Fresh laws take effect since July 1

The new laws include (1) the Law on International Treaties; (2) the Law on amendments and supplements of some articles of the Law on Value Added Tax, the Law on Special Consumption Tax, and the Law on Tax Management; (3) the Law on professional servicemen, national defense workers and officials; (4) the Law on Administrative Procedures; (5) the Law on Referendum; (6) the Code on Civil Procedure; (7) the Law on Hydrometeorology; (8) the Law on Statistics; (9) the Law on the supervision of the National Assembly and People’s Councils; (10) the Law on Internet Information Safety; (11) the Law on Sea and Island Natural Resources and Environment  the supervision of the National Assembly and People’s Councils; (12) the Law on Occupational Safety and Hygiene; (13) the Law on promulgation of legal documents; (14) the Law on veterinary.  

Clear process of international treaties

The Law on International Treaties consists of ten chapters and 84 articiles. It clearly stipulates process, procedures, and competence of the National Assembly, the State President, the Government, and the PM on international treaties.

Services for elderly exempted from VAT

According to the Law on amendments and supplements of some articles of the Law on Value Added Tax, the Law on Special Consumption Tax, and the Law on Tax Management, services for the elderly are exempt from value added tax. The move targets to enable domestic and foreign investors to take care of old and vulnerable people in society.

Enterprises and cooperatives buying farming, breeding, aquaculture produces that have not been processed into other products or have only been semi- processed and selling them to other enterprises or cooperatives are not required to declare and pay VAT but may deduct input VAT;

Law on Administrative Procedures

The Law composed of 372 articles arranged in 23 chapters. It prescribes fundamental principles in administrative procedures; tasks, powers and responsibilities of procedure-processing agencies and persons; and rights and obligations of procedure participants and related entities. It also establishes the order and procedures for instituting lawsuits, settling administrative cases, executing administrative judgments and settling complaints and denunciations in administrative procedures.

Referendum age

Vietnamese citizens who reach the age of 18 by the date a referendum is held by the State have the right to cast votes in the referendum, according to the Law on Referendum which enters into force on July 1 this year.

The Law also prescribes cases of non-organization of referendum. Accordingly, no referendum will be held again on the same issue which has been put to referendum within 24 months after the referendum result is announced./.
