owned enterprises; to strengthen the management of the State and owners, particularly the inspection and supervision of law compliance; to increase transparency and capacity of corporate governance; to enhance the inspection and supervision of financial conditions of enterprises to ensure financial discipline and make corporate financial system healthy.

- The Ministry of Planning and Investment assumes prime responsibility to work with relevant ministries, agencies and localities to summarize the Enterprise Law, review existing legal regulations; on such basis, to build a suitable legal framework to efficiently manage State-owned enterprises.

4. Enhancing structural shift and improving the efficiency of economic sectors and regions

Ministries, agencies and localities, under their assigned competence, shall:

- Review and implement mechanisms and policies to beef up the development of each economic sector, region, inter-sectoral connectivity and inter-regional linkage.

- Focus on instructing restructuring of production with priority given to products with high added value, using high technology, information technology, clean technology, and energy-saving and environmentally friendly technology

- Step up the development of agriculture, forestry, aquaculture, supporting, and value-added industries.

- Take synchronous measures to lure investment in high value-added fields, high technology, and sectors with comparative advantages.

- Continue to fruitfully implement the overall Strategy to develop the service sector; encourage investment in developing advantageous and high value-added service sectors, like tourism, telecommunication, information technology, aviation, finance, banking, distribution, logistics, etc.

- Thoroughly review and implement appropriate solutions to heighten the efficiency of industrial, processing, high-tech parks, etc.

5. Mobilizing resources to improve the efficiency of agriculture and rural development

a) The Ministry of Agriculture and Rural takes prime responsibility to coordinate with Ministries, agencies and localities:

- To instruct the implementation of programs and projects to deploy the Party Central Committee’s Resolution on agriculture, peasants and rural areas passed at its 7th Plenary session.

- To speed up the implementation of National Target Program on building new rural areas, which targets to provide new rural area planning schemes to 100% communes by the end of 2013; of which infrastructure facilities for agricultural production and rural development of 50% communes shall be identified. Mobilize resources in society for building 200 communes that meet new rural standards. Integrate the National Target Program on building new rural areas with other National Target Programs in rural areas.

- To coordinate with Ministries, agencies and localities in realizing the Project on vocational training for rural laborers in the 2010-2020 period; to prioritize the implementation of job creation programs for poverty reduction; to create favorable conditions for ethnic people, policy beneficiaries to enjoy State public services. To provide support to economic sectors, especially small and medium-size enterprises when investing in production and development of processing industry and farm produce preservation, handicraft industry, and other industries and services in rural areas, job creation, increase of farmers’ income, consumption stimulation in rural areas.

- To implement effective assistance solutions, especially credit loans, application of scientific and technological advances, market organization in order to boost the production of advantageous farm products.

- To build new production models in agriculture, bio-agriculture, clean agriculture, high-tech application, and high-economic value agricultural products. To select highly competitive farm produces which are potentially favored by local and foreign markets.

- To keep and protect 3.8 million hectares of rice growing land. Continue to apply intensive cultivation by utilizing scientific and technological advances, make extensive investment in order to increase productivity, reduce post-harvest losses, and improve the quality of products for local consumption and export. Multiply “role model fields” regarding rice production and consumption, and application of good agricultural practice (VietGAP), etc.

- To gradually restructure the animal husbandry sector, shifting from scattered household breeding to farms for which the origin of products could be traced. Actively prevent epidemics, and quickly develop animal husbandry towards high efficiency and food safety. To ensure the supply of varieties, techniques, feeds, bio-micro products used in breading. To create favorable conditions for the establishment of breeding farms and industrial slaughterhouses.

- To develop aquaculture, especially key products like brackish water shrimps, tra fish, etc; to produce advantageous products in the direction of intensive cultivation and disease safety. To develop concentrated production models for varieties and aquatic products in accordance with GAP and Global GAP standards, etc for such key products as brackish water shrimps, tra fish, bavalvia. To conduct survey, make planning schemes, and improve forecast capacity of fishing grounds and aquatic sources; provide instructions and manage the exploitation of seafood as planned, focusing on offshore and ocean-bound fishing grounds. To effectively support fishermen to catch fish in offshore fishing grounds in a safe and effective manner. To invest in upgrading equipment and technologies for aquatic processing facilities, thus raising the proportion of high-value-added products, ensuring food hygiene and safety, and improving the quality of products for local consumption and export.

- To continue to allocate land and make contract on forest protection and development with households, communities, and organizations; implement solutions to protect and develop forest resources sustainably, encourage and create favorable conditions for organizations, individuals, households to increase investments in production forests towards intensive farming and higher efficiency.

- To invest in revamping, upgrading and modernizing salt fields in association with expanding salt producing acreage in order to raise productivity, quality, and supply of salt for domestic consumption.

- To continue to invest in developing multi-purposed irrigation systems, and climate change and sea level rise responsive measures to meet the requirements for the sustainability of intensive cultivation, aquaculture development and salt production, and ensure adequate water supply and drainage for industrial parks and residential consumption. To improve the efficiency of management and exploitation of current irrigation systems. To prepare active response plans to prevent and mitigate damage caused by rains and storms; to enhance response capacity to promptly and effectively deal with natural disasters in all circumstances. To focus on upgrading river and sea dykes and taking measures to prevent flooding in big cities. To be proactive in instructing responsive measures against natural disasters and taking timely and effective solutions to prevent drought; and fruitfully implement resettlement programs and move people from natural disaster-prone regions.

- To multiply effective structural shift and production models like (role model rice fields, VietGAP, etc). To enhance inspection to ensure farm-to-fork safety and hygiene.

- To study and early promulgate proper mechanisms and policies on conditional tra fish business and on rice purchase and stockpile.

b) The Ministry of Planning and Investment assumes prime responsibility to coordinate with relevant ministries and agencies to study and quickly issue proper mechanisms and policies in order to draw more investment in agriculture and rural areas; preferential policies for investment in supporting and processing industries; farm produce processing, and afforestation and residential infrastructure development.

6. Ensuring power supply for production and consumption

a) The Ministry of Industry and Trade assumes prime responsibility to coperate with the Electricity of Viet Nam, ministries, agencies and localities:

- To remove barriers and take synchronous and drastic measures to help contractors speed up the implementation of power projects for timely, safe  operation.

- To minimize power cut. To seriously realize the Prime Minister’s Instruction No. 171/CT-TTg dated January 26, 2011 which details specific measures to encourage power savings.

- To speed up information dissemination on mechanisms and policies on power production, supply and use; to broadcast TV and radio programs with practical contents to encourage businesses and residents to practice power savings.

b) The Ministry of Finance assumes prime responsibility to coordinate with relevant ministries and agencies to propose appropriate plans to amend calculation methods of natural resource tax imposed on countries generating hydro-electricity and submit them to competent authorities for consideration and approval.

7. Enhancing efficiency and effectiveness of State management and decentralization of State management

a) The Ministry of Home Affairs assumes prime responsibility to coordinate with ministries, agencies and localities:

- To review and evaluate the implementation and propose solutions to amend and supplement the Government’s Resolution No. 08/2004/NQ-CP dated  June 30, 2004 on continuing to accelerate decentralization of State management between the Government and administration of provinces and cities directly controlled by the central government in a bid to clarify tasks, rights and obligations of each level to guarantee the Government’s unified governance and improve a sense of responsibility of local authorities. To submit proposed solutions to the Government in Q4/2013.

- To gradually shifting from giving order to serving and supporting at State management agencies.

- To enhance governance decentralization in association with rights, obligations and responsibility of each level; and responsibilities to inspect, supervise and monitor the implementation. To strengthen the efficiency and effectiveness of State management of each agency, focusing on rights and responsibilities of the heads of agencies.

b) The Ministry of Justice assumes prime responsibility to coordinate with ministries, agencies and localities:

- To fruitfully implement the Law on handling administrative violations; timely develop and submit decrees on handling administrative violations to the Government for approval.

- To fruitfully implement the Law on judicial appraisal, continue to remove bottlenecks in procedural field, especially those in corruption cases.

- To effectively implement solutions to strengthen the efficiency of civil judgments enforcement under the National Assembly’s Resolutions No. 37/2012/QH13 dated November 23, 2012 on prevention and combat of law infringements and crime, focusing on  fulfilling the assigned figures of civil judgments enforcement in 2013.

 

IV. ENSURING SOCIAL SECURITY, SOCIAL WELFARE AND IMPROVING PEOPLE’S LIVING STANDARD

1. Boosting job creation and ensuring laborers’ incomes

a) The Ministry of Labor, Invalids and Social Affairs assumes prime responsibility to coordinate with relevant agencies:

- To design and perfect the system of documents to guide the implementation of the Labor Code (amended); to continue to finalize and submit to the National Assembly the Employment Law; to devise a Program on public employment; to enhance State management on laborers, including foreigners working in Viet Nam and Vietnamese guest workers.

- To develop an action program for the implementation of the vocational training development strategy till 2020; to study the composition of the Law on amending and supplementing some articles of the Law on Vocational Training.

- To effectively realize the national target program on employment and vocational training in the 2012-2015 period. To develop vocational trainining to produce high-quality workforce for the country’s spearhead economic sectors and key economic regions. To boost vocational training for rural laborers to contribute to the transformation of rural labor strucutre, improvement of people’s living conditions, and the building of new rural areas. To synchronously develop the elements of the labor market, raise the quality of labor market forecast and information; to enhance the State’s role in monitoring and regulating labor supply and demand.

- To continue to improve and fruitfully implement policies on job creation in association with economic restructuring process and production and business development.

- To closely monitor changes in foreign markets, expand labor export markets by seeking new markets while increasing currently stakes in current markets, especially those offering high salaries and safety; closely monitor Vietnamese guest laborers; to protect legitimate rights of laborers while promptly handling violations of workplace disciplines that can affect market expansion; to monitor, support and utilize these guest workers after they return home.

- To arrange and renovate businesses and establishments authorized to export manpower to ensure their open, transparent and effective operations. To strive to raise the employed female labor proportion to 48% in 2013.

b) The Ministry of Education and Training takes prime responsibility to coordinate with the Ministry of Labor, Invalids and Social Affairs, ministries, agencies and localities to be proactive in training and supplying workforce which meet quality and quantity needs, especially for enterprises operating in key economic zones, industrial and hi-tech parks, focusing on establishing coordination and partnership in training; to gradually improve the quality of education and training at all levels highly regarding the needs of sectors, localities and the entire society.

2. Reforming salary, social and unemployment insurance policies and ensuring labor safety

a) The Ministry of Home Affairs assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To fruitfully realize the Resolution passed at the 5th Plenary session of the 11th Party Central Committee; to soon amend and supplement some policies which would help immediately adjust salary regime and allowances for officials, public employees, laborers, retired people, and people who rendered meritorious services to the nation in a bid to quickly repair the current urgent shortcomings regarding budget balance capacity. To design an overall project on reforming salary policies, social insurance and allowances for people who rendered meritorious service to the nation through 2020 and submit it to the 7th Plenary session of the 11th Party Central Committee.

- To continue to accelerate administrative reform, streamline apparatus, and impose personnel and administration expenditure quotas.

b) The Ministry of Labor, Invalids and Social Affair assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To improve working conditions, ensure labor safety and reduce labor accidents, occupational diseases and labor disputes. To carry out measures uniformly to build an harmonious and healthy labor relation; to inspect and promptly solve labor disputes to minimize labor strikes at enterprises.

- To fruitfully implement the National Program on labor hygiene and safety in the 2011-2015 period.

- To study and build the Law on amending and supplementing some articles of the Law on Social Insurance. To review and perfect social insurance mechanisms and policies in the direction of increasing stakeholders, ensuring rights and interests of the insured, and balancing and increasing the Social Insurance Fund. To drastically inspect, supervise, and strictly deal with infringements of regulations on social and unemployment insurance.

- To review and supplement regulations on employers’ responsibility for paying social insurance for their employees to ensure rights and legitimate interests of unemployed laborers and prevent seeking profits from unemployment insurance.

3. Fruitfully implementing policies to back the poor and policy beneficiaries

a) The Ministry of Labor, Invalids and Social Affairs assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To effectively realize the Plan on the implementation of the Government’s Resolution No. 80/NQ-CP dated May 19, 2011 on orientations for sustainable poverty reduction in the 2011-2020 period, the National Target Program on sustainable poverty reduction in the 2012-2015, and the Project on supporting poor districts to boost manpower export for quick and sustainable poverty reduction in the 2009-2020. To study and amend some criteria of the National Target Program on building new rural areas in line with target localities’ reality.

- To study, design and implement specific projects and solutions for sustainable poverty reduction, focusing on creating favorable conditions for the poor in disadvantaged provinces in the North, Central Highlands and Southwestern region to promote production and increase incomes.

- To fully implement promulgated policies in favor of vulnerable people; to improve living conditions of policy beneficiaries, create favorable conditions for them to surmount difficulties and integrate into the community.

- To fruitfully implement the Project on social work development. To make planning and investment in building a system of social sponsor centers, increase scope and service quality of these centers; to develop community-based caring models for those with disadvantaged circumstances; to take measures to encourage the private sector to participate in deploying caring models for the elderly, orphans, HIV/AIDS-affected children, people with disabilities, especially nursing homes etc; to encourage people to invest in developing high-quality nursing homes to meet the increasing demand in society.

- To perfect the legal system guiding the implementation of the Ordinance on preferential treatment to people with meritorious services to the revolution (revised); to timely and fully enforce policies and mechanism on preferential treatment to people with meritorious services to the nation; to continue handling unsettled cases relating to certifying and recognizing people with meritorious services to the nation; to fix wrongdoings in attesting and enforcing policies for people with meritorious services to the nation; to make planning, arrange and invest in developing a grassroots network of care, convalescence, orthopedics, functional rehabilitation centers that meet requirements of medical treatment and health recovery of those people; to invest in building, repairing, restoring and upgrading martyrs memorials in order to use them for educating revolutionary tradition for the youth in the long term; to effectively implement the project on searching, gathering, and identifying the remains of revolutionary martyrs that still lack information. To coordinate with the Ministry of Construction to realize the project on housing assistance for policy beneficiaries who yet have concrete houses.

b) The Ministry of Justice assumes the prime responsibility to coordinate with other ministries, agencies and localities to continue to effectively deploy the Strategy for legal assistance development in Viet Nam through 2020 with orientations to 2030; to continue to focus on improving the quality of legal assistance for the poor and ethnic minorities in accordance with the Prime Minister’s Decision 59/QD-TTg dated December 24, 2012.

c) The Committee for Ethnic Minorities assumes prime responsibility to coordinate with Ministries, agencies and localities:

- To effectively implement the current policies relating to ethnic minorities.

- To submit for the Prime Minister’s permission to carry out infrastructure, production investment and development projects as well as policies assigned to the Committee. To continue to review, amend, supplement and improve socio-economic development policies designed specifically for ethnic minority-inhabited and mountainous areas in the 2013-2015 period.

b) Ministries, agencies and localities, under their assigned competence, synchronously and effectively carry out national target programs and national programs, focusing on the regions having high number of poor people, and rural, remote, island and ethnic minority-inhabited areas.

dd) The People’s Committees of provinces and centrally-governed cities:

- To enhance instructions and inspection of the implementation of policies for the poor and policy beneficiaries in their own administrative boundary.

- To closely monitor between-crop food shortage and losses caused by natural disasters for timely deploying relief aid at affected localities and proposing solutions to overcome consequences.

- To develop and multiply proper prevention and relief aid models in order to promptly cope with and mitigate harmful impacts of natural disasters, instruct people to proactively prevent and fight natural disasters, rescue and support each others in case of natural disasters.

e) The Ministry of Construction assumes prime responsibility to coordinate with other ministries, agencies and localities in implementing social housing programs and other projects to build houses for people with meritorious services to the nation, poor rural residents, low-income earners, industrial workers and students...

4. Enhancing youth development work, child care, ensuring gender equality, caring and promoting the role of the elderly

Ministries, agencies and localities, under their assigned competence:

- To fruitfully carry out programs and projects on youth development. To effectively implement the pilot Project on construction of bridges in rural areas in the North, Central region, Central Highlands, and extremely disadvantaged regions. To finalize projects in order to facilitate the youth’s participation in socio-economic development, national defense and security.

- To effectively implement the National Action Plan for Children in 2012-2020, the National Target Program on child protection in the 2011-2015 period; to implement children’s rights, create a safe, healthy and friendly environment for children. To create favorable conditions for children to develop comprehensively and push back child abuse risks. To study, amend and supplement legal documents, mechanisms and policies for child protection, care, and education; to enhance inspection and supervision of the enforcement of laws and policies relevant to child protection and care; to develop a national database system on child protection and care; to fully implement relevant international treaties to which Viet Nam is a signatory.

- To effectively implement the national Strategy for gender equality to 2020, the National Program on gender equality in the 2011-2015 period, solutions to promote women’s equality in socio-economic activities and families. To enhance education and communication to raise behavioral change and awareness of gender equality and related laws on women’s rights of people, particularly those living in mountainous, remote and ethnic minority-inhabited areas.

- To synchronously carry out projects and solutions stipulated in the National Action Plan for the elderly in 2012-2020. To successfully implement regulations and policies on the elderly, especially the policies relating to pensions, social insurance, social benefits, and demolition of temporary houses. To enhance inspection and supervision over the enforcement of laws and policies for the elderly.

- To effectively implement the National Target Program on drugs prevention and fight in 2012-2015; the Action Program on prostitution prevention and combat in the 2011-2015 period. To continue improving the efficiency of drug detoxification, especially in detoxification centers; to develop effective community-based and families-based detoxification and post-detoxification management models. To focus on implementing solutions to ensure employment, income and reintegration into the communities for post-detoxified addicts and former prostitutes.

V. DEVELOPING EDUCATION AND TRAINING, SCIENCE AND TECHNOLOGY, AND HEALCARE

1. Developing education and training

a) The Ministry of Education and Training assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To quickly implement the Law on Tertiary Education, the Strategy for education development in 2011-2020 and the Conclusion 51-KL/TW dated October 29, 2012 adopted at the 6th Plenary session of the 11th Party Central Committee relating to the Project on “basically and comprehensively renovating education and training to meet the requirements of industrialization and modernization in the context of socialist-oriented market economy and international integration.”

- To effectively renovate quality-based educational development models. To enhance quality management, improve the quality of education and training, and focus on ethical education; closely combine “language teaching”, “ethical education” and “vocational training.”

- To continue renew education management mechanisms; to intensify State management over education and training through inspection; to focus on building the line-up of teachers and education managers who meet educational and training requirements of the country’s modernization and industrialization process.

- To actively implement Directive No. 10-CT/TW dated December 5, 2011 of the Politburo on universalizing pre-school education for under-5 children; to consolidate the results of universal primary and junior school education; to enhance the sorting of post-junior high school students and eliminate illiteracy among adults.

- To ensure fairness in education and training, prioritize investment for education development in the regions facing extreme difficulties socially and economically, and ethnic minority-inhabited areas, and consolidate the system of fully-boarding and semi-boarding schools.

- To renovate the financial mechanism for tertiary level, adjust school fee reduction and exemption mechanisms in favor of beneficiaries; to improve mechanisms and solutions to boost investments sourced from various resources in scientific and technological development, focusing on reputed universities. To continue to renew education management towards decentralizing administration of the Ministry of Education and Training, agencies and localities under the Government’s Decree No. 115/2010/ND-CP dated December 24, 2010; to continue to grant self-control right and self-responsibility to eligible and capable universities in accordance with legal regulations.

- To continue to adjust and renovate some contents of curriculum, teaching methods, tests, examinations, and evaluation at all educational level to promote creativeness, self-study, self-research, and practical skills among pupils and students to suit requirements as well as the country’s current conditions. To encourage the piloting of assessing teachers’ performance via surveys.

- To develop proper mechanisms and policies to encourage the development of partnership models between employers and training facilities; to enhance contract-based training; to adjust training structure suitable for Viet Nam’s socio-economic development orientations and its human resource development planning in the 2011-2020 period; to speed up education and supply of human resources based on societal needs.

- To implement solutions to boost education socialization, provide education for all, build a “learning society”, and create favorable conditions for every citizen to pursue life-long study.

- To finalize adjustments to the Planning scheme of a university and college network for the 2011-2020 period to make it suit the Strategy for and Planning scheme of national human resource development for the 2011-2020 period. On the basis of the network of universities and colleges approved by the authorized agency, social resources are encouraged to pour into building educational facilities, schools, classrooms and equipment.

- To speed up the progress of the Program on consolidating schools, classrooms, and public houses for teachers, and the Project on building outstanding universities and lecture halls for some big universities.

b) The Ministry of Finance assumes prime responsibility to coordinate with the Ministry of Education and Training, other ministries, agencies and localities to study and renovate the financial mechanism of the education sector, encourage and effectively utilize State and social resources.

c) The Ministry of Planning and Investment assumes prime responsibility to coordinate with the Ministry of Finance and relevant ministries and agencies to develop plans and programs of action to concretize the viewpoint that says education and training is the top national policy that needs prioritized investment.

d) The Ministry of Construction assumes prime responsibility to coordinate withe the Ministry of Education and Training, other ministries, agencies and localities to beef up the progress of construction of dormitories for students.

dd) The Viet Nam Bank for Social Policies coordinates with the Ministries of Finance, Planning and Investment, Education and Training to continue implementing credit policies for pupils and students.

e) Ministries, agencies and localities quickly deploy their own human resource development planning schemes, coordinate with enterprises to train and provide market need-based human resources, making human resources a competitive advantage of each sector and each locality.

2. Developing science and technology

a) The Ministry of Science and Technology assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To design the Government’s Action Program for the realization of the Party Central Committee’s Resolution 20-NQ/TW dated November 1, 2012 on science and technology development to serve industrialization and modernization cause in the context of socialist-oriented market economy and international integration. To coordinate with relevant Ministries and agencies to study and propose mechanisms and policies needed to be renewed and remove barriers to scientific and technological activities.

- To perfect legal framework for the science and technology area in order to create a unified and uniformed legal system for this area. To continue to improve the Law on Science and Technology (revised) and submit it to the 13th National Assembly for comments at its 4th session. To study, amend and supplement the Law on Atomic Energy and the Law on Technology Transfer.

- To deploy the Project on “Continuing renovating the management mechanism for science and technology activities”; to renovate investment methods and financial regime for science and technology activities; to apply the ownership-transfer mechanisms on outcomes of scientific and technological research funded by State budget; and to deploy policies to utilize science and technology workers.

- To mobilize resources for the effective implementation of national product, national technological innovation, and high-tech development Programs.

- To review and evaluate the application of self-reliance and self-responsibility mechanism at public science and technology organizations. To realize the Program on developing scientific and technological enterprises and support the application of self-control and self-responsibility mechanism at scientific and technological organizations; to prioritize solutions to develop scientific and technological enterprises. To develop mechanisms, scout, and support promising young researchers’ groups and strong research groups grown from universities and technology nurturing research institutes to form scientific and technological enterprises.

- To continue to invest in building high-tech parks approved by the Prime Minister; steer resources to developing the Hoa Lac High-tech Park. To organize the implementation of the Program on science and technology market development, the Program on enhancing investment in raising the capacity of measurement, testing, application and transfer of technology at local level. To develop a network of organizations which provide technical, scientific and technological, intermediary, transfer, consultancy, evaluation and pricing services. To invest in shaping national science and technology exchange floors in Ha Noi, Ho Chi Minh City and Da Nang which are connected to technology transfer centers of other provinces and cities.

- To focus on enforcement and protection of intellectual property rights, and exploitation and development of intellectual properties. To deploy solutions to improve the capacity and efficiency of the intellectual property right protection and enforcement system nationwide. To support intellectual property development from now to 2015, especially research, development, protection and exploration of enterprises’ inventions.

- To develop the national standard measurement system in line with regional and international standards. To boost the application of national technical standards; to inspect, examine and handle violations of measurement and standards regulations for domestically made products, imports and exports in order to boost export to reduce trade deficit. To continue to invest in infrastructural and technical facilities for measurement and testing activities. To develop a network to assess how key products and commodities meet technical specifications and national standards.

- To implement the Project on international integration in science and technology; to strengthen cooperation with developed countries on science and technology; to organize joint research activities, train scientists and related managers abroad; to take prime responsibility to coordinate in organizing international conferences and workshops in Viet Nam.

- To deploy the Master planning scheme for the implementation of the Strategy for peaceful utility of atomic energy through 2020. To focus on material and technical preparations; to improve the  legal framework; to train a contingent of high-quality technicians and managerial officials in service of the development of nuclear power; to conduct information dissemination to improve people’s awareness of nuclear safety and security. To enhance State management activities over the control of radioactivity sources, nuclear safety and security. To increase potential and resources to step up radiation research and applications in agriculture, industry, healthcare, etc to serve socio-economic development. To launch the Project on building the Viet Nam-Russia Scientific and Technological Research Center.

b) The Ministry of Finance assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To study and promulgate a new financial regime for the scientific and technological field.

- To review and develop appropriate tax policies to encourage enterprises to invest in scientific research and technological renovation.

c) The Ministries of Science and Technology, Education and Training, under their assigned functions and missions, coordinate with other Ministries, agencies and localities to sum up role model enterprises and households which have operated effectively thanks to the application of scientific and technological advances in production, business and management, to support ministries, agencies and localities in instructing the implementation of a new growth model through the operations of enterprises and with State assistance in terms of human resources and scientific and technological applications.

d) Ministries, agencies and localities, based on their assigned functions and missions, work:

- To quickly realize Resolution No. 20-NQ-TW dated November 1, 2012 of the 11th Party Central Committee on “scientific and technological development in favor of modernization and industrialization process in the context of socialist-oriented market economy and international integration” and the Government’s Action Program to implement the Resolution.

- To allocate adequate State budget-sourced investments and properly use them for science and technology development. To implement solutions comprehensively to attract all social resources for science and technology development.

- To speed up social science and theory research, review the realities and provide scientific grounds for national development in the new context.

3. Population work and public healthcare

a) The Ministry of Heath assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To synchronously implement measures to control population growth rate and maintain a reasonable, low birth rate.

- To implement synchronous measures drastically to reduce hospital overload, especially in central-level hospitals. To combine the development of general medical examination and treatment services with high medical techniques and specialized treatment.

- To improve the efficiency of the use of State budget and legalized proceeds to improve the quality of healthcare and treatment services, effectively use infrastructure and equipment of invested healthcare facilities. To further mobilize social resources on modernizing equipment and facilities to serve healthcare and treatment. To develop private healthcare services, enhance public-private partnerships. To boost the mobilization of resources for building demand-based high-tech and modern medical examination and treatment centers for outpatients in order to reduce the number of people going abroad for medical examination and treatment.

- To increase investment in healthcare system and reform the financial regime of the healthcare sector. To step up the implementation of some key projects. To consolidate and improve the organization of grass-roots healthcare network, focus investment on upgrading district-level hospitals and inter-district general hospitals; to invest in upgrading general hospitals in mountainous areas and disadvantaged areas, tuberculosis hospitals, psychiatry hospitals, tumor hospitals; to gradually upgrade communal medical stations; to build competent laboratories; to enhance investment in upgrading and improving provincial and district-level preventive health centers.

- To conduct education to encourage medical workers’ good manners, improve professional skills and competence, implement rotation of medical workers in order to pass on technologies and techniques to grass-roots levels to enable them to effectively utilize infrastructure and equipment of medical facilities, particularly those hospitals that have been funded by the Government bonds.

- To ensure adequate supply of essential medicines for treatment. To enhance management over medicines, drug prices, and hospital fees to ensure people can afford expenses that are suitable for their incomes under proper roadmap. To direct localities and units to well organize drug purchase biddings in accordance with legal regulations in order to stabilize drug prices. To develop a planning scheme for the development of the pharmaceutical industry and the production of pharmaceuticals and oriental medicines.

- To coordinate with the Ministry of Finance, Viet Nam Social Insurance and localities in designing, verifying and implementing the newly-approved capped medical service prices at healthcare facilities.

- To actively deploy preventive health work to prevent the occurrence of pandemics. To enhance safe vaccination and bio-safety at laboratories. To prevent, fight and successfully manage non-infectious diseases like cardiovascular disease, cancer, and diabetes, occupational diseases, and accidents and casualties. To focus on HIV/AIDS prevention and control to achieve the three targets of having no new HIV cases, no new HIV death and non-discrimination against HIV/AIDS carriers.

- To effectively organize the implementation of the Law on Insurance and its guiding documents. To enhance information dissemination of policies regarding health insurance regime, mobilize and provide support for people who live just above the poverty line to afford health insurance to ensue social security. To study, amend and supplement the Law on Healthcare Insurance in order to improve the implementation efficiency and effectiveness, particularly for ethnic minorities, people in mountainous areas, poor households and those living in extremely difficult areas.

b) The Ministries: Industry and Trade, Heath, Agriculture and Rural Development, based on their assigned functions and missions, coordinate with other Ministries, agencies and localities:

- To develop national technical standards for foodstuff products. To ensure food safety for products which are managed by them.

- To drastically implement measures to ensure food safety and hygiene, prevent food poisoning and diseases transmitted through foodstuff. In 2013, progress must be created to prevent illegal imports of foodstuff of low quality, unclear origin and insanitation.

c) The Ministry of Culture, Sports and Tourism coordinate with the Ministry of Health, other relevant ministries and agencies to provide instructions and organize the implementation of the Program on improving Vietnamese people’s physique.

 

VI. STRENGTHENING STATE MANAGEMENT OVER LAND, RESOURCES, ENVIRONMENTAL PROTECTION, PREVETION AND CONTROL OF NATURAL DISASTERS AND CLIMATE CHANGE RESPONSE.

1. The Ministry of Natural Resources and Environment assumes the prime responsibility to coordinate with Ministries, agencies and localities:

- To quickly deploy the Law on Environmental Protection (revised), Land Law (revised) after being approved by the National Assembly. To quickly review, amend and supplement regulations, mechanisms and policies on resource management and environmental protection. To encourage economical and efficient use of land, resources, and energy. To enhance the management efficiency in protecting and properly exploiting land and natural resources.

- To effectively implement the Strategy for national environmental protection through 2020, vision to 2030.

- To effectively implement the Government’s Resolution on urgent issues of the environmental protection area and the National Target Program on overcoming pollution and environmental improvement. To focus on overcoming pollution in craft villages, industrial clusters and parks, river basins, and rural areas. To speed up inspection of observation of legal stipulations on environmental protection, strictly impose sanctions against offenders; to prevent illegal and wasteful exploitation of natural resources. To enhance management and handling of illegal mineral exploitation and export.

- To actively speed up international cooperation, especially in managing and exploiting rivers shared with neighboring countries.

- To speed up communications to raise the whole society’s awareness of and responsibility for environmental protection. To continue focusing on organizing the implementation of the National Target Program on climate change response, the Support Program To Respond to Climate Change (SPRCC) financed by sponsors. To supplement and improve the action plan for climate change adaptation and sea level rise. To fully observe international commitments to climate change promised by Viet Nam.

- To enhance cadres’ capacity, material and technical foundations, IT application in natural disasters and climate change study and research.

2. The Ministry of Planning and Investment assumes prime responsibility to coordinate with Ministries, agencies and localities to design action programs to implement the Strategy for sustainable development in the 2011-2020 period, the Strategy for Green Growth; to mobilize resources for the implementation of these programs.

3. The Ministry of Agriculture and Rural Development assumes prime responsibility to coordinate with Ministries, agencies and localities:

- To supplement and amend mechanisms and policies to make them appropriate to realities in order to encourage enterprises’ investment in processing timber and other forest products and ensure legitimate rights of people who engage in forest plantation, production, protection and exploitation in a proper and effective manner. To continue implementing solutions for sustainable forest protection and development; to enhance protection of specialized use and preventive forests, effectively prevent forest destruction; effectively prevent forest fires.

- To monitor and urge Ministries, agencies and localities to strictly implement policies on rice land protection and development in accordance with the Government’s Decree No. 42/2012/ND-CP dated May 11, 2012.

4. The Ministry of Construction assumes prime responsibility to coordinate with Ministries, agencies and localities:

- To continue developing mechanisms and policies to attract economic sectors to invest in the construction of systems for collection, treatment of wastewater and solid wastes; in urban environment sanitation and urban transport systems in the direction of comprehensiveness and urban environment protection. To continue directing and inspecting centrally-governed cities in making transport planning schemes for the construction of modern and smart urban transport systems.

- To continue organizing the implementation of the Program on clean water loss prevention through 2025, the Program on investing in solid waste treatment in the 2011-2020; to design planning schemes of wastewater drainage systems, firstly in residential areas and industrial parks.

5. People’s Committees of provinces and centrally-governed cities:

- To resolutely revoke suspended projects and planning schemes, especially projects relevant to the conversion of land use purpose from rice land.

- To timely overcome and multiply proper prevention and relief models to cope with and reduce negative impacts of natural disasters. To effectively implement the Program on population allocation, especially in the regions with high risks of landslide and flash floods, border communes, and migrant residents.

VII. FURTHER ACCELARATING ADMINISTRATIVE REFORM, UPHOLDING PEOPLE’S RIGHT TO MASTERSHIP, PREVENTING CORRUPTION AND WASTEFULNESS, ENSURING SOCIAL ORDER AND BUILDING CULTURAL LIFE

1. Pushing up administrative reform

a) The Ministry of Home Affairs is responsible for coordinating with other ministries, agencies and localities:

- To organize the effective implementation of the Master Program on State administrative reform for the 2011-2020 period; to speed up the application of the one-stop-shop (OSS) mechanism, inter-agency OSS model, and information technology in management; to clearly define State functions and duties in the market-oriented economy; to handle the overlapping functions and tasks and loopholes in State management; to accelerate social participation in some public services in parallel with streamlining organizational apparatus and staff and restructuring public finance.           

- To implement the Resolution of the 4th plenum of the 11th Party’s Central Committee on urgent issues in Party building in association with the Government’s Directive No. 1973/CT-TTg, dated November 7, 2011 on further steeping up the learning and following of the moral example of President Ho Chi Minh, encourage changes in service manner of civil servants on duties, enforce administrative disciplines and rules, and raise the effectiveness and efficiency of State apparatus.       

- Speed up the realization of the Project on intensifying reforms of public duty and civil servant regime; to continually review and adjust organizational structure, personnel, and operational regulations of the State management apparatus towards simplicity and efficiency; to clearly clarify State office heads’ tasks, authorities and responsibilities; to delegate a sense of responsibility to office heads to improve operational quality and efficiency of State administrative apparatus. 

- To perfect the personnel and staff management regulations with clearly defined duties, responsibilities, rights and interests; to enhance professional skills and competence and political firmness.    

- To review State management decentralization, stipulate clearer State management responsibilities in economics at central and local levels, and between sectors and branches, and combine responsibility with authority and obligations with benefits in accordance with local socio-economic development realities; to bolster inspection and supervision of the decentralization process; to study and amend legal documents to concretize the Constitution  (amended); to clearly clarify duties and power of the Government  and local authorities at all levels.         

-  To reinforce administrative disciplines and rules and public morality, build people’s confidence and consensus, enhance instruction, examination and supervision of local administrations’ implementation; to create favorable conditions for people, community and social organizations to engage in supervisory work.

b) The Ministry of Justice is in charge of working with other ministries, agencies and localities:

- To definitely realize plans on administrative procedure simplification which are stipulated at the Government’s resolutions in order to interpret administrative reform results to serve people and businesses. 

- To marshal all resources for building up the Master Plan on simplification of citizen-related administrative procedures and paperworks and building of inhabitant database; complete and submit to the Government for issuance a resolution on key tasks of administrative procedure reform, business environment improvement and investment attraction.     

c) Based on their assigned functions, duties and authorities, ministries, agencies and localities have:

- To compose and submit to the Government a decree stipulating their functions, responsibilities, power and organizational structure.

- To continue to review, amend and supplement regulations to speed up administrative procedure simplification (especially those relevant to customs, tax, land access, credit, investment and business registration, etc) to save time and cut costs for both enterprises and ordinary people.

- To accelerate information technology application at State agencies and renovate management models of the administrative system in an open and transparent manner in State management work.

- To study, amend, supplement and perfect policies and measures to promote the economic restructuring process along with renovating growth model; to boost reform and perfection of institutions in service of the socialist-oriented market economy in Viet Nam. 

- To proactively deploy, maintain and renovate quality management systems in line with TCVN ISO 900:2008 on professional operations. 

2. Upholding people’s right to mastership

Based on their assigned functions, duties and authorities, ministries, agencies and localities have: 

- To direct the implementation of the regulations on democracy at the grassroots level and ordinance on exercise of democracy at communes, wards and towns; to promote people’s role in supervising performance of cadres and State agencies; to enhance contacts and dialogues and concentrate on resolving legitimate proposals lodged by people and businesses. 

- To exercise disciplines and rules, strictly punish infringements of people’s right to mastership and make corrupt use of democracy to spoil the nation.

- To perfect mechanisms for people to contribute comments, make criticism and supervise the performance of the Party and State, especially on socio-economic policies, planning, plans, programs and key socio-economic development projects. 

3. Intensifying inspection, preventing and fighting corruption, wastefulness and crime

a) Based on their functions and missions, ministries, agencies and localities synchronously deploy measures on prevention and combat of corruption and wastefulness in accordance with the Conclusion of the 5th Plenary session of the 11th Party Central Committee; to focus on effective preventive measures, strengthen investigation and inspection of corruption cases and seriously and promptly penalize corrupt behaviors. 

b) The Government Inspectorate works with relevant ministries, agencies and localities:

- To continue renovating directing and executive approaches to proactively realize inspection and anti-corruption plans at all levels and sectors; to reinforce State management work and seriously abide by regulations of the Inspection Law and the Anti-corruption Law and relevant guiding documents. 

- To enhance institutional building and perfection work; to disseminate and popularize legal regulations on corruption prevention and fight; to supervise and instruct the realization of anti-corruption measures, centering on localities and fields vulnerable to corruption.

- To intensify inspection to analyze the situation and detect corrupt behaviors, focusing on the areas highly exposed to corruption.

- To inspect responsibilities for enforcing the anti-corruption laws, focusing on supervising, inspecting, detecting and handling major corruption cases.

- To reinforce surveillance and examination of inspection activities and improve the quality of inspection conclusions; to seriously enforce inspection conclusions, proposals and infringement handling measures. Inspection agencies shall have to pass corruption cases to investigation agencies after detecting criminal signs.

c) The Ministry of Public Security is responsible for coordinating with other ministries, agencies and localities:

- To enhance investigation to expose corruption cases, focusing on such areas as land, natural resources and minerals use and management; basic construction investment; management of State budget collection and spending; management and use of capital and assets in State-owned enterprises; credit, banking; personnel work; and relations between State agencies and people and businesses. 

- To work with relevant agencies to timely and strictly handle violations to consolidate people’s confidence in the Party and State.

- To speed up the fulfillment of Political Bureau’s Directive 48-CT/TW, dated October 22, 2010 on enhancing the Party’s leadership over crime prevention and combat in the new circumstances; the National Assembly’s Resolution 37/2012/QH13, dated November 23, 2012 on prevention and combat of legal infringements and crimes, operation of the Supreme People’s Pocuracy and  the Supreme People’s Court, and execution of judgments in 2013; the Prime Minister’s Decision 282/QD-TTg, dated February 24, 2011 guiding the implementation of the Political Bureau’s Directive 48-CT/TW, dated October 22, 2010 on enhancing the Party’s leadership over crime prevention and fight in the new circumstance; to accelerate the movement “the entire people protect national security”, expand role models in criminal prevention and combat, get the whole political system involved under the Party’s leadership and authorities at all levels in which the police force plays a core role; to focus on dealing with complicated security situations in key areas; to attack and crack down crimes especially organized crimes using weapons, drug crimes and corruption crimes; to closely coordinate with procedural and diplomatic agencies in inspection, prosecution and trial of criminals including foreign ones; to enhance State management of social order, increase patrols to control and redeem arms and explosive materials, inspect types of conditional businesses, and administer the number of inhabitants as well as temporary residents.

d) The Ministry of Justice works with relevant ministries, agencies and localities to advance property auction sales in line with the Government’s Decree 17/2010/NĐ-CP, dated March 4, 2010 especially public assets and land use rights as part of efforts to exercise thrift practice, prevent wastefulness and raise State budget collection. 

dd) The Ministry of Information and Communication, Radio the Voice of Viet Nam, the Viet Nam Television, the Viet Nam News Agency, press agencies, other ministries, agencies and localities disseminate and popularize the legal regulations on anti-corruption and crime prevention.

4. Building an advanced culture of Viet Nam with strong national characteristics 

The Ministry of Culture, Sports and Tourism works with other ministries, agencies and localities:

To instruct the implementation of projects to carry out the Political Bureau’s Resolution 23-NQ/TW on accelerating cultural and art activities in the new period; to build healthy cultural lifestyle and environment; to set up and upgrade the cultural and sport system at the grassroots levels; to develop cultural families, villages, communes, districts and public places; to strictly control festivals in line with legal regulations, uphold traditional cultural values and prevent  the abuse of festivals. 

- To carry out the National Target Program on Culture, and projects to preserve cultural heritages and promote traditional art values, build a cultural life, invest in entertainment centers for children; to fruitfully exploit regional tourism potentials.  

- To deploy policies to mobilize all social resources in cultural activities and creation to provide, popularize and offer high-quality cultural products, works and projects in order to improve cultural taste for people; to encourage greater social involvement in cultural activities; to assess and draw lessons from activities in which public sites shift from providing cultural services to operating with public service mechanisms.   

- To finalize the Cinema Development Strategy and Planning by 2020 with a vision towards 2030 and submit it to the Prime Minister in in Q3, 2013 for issuance. 

- To continue to enforce the Law on Domestic Violence Prevention and Control and build a model of advanced and happy Vietnamese family.

VIII. ENSURING NATIONAL DEFENSE AND SECURITY, SOCIO-POLITICAL STABILITY; RAISING DIPLOMATIC WORK EFFICIENCY

1. Ensuring national defense, security and socio-political stability

a) The Ministry of National Defense assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To synchronously implement solutions to ensure national defense and security; to continue to guarantee comprehensive needs of the Viet Nam People’s Army, including weaponry, to be met, intensify technical capacity, giving priority to building barracks in key and border areas, at sea and on islands.

- To deploy the implementation of the Viet Nam Maritime Law, tasks defined in the overall planning scheme for realization of the Viet Nam Maritime Strategy through 2020, tasks of building and developing the defense industry and search and rescue work; key approved projects of the East Sea-Island Program. To be consistent in carrying out the policy of settling sea issues through peaceful measures and on the basis of international law; to firmly protect Viet Nam’s sovereignty and sovereign right at sea, effectively contributing to ensuring peace, stability, security, maritime safety in the East Sea.

- To coordinate with relevant ministries and agencies to finalize land border demarcation and landmark planting; to speed up the progress of projects on building patrol roads in border areas (financed by the Government bonds) and a system of border guard posts.

- To focus on consolidating national security and defense coupled with promoting socio-economic development and reducing poverty to ensure the creation of fundamental conditions for production and life of people living in areas coded CT229, Northwestern and Central Highlands regions, border areas and islands; to accelerate the building progress of economic-defense zones in line with approved adjustments; to build economic-defense zones on the sea.

b) The Ministry of Public Security assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To take measures to ensure political security, social order and safety, thwart all conspiracies and plots attempted to sabotage the country’s peace, stability, especially in the fields relating to the East Sea and religion; to pay special care to key areas and regions in terms of political security and social order and safety; to take effective measures to spoil Internet-based attacks.

- To reinforce professional and technical measures in the fight against crime, especially serious crimes like murder, robbery, juvenile crime, high-tech crime, corruptive use of the Internet to propaganda against the Party and State and ruin the prestige of Party and State leaders; crime with the involvement of foreign elements, trans-national drug crime, and human trafficking; to strictly deal with gambling, betting on the last two numbers of the first prize (in the national lottery), and football betting.

- To take synchronous measures to minimize traffic accidents and alleviate urban traffic congestion; to enhance prevention and control of fires and explosions and violations of food hygiene and safety laws.

c) The Ministry of Transport assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To drastically implement solutions and tasks to secure traffic order and safety, reduce traffic accidents by 5-10% compared to 2012.

- To seriously observe the Party of Viet Nam Central Committee’s Secretariat’s Directive No. 18-CT/TW dated September 4, 2012 on strengthening the Party’s leadership on ensuring road, railway, waterway traffic and safety  and address traffic congestion; Resolution 88/NQ-CP dated August 24, 2012 on enhancing the implementation of key measures to ensure traffic order and safety and the Government’s Resolution 16/2008/NQ-CP dated July 31, 2008 on gradually easing traffic congestion in Ha Noi and Ho Chi Minh City.

- To speed up education and information dissemination and impose strict sanctions to ensure on road, inland waterway, railway, seaway and airway traffic order and safety.

- To enhance inspection and supervision of the implementation of State management over transport businesses and collectives; to intensify inspection of observation of regulations on coordinating and implementing tasks of ensuring traffic order and safety while managing transportation operation.

d) The Government Inspectorate assumes prime responsibility to guide and supervise ministries, agencies and localities:

- To well organize reception of people coming with problems to be solved or comments, settle complaints and denunciations under the Law on Complaints and Denunciations; to submit the Draft law on people reception to the National Assembly.

- To continue to enhance inspection of the responsibilities of officials authorized to solve complaints and denunciations.

- To focus on addressing prolonged, unsettled and complex complaints and denunciations. To timely settle complaints and denunciations under their competence, especially cases relating to land, resources, environmental protection involving many petitioners, and cases in which involved people abuse complaint and denunciation to cause disorders.

- To effectively implement legal decisions regarding the settlement of complaints and strengthen disciplines and rules in this field.

- To heighten the responsibilities of the heads of State agencies (first of all, the Chairmen of People’s Committees at all levels) in people reception, settlement of complaints and denunciations; to enhance dialogues and  reconciliation and handle budding cases right at the grass-roots levels

- To summarize and report to the Government the results of complaint and denunciation settlement in 2013, focusing on complicated, unsettled and prolonged cases, and then report to the National Assembly at its 6th working session.

dd) Ministries, agencies and localities, based on their assigned competence, need to well perform citizen reception work, and process petitions, and denunciation; to focus on addressing land-related petitions lodged by groups of people; to basically solve complicated, unsettled and prolonged cases that caused public anger.

2. Improving the efficiency of diplomatic work

a) The Ministry of Foreign Affairs assumes prime responsibility to coordinate with relevant agencies:

- To continue to deploy the missions assigned in the Prime Minister’s Directive No. 01/CT-TTg dated January 9, 2012 on some measures to carry out orientations on  active and proactive international integration, especially in designing and implementing the Politburo’s Resolution on international integration and the Action Program on realizing the Resolution.

- To design and continue to implement measures to lift up and further deepen the relations with foreign partners, particularly neighboring countries, ASEAN member countries, strategic partners, big countries, comprehensive partner, traditional friends and other highly potential partners.

- To proactively, actively and responsibly work with other ASEAN member countries to build a strong ASEAN Community, enhance the relations between ASEAN and the bloc’s partners and maintain the central role of ASEAN in regional cooperative mechanisms. To actively participate in making responsible, practical contributions or proposing Viet Nam’s initiatives to multi-lateral forums, especially the United Nations, World Trade Organization, Non-aligned Movement, APEC, ASEM, EAS, and Mekong sub-region cooperative mechanisms, etc. To actively cooperate with other countries and international organizations in dealing with international common issues including response to non-traditional securities threats, especially climate change, maritime freedom and security, water security, food security, etc.

- To continue to boost economic diplomacy to serve economic stability, economic restructuring and growth model transformation; fruitfully deploy the Project on orientations of diplomatic work through 2020; to actively propose recommendations regarding international economic issues in favor of the Government’s administration; to deepen economic and trade contents of cooperation with strategic and potential partners; improve the efficiency of joining multi-lateral cooperative forums and mechanisms; to enhance supervision and speed up the implementation of international agreements and commitments; to enhance coordination among Ministries, agencies, localities and business in expanding overseas economic activities, export and tourism markets, in luring foreign direct investment (FDI) and official development assistance (ODA), in exporting labor, and in addressing arising economic disputes; to actively coordinate in building international economic integration policies; to speed up political and diplomatic lobbying activities to help with achieving key goals of negotiations for free trade agreements, focusing on completing negotiations on Trans-pacific partnership (TPP) and gaining market economy status recognition for the country.

- To speed up the settlement of unsolved issues regarding land and sea borders and territory with relevant countries on the basis of international law and principles of code of conducts in the region. To resolutely struggle against acts of violating the sovereignty, sovereign rights, jurisdiction and national interests of Viet Nam in the East Sea; to accelerate the implementation of the Declaration on the Conduct of Parties in the East Sea (DOC) and work towards the construction of the Code of Conduct (COC).

- To continue to realize the Strategy for Cultural Diplomacy through 2020. To accelerate overseas Vietnamese affairs, improve policies for overseas Vietnamese, and encourage overseas Vietnamese to make practical contribution to the national development and protection; to be proactive and prompt in protecting Vietnamese citizens and legal entities abroad.

- To continue to accelerate research work, strategic forecast; to enhance local diplomatic activities and coordinating role in a bid to increasing the efficiency of coordination between the State’s diplomacy, the Party’s diplomacy and the people-to-people diplomacy in deploying diplomatic activities and international integration.

- To coordinate with the Ministry of Information and Communications and other ministries and agencies to enhance foreign information service as stipulated in the Prime Minister’s Directive 21/CT-TTg dated August 6, 2012 on deployment of the Strategy on the development of foreign information service in the 2011-2020 period.

b) The Ministry of Justice assumes prime responsibility to coordinate with other ministries, agencies and localities:

- To perfect and submit to the Prime Minister the Master Project on handling disputes between the Government and foreign investors and Decision on the Regulations on coordination among ministries, agencies and localities in tackling disputes between the Government and foreign investors; to effectively implement the Project on approaching and  accession to multilateral institutions settling international disputes.

- To develop and deploy the Plan for implementing Viet Nam’s obligations as a full member of the Hague Conference on international justice after the country officially became a full member of the conference; to actively take part in negotiations and development of new international legal tools within the Conference framework.

c) The Ministry of Planning and Investment assumes prime responsibility to coordinate with relevant agencies to design plans on negotiations within the AFAS framework, ensure Viet Nam’s interests upon opening the service market towards the goal of building an ASEAN Community; finalize the report on “overall evaluation on Viet Nam after five years of joining the World Trade Organization” and submit it to the Prime Minister in January, 2013.

d) The Ministry of Industry and Trade assumes prime responsibility to cooperate with relevant ministries and agencies:

- To submit to the Prime Minister in January, 2013 the Plan for instructing the implementation of the Prime Minister approved Strategy for joining free trade agreements until 2020 to provide a foundation for ministries and agencies to design their own follow-up plans.

- To submit to the Prime Minister in Q2/2013 the Plan for negotiations on Viet Nam-EU Free Trade Agreement.

- To submit to the Prime Minister in Q2/2013 the Project for negotiations on Customs Alliances between Viet Nam, Russia, Belarus and Kazakhstan.

- To submit to the Prime Minister in 2013 the Strategy for economic integration through 2020.

IX. STRENGTHENING INFORMATION DISSEMINATION AND GENERATING SOCIAL CONSENSUS

1. The Ministry of Information and Communications, Radio the Voice of Viet Nam, the Viet Nam Television, other ministries, agencies and localities, under their assigned functions and task, have:

- To disseminate and popularize the Party and State’s guidelines and orientations; to generate high consensus and determination to fulfill the goals and plans set for 2013; to strengthen openness and transparency and proactively supply mainstream information regarding issues of pubic concerns. To proactively provide information to orientate public opinions, especially on complicated, sensitive news. To honestly reflect positive signs and role models to lead public opinions to follow the viewpoints, orientations and policies of the Party and State; timely expose and criticize negative phenomena and harassment in socio-economic activities.

- To timely disseminate the Government-initiated management measures to realize socio-economic development plans; publicize national and international important events; improve the quality of news and program channels to better meet people’s rising demands for information; improve the quality and content of programs and expand broadcasting coverage to mountainous, remote and far-reaching areas and increase radio and television broadcasting time of programs in ethnic minority languages; maintain and raise the quality and the number of households watching national television channel and listening to programs of Radio the Voice of Vietnam.

- To speed up the progress of composing the digital information safety draft law; strengthen State management over information, especially on social networks, and personal blogs; resolutely combat and strictly punish legal infringements, abusive acts, distortion and fabrication to harm the country  and run against national culture and tradition; perfect a press system planning to ensure the press’s efficient operation on the right track and set goal; penalize organizations and individuals which post inaccurate information against the Party and State’s policies and guidelines; successfully counter hostile forces which make corruptive use of the Internet to sabotage the Government.

- To accelerate the development of information technology industry and information technology and communication (ITC) service applications in society; advance ITC applications in State agencies; improve contents of information systems and electronic websites; better the quality, efficiency and methods of managing and holding video-conferences at all levels, agencies and localities.

- To bring into play the role of the Fatherland Front and its member organizations and mobilize collective strength to fulfill socio-economic goals; take care of people’s lives and protect their practical interests; disseminate and encourage people from all walks of life to unite, believe and follow the Party and State’s orientations and policies.

- To reinforce the Party’s leadership and the State’s management on press information. To highlight the role and responsibility of mass media agencies in providing objective and accurate information in accordance with orientations and in favor of national interests. To encourage ITC applications and use of Internet conveniences; to take necessary measures to fruitfully prevent the abuse of information to sabotage the country; impose tough punishments on dissemination of false information; and effectively fight against Internet-based hostility activities.

- To intensify the dissemination of information abroad to help overseas Vietnamese better understand the Party and State’s orientations, guidelines and policies.

- To promote the realization of the project on developing Viet Nam into an ITC power in the world, the national program on IT application among state agencies in the 2011-2015 period, the program on digital terrestrial television by 2020, the national target program on expanding information to mountainous, remote, border areas and islands.

- To enhance ITC applications in society; expand the post service network to catch up with people’s demands for communication and socio-economic development requirements.

2. The Ministry of Justice chairs and works with related ministries, agencies and localities to:

- Effectively enforce the Law on law dissemination and education, closely follow social demands, national and local socio-economic development plans and roadmap to implement newly-issued laws and decrees; fruitfully implement the Government’s programs and policies on law dissemination and education.

- Strengthen mediation work at the grassroots level to help reduce complaints and denunciations and generate consensus in population and society.

Part 2

ORGANIZATION AND IMPLEMENTATION

1. Based on this Resolution and related Resolutions of the Party and National Assembly, the Ministers and leaders of Ministerial-level agencies, leaders of the Government-managed offices, Chairmen of the People’s Committees of centrally-governed cities and provinces need:

- To quickly design, issue, and implement in January 2013 specific action programs of each Ministry, agency and locality; clearly identify goals, tasks, time, and units in charge so as to put them in the Working plan of the Government, Ministries, agencies and localities to implement.

- To concentrate on drastically, flexibly and effectively implementing solutions mentioned in this Resolution, and policies and guidelines of the Party, the National Assembly and the Government; to take prime responsibility and directly instruct the realization of the Resolution and hold responsible before the Government and Prime Minister for the organization of implementation of the resolution in their fields in accordance with their assigned functions and missions. 

- To proactively monitor and supervise in order to take appropriate, prompt and flexible handling measures; to set up working groups to research the sectors and fields under their charge or relating to socio-economic development in localities so as to propose timely and effective instructions and executive solutions; to strengthen transparency and a sense of responsibility for public assignments; to enhance supervision, inspection and assessment of the performance of every agency, organization and individual; to timely reward achievements and punish infringements occurred during the implementation of assigned duties.

- To pay attention to enhancing coordination for implementation between ministries, agencies and localities; closely work with the agencies of the Party, State, Fatherland Front of Viet Nam and mass organizations to successfully realize the goals and missions stipulated in the Resolution; raise community consciousness and responsibility and at the same time clarifying functions, tasks, responsibilities and authorities of every agency, organization and individual in deploying the implementation.

- To guide the effective implementation of democratic regulations at the grassroots level, heighten people’s supervisory role in activities of civil servants, State officials and agencies; increase contacts and dialogues and concentrate on solving legitimate petitions lodged by businesses and citizens; proactively disseminate fully and timely information and at the same time promoting exchanges and receiving feedbacks from citizens and businesses relating to mechanisms and policies, especially those pertaining to people’s life and businesses’ performance.

- To regularly check and inspect the progress and outcomes of implementation of the set working programs; hold monthly meetings to review the implementation of the Resolution; synthesize, evaluate and report the implementation of the Resolution monthly and quarterly and send the reports to the Ministry of Planning and Investment before the 20th day of a month and at the last month of each quarter. The Ministry of Planning and Investment plays the host and cooperates with other ministries, agencies and localities to check and supervise the implementation of the Resolution and report to the Government at its monthly regular meetings.

- The People's Committees of centrally-governed cities and provinces intensify instructions to the implementation of solutions in a synchronous manner in order to muster resources for development investment, boost production, reinforce control of prices, market, and food hygiene in association with safeguarding social welfare, social and cultural development and environmental protection in their localities.

2. The Ministry of Information and Communications, the Viet Nam News Agency, Radio the Voice of Viet Nam, and the Viet Nam Television proactively work with other ministries, localities and the Party Central Committee’s Commission for Popularization and Education to disseminate the Resolution to all sectors and at all levels; increase information to encourage the business community and people to understand and positively respond and carry out the implementation. 

3. The Ministries, agencies and centrally-run provincial and municipal People’s Committees review, sum up and evaluate the implementation of the Resolution within the scope of their assigned function and tasks, propose instructive and executive solutions of the Government for the next year, and report to the Prime Minister and also the Ministry of Planning and Investment before November 25, 2013. The Ministry of Planning and Investment synthesizes and assesses the outcomes of the realization of the Resolution of each ministry, agency and locality and report to the Government at its regular meeting in December, 2013./.
